Centre asked to remove illegal constructions in Lutyens’ Zone
New Delhi, October 19 A Division Bench of Chief Justice Markandeya Katju and Justice Madan B Lokur said if it was not done within four weeks, the court would be forced to take action. “Either you (the Centre) do it yourself or we will see to it that the law is enforced,” Chief Justice Katju said. He, however, said if the Centre wanted to change the law it can bring in a legislation and get it passed by Parliament. “We will enforce the law as it is today,” he added. “You may be a Member of Parliament or a Minister but you cannot break the law. Even I can’t do it,” Chief Justice Katju observed. The Bench rejected a status report filed by the Centre which indirectly sought to justify the alterations in the bungalows on the ground of paucity of space as the Ministers, MPs were visited by a large number of people and they also needed accommodation for their security and other staff. Amicus Curiae Rekha Pallai pointed out that out of 514 bungalows surveyed by CPWD, 231 were found to have illegal additions/ alterations without permission from the competent authority. Taking suo motu cognizance of news reports on illegal construction in the Lutyens’ Zone, the court had in September, last year, issued notices to CPWD and NDMC in the matter. Justice A K Sikri had earlier taken suo motu cognizance of newspaper reports about illegal constructions in the bungalows of several politicians, including Union Minister Ram Vilas Paswan, BJP leaders L K Advani, Pramod Mahajan, Vikram Verma and Sushma Swaraj, Samajwadi Party leader Amar Singh, former Ministers Nitish Kumar and Sharad Yadav and forwarded the matter to the Chief Justice for further action. The offices of Congress and BJP on Akbar Road and Ashoka Road, respectively have also come under the court’s scanner for similar alleged violations. According to a list released by the Urban Development Ministry, 38 MPs/Ministers have unauthorised constructions in their bungalows, the newspaper report had said. |
Woman, lover sentenced to life for murdering husband
New Delhi, October 19 However, two other accused Prem Chand and Shiv Mohan, co-workers of the convicts, who had been seen with Lalji on the night of the murder, were acquitted of all charges for lack of evidence. “Lalji and Laxmi had a common motive to do away with the accused, and there is a chain of links that can be clearly seen,” the Judge noted, adding “the deceased would in no circumstances have expected a plot of murder by his wife and the person living in his house as a younger brother”. On February 24, 2002, a rotting body of a dead 25-year old man was found floating in the Okhla sewage plant, with ligature marks on his head, and a rope tied around his neck, later identified as Nandu. It turned out that Nandu, who allegedly was an alcoholic and used to beat his wife frequently, lived in Srinivas Puri, south Delhi with his wife and Lalji, whom he treated like his younger brother. Prosecution examined 22 witnesses, including Nandu’s brother, Ram Singh, who deposed that Nandu had suspected that his wife and Lalji were having an affair. Munna Lal, another witness, told the court that the two convicts, who were his employees, often used to sit together at the workplace. |

Attempt to usurp Railway land
Ghaziabad, October 19 In December 2000, an
FIR was filed against four persons for occupying this land. After this, the
land mafia had gone into hibernation. But now once again it has become active. The Chief Engineer said a complaint had been sent to the SSP and the SO of the Kotwali police station. Sources said the District Magistrate
had also been apprised of the matter. In Ghaziabad Mahanagar, railway land and property worth crores has been occupied by the land mafia since the time Mr C. K. Jaffer Sharif was the Railway Minister. Certain people have built houses right on the railway track in the Kela Bhatta area. In the Kela Bhatta and Sahibabad areas, there is railway land which has been occupied by the land mafia and common people. While the district administration has been taking action against the illegal occupation of gram samaj land no action has ever been taken for redeeming sizeable railway land either
by the Railway Ministry or Northern Railway authorities. |
Jamiat gets govt nod for sending relief to Pak
New Delhi, October 19 The Jamiat has decided to send relief material worth Rs 2 crore to the victims in Pakistan, spokesperson Maulana Abdul Hameed Naumani said. He said his party, which was basically active in the religious field, had started relief and rehabilitation work just after second day of the earthquake in Srinagar, Uri and other parts of Kashmir where thousands of families had become homeless. Later, it sought permission from the government for sending relief material to Pakistan. After getting permission from the government, the Jamiat leaders contacted the president of the Majlise Muttahida Amal in Pakistan, Maulana Fazl-ur-Rehman, for the relief required. Its contact in Pakistan demanded only tent and blankets as there was enough of other material, Maulala Hameed Naumani said. Since most of the tents had been purchased by the government for the earthquake victims in Kashmir and Pakistan, they were not available in bulk in the market. Finally, it had contacted manufacturers in Amritsar and Ahmedabad for 6,000 tents and blankets were being manufactured by a factory in Panipat. One tent cost Rs 1500 and a blanket Rs 125. Two blankets would be given to each family, he said. A delegation of five senior leaders of Jamiat — Maulana Mahmood Madni, general secretary, Maulana Mouzziddin, general secretary of Imarat-e- Sharia, Maulana Abdul Hameed Naumani, spokesman of the Jamiat, Mohammad Sabir, general secretary of the Andhra Pradesh unit, and Nadeem, general secretary of Marathwara, would leave for Pakistan after Divali. He said the Jamiat was also involved in relief work in Srinagar, Uri, Tangdhar and other quake-affected areas of the valley. Maulana Mahmood Madni made a three-day visit to these cities to witness the actual situation. So far, the Jamiat had distributed 10,000 blankets, 6,000 mats and a kit of eatables of 20 kg. The material was stored in Darul Uloom Bilalia near Lal Chowk. A large number of mats were still lying in its headquarters in Masjid Abdunnabi at ITO. The relief work was being organised by its activists in the valley, Manzoor Wagnu in Uri and Mufti Masood in Srinagar and Mufti Adbur Rashid in Tangdhar. Tablighi activists are also involved in this work. |
After GSCASH, JNU students want
New Delhi, October 19 Pointing out the need for a separate body that can be incorporated with the Equal Opportunities Office of the university, Rohit, a former JNUSU president and an activist of the SFI, said, “during the last few years we have seen several reported as well as unreported cases of caste atrocities on the campus. And it is unfortunate that the administration has neither dealt with them with sensitiveness, nor have the accused been punished”. Citing the methods of mistreating students of reserved sections, Rohit said, “violence, verbal abuse and restrictions… once a student from a reserved section was even prevented from using a computer…” “JNU is not an island. The people making caste distinctions on the campus are part of a society that thrives on discrimination,” said Rohit. It is not the SFI alone that has raised the demand for a “separate body that would deal with complaints of caste atrocities”. Another Left faction, the AISA too is emphatic that there should be no place for caste atrocities on the campus. “It is ironic and shameful that a university like ours too has its share of caste politics. Which is why we are committed to struggle against the communal forces of the ABVP and its twin, the JNU Patriotic Forum, and ensure that all those guilty of violence are punished, ” said Mona Das, who is contesting for the president’s post in the forthcoming JNUSU elections. While both Rohit and Mona admit that the campus is quick to “isolate” those found guilty of caste discrimination, they want “strengthening of the Equal Opportunities Office that looks into complaints of this nature”. “Those who discriminate on caste lines receive flak from the JNU community for their conduct, but we want a more institutionalised body that will take up the issue more seriously. It has to be on the lines of the
GSCASH, where the members are sensitised and without any bias or prejudice,” Rohit pointed out. |

Burari residents rally for water
New Delhi, October 19 The memorandum said that Burari area consisted of eight villages and 43 colonies but they were not supplied with potable water. Water supplied through tankers is not sufficient. As soon as a tanker reaches the colonies, residents rush to fill up their containers. Sometimes they fight while filling them. The memorandum reminded the Chief Minister that supplying water through tankers proves quite costly as much water goes waste. The Delhi Jal Board has issued warning against the use of handpump water as it is not potable. Now the residents of Burari are supplied with rain well water which is also undrinkable. The resident welfare association asked the government to supply potable water immediately. If their demand is not met, they will gherao the Delhi Secretariat, it warned. |

New Delhi, October 19 Mrs Kanti Devi Gupta and her husband had jointly deposited Rs 3,90,000 at Dariba Post Office in 1998 under the Monthly Income Scheme (MIS), for a monthly interest of Rs 4,225 till 2004, final maturity being Rs 4,29,000. The complainant’s husband died in August 2000 and when the amount matured, she was shocked to receive an amount lesser than the deposit and Rs 59,025 short of the due sum. Rebuking the post office for “acting against principle of natural justice”, Consumer Disputes Redressal Forum (North) president K K Chopra and its members N. Mittal and S. C. Jain directed the Post Master to pay the disputed amount of Rs 59,025 with nine per cent interest and Rs 12,000 as compensation for causing mental agony to Mrs. Kanti Devi. The court of Additional Sessions Judge P. K. Bhasin had on August 10, after watching the CD of the sting operation, rejected their bail application accusing them of making the high-security prison a “money-making mill”. |
