Judge reserves order on doctor couple’s bail Ambala, November 18 The local police registered a case against them on October 24, when a woman, Amarjit Kaur, died at their centre while the doctor couple was aborting her four-months malformed foetus. The counsel for the state, while opposing the cancellation of bail, said the ultrasound centre was not authorised for conducting ultrasound and MTP. The foetus was not found in the womb of the deceased during the postmortem examination, which might have been thrown somewhere by the doctors. The counsel for the state said the couple was aware that the abortion could lead to the death of the patient. The lower court had granted bail by going beyond its jurisdiction. On the other hand, the counsel for the couple, while supporting the bail, said it was a case of natural death and the couple could not be held responsible for it. He said initially the case was registered against the doctors under Section 304-A of the IPC, but later, subsections 3, 4, and 6 of the PNDT Act were added in the FIR to make the case non-bailable. He said the complainant had reported that the death took place due to the negligence of the doctors, which came under Section 304-A of the IPC and was a bailable offence. The counsel argued that the bail granted by a Magistrate could be cancelled only on the ground that the accused was misusing it was likely to leave the country or was interfering in the administration of justice. He said the lower court had not gone beyond its jurisdiction and the bail should not be cancelled. |
