High Court no to reversion of 16 HCS officers

A Division Bench of the Punjab and Haryana High Court upheld the judgment of a single Judge reversing the orders of reverting 16 HCS (Executive) officers. Declaring their appointment as HCS officers valid, Justice Permod Kohli had earlier ruled they had the right to continue in service.

Bhoria is tax tribunal chief

A retired IAS officer of the Haryana cadre, KS Bhoria, has been appointed Chairman of the Haryana Tax Tribunal. Earlier, the state government had decided to appoint a former judge of the Delhi High Court, Justice SL Bhayana, on the post.

The results of the secondary examination - March 2011 - of the Haryana Board of School Education, Bhiwani, will be declared tomorrow. The pass percentage of regular candidates is 68.03 and that of private candidates 74.51.

A salesman at a petrol filling station on the national highway No 1 here was shot dead by armed assailants late last night. The deceased has been identified as Narender Kumar of Gwalisan village here.

Mewat villages sans power for 10 days

Several villages of this backward area continue to be powerless for the past nearly 10 days. Sonia Gandhi is slated to launch a health programme for pregnant women and newborn children and dedicate a drinking water scheme here on Wednesday.

Several residents of Sakras, Kalakhera, Kaliabas, Nasirbas and Jhopri villages in Nuh district told The Tribune today that they had been living without electricity for the past 10 days in this hot weather.

“The problem started when a thunderstorm uprooted many electricity poles as well as trees that fell on electric lines and disrupted power supply. Since then, we have been forced to live without electricity, barring a few hours some days ago,” said a resident of Sakras village.

Similar complaints were aired by residents of several other villages adjoining Sakras. They maintained that initially, the power supply to more than 100 villages had been disrupted due to the thunderstorm.

However, while electricity supply to other villages was resumed within a day or two, the residents of Sakras and adjoining villages, fed by the Sakras feeder, continue to reel under intense heat and darkness.

INLD to stand by farmers against land acquisition

Indian National Lok Dal General Secretary and legislator Ajay Singh Chautala today assured farmers that his party would stand by them if the government tried to acquire their land forcibly.

Addressing farmers who have been protesting against the acquisition of their land at Agroha, near here, he said forcible acquisition of land would never be allowed, especially if it happened to be fertile land.

Criticising the Hooda Government he said Haryana’s land acquisition policy was loaded against the farmers and that was why farmers had been opposing it all over the state.

He said the policy favoured corporates and private builders.

He said the INLD would stand by farmers and fight for their cause. He said the rate of Rs 8 lakh per acre offered to farmers of the Agroha area was not even one-third of the prevalent market rate.

Mayawati’s visit infuses life into dormant BSP

Mayawati’s visit to Chandigarh has given a new lease of life to her party in Haryana. The BSP, which rose to new heights in the 2009 Lok Sabha elections polled about 16 per cent votes, had suffered a setback during the Assembly elections that followed after six months. The party’s vote share went down to about 8 per cent. Since then the party was more or less dormant.

Most of the non-SC leaders, who had joined the BSP before the Lok Sabha elections, became inactive after the Assembly elections. Many of them were in touch with other parties to secure their political future. In addition to the poor performance of the BSP in the Assembly elections, there was another reason for their inactiveness. Almost all of them had joined the BSP due to the efforts of the former in charge of the party in Haryana, Maan Singh Manhera.

After the Assembly elections, Manhera was transferred by the high command to Himachal. The leaders who had joined the BSP at his behest felt that they had no godfather in the party now.

It goes to the credit of Raja Ram, senior national vice-president of the BSP, who is now looking after the party affairs in Haryana, that he was able to activate all these leaders once Mayawati announced her plan to address party workers of northern India in Chandigarh.

Among those inactive BSP leaders who turned up for the rally today were former ministers Devinder Sharma and Narinder Sharma, former MLA Zakir Hussain among others.

Mayawati’s announcement that her party would contest the elections in northern states alone has disappointed certain Haryana BSP leaders, who were trying that their party should enter into an alliance with a regional party before the next Assembly elections.

Mayawati has a bitter experience of having an alliance with regional parties in Haryana. When Kanshi Ram used to head the party, he had entered into an alliance with the INLD for the 1998 Lok Sabha elections. But immediately after the elections, the INLD had announced its support to the BJP.

No wonder, Mayawati, is shy of entering into an alliance with any party in the region.

High Court no to reversion of 16 HCS officers

A Division Bench of the Punjab and Haryana High Court upheld the judgment of a single Judge reversing the orders of reverting 16 HCS (Executive) officers. Declaring their appointment as HCS officers valid, Justice Permod Kohli had earlier ruled they had the right to continue in service.

Taking up the matter, the Division Bench of Justice MM Kumar and Justice Gurdev Singh today dismissed an appeal filed by the state against the judgment.

Appointed against additional vacancies, they were ordered to be repatriated after a reduction in the cadre strength - an order, which had failed to find favour with Justice Kohli. Quashing the impugned order issued on August 5, 2008, Justice Kohli had directed: The petitioners are deemed to have been validly appointed. The directions had come on a bunch of four petitions filed by Devi Lal Sihag and others. Seeking the quashing of the orders, they had challenged the validity, legality and the propriety of the action. Justice Kohli had taken note that the petitioners were working in different capacities in Haryana before being appointed to the HCS. On April 17, 2007, they were served a notice to show cause why they should not be repatriated to their parent departments. They were told the state government has reduced the cadre strength of the service from 300. Counsel for Haryana argued that the petitioners were appointed against additional vacancies. With the reduction in the cadre strength, the vacancies against which they were appointed stood abolished. “The petitioners’ exit has to follow with the reduction in the vacancies,” it was argued.

Justice Kohli had asserted: “Their appointments were not against particular posts created in a particular year or time. The petitioners’ appointments are against the posts in the cadre of service and not against a particular post of a particular year”. Allowing the petition, Justice Kohli had added: “The petitioners’ appointment was within the total sanctioned strength of vacancies and the very basis of the impugned order that the vacancies occupied by them stood abolished is flawed and contrary to the rules of service jurisprudence.”

HC notice to MDU

Just about two days after a report on law education being in a complete mess at Maharshi Dayanand University was carried in these columns, the Punjab and Haryana High Court today took suo motu cognizance of the matter.

Acting Chief Justice Adarsh Kumar Goel asserted: “The news item ‘Law education a mockery at MDU” in The Tribune dated May 27 highlights that law education is in a complete mess at MDU, Rohtak.

“A large number of students are enrolled in the evening LL.B course. They do not attend the classes, but are allowed to appear in the examinations.

“As per the rules laid down by the Bar Council of India, 70 per cent attendance is mandatory. But by violating the rules, the MDU authorities allow students (to appear in examinations) having zero or negligible attendance. This practice has been going on for long. If the facts appearing in the news item are correct, the matter deserves to be looked at in the PIL jurisdiction of this court”.

Taking up the matter this morning, acting Chief Justice Goel and Justice AK Mittal issued notice to MDU. The case will now come up for further hearing on July 18.

Acute LPG shortage in region

The region is facing an acute shortage of LPG these days. The shortage in the summer is unprecedented, according to sources in the trade. Normally such type of shortage is witnessed during the winter, say the sources.

In most of the places in Haryana, Punjab, Jammu & Kashmir and Himachal Pradesh, consumers have to wait from seven days to 30 days for the delivery of LPG refills. LPG dealers say that HP Gas consumers are facing the worst situation. Most of the HP Gas dealers have a backlog of 20 days to 30 days. For the Bharat Gas dealers, the backlog ranges from 12 days to 15 days. The Indane consumers are better placed as their waiting period is between seven days and 12 days.

The dealers say that if this is the position of backlog during the summer when the demand for LPG is much lower, the consumers should be ready to face an acute shortage of LPG during the winter.

Not only the consumers even the dealers are a harassed lot. The dealers say the situation has created an "alarming, difficult and volatile work environment" for them as they have to face the wrath of both consumers and the district administration for no fault of theirs.

The dealers say the administration, faced with public ire, issues instructions to them that are in conflict with the policy guidelines and marketing interests of the oil companies. Recently, the administration in two districts of Haryana decided to install its own software in the computers of the dealers, who were asked to upload their consumer data on this programme so that the refills could be booked as per the guidelines of the administration. The dealers say that under the instructions issued by the oil companies, the sharing of consumer database with anyone other than the oil company is an offence.

In Chandigarh, surprisingly the administration, the dealers allege, lodged an FIR against a dealer in commercial cylinders, which are not subsidised and are meant for open sale.

The All-India LPG Distributors Federation (north-western region) has decided that if the oil companies failed to take corrective measures within 15 days, its members would sit in dharna outside the offices of the companies.

Kalanaur Firing
Ex-MLA gets 14-day judicial custody

Rohtak, May 30
Balbir Singh, alias Bali Pehalwan, a former MLA from Meham, who surrendered before the police a couple of days ago in connection with the firing incident at Kalanaur on May 5, was remanded in judicial custody for 14 days by a local court today.

Bali, along with several others, was wanted in the firing case in which one person was killed, but evaded arrest for 22 days by keeping himself holed up in his house with residents of Mokhra village providing him security.

“The police has arrested 16 persons, who have been named accused in the case,” said SSP Satish Balan. Bali was remanded in police custody for two days after his surrender on May 27. He was produced in a court again this morning, which sent him to judicial custody.

While 13 persons named in the FIR are in judicial custody, the remaining three have been remanded in police custody.

The SSP rebutted media reports that he was among the officials who escorted the former INLD MLA to the IGP’s office on the day of the surrender. The police had recovered several arms, including four licensed weapons, from the accused. One country-made revolver had also been recovered, said sources.

A youth, identified as Vishnu, hailing from Nighana village, was killed in the firing incident.

Bhoria is tax tribunal chief

A retired IAS officer of the Haryana cadre, KS Bhoria, has been appointed Chairman of the Haryana Tax Tribunal. Earlier, the state government had decided to appoint a former judge of the Delhi High Court, Justice SL Bhayana, on the post.

However, when it appeared in the media that Justice Bhayana as the Sessions Judge had acquitted all the accused in the Jessica murder case, the government changed its mind.

Yudhvir Singh, also a retired IAS officer, is likely to be appointed as a member of the tribunal. This will be his second term as the member. Former Additional Excise and Taxation Commissioner, Haryana, Mukesh Lata Gupta and advocate Subhash Kaushik will be two other members of the tribunal. — TNS

Petrol pump salesman shot

Jhajjar, May 30
A salesman at a petrol filling station on the national highway No 1 here was shot dead by armed assailants late last night. The deceased has been identified as Narender Kumar of Gwalisan village here.

According to reports, the incident took place around 11 pm when five armed youths on two motorbikes came to Suraj Filling Station and took all three salesmen- Narender, Mange Ram and Hariom- captive at gunpoint.

Narender reportedly tried to overpower the assailants but failed to do so.

Consequently, the assailants opened fire on Narender, killing him on the spot. The assailants fled from the spot along with booty, said the police.The police has registering a case of murder against five youths.

Jhajjar SP Sourabh Singh rushed to the spot and sent the body to the civil hospital for a postmortem. after taking stock of the situation.

Three police teams have been constituted to nab the assailants,” said the SP.
