Court upholds ownership of Liberhan
brothers Ambala, November 19 Younger brother of Justice Liberhan, Tajender Mohan Singh Liberhan filed a suit in two years ago on the basis of a report published in an national English daily on the basis of a report given by the then Additional Director, Local Bodies alleging therein that Liberhan brothers are in illegal possession of government property No. 127-A and 127-B at Ambala Sadar and the Municipal Council wrongly sanctioned mutation in their favour. Prior to the filing of the suit, the Ambala Estate Officer on December 23,1999 issued a show cause notice to the plaintiff alleging therein that the property belonged to the Government of Haryana and why the same should not be resumed. Mr Liberhan filed a reply to the notice but no decision was taken on the reply the said show-cause notice. The court observed that the plaintiffs were claiming ownership on the basis of mortgage deed registered in 1924, wherein it is mentioned that Mr Mokha Singh and after his death his sons Dewan Alakh Dhari and Sardar Pritam Singh, were owners of the property No. 127-A known as Punjab Ice Transparent Factory. The court further observed that later Mrs Vidya Wati Liberhan and Mrs Chand Hoon became the owners and in possession of property No.127-A and lessee of property No.127-B and 170, Bank Road, Ambala Sadar. After the death of MrsV.V. Liberhan and after the purchase of share of Mrs Chand Hoon, the plaintiff, his brothers, sister and sister in law stepped into the shoes of Mrs V.V. Liberhan and became owner and in possession of property No.127-A and lessee of property No.127-B. In this suit earlier the court had granted ad-interim injunction, in favour of the plaintiff which was confirmed by the high court. However the high court directed the lower court to decide the suit in one year. The civil court now passed the decree declaring plaintiff and his brothers to be the owners and in possession of property No. 127-A. One of the witnesses admitted that the government, was not in possession of any deed of grant and GLR had not been transferred to the Municipal Council. Some of the witnesses have admitted that only limited powers had been conferred on the state the Haryana for managing the excised area by the notified area committee, no power had been given to the state to resume the properties for specific reasons. The court further observed that no opportunity of hearing was provided to the plaintiff and the principle of natural justice had been violated. It was also observed that the compensation offered to the plaintiff was determined in 1985 i.e. 14 years prior to the resumption notice whereas the value of the property in 2000 is much more than it was 1985. After discussing in detail the vidence of the government, the court observed that the court had come to the conclusion that the case of the plaintiff had got more force that the case of the defendants.

The commission took suo motu cognizance of a newspaper report entitled “Five Dalits lynched in Haryana” in a daily on October 17 last year. The report stated that five Dalits, who were carrying animal hides and a cow in a vehicle, were beaten to death on October 15 last in Jhajjar district of Haryana and that two of them had been torched. |

Water filter for the
masses Ambala, November 19 Dr Safir Alam, Director of the kendra, said the ‘janta water filter’ comprised two earthen pots and a filter candle. “It can be prepared by anyone. One needs to make a hole in a earthen pot and fix the filter candle. Then keep another earthen pot below it. If required, then a tap can be affixed in the lower earthen pot,” he said. Dr Upasana Singh of the kendra is now giving final touches to a “janta fridge.” The refrigerator will keep the food inside it cool. Dr Upasana Singh said while the water filter cost barely Rs 120, the janta fridge could be prepared at a cost of about Rs 1,500. “The technology is cheap and practical,” she said. The janta water filters have been distributed in some villages where the response has been favourable. The users of the filter have pointed out that there are fewer cases of water borne diseases as compared to previous years. |

chiefs Ambala, November 19 The new youth wing presidents are — Ambala City: Mr Sunil Trikha, Ambala Cantt: Mr Surendra Raju Sharma, Naggal: Mr Ram Kumar Batarohan and Mullana: Mr Som Prakash Saini. He said the Naraingarh president would be announced after the Rajasthan elections. He said the new presidents must work for further strengthening the party. They should inform the people about the welfare activities being carried out by the Chautala government, he added. |
