IT activists protest gagging social site users
New Delhi, December 8 According to the activists, the section in question stands in gross violation of the right to free speech and expression that the Indian Constitution guarantees under the Article 19 (1) (a) and is a clear attempt of the government to muzzle public opinion. On the occasion, Kanpur's Aseem Trivedi, a cartoonist who was arrested under the same section and on charges of sedition on September 8, 2012, said, "The government has been misusing the IT law. Many people have been arrested for posting harmless comments and updates on social networking sites which hurt the sentiments of a few people under the draconian Section 66 A which also has three years of imprisonment." In this context, the Supreme Court had last week taken suo motu cognisance of the matter following a PIL filed by a Delhi University student, Shreya Singhal, seeking scrapping off the section concerned. Apart from Aseem's detention and the arrests of Shaheen Dhadha, 21, for putting up a post on Facebook and her friend, Renu Srinivasan, for liking it, there have been several other instances, such as the arrest of businessman Ravi Srinivasan in October 2012 by the Puducherry police for tweeting against a politician from Tamil Nadu; arrest of two Air India employees, V Jaganatharao and Mayank Sharma by the Mumbai police for posting contents of Facebook and Orkut against the political coteries. Activists feel these incidents have created a panic among the Internet users. Participating in the protest, activist Alok Dixit and Ashish Tiwari of Save Your Voice Campaign, said, "An innocent man tweeting about a powerful figure to his dozen-odd followers can, at best, be tried for defamation. But Sec 66A has become a handy tool in the hands of powerful people to get innocent people arrested. It is unconstitutional and so should be abolished." Aseem said that in 2008, there were eight laws which were passed without ensuring any proper discussion on the floor of the House and the IT Act Section 66 A was one of them. |
Lokayukta for accountability in encroachment cases
New Delhi, December 8 The Lokayukta made the recommendations while deciding a complaint of Subhash Chandra Bansal against Nirmala Thakur, Municipal Councillor, Rohini. The Councillor was elected in 2007 while the registration of the Shiv Shakti Sanatan Dharam Mandir Society in Rohini and the establishment of idols were made from 1994 to 1997. While holding that the case against the Councillor was not proved, the Lokayukta made suggestions under Section 16 of the Act (Delhi Lokakyukta and Uplokayukta Act, 1995). "It is high time that we recognize the stark reality that either influential local politicians or religious groups encourage unauthorized occupation of public land. The statutory authorities either on account of their laxity or on account of influence, which the local group or politicians wield, are loath to immediately remove the encroachment," he said. The Lokayukta said, "Within a short time either a temple, gurudwara or mosque comes up on a public land or a claim is made of it being in existence for long. Here, public and religious sentiment is also built up. It is at this stage that fait accompli is presented before either the religious committee or courts, seeking allotment of such lands or regularization of encroachment." "The courts then deprecate the encroachment and give the advice of putting an end to it," the Lokayukta said. |

Two held for stealing seven diamonds
New Delhi, December 8 Deputy Commissioner of Police (Crime and Railways), SBS Tyagi, said, "Deepak, a resident of Shakarpur, and Raviraj Gupta who belongs to Kolkata, have been arrested. Gupta is a goldsmith and can evaluate diamonds. Seven diamonds worth Rs 45 lakh have been recovered from them." Tyagi said that the victim, Binu Jain, is a diamond dealer. He allegedly disclosed to the police that Gupta had telephoned him and requested him to come with the diamonds at H-60, South Extension Part -1, Delhi. The office had been rented by the two accused. Gupta had told him that he wanted the diamonds for his clients. He had found Jain's number on the Just Dial portal. On June 13, Gupta again telephoned the victim and asked him to come to his office with the diamonds. When they met, he took the diamonds and told Jain that he wanted to show them to his brother who, he claimed, was waiting in another room of the office. The accused, however, fled with the jewels from the rear gate. Jain waited for an hour. He then informed the police about the theft. The police registered a case regarding the matter under IPC sections 406 (Punishment for criminal breach of trust) and 420 (Cheating and dishonestly inducing delivery of property) at the Kotla Mubarakpur police station. On November 24, the police was tipped off that Deepak would arrive at Brittania Chowk from where he would reach Karol Bagh to sell one of the stolen diamonds. The police arrested him at Brittania Chowk and recovered the jewel. Gupta was later arrested at Shakurpur and is under police custody till December 9. The police has recovered the remaining six diamonds from Kolkata. Tyagi said, "The interrogation of the accused persons has revealed that to earn easy money, they took to crime. Deepak is involved in more than 26 cases of theft and burglary. Both the accused met in jail and became friends. They had planned to cheat jewellers after coming out of jail." |
