Governor can now review ACRs of IAS, IPS officers
Chandigarh, August 25 In an order issued here yesterday, the state government abolished the system of reviewing ACRs by a Cabinet subcommittee. It authorised the Governor to review an ACR in which the Chief Minister might have recorded adverse remarks about an IAS or IPS officer. The state government’s order is a step forward in institutionalising the system of reviewing the ACRs of all-India services officers. Underlying the order is also the assumption that the Chief Minister, rather than making an objective assessment of the professional capabilities of an officer, may be guided by subjective reasons while writing his comments. The practice of reviewing comments on the ACRs of officers
written by the Chief Minister was first introduced by the last Haryana regime headed by Mr Om Prakash Chautala. The Indian National Lok Dal (INLD) government was under pressure from the officers close to the regime to review their ACRs that were “spoilt” by the previous Chief Minister, Mr Bansi Lal. Mr Bansi Lal, at the fag end of his three-year stint terminating in 1999, recorded adverse comments in the ACRs of a number of IAS officers. The ACRs were “corrected” after Mr Chautala came to power in the state. The INLD government came up with the system of having a sub-committee of Cabinet Ministers for reviewing the adverse comments by the Chief Minister in the ACRs of all India services officers. It is however, learnt that Mr Chautala, too, recorded adverse comments recorded in the ACRs of certain officers, and while doing so, it was not always the professional capabilities of the officers that were taken into account by him. Hence, the Bhupinder Singh Hooda government felt the need for reviewing the ACRs
written by Mr Chautala. The state government has substituted the Cabinet subcommittee by the Governor. It was felt that since Cabinet ministers figured below the Chief Minister in the governmental hierarchy, it was
inappropriate well to ask a Cabinet subcommittee to review the comments made by the Chief Minister. |
Committee to study need for gurdwara panel
Chandigarh, August 25 Haryana Assembly Speaker H.S. Chatha will be the chairman of the committee. The other members of the committee are Mr Bhupinder Singh Jauhar (Yamunanagar), Mr Gurcharan Singh Aneja (Kurukshetra), Mr Mohinder Singh (Fatehabad), Mr Raghubir Singh Virk (Karnal), Mr Kuldip Singh (Rohtak) and Mr Kulbir Singh Kalyana (Karnal). The District Attorney in the office of the Advocate-General, Haryana, Mr N.S. Bhinder, has been appointed member-secretary of the committee. Mr Bhinder is also the honorary legal adviser, Commissioner, Gurdwara Elections. According to the order issued by the Financial Commissioner and Principal Secretary, Home Department, the committee will study the issue of constitution of a separate gurdwara management committee for managing the affairs of gurdwaras and related institutions by reorganising the existing Shiromani Gurdwara Parbandhak Committee. Although the notification does not say so, sources said the committee had been told to complete the process and submit its report within six months. After coming to power, Chief Minister Bhupinder Singh Hooda had asserted that his government was considering the demand of Haryana Sikhs for the formation of a separate Haryana gurdwara parbandhak committee. A draft Bill of the proposed Haryana Sikh Gurdwara (Management) Act, 2005, has been finalised and is being studied by the government. The Act, when it is passed by the Vidhan Sabha and has received the assent of the President of India, will allow the constitution of a Haryana Sikh gurdwara management committee (HSGMC). The HSGMC would have its headquarters at Ambala, Panchkula or Kurukshetra. The 35-member body will have control over gurdwaras in Haryana. The state has 40 historical gurdwaras and 29 notified gurdwaras. One of the jobs of the newly constituted committee will be to see if the Haryana Vidhan Sabha has the power to legislate on the subject as the Sikh Gurdwara Act, 1935, is Central
legislation. |
Councillors dissatisfied with MC President
Ambala, August 25 The rebellion is a clear indication of fissures which have developed within the Congress municipal councillors despite their victory in the MC elections. The Congress had won the MC elections and had upset the BJP applecart. A group of Congress councillors have now raised the banner of revolt against MC President, Ms Neelam Sharma. The Congress councillors have met Ambala Cantt MLA D.K. Bansal and have expressed displeasure over the style of functioning of the MC President. The councillors have apparently told Mr Bansal that the “behaviour” of Ms Neelam Sharma is not in consonance with the post of the MC President. They have stated that the problems being faced by them are not getting solved. They have also claimed that there has been a slow-down in development activity in their wards. Ms Neelam Sharma, however, said she was taken aback by this development. “As a matter of fact, before meeting the MLA, Mr Bansal, the councillors were sitting with me and none of them said anything. I am surprised. Had there been any grievance, they could have directly come to me,” she said. She said it seemed the MLA, Mr D.K. Bansal, had formed an opinion based on only side of the story. “Before forming an opinion, Mr Bansal should hear my version also. I have strived hard for overall development of Ambala Cantt and have never discriminated against any wards. Development work worth lakhs of rupees are being carried out in each ward,” she said. The Ambala Cantt MLA, Mr D.K. Bansal, said a significant number of Congress municipal councillors had expressed dissatisfaction over the functioning of MC president Ms Neelam Sharma. “I have been apprised of the matter and I am looking into it. I am going to settle the matter after taking into consideration different aspects,”

Institute directed to pay damages to students
Fatehabad, August 25 Bhuwaneshwar, a resident of Dhiktana of Hisar district, and Kuldeep Singh, a resident of Daulatpur in this district, had filed separate complaints in the consumer forum through which they had alleged that they had appeared in the senior secondary examination of the open school at Lekh Raj Memorial Tagore Mandir, Fatehabad. The candidates submitted in their complaints that they were present during mathematics paper held on June 3, 2004. The candidates’ roll numbers were 05C533201 and 05C533138, respectively, as allotted by the institute. But in their results both candidates were shown as having absented themselves from the paper. The complainants wrote several letters to the institute but to no avail. In the meanwhile, the complainants took competitive examination for admission to engineering held by Guru Jambeshwar University, but had to miss the opportunity due to the non-declaration of results. The candidates demanded Rs 95,000 each as compensation for the loss of one year, mental torture and agony suffered by them, besides costs of litigation. They made the Director, National Open School, Government of India, Kailash Colony, 31-B, New Delhi, and the Regional Director, NIOS, Sector 11-C, Chandigarh as parties to the complaint. In their reply, NIOS, while admitting that the candidates appeared in the mathematics examination, maintained that they had scored only 19 out of 100 marks apiece and hence there was no loss of year to the candidates. It said it was a bona fide mistake on its part but added that it had already communicated the results to the complainants. The NIOS, however, failed to furnish the answer-sheets of the candidates on the plea that it preserved the answer-sheet for 4 months only. The NIOS also opposed the complaint on the ground that the candidates were not consumers of the NIOS since the institute was not engaged in any business activities and hence complaint in the consumer forum was not maintainable. The Forum president, Mr Jagwant Singh, and member, Mrs Babi Sethi, in their separate judgments in the two cases observed that the NIOS had been negligent and deficient in service in withholding the results without cogent reasons. The NIOS, they observed, went to the extent of preparing false documents showing the candidates absent in mathematics examination, whereas their signatures were but on the attendance sheet of that date. The institute later showed the candidates as having failed while the answer-sheets were not available with the institute. It is pertinent to mention here that on of the complainants, Kuldip Singh got through the next years’ mathematics examination by securing 87 per cent marks. The president and the member observed in their judgment that a student appearing in an examination after paying fees to a board or university was a consumer of that board or university. They said they were of the considered view that NIOS was negligent and deficient towards the complainants and held them guilty under Sections 2 (1) (g) and 2 (1) (o) of the Consumer Protection Act, 1986. |
Pradeep Jamawadi, nine others get five years’ jail term
Bhiwani, August 25 According to the prosecution, driver of Haryana Roadways bus (HR 39-4620), Jora Singh filed a report to the Bhawani Khera police on November 17, 2003 that he was driving his bus with conductor Dharmpal from Hansi to Bhiwani at 11.30 am on November 17. Head Constable Sukhbir, constables Ramesh, Mahender and Ramphal boarded bus with accused Pradeep Jamawadi, Dalsher and Pradeep Badala. Five six other unidentified youths were also travelling in the bus. He added when the bus arrived near Milakpur village, a few miles from Bhiwani at 11.45 am, one of the youth asked him to stop the bus stating that as his house was near here. As he slowed the bus other youths engaged in a scuffle with the police party to free the accused. In the meantime, a commander jeep, in which five six youths, armed with iron rods and lathis, pistol alighted from the jeep and boarded the bus. According to the challan, a youth identified as Sri Bhagwan fired a shot at the policemen but it injured one of the accused Dalsher. The accused, however, was able to free Pradeep Jamawadi in handcuffed position, whereas, the driver, conductor and passengers overpowered other accused Pradeep Badala. The police had registered a case on the complaint of Jora Singh against Pradeep Badal, Sri Bhagwan, Jai Bhagwan, Jagdish of Nindana, Dalsher of Baas, Subhash, Manoj, Shamsher of Nindana, Kuldeep of Badala and Pradeep Jamawadi of Jamawadi village under Sections 148, 224, 225, 332, 353, 307, 149 of the Indian Penal Code (IPC) and sections 24,54,59 of the Arms Act. The court finding Sri Bhagwan and Jagdish guilty under the Arms Act and sentenced them to two years imprisonment and fined them Rs 500. |

Insurance manager dupes investors of Rs 53 lakh
Bhiwani, August 25 The company has reported the matter to the police. The manager has absconded after duping the company of Rs 53 lakh which had been invested in the company by the investors. Police sources said that the local branch manager of PCL India Ltd, an insurance and savings company, allegedly embezzled Rs 53 lakh by making fake documents. A senior official, when inspected the record, discovered manipulations in the accounts books. The company has suspended the branch manager and instituted an inquiry against him. The accused manager has been identified as Umesh Verma from Palwalpuram in Meerut district in Uttar Pradesh. |
No power crisis, says UHBVN
Rohtak, August 25 In a press statement issued here on Tuesday, Mr S. P. Gupta, Superintending Engineer (Operation), said all equipment required for maintaining supply was available and that there were no reports of shortage as pointed out by the union. The HSEB Workers Union had in a press statement claimed here on Tuesday that shortage of conductors, meters and transformers had aggravated the power crisis and that because of erratic supply the suffering public was assaulting nigam employees posted at substations. Mr Gupta said the real reason for power shortage was the gap between demand and supply. The UHBVN was not responsible for the power crisis since it did not generate any power, he added. |
MoU signed on disease surveillance project
Chandigarh, August 25 While stating this here yesterday, the Haryana Health Minister, Mrs Kartar Devi, said the programme, involving an expenditure of Rs 11.44 crore, would also help in initiating an effective response to the impending outbreak of any disease well in time. Also, it would provide essential data, monitor the programme to control diseases and help allocate resources more rationally. |
3-yr jail term in bribery case
Jagadhri, August 25 Additional District and Sessions Judge S.S Lamba, while pronouncing the order, also fined municipal engineer Yashpal Aggarwal of Rs 2,000. Aggarwal had demanded and accepted a bribe of Rs 5,000 from a contractor Mr Balbir Singh.
