The party has retained most outgoing MLAs even though a few months ago the then in charge of Haryana affairs Moti Lal Vora, AICC treasurer, had accepted the suggestion made by Finance Minister Birender Singh and CM Bhupinder Singh Hooda that the party should replace about 40 per cent of the sitting MLAs.

Cavalcade trouble for INLD’s Dilbag
Yamunanagar, September 23
The INLD candidate, transporter Dilbag Singh, today filed his nomination papers accompanied by a cavalcade of more than 300 vehicles here this evening. He filed his papers 3 pm sharp, the official deadline, though he reached the office at 2.30 pm. He told the returning officer that he had done so on the advise of his astrologer. In official records the time of filing of papers has been mentioned as 2.55 pm.

We’ll win 55 seats: Bhajan
Sirsa, September 23
Former Haryana Chief Minister Bhajan Lal today claimed that the HJC led by his son Kuldeep Bishnoi would win 55 seats in the coming elections. Former Deputy Chief Minister Chander Mohan, a sitting MLA from Kalka (Panchkula district), and six more have been dropped by the Congress.

Ramesh Kaushik from Rai, Bharat Singh Chokher from Samalkha, KL Sharma from Shahbad, Randhir Singh from Barwala, Hari Ram from Jhajjar and Azad Mohammed from Ferozepore Jhirka have not been nominated this time. Shamsher Singh Surejewala has already opted out of the contest. The Rohtak seat that fell vacant on the elevation of Shadi Lal Batra to the Rajya Sabha has been allocated to his distant relative Bharat Bhushan Batra.

Shahbad and Jhajjar have been declared reserved seats.

On the list announced today were names of senior leaders Bhupinder Singh Hooda, Birender Singh, Mange Ram Gupta, Kiran Chowdhry, Venod Sharma, Phool Chand Mullana, Harmohinder Singh Chatha, Capt Ajay Singh Yadav, Dharambir Gaba, Karan Singh Dalal, Anand Singh Dangi and Lachhman Dass Arora.

The party has re-fielded the sitting MLA from Fatehabad, Dura Ram, a son-in-law of former CM Bhajan Lal, and Somvir Singh from Loharu, a son-in-law of the late Bansi Lal.Kailasho Saini, who left the INLD to join the Congress, has been given the p ticket from Ladwa. Her former associates in the INLD, Sampat Singh and Sushil Indora, who had also joined the Congress, are not in the first list. The list shows the rising strength of Chief Minister Hooda in the party. Though he has managed to secure a major share for his faction, other factions have been accommodated too.

AC Chaudhary, minister and sitting MLA from Faridabad, who had raised his voice against the Chief Minister some months ago, is not on the list, much to the surprise of observers. Neither has the name of the sitting MLA from Mundhal Khurd been cleared.

The allotment of ticket for the Panchkula assembly segment to sitting MLA from Ambala cantonment DK Bansal has surprised not only the MLA but also his supporters. A first-time MLA, Bansal had contested the elections in 2005 and had won by a narrow margin.

Four-time MLA Nirmal Singh, who till now had been contesting from the now abolished Naggal constituency, has been given the ticket from Ambala Cantonment.

Notorious for “aaya Rams and gaya Rams,” Haryana leaders these days are ‘switching’ loyalties for political rehabilitation.

Senior Congress leader Jai Prakash Gupta quit the party today to join the HJC and has been given the party ticket for the Karnal assembly constituency. Tarlochan Singh, president, Karnal unit, has severed his ties with the HJC, describing the party action as “betrayal”.

Jai Prakash defended his switchover, declaring: “Everything is possible in politics and I’m not married to Hooda... My sole objective is the welfare of people and development. I reserve the right to join the party of my choice.”

Tarlochan Singh, taken aback by the turn of events, said this was “betrayal” of the workers who had stood by Bhajan Lal for years. He said 50 district office-bearers were quitting the party along with him.

Welcoming Jai Prakash to the party, senior HJC leader Rakesh Kamboj said it would strengthen the party and the HJC would fare better in the elections.

Balwinder Kalra of the Congress who had joined the HJC in the hope of contesting from Karnal was also left high and dry and quit the party to join the BSP.

In a setback to Congress nominee from Fatehabad Dura Ram, Pahlad Singh Gillankhera, a staunch supporter of Haryana minister Kiran Chowdhry, today announced his decision to contest as an Independent.

Gillankhera made this announcement at a well-attended meeting of his supporters here today. He will file his nomination papers on September 25.

Bhisham Pitameh, another aspirant for the Congress ticket, has been nominated by the BJP from Fatehabad.

Gillankhera, who enjoyed close ties with the late Bansi Lal and his son Surender Singh, has contested the Darba Kalan seat twice and the Fatehabad seat once, though unsuccessfully, on the Haryana Vikas Party ticket.

Gillankhera said even during the 2005 poll, he was the strongest contender but the then HPCC president Bhajan Lal allotted the ticket to his nephew Dura Ram.

“This time again my claim has been ignored... The Congress has ignored my contribution.” He said it was on the advice of his supporters that he had decided to fight the elections as an Independent.

The Congress seems to have followed the maxim of “old is gold” while deciding candidates for 68 seats in Haryana.

The names were declared today. The party has retained most outgoing MLAs even though a few months ago the then in charge of Haryana affairs Moti Lal Vora, AICC treasurer, had accepted the suggestion made by Finance Minister Birender Singh and CM Bhupinder Singh Hooda that the party should replace about 40 per cent of the sitting MLAs.

The party has gone to the extent of fielding sitting MLAs who have lost their constituencies in the delimitation exercise from seats to which they are not even remotely connected. This may cost the party dear as it has ignored aspirations and wishes of its local workers.

Obviously, one of the compulsions in retaining the sitting MLAs before the Congress has been the severe infighting that came to the fore during ticket distribution.

With senior leaders of the Haryana Congress pushing for the nomination of their favourites, the high command had to strike a balance among all factions.

One way to pacify various factions was “transplantation” of MLAs. For example, Geeta Bhukkal, whose constituency Kalayat in Kaithal district was de-reserved during the delimitation, could have been accommodated in the neighbouring constituency of Narwana, earlier represented by Power Minister Randeep Singh Surjewala, which has been reserved now. But she has been “transplanted” in the distant Jhajjar.

Similarly, Satwinder Singh Rana, who lost his Rajaund constituency in Jind district during delimitation, will now contest from Kalka. Sitting Ambala cantt MLA DK Bansal has been shifted to Panchkula, from where former deputy chief minister and elder son of Bhajan Lal Chander Mohan has been denied the ticket for obvious reasons.

Bansal has been transferred to Panchkula because the party wanted to accommodate former Haryana Youth Congress president Nirmal Singh from Ambala Cantt, as his constituency, Naggal, has been abolished.

The ticket to Rana and Bansal from Kalka and Panchkula is being strongly resented by local Congressmen who see this as a blow to their aspirations and interests.

Many have decided to remain low key during the election campaign, if not turn rebels.

In a record of sorts, the Congress, although known for delaying lists, has yet to finalise its complete list of 90 candidates with just two days left for thefiling of nominations.

Sources say that the remaining list of 22 candidates is proving to be more contentious with various factions having taken a rigid stand in support or against certain candidates

.Only a firm intervention by Sonia Gandhi can untangle the problem.

Cavalcade trouble for INLD’s Dilbag

The INLD candidate, transporter Dilbag Singh, today filed his nomination papers accompanied by a cavalcade of more than 300 vehicles here this evening.

He filed his papers 3 pm sharp, the official deadline, though he reached the office at 2.30 pm. He told the returning officer that he had done so on the advise of his astrologer. In official records the time of filing of papers has been mentioned as 2.55 pm.

Dilbag Singh owns movable and immovable property estimated at Rs 8.36 crore as mentioned in his affidavit attached with the nomination papers.

Dilbag Singh was followed by a cavalcade of more than 300 vehicles carrying INLD flags.

The procession began near the railway station at 12 noon and reached the mini secretariat in two hours.

As a result, traffic on internal roads as well as the highway was thrown into chaos.

Dilbag Singh claimed that the vehicles belonged to his supporters. District election Amit Kumar Agarwal said: “ We have made the video of the procession and action will be taken accordingly. The cost incurred on the procession and vehicles will be included in the expenditure of the candidate.”

Regarding the time of filing the papers, he said the candidate was required to reach the office before 3 pm and it did not matter if the process took some time.

‘EVMs can’t be tampered with’

The Deputy Chief Election Commissioner with the Central Election Commission, Dr Alok Shukla, said here today that the allegations regarding electronic voting machines (EVMs) were baseless as these machines were tamperproof.

Addressing a meeting of Deputy Commissioners and senior police officers of all six districts in Gurgaon division at the Haryana Institute of Public Administration (HIPA) here, he exhorted them to understand the functioning of EVMs and convince all concerned that these could not be tampered with.

Dr Shukla pointed out that the EVMs were manufactured by the BEL and the ECIL and supplied throughout the country. “No one knows which machines would be sent to which place and hence the allegations that the engineers in those companies may have programmed the machines to favour any given candidate are wrong and baseless,” Dr Shukla said, adding that each EVM had one-time programmable chip and one cannot write again on it.

‘Moral turpitude’ covers more than sex offences: HC

The Punjab & Haryana High Court has ruled that the concept of moral turpitude involves more than being involved in a sexual crime. Justice Ranjit Singh asserted: “There is a tendency to restrict the term to sexual crimes but the meaning certainly is much broader. Sexual crimes, of course, would fall within the scope of the definition…. It may be possible to say that mere assault, causing hurt, etc, does not or may not involve moral turpitude. Whether it does or does not would depend upon the particular facts pertaining to the individual case”.

The judge added: “Homicide may or may not involve moral turpitude depending upon the degree of the crime, and so would be the position regarding attempted homicide”.

The high court’s ruling came on a petition filed by one Parvesh against the state of Haryana and other respondents. “Despite due selection the respondents have declined to appoint the petitioner as constable on the ground that, though he is acquitted of the offence alleged, it involved moral turpitude”.

Parvesh was allegedly involved in a criminal case for offences under sections 323, 325, 307, 506 & 34 of the IPC but was acquitted after the trial.

Justice Singh observed: “The term moral turpitude is not defined anywhere, and the term has been used in law for centuries…. Moral turpitude is something that would mean, as noted by the Supreme Court, an act that is vile, deprave or having any connection showing depravity. It has been held to mean something that is contrary to justice, honesty, modesty or good morals in the background of a false statement made by a person…”

“To say that all conduct alleging an attempt to murder would be an offence involving moral turpitude would amount to doing injustice to the term. This has to be seen and appreciated in the context and circumstances of the case to see if conduct was base, vile or deprave. To term the offence of attempt to murder as such involving moral turpitude would not be a fair approach and cannot be so adopted”.

Before parting, Singh said: “The respondents shall consider the case of the petitioner for appointment by giving him a constabulary number within a month from the date of receipt of a copy of this order.”

Shangla is chief of judges’ association

Additional District Judge, Kurukshetra, Neelima Shangla has been elected the state president of the unified body of senior judges and lower judicial officers.

The election was held at the general body meeting of the Haryana Judges’ Association formed by merger of twin associations of sessions judges and lower judicial officers in Jind.

The meeting was attended by sessions judges, additional sessions judges, chief judicial magistrates and judicial magistrates from all over the state.

Earlier also two separate associations of sessions judges (superior judges) and association of civil judges (lower judiciary) were merged into one association under the banner of the Haryana Judges’ Association in 1985 and Justice NS Rao, the then registrar general of the Punjab and Haryana High Court and the senior most judge of Haryana was elected the first president of the association. Shangla has been elected the president of the association after 24 years as the bigger association had split and judicial officer up to the rank of senior sub-judge had formed a separate association. However, both the associations merged into one with effect from September 21.

The newly elected office-bearers and members resolved to work more earnestly for speedier dispensation of justice and also discussed various issues to introduce better working conditions for judicial affairs. Jind CJM Sandeep Singh and Sangeeta Sachdev were elected as vice-presidents while Sanjay Khanduja, civil judge (senior division), Jind, Amit Sehrawat, civil judge (junior division), Faridabad, and Rajesh Garg, CJM, Kaithal, were elected general secretary, joint secretary and treasurer, respectively.The executive members included SK Dhawan, Additional Sessions Judge, Kurukshetra, Naresh Kumar Singhai, civil judge (senior division), Kurukshetra, Phalit Sharma, CJM Sonepat, S K Garg ADJ, Faridabad, SP Singh, ADJ, Faridabad, Rajesh Sharma, Vimla Sapra, Narender Sharma, Sushil Kumar, Sudhir Parmar, Jagjeet Singh, Roopam, Sunil Chauhan and Jitender Hooda. SS Lamba, sessions judge, Hisar, was nominated as patron.

Factory workers lathicharged

Over 10 workers of a factory located near Hero Honda Chowk in the city were injured in a lathicharge on them in front of their factory late last night. Policemen also manhandled a reporter of a news channel and snatched his camera. The workers of Sunbeam factory were holding a protest in support of their demands. They began a dharna after the management reportedly sacked some employees.

Late last night, some drivers working for the factory management tried to take their vehicles out of the factory. They were stopped by the protesting workers, following which the policemen deployed there intervened and a clash ensued.

Over 10 workers were injured in the lathicharge. Roshan Bhardwaj, a reporter of a news channel, who had gone there to cover the incident, was also manhandled by the policemen.

The reporter's identity cared, recently issued to him by the local Police Commissioner, was not accepted by the policemen, who apparently considered it of little significance.

Following this, several local journalists assembled in front of the residence of the Commissioner of Police, SS Deswal. The Commissioner, however, kept them waiting for long. Finally, he emerged and regretted the incident.

Meanwhile, the workers injured in the lathicharge have been admitted to the local Civil Hospital.

Suicide: Kin block traffic

Anger and grief marked the “Rasam Kriya” of Sahib Singh, who had committed suicide on September 13 and mourners, including family members, neighbours and friends of the deceased, blocked the Karnal-Kunjpura road for over an hour in protest against police “inaction”.

Sahib Singh, in his suicide note, had held some persons responsible for driving him to take the extreme step. The protesters demanded the arrest of these persons.

Dharamveer and Jai Bhagvan (brothers) and Saroj (sister) demanded action against those responsible for their brother’s demise. — TNS
