Justice HL Dattu appointed CJI

New Delhi, September 6
Justice Handyala Lakshminarayanaswamy Dattu was on Friday appointed as the next Chief Justice of India and will have a tenure of 14 months.

The President is pleased to appoint Justice Dattu as CJI with effect from September 28, 2014, the law ministry announced here.

The present incumbent, Justice RM Lodha, retires on September 27. The senior-most judge of the Supreme Court after the CJI, Justice Dattu (63) has been heading the bench monitoring investigations into the 2G spectrum scam.

Justice Dattu, who will take charge as the 42nd CJI, retires on December 2, 2015.

“I will request for blessing of all citizens of this country to give me courage and confidence to take this institution of mine to the highest stride,” he had said on Wednesday when the file relating to his appointment reached the Prime Minister’s Office.

Justice Dattu, whose father was a schoolteacher, said: “It will be the happiest day of his life to head the institution of judiciary and at the end of the day I can only say that I will do my best to improve the institution.”

“Mine is the best institution in the world,” he added. However, the judge, who started his legal profession from Karnataka, refused to comment on the issue of latest controversy surrounding the attempt to scrap the collegium system of appointment of judges for higher judiciary.

He joined the Supreme Court as a judge in December 2008. Born on December 13, 1950, he enrolled as an advocate in 1975 and began practising in Bangalore and dealt with all types of matters — civil, criminal, tax and Constitutional cases. — PTI

Gen Singh hits back at AFT verdict in Sukna land scam

New Delhi, September 6
Former Army chief and Union Minister General VK Singh, against whom the Armed Forces Tribunal (AFT) had commented in the Sukna land scam, today questioned the findings against him and said the government should challenge it in a higher court.

Lt Gen PK Rath, who was given a clean chit by the tribunal, said he felt vindicated by the judgment. Reacting to the verdict, Singh said: “In the tribunal’s judgment, instead of reacting to issues, personal attack has been made. Perhaps, we hardly get to see such a judgment. It was a clear issue where corruption could have been prevented. After such a judgment, people will no more be scared of corruption.”

He was commenting on the tribunal’s virtual indictment of his actions as Army Chief in the court martial of former 33 Corps Commander Lt Gen PK Rath, who was given a clean chit by the tribunal in the Sukna land scam.

“They also don’t tell anybody that institution was to be constructed on this land and not just a school. Through this judgment, the morale of corrupt people will go up,” he said.

“You say that in view of security perspective, an NOC cannot be given on land. But, when new person comes, it is then said that there was no security concern and you don’t tell anybody about anything in this regard, which suggests wrongdoing,” he said.

Gen Singh said: “I have nothing to comment on the decision. The tribunal has an honourable judge who is advised by the retired armed forces officers. He goes by their advice because he does not know anything about armed forces.” — PTI

Supreme Court’s order on Undertrials
20,000 prisoners likely to be released from UP jails
Shahira Naim/Manas Dasgupta

Lucknow/ Ahmedabad, Sept 6
At least 20,000 under-trials lodged in 66 jails of Uttar Pradesh are likely to be the beneficiaries of the Supreme Court’s order to release all undertrials who have completed half the sentence for their offence.

UP Additional Director General (Jail) Rajiv Bhatnagar instructed 66 central and district jails in the state to prepare a list of undertrials who have completed half of their stipulated punishment.

Bhatnagar hoped the state government will release them by October 1.

There are 87,261 prisoners lodged in the state’s jails. Of them, charges have been proved against 25,648 while rest of them are still undertrials, said sources.

Relief for 200 in Gujarat

Ahmedabad: The Home Department of Gujarat directed jail authorities to prepare a list of those undertrials who can be released as per the recent SC order. The preliminary estimates showed only 200 prisoners lodged in state’s jails will be benefitted from the order.

Spokesperson for Sabarmati Central Jail, Ahmedabad, said there would not be more than 20 prisoners (in Sabarmati jail) who would meet the criteria and enjoy the freedom under the apex court’s order.

He says the number of undertrial prisoners lodged in Gujarat jails is less as compared to other states because courts in the state are usually liberal towards them. They easily grant bail to those who were arrested on petty charges and release them on parole on various grounds.

Power supply cut after Haryana breached contract: Adani firm
Manas Dasgupta

Ahmedabad, September 6
An official spokesman for Adani Power refused to comment on Haryana Chief Minister Bhupinder Singh Hooda’s letter to PM Narendra Modi, pointing out that the issue was sub-judice and no one, including Modi, would be able to help.

The spokesman pointed out that power supply to Haryana by the company through its dedicated supply line from the Mundra power project in Kutch district of Gujarat was discontinued sometime back due to the breach in contract conditions by the Haryana Government. Along with the Adanis, the Tatas had also stopped power supply to Haryana for the same reasons.

The issue had already passed through two quasi judicial authorities and both have ruled in favour of the Adanis and Tatas. It was the Haryana Government that had gone to the Central Electricity Regulatory Commission against Adanis and Tatas and the authority had ruled in favour of the two private power supply companies. The matter was taken to the appellate tribunal, which, too, ruled in favour of the two companies and it was the Haryana Government which moved the Supreme Court against the tribunal’s ruling and the matter was pending in the apex court.

The spokesman said the Adanis had already filed their reply to the Haryana Government’s petition in the apex court on the dispute. “There was no meaning for the Haryana CM to politicise the issue at this stage by writing a letter to the PM, seeking his intervention, as no one will be able to help in the matter till the Supreme Court takes a decision,” he said.

The spokesman said the Haryana CM was apparently hinting at the PM’s close relations with Adani Group chairman Gautam Adani, but “political intervention will not be possible in this issue at this stage”.
