2 dissident MLAs sent to jails

Lucknow, November 10
Two dissident Independent MLAs Raghuraj Pratap Singh alias Raja Bhaiya and Dhananjay Singh, who had been remanded in judicial custody till January 4 under the Gangsters Act, have been shifted to Banda and Jhansi jails respectively, official sources said here today.

The two legislators were shifted to Banda and Jhansi jails amidst tight security late last night on the directive of the district magistrate keeping in view the law and order situation, they said.

They were arrested a few days ago for allegedly threatening BJP MLA Puran Singh Bundela for deserting the rebel camp.

They were lodged in the Fatehgarh Central Jail and were brought here on Friday and produced before the court, which remanded them to judicial custody till January 4.

Meanwhile, in a softening of stand, dissident BJP legislators in Uttar Pradesh today said they were ready to meet the party high command to apprise them of their grievances but insisted that a congenial atmosphere was a must for the parleys to resolve the stand-off with the state leadership.

The dissidents have sought time with national leaders, including Prime Minister Atal Behari Vajpayee and Deputy Prime Minister L.K. Advani to apprise them of their grievances and the ongoing political stalemate, rebel MLA Shiva Kant Ojha said.

The rebel group was expected to leave for Delhi within a day or two after getting the green light from the party high command, he said.

In a related development, the scrutiny of nominations for Rajya Sabha poll from Uttar Pradesh, stayed by the Election Commission, will be taken up tomorrow following clearance given by the commission.

Returning Officer R.P. Pandey told reporters here today that the EC’s nod had paved the way for going ahead with the scrutiny process. PTI

HC order ‘not to affect’ Dec 13 attack case

New Delhi, November 10
Unperturbed by the Delhi High Court order holding that the intercepted communications between the accused persons in the Parliament attack case were not admissible evidence under POTA, the prosecution today expressed confidence that it was unfazed by the order and would prove its case.

“We are not affected by the high court order. There are sufficient evidence including the circumstantial evidence to prove the conspiracy and involvement of the accused persons in the December 13 attack on Parliament,” senior public prosecutor D.P. Aggarwal told PTI, a day before the start of final arguments in the case.

Jaish-e-Mohammed (JeM) militants Mohammad Afzal, Shaukat Hussain Guru, his wife Navjot Sandhu, alias Afsan Guru, and S.A. R. Geelani, suspended lecturer of a Delhi University College, are facing trial in the case.

Mr Aggarwal said even after the intercepted conversations were disallowed as evidence, there were sufficient facts and circumstances to prove the guilt of the accused persons.

During the trial proceedings, Geelani’s cousin deposing as a defence witness had admitted that he spoke to him on the day of the attack, he said.

Besides, the eyewitnesses account of the attack, seizures made from the accused, the confessional statements of Afzal and Shaukat under POTA were sufficient to prove the guilt of the other accused persons, Mr Aggarwal said. While the two JeM militants had willingly recorded their confessional statements, Geelani had declined the offer before the DCP.

The high court order had come on an appeal by the three accused — Geelani, Shaukat and his wife against the Special Court’s order rejecting their applications challenging the inclusion of intercepts as evidence under POTA. PTI

BJP ‘delaying relief to ’84 riot victims’

Kanpur, November 10
UP Congress general secretary Kuldeep Singh today charged the ruling BJP with delaying tactics in the relief and rehabilitation package to the families of victims of 1984 riots in Delhi and Uttar Pradesh.

Talking to reporters here today, Mr Kuldeep Singh said the ruling party’s intentions were to keep the issue of riot relief alive to draw political mileage during the elections.

He said then UP Governor Moti Lal Vora granted a package as interim relief to the victims’ families in the state but it was yet to be implemented.

Besides, the state government had earlier instituted an inquiry by a Revenue Board member but had later set an inquiry panel headed by a Commissioner and was seeking afresh affidavits from the victims’ families just to delay the disbursement of relief, he alleged.

Mr Kuldeep Singh urged the BJP to come forth and announce its clear stand on the issue. UNI

India asks B’desh to close militant camps

New Delhi, November 10
Talking tough, India has asked Bangladesh to close down militant training camps existing in that country and hand over insurgents taking shelter there asserting that they are getting support from the ISI.

India has handed over to Dhaka a list of 99 training camps existing in Bangladesh, pinpointing their exact locations, and a list of 77 insurgents, including some leaders, and nine criminals who have been arrested by the authorities there.

The training camps, whose list has been prepared by the Indian security agencies, includes 25 run by the National Liberation Front of Tripura (NLFT), 20 run by the All-Tripura Tiger Force (ATTF) and 18 by the National Socialist Council of Nagaland-Isak Muivah (NSCN-IM).

The list also includes 10 training camps run by the People’s Liberation Army (PLA), 17 by the United Liberation Front of Assam (ULFA), two by the National Democratic Front of Bodoland (NDFB), two by the Muslim United Liberation Tiger of Assam (MULTA), three by the Achik National Volunteer Council, one by the Chakma National Liberation Front (CNLF), and one by the Dima Halam Daoga, they said.

The list of insurgents includes those from Assam, Nagaland, Tripura and Manipur along with details where and when they were arrested in Bangladesh.

Other insurgents demanded include Bendage Wati, Chooba alias Maden, Tusi, Champa, alias Chaoba, Kaning Aum (all of the ULFA), Sohan Deb Barma and Ghanta Deb Barma of the ATTF, Saul Borok, Dhingro Deb Barma, Makshod Borok, Saybam Deb Barma and Kumon Deb Barma (all of the NLFT). PTI

Don’t hit out, if want to hit it off

Think hard before you hit your wife — you might forfeit your right to have sex with her, if the National Commission for Women (NCW) has its way.

Towards this end, the NCW has demanded amendments in the Domestic Violence Bill, including a provision to restrain an accused husband from forcing sexual cohabitation and to ensure rights to matrimonial home for the wife.

Concerned over the “gravity” of the violence against women within the four walls of her house, the NCW, which has submitted its recommendations to the government for needful changes, said “emphasis should also be laid on remedy for victims of domestic violence. However, this aspect is missing in the Bill introduced by the government.”

Stressing the need for the “widening” of the definition of the term “domestic violence”, the Commission said “the definition of domestic violence in the present Bill is limited and instead of protecting women from domestic violence, it seeks to legitimise some forms of violence in order to maintain domestic harmony.”

“The definition of domestic violence as given in the Bill further has not addressed specifically to the problem of sexual abuse of children in family, marital rape and other similar forms of violence as mentioned in the draft Bill prepared by the NCW,” the Commission said.

Demanding that the protection order in domestic violence incident should include a direction for all cases in which a wife lives separately from her husband, along with children, and for giving the matrimonial home to the wife for separate living, the NCW said the order should also contain a provision that the accused husband cannot force the wife to have sexual relationship.

The Commission also suggested provision of emergency monetary relief saying “notwithstanding any other law in force, every person aggrieved has a right to obtain protection against domestic violence under this Act in the form of protection orders and emergency monetary relief.”

Among other recommendations regarding the protection order, the NCW said the order should prohibit the respondent from enlisting the help of another person to commit any such acts of domestic violence, entering the place of employment of the person aggrieved or, if person aggrieved is a child, its school.

It should also prohibit the respondent from entering the residence of the person aggrieved, the Commission said, adding that the order should also restrain the respondent from alienating or disposing of the shared household or encumbering the same or renouncing his rights in the shared household. Exclude Hardwar from Uttaranchal’

A protest rally organised by the Hardwar Bachao Sangharsh Samiti and the signing of a memorandum in blood by hundreds of persons, demanding the exclusion of Hardwar from the hill state of Uttaranchal, marked the second anniversary of the creation of the state, here on yesterday.

Hundreds of youth, riding on motor cycles and scooters, marched through the main streets of the city and held a rally in front of the camp office of the District Magistrate, Mr S.K. Maheshwari. They handed over a memorandum, signed in blood, to be forwarded to the President of India, demanding the restoration of the district to the parent state of Uttar Pradesh.

National general secretary of the Samajwadi Party, Ambrish Kumar said Hardwar had no geographical, linguistic and cultural affinity with Uttaranchal. The Central Government, ignoring the resolutions of the UP Assembly and the wishes of the majority of people of Hardwar, had included the district in the new state, he alleged.

Mr Murli Manohar, spokesman of the sangharsh samiti, said that by the end of the year, five lakh signatures from the district would be collected on a memorandum to be submitted to the President. A copy of the memorandum would be submitted to the Supreme Court where three writ petitions, challenging the constitutional validity of the inclusion of the district in the new state, are pending for consideration, he added.

Hope for Malta victims’ kin

In a development which could bring some hope to the families of the Malta Boat Tragedy victims, the Indian Embassy in Rome has received a communication from an advocate handling the case that the families of the victims would not be able to join as plaintiffs to claim damages from the accused when the case is submitted for trial.

Advocate Ettore Randazzo in Syracuse, Italy, who is handling the case of the families of the victims of the Malta Boat Tragedy, in which 289 South Asian youths, including 170 Indians — most of them hailing from Punjab — drowned in the icy Ionian Sea between Greece and Italy on the 1996 Christmas eve, has informed the Indian Embassy that the trial judge had allowed the families of the victims to join as plaintiffs to claim damages from the accused.

Mr Randazzo also informed the Indian mission that chief prosecutor Dr Camplsi’s request to the Court of Syracuse to change the initial charge against the 15 accused from “culpable murder” to “wilful murder” had also been accepted by the judge of the court.

Deputy Chief of Mission, Indian Embassy, Mr Yogesh Gupta, while forwarding the letter of Mr Randazzo to Joint Secretary in the External Affairs Ministry here has informed that he had asked the advocate to advise on the related procedure for the purpose.

Mr Gupta has also sent a translation of a report from a local daily La Republica which corroborates that the chief prosecutor of Syracuse would not be prosecuting the 15 accused in the case for the murder of 283 Indian, Pakistani and Sri Lankan immigrants involved in the accident.

Though none of the accused are presently in custody of the Italian authorities, the fact that a criminal case has been registered against these persons for the murder of the South Asian nationals is vindication of Malta Boat Tragedy Association, which has been following the case.

With a message that spiritual powers could destroy the negative forces, and giving a call to blend science with spirituality, Chief Minister N.D. Tiwari today told delegates at a conference on science and meditation to treat spirituality as a tool for bringing about human welfare.

Mr Tiwari was speaking after inaugurating a three-day ‘International Conference on Science and Meditation’ at the Himalayan Institute of Medical Sciences at Jollygrant, situated midway on the Dehra Dun-Rishikesh road.

“As the modern age is attracting the youth to materialism, the consequent need for meditation has increased”, Mr Tiwari emphasised. He said destructive forces could be eliminated once spiritual learning came into play.

The earlier recipients of the award include Mother Teresa, Amitabh Bachchan, Satish Gujral, Manjit Bawa, Pandit Jasraj, Asha Bhosle and Jagjit Singh.

SABe TV to air new satire from Nov 18

With the fate of comedy serial “Raamkhilavaan (CM) n Family” hanging fire due to litigation, SABe TV may court controversy again with the launch of another tongue-in-cheek satire “Public Hai Sab Janti Hai” from November 18, as one of its episodes is a spoof on a popular star mowing down pavement dwellers.

While the former went off air due to protests by RJD activists over the close resemblance to former Bihar Chief Minister Laloo Prasad Yadav’s family, the new launch also has an edgy reality bites flavour.

Talking to mediapersons here last night, producer and script- writer Ashwini Dheer said the new satire “Continues our fight for freedom from suppression of creative expression.”

Any burning issue from the latest scam to the ‘gaurav yatra’ in Gujarat could figure as the raw material for the serial, he warned.

The new serial will also act as a “filler”, till “Ramkhilavaan” makes a comeback, Dheer stated.

“Public Hai Sab Janti Hai” directed by Vijay Krishna Aacharya will focus on issues of the day, featuring a narrator and witty repartees from the cast comprising Sushmita Mukherjee, Sanjay Mishra and Vineet Kumar. UNI

Keeping his Railway Budget promise of introducing 16 Jan Shatabdis across the country, Railway Minister, Nitish Kumar will flag off a Jan Shatabdi linking Hazrat Nizamuddin station here and Kota tomorrow.

The 2060 Jan Shatabdi will leave Hazrat Nizamuddin at 1.15 pm and reach Kota at 7.40 a.m. while 2059 train will depart from Kota at 6.05 pm and reach Hazrat Nizamuddin at 12.35 pm the same day. The train will halt at Mathura Junction, Bharatpur, Hindon City, Bayana and Sawai Madhopur stations on the journey.
