New Delhi, September 25 Justice Shiv Narayan Dhingra ruled that merely mentioning their names in the complaint filed by an alleged dowry harassment victim was not enough for the registration of a case against them under Section 498 of the Indian Penal Code. Quashing an FIR against Shashi Bala Mittal, the maternal aunt of a man accused of dowry harassment, justice Dhingra said that if no cognisable offence was disclosed in the complaint, an FIR could not be registered against such a person, on the ground that a request had been made by the complainant for cruelty, dowry demands, harassment, or sexual exploitation. The complainant in the entire body of complaint had not uttered a word against her husband’s aunt, in respect of allegations ... causing any offence against her, the court added. The court was dealing with a petition filed by Mittal seeking quashing of an FIR lodged by her nephew’s wife for allegedly harassing her for dowry in July this year.

New Delhi, September 25 Taking a serious note of the allegations made by Nizamuddin, a resident of Sultanpuri in West Delhi, a division bench of justice R S Sodhi and justice B N Chaturvedi issued directions to the Delhi Police to inquire whether relatives of Nizamuddin’s wife Shabnam (name changed) had sold her off.Women should not be treated as animals, the bench said, expressing anguish over the allegations. “We are hurt and feel very bad about it. This is very sad,” the bench remarked, seeking suggestions from lawyers of both the parties on the best legal remedy available to them. The court was hearing a habeus corpus petition filed by Shabnam’s mother, claiming that her daughter, married to Nizamuddin last year, had been untraceable since March this year. She also alleged that Nizamuddin ill-treated her daughter after their marriage and that he along with his family members prevented Shabnam from meeting her. Denying his mother-in-law’s charges of ill-treating his wife, Nizamuddin instead alleged that several members of his wife’s family were involved in human trafficking racket. He also alleged that his in-laws had concealed that his wife was already married to someone else before their marriage was solemnised. Shabnam married him without legally divorcing her first husband, he

SC for free treatment to
poor patients in private hospitals
New Delhi, September 25 The super-speciality Dharamshila Hospital and Research Centre has challenged the Delhi High Court judgement directing all such hospitals not only to treat 25 per cent OPD and 10 per cent IPD patients absolutely free of cost but to provide free medicines and consumables. A bench headed by Chief Justice K G Balakrishnan issued notices to the Delhi government and the NGO, Social Jurist, on whose PIL the High Court had delivered the verdict. Senior advocate Shanti Bhushan, appearing for the hospital, said free drugs and consumable for the treatment of cancer patients which comes to almost 70 to 90 per cent of the expenses of the total treatment of any patient, cannot be provided free by the hospital. He submitted that treatment of cancer, including chemotherapy, cannot be provided at the subsidised rate. The court, which once observed that the land was allotted to the petitioner for the type of hospital it had agreed to with the government, said the limited aspect of providing free medicine could be examined. However, the court made it clear that such hospitals have to comply with the condition of providing 25 per cent of bed and consultation for reasonable treatment free of cost. If the hospitals find it difficult to provide free treatment to stipulated number of patients, they can return the land, the bench observed. The High Court on March 22 had directed that hospitals granted land at subsidised rates had to comply with the term of free treatment to poor patients of Delhi. Fixing the income level to avail the benefit of free treatment, the bench had said, every person who has no income or has income below Rs 5,000 per month shall be treated under this category unless and until the (court-appointed) committee takes a final view in regard to fixation of criteria of minimum income for receiving benefit under this scheme. The High Court had also pulled up the hospitals for not complying with the provision of free treatment despite a clause in the lease deed pertaining to the land allotment and directed them to part with the profits they had made during years of non-compliance. The High Court had also created a special pool where these hospitals had to deposit a portion of their profits earned during all these years of non-compliance which would be used for the welfare of poorer sections of society. The High Court also appointed a special committee including Delhi’s chief secretary and finance secretary and director general of health services to determine the amount payable by the hospitals after examining their accounts and other

Incest victim testifies
New Delhi, September 25 Sanjay Yadav was arrested in November 2005 after his 12-year-old daughter lodged a complaint with Sultanpuri police station in northwest Delhi that he had raped her for five months. Additional sessions judge Narottam Kaushal recorded the in-camera the statement of the minor girl while the accused father watched the proceedings from Tihar jail. On July 3, the court had decided to record the incest victim’s statement through video conferencing in view of her relationship with the accused. “The relation between the accused and the rape victim is such that she may not be in position to depose fearlessly. I, therefore, direct that she shall be examined with the accused watching the proceedings through video conferencing”, the court had earlier said. The additional public prosecutor had argued that the victim was the daughter of the accused and his presence in the court would not be conducive for recording her testimony. He had sought recording of victim’s statement using video conferencing so that the presence of the accused may not adversely influence her. Following the submission, the court had directed the Tihar jail superintendent to ensure the presence of the accused in video conferencing room on the date of victim’s

Fire in power station
Noida, September 25 Two transformers installed on the premises were completely gutted while a third one was slightly damaged in the fire. Firemen struggled for about an hour to bring the fire under control. The LT bushing in 5 MVA transformer in the power sub-station located in 33/11 in Sector-58 blew up on Monday evening. The fire also caught onto a nearby 10 MVA transformer lying nearby into its fold. The flames could be seen from a distance. There was panic in some IT companies adjacent to the sub- station, Roads were blocked from both sides and five vehicles with senior fire brigade officers were urgently summoned for evacuating the staff. But fortunately the firemen had brought the situation under control by using foam tenders. Power will remain cut off in the area for three days due to transformers having been gutted, officials said. It is expected to take a month to fully re-commission the sub station, according to executive engineer, A.P. Mishra. The entire area of Sector-57 and 50% of Sector-58 will remain without electric supply for at least three days. No temporary arrangement has also been made as temporary load of 15 MVA can not be shifted to other areas, officials said. |

Move to make Delhi smoke-free by 2009
New Delhi, September 25 The Delhi health ministry will table a proposal to the cabinet to ban smoking in public places. After getting the cabinet nod, it will be sent to the union ministry for finalisation. At present, there is a fine of Rs 200 for smoking on public places and the government is planning to increase the fine up to Rs 500, sources said. In the beginning, the law will be enforced in government buildings. There will be a nodal officer on each floor. People can make complaint to the officer. Later, it will be enforced in private offices through Bhagidari scheme, the sources said. Delhi Health Minister Yoganand Shastri said that the state government would launch an educational campaign to educate the ill-effects of tobacco and the dangers of second-hand smoke to the citizens of the Capital. The government is also working on a proposal to make counselling and tobacco cessation services available in the selected hospitals in Delhi for those who want to quit smoking. He said that smoking caused more than one million deaths each year in the country. Fifty per cent of cancer deaths, the majority of cardio-vascular and lung disorders, other related diseases are attributed to tobacco consumption. Tobacco-related mortality is very high. He further said that prevalence of smoking was very high in Delhi with reported prevalence of 40 per cent in men and three per cent in women. The use of tobacco continues to grow at the rate of five to seven per cent every year. Dr Shastri said that the cost of treating the tobacco-related diseases as estimated by the Indian Council of Medical Research (ICMR) in 1999 was 6.61 billion US dollars. Keeping this in view, hundred per cent smoke-free environment is the only effective strategy to protect the health of non-smokers. |

Model transport system for NCR soon
Noida, September 25 Two days’ meetings have covered much ground and final agreement is likely to be inked between Delhi and UP government officials. This was disclosed by Pradeep Shukla, principal secretary, Transport of UP, here on Monday. As per the apex court’s decision, UP three-wheelers cannot enter Delhi, while there is no restriction on taxis, he said. Even in Delhi, there has been a ban on registration of new autos for the last two years. Regarding 16-km limit on permits between Noida and Greater Noida, Shukla said the government was considering new form of permit in the context of changed circumstances. He said UP was considering plying buses to Faridabad and Gurgaon also. An agreement with Delhi will pave the way for bus routes to Haryana also. He said an MoU will be signed soon between UP Roadways and Noida Authority for connecting principal UP towns with Noida and building a bus stand in Noida. The work on the bus stand will be taken in hand by Noida Authority after this agreement. Shukla indicated that direct buses connecting Noida with the key cities and town of the state will soon start operating. |

New Delhi, September 25 Noted environmentalist Vandana Shiva along with leading UP trade leaders Ashok Goel, Sanjay Patwari also participated in the dharna. A Vyapar Bachao Sangharsh Yatra led by Ashok Goel, which went through different districts of UP in the last 17 days also culminated at
Rajghat. The trade leaders at the dharna strongly demanded the union government to release a white paper on the impact of corporate entry into retail trade. They also demanded a national policy on retail trade and small industries. “The mushrooming growth of corporate retailers will ultimately destroy centuries old trade and social fabric of India and will result into loss of employment to crores of people. Unfortunately the government is maintaining a complete silence on the matter,” said Khandelwal. The protestors were also of the opinion that the strengthening of domestic trade of India has become a necessity in order to meet global challenges and competition. They also alleged that the strengthening of internal trade was never on the agenda of any union government. |

New Delhi, September 25 The National Museum exhibition and public relations director R.R.S Chouhan told The Tribune that the unique exhibition would offer a rare opportunity to visitors to see some exquisite jewellery pieces. It would remain open from 10 am to 6 pm on weekdays, except Mondays. “All 173 pieces are splendid and priceless works of art, associated with the Mughals, Nizams, Qutubshahis. They are being presented in a new setting and ambience,” he said, adding that it was the second show of the fabulous jewels. The president of the Indian Council of Cultural Relations (ICCR) Karan Singh and the union culture minister will inaugurate the exhibition tomorrow. The majestic Jacob Diamond is believed to be the same stone as the Victoria Diamond. Jacob Diamond is presumably found in an African mine. It is also known as the Imperial Diamond. Formerly owned by the Nizam of Hyderabad , Jacob Diamond is currently owned by the Government of India. The rectangular cushion-cut diamond with 58 is 39.5 mm long, 29.25 mm wide and 22.5 mm deep and weighs around 184 . It was brought to India by Alexander Malcom Jacob, who sold it to the VI Nizam of Hyderabad, . The government purchased the diamond, along with other in 1995. The market value of the diamond is said to be around 400 crores. “Jacob Diamond is the sixth largest diamond in the world,” says Chouhan. As far as the fabulous satlada necklace is concerned, it is made up of Basra pearls and is the only one available in the world, says Chouhan. It comprises seven-beaded rows with two large-sized diamonds and some enamel work. |

CPM fears sabotage of Tribal Act
New Delhi, September 25 Taking a dig at the UPA government for failing to notify the rules under the bill, CPM politburo member Brinda Karat told reporters here that some lobby, whether it was within or outside the UPA government or the bureaucracy, was trying to sabotage the Tribal Bill. She said that in wake of the centre’s casual approach in notifying the rules, tribal people were being evicted from their land in various parts of the country. Karat expressed surprise over the government’s inaction even after the bill titled the Scheduled Tribes and Other Traditional Forest Dwellers (recognition of forest rights) Bill 2006, was adopted unanimously by the Parliament. While the law aimed at protecting the rights of tribals over forestland and resources, the government inaction in notifying the rules, had put the tribals in the dock, she said. Karat added that she had met tribal affairs minister P R Kyndiah and had sought immediate action in this regard. She pointed out that a committee for drafting the rules for legislation was formed in March this year and it had submitted the drafted rules in two months. The legislation, passed in December 2006, is meant to protect the rights of tribals to the forestland, where they have been living for generations.

New Delhi, September 25 In its report, the Public Accounts Committee of the assembly recommended the CBI to probe the matter. It held that the cases against officials involved in the scam should be forwarded to the Central Vigilance Commission (CVC). The assembly accepted the report in presence of Chief Minister Sheila Dikshit and the then power minister Haroon Yusuf. But the Delhi Government has neither handed over the case to the CBI nor has it forwarded any case against the officials involved in the scam to the CVC. Mukhi held it as a breach of privilege and contempt of House by the Chief Minister. |

Autolifter arrested
New Delhi, September 25 The police arrested Amrik Singh from a parking spot on the Chandni Chowk road. One loaded country made pistol was recovered from his possession. During interrogation it was revealed that the accused was involved in at least nine auto theft cases. The police team later recovered three cars and two motorcycles, which were stolen by the gang from different areas of North Delhi. The vehicles were usually disposed off in Nepal with the help of another contact Babu Ram. A hunt has already been launched to nab the rest of the gang. One arrested for murder
The south district police has arrested one person in connection with the Bipin Kumar murder case. The chopper used for committing the murder has also been recovered. The motorcycle of the deceased and Rs 35,000 has been withdrawn from the victim’s account. The police arrested Kundan Singh from Saket for allegedly murdering his friend and former colleague Bipin Kumar. According to the police, Bipin had shares in the BHEL worth Rs 5 lakh. Kundan was also close to Bipin even knew the password for his bank account. Kundan decided to eliminate him so that he could get hold of his entire bank balance. He allegedly strangulated Bipin, mutilated the body with a chopper and threw the body parts in a jungle near Lado Sarai. The police found out that an amount of two lakh rupees were drawn from Bipin’s bank account from various ATMs. The inquiries done in this angle later helped the police to zero in on Kundan. Police discovered Bipin’s badly mutilated body on August 12. Interstate robber gang busted
The Delhi Police has arrested three alleged members of an interstate gang of robbers wanted in almost three dozen cases. Raju Beniwal, Ravinder and Raja Sukhdev were arrested from Aruna Asaf Ali Road on Sunday night. Acting on a tip off a crime branch team had sketched out a plan to apprehend members of the Raju Beniwal gang, who were present in the JNU campus. They intercepted the trio, who were on two motorcycles at around 9 pm. According to the police one of the riders fired a shot at the police party. The police recovered one loaded Italian pistol, one country made pistol and a knife from them. Police sources claim that the gang was operating in Delhi and neighbouring districts of Haryana. |

Tour operators condemn rape, want security
New Delhi, September 25 “We are shocked to hear the news of tourists being raped in a hotel of Agra and condemn this dastardly act,” said Subhash Goyal, president of the Indian Association of Tour Operators (IATO). Appealing for the strictest possible punishment to the perpetrators, the IATO president said that the government should deploy tourist police at popular tourist centres, without any delay. The IATO also conveyed its regrets to the Japanese government and assured that such incidents would not be repeated. The two women, aged 21 and 23, had arrived in the Capital on September 16 and had left for Jaipur the next day, from where they went to Agra on September 19. There they met Japanese-speaking Sunny and Rais, and had drinks with them. Sunny, his brother Rajan and Rais allegedly assaulted them sexually. The victims informed the Japanese embassy in the Capital about the alleged rape yesterday and an FIR was

NHRC seeks report on hospital hygiene
New Delhi, September 25 Superintendent of Bara Hindu Rao Hospital here to submit within four weeks a factual report on unhygienic conditions in the hospital. Taking suo motu cognisance of a news report in a national daily, which said that the female surgical ward of the hospital stinks due to lack of proper services, the Commission has observed that it is a serious violation of human rights of the patients. According to the news report, two adults and two infants due to shortage of beds share each bed in the female surgical ward. The floor of the ward is flooded with urine, exposing new-borns to a host of infections. The report further said that patients sometimes come with four attendants who sleep in the same ward and this leads to overcrowding. |
