New Delhi, August 29 However, the government told the Supreme Court that an advisory committee had been set up to deal with the problem of pornographic websites. Additional Solicitor General L Nageswara Rao told a Bench headed by Chief Justice RM Lodha that the committee was expected to submit its report within three weeks, upon which the court posted the next hearing on a PIL on the issue after a month. Advocate Vijay Panjwani, appearing for petitioner Kamlesh Vaswani, contended that as many as 40 million porn websites were available on the internet and the government had not blocked a single site. Rao said the government had always acted on complaints against specific websites. The government was planning to ask social websites to have their servers in India for effectively blocking such content. Also, free software was available which the parents could use at home to deny access to their children to internet porn. Panjwani, however, said this would not be of help as a lot of teenagers had their own cell phones with the internet facility. Acknowledging the problem, the Bench said if the existing sites were blocked today a fresh set of 40 million websites could crop up tomorrow as scientific advancement was faster than enforcement of laws. “There is a need for synthesising laws, technology and governance. If you can’t enforce your laws, then there is no point in having them. A lot of homework is required to deal with the issue,” the Bench said. Another SC Bench issued notice to the government on another PIL by internet service providers (ISPs) protesting against the frequent official orders asking them to block contents which they were not hosting. Earlier, the government had contended that blocking pornography on the internet would involve filtering all the material, including emails, and this would slow down search results and electronic communication, besides coming in the way of accessing educational sites and transacting business. Further, there would be legal impediments in shutting out contents hosted from servers in foreign countries where net porn was legal. Even if such material was blocked, technology was available to bypass the filtering process through encryption and view pornography, it was contended. According to the PIL, some of the websites had graphic scenes of violence, brutality and deviant and destructive acts that would corrupt children, posing a grave threat to public order. “Most offences committed against women, girls and children are fuelled by pornography. The worrying issue is that the severity and gravity of such images is increasing,” the petitioner contended.

Apex court raps govt for plight of undertrials
New Delhi, August 29 “It is going from bad to worse. We can’t allow this,” a Bench headed by Chief Justice RM Lodha remarked while hearing a PIL on the problem of such prisoners languishing in jail for years due to delays in the investigation and filing of chargesheets against them. The apex court asked the Centre to file a status report on under-trials across the country, specifying their number as on March 31, 2014. The Bench, which included Justices Kurian Joseph and RF Nariman, made the observation after being told that several states had not even responded to the notice issued by the court on the PIL. “Once notice is issued, you should take it seriously. Tackling this problem is the obligation of every state and can’t be left to the judiciary,” the Bench said while hearing the PIL filed by an organisation “Fight for Human Rights.” Going by the prevailing situation arising from official apathy, it would be appropriate if the petitioner changed its name to “Fight against Human Rights Violations,” it remarked sarcastically. The fact that such a large number of STs were in jail highlighted the need for “immediate action to deal with the serious problem,” it said. But the state governments were not concerned even after the matter had reached the SC, it lamented. Advocate Rupinder Suri, appearing for Centre, assured the court that a meeting of state home secretaries would be convened in six weeks.

SC slaps notice on MP High Court judge
New Delhi, August 29 Issuing notice to the High Court judge, a Bench headed by Justice JS Khehar also sought responses from the Secretary General of the Supreme Court and Registrar General of the High Court on her plea to scrap the existing panel and constitute a fresh committee including two Chief Justices from other high courts. “In the meantime, proceedings in furtherance of the order dated August 8, 2014 (of MP Chief Justice) shall remain stayed,” the Bench said in its order after a brief hearing. The former Gwalior judge, who had resigned alleging sexual harassment by the HC judge, had moved the apex court raising questions over the judicial panel to look into her complaint. In her plea, she has said that her resignation is a “constructive termination” and she be reinstated with all consequential benefits. She said the HC order of August 8 constituting a judicial panel should be quashed as she felt it would not do justice to her. “The Chief Justice of India in his administrative capacity should constitute a committee comprising two Chief Justices from outside the High Court of Madhya Pradesh and another high court judge and also an external non-judicial member to enquire into her complaint,” the petition said. She had earlier also raised objections to the inclusion of a MP High Court judge in the committee set up to go into her complaint. She had said the judge, who had harassed her sexually, was still discharging judicial and administrative functions over the staff who were working with her and have witnessed her victimisation. The Gwalior judge had also objected to the summons being sent to her husband and daughter to be present at the enquiry. — PTI |

CBI files closure report in coal scam, no case against

New Delhi, August 29 The CBI has told the court it will file some documents related to the case before it after which Special CBI Judge Bharat Parashar fixed the closure report for consideration on September 1. The FIR against Birla and former Coal Secretary PC Parakh was registered in October last year by the CBI, which had alleged that Parakh had reversed his decision to reject coal block allocation to Hindalco within months “without any valid basis or change in circumstances” and shown “undue
favours”. The FIR related to allocation of Talabira II and III coal blocks in 2005 and the CBI had booked
Birla, Parakh and other officials of Hindalco. During investigation, the CBI, however, had found that there was no “quid pro quo” on the part of Parakh and there was no wrongdoing in allocation of coal blocks to
Hindalco. In its FIR, the agency had alleged that during the 25th Screening Committee meeting, chaired by
Parakh, applications of Hindalco and Indal Industries were rejected for mining in Talabira II and III “citing valid reasons”. On the recommendations of the screening committee, the coal blocks were allocated to Mahanadi Coalfields and Neyveli Lignite Corporation, both
PSUs. These recommendations were placed before the “Competent Authority” which agreed with
Parakh, who later issued letters of allocation to the PSUs on June 16 and July 15, 2005. Within days, a “personal meeting” took place between Parakh and Birla in which the industrialist requested for the allocation of Talabira II coal block, the CBI had said. “Pursuant to these letters and personal meeting between Parakh and
Birla, Parakh recommended the allocation of Talabira II along with Talabira III coal block to Hindalco Industries Ltd, along with other two companies,” the agency had alleged in its FIR. — PTI

Area under kharif crops down
New Delhi, August 29 Deficient rains in many parts of the country have resulted in depletion of water in 85 important reservoirs, which are currently holding 102.741 BCM — 66% of their total storage capacity. The IMD has predicted improvement in rains in central and southern parts of the country, but as the situation is at present, the storage is 83% of the capacity of the corresponding period of the last year and 100% of storage of average of last 10 years. The storage position during the current year is less than that of last year but better than the average storage of last 10 years, says the government. However, poor rains have already affected kharif sowing. Though the principal kharif crop paddy appears to have surpassed last year’s figure on the same date, the Agriculture Ministry figures show that deficient rains have adversely affected crops like coarse cereals, pulses and oil seeds and area under them is down significantly. Though the total sown area as on August 29 stands at 966.25 lakh hectares as compared to 998.01 hectares at this time last year, the area under paddy at 350.02 lakh hectares has surpassed the 349.46 lakh hectares on the same date in the 2013-14 crop year. Poor rains have affected sowing of pulses, coarse cereals and oil seeds in rain-fed areas. As per the Agriculture Ministry, area under pulses is down to 95.40 lakh hectares as compared to 100.64 lakh hectare of last year; coarse cereals 170.83 lakh hectares compared to 190.64 lakh hectares of last year and oil seeds 172.21 lakh hectares as compared to 186.70 lakh hectares of last year. As per the Centre, states having better storage than last year for corresponding period are Jharkhand, Uttar Pradesh and Chhattisgarh. Those with lesser storage than last year for the corresponding period are Himachal Pradesh, Punjab, Rajasthan, Odisha, West Bengal, Tripura, Gujarat, Maharashtra, Uttarakhand, Madhya Pradesh, Andhra Pradesh, Karnataka, Kerala and Tamil Nadu. The worst hit in the country is the western region where the storage in current year is less than last year and also less than the average storage of past 10 years. So far as the northern region — Himachal Pradesh, Punjab and Rajasthan — is concerned, the total storage available in six reservoirs of the region is 13.88 BCM — 77% of the total capacity. The storage during corresponding period of last year was 91%.

Schedule for Katra trains announced
New Delhi, August 29 Announcing the time table, General Manager of Northern Railway Pradeep Kumar said that the new trains announced during the Railway Budget 2014 would be commissioned from September 1. Three new weekly premier trains are being launched from Katra Vaishno Devi to Bandra, Sealdah, Yeshvantpur and Ahmedabad. The train for Bandra will depart from Katra Vaishno Devi at 10.15 am. It will arrive at Bandra at 6.45 am. For Sealdah, the train will depart from Katra Vaishno Devi at 6 am to reach Sealdah at 2.55 pm the next day. For Yeshvantpur, the train will depart from Vaishno Devi at 6.30 am to reach Yeshvantpur at 8.15 pm and for Ahmedabad, the train will start from Katra Vaishno Devi at 10.30 pm to reach Ahmedabad at 11.55 pm the next day. The train frequency between Katra Vaishno Devi and Bandra, Sealdah and Yeshvantpur has not yet been decided. As far as Ahmedabad is concerned, it will leave Vaishno Devi every Tuesday and Ahmedabad on every Sunday, he said.

PMO overrules Rajnath again, picks Ravi as Naga interlocutor
New Delhi, August 29 “The government has appointed RN Ravi as the new official interlocutor and government of India representative for Naga peace talks,” an official notification said today. Sources said Home Minister Rajnath Singh had recommended Ajit Lal, who had retired as the JIC Chairman in July, as the interlocutor for Naga talks. However, after deliberating on the suggestion for several weeks, the PMO overruled the recommendation and appointed Ravi instead. The reason behind Ravi’s appointment was his expertise in Northeast affairs as he was looking after the region during his tenure in the Intelligence Bureau from where he retired as Special Director in 2012. Earlier, the PMO had overruled the recommendation of the Home Ministry to appoint IPS officer Alok Singh as the private secretary to the Home Minister on the ground that he had served as a PS to former External Affairs Minister Salman Khurshid. Ravi, a 1976 batch IPS officer from Kerala cadre, will have to negotiate with Naga rebel group NSCN (IM), who had blamed the UPA government for failure to evolve a solution to the insurgency problem in Nagaland. — PTI

Govt effects secy-level reshuffle
New Delhi, August 29 Lavasa, who had been the civil aviation secretary since January 2014, has been named the environment ministry secretary. V Rajagopalan, who held the post till now, has superannuated. V Somasundaran, a 1979-batch Kerala cadre IAS officer, would be taking over as secretary of the civil aviation. Rakesh Singh would be the new secretary at the steel ministry. Sunil Arora has been appointed as the secretary, skill development, a new ministry under the Modi government. G Mohan Kumar has been named secretary of the Defence Production Department.
