AAP won’t fight Assembly poll in state

It’s official. The Aam Aadmi Party (AAP) will not contest Assembly elections in Haryana. The state executive body of the party took the decision at a meeting chaired by national executive body member Yogendra Yadav here today. He called upon the state body to be ready for the Delhi elections.

Though members of the state body decided to go with AAP convener Arvind Kejriwal’s decision not to the contest Assembly elections in four states — Haryana, Jammu and Kashmir, Maharashtra and Jharkhand — some members termed the decision as ‘suicidal’ as the party was gaining ground in Haryana.

The state body of the party conducted a survey in Haryana to get feedback from volunteers on contesting Assembly elections. More than 95 per cent of volunteers gave their consent to contest elections, said Yogendra Yadav.

“The party will suffer if we don’t contest elections. But we have to strike a balance as party’s national convenor Arvind Kejriwal is not in favour of contesting Assembly elections in four states. The state unit of AAP has taken the decision with a heavy heart. The party will now focus on Delhi elections,” Yadav told mediapersons after the meeting.

He said around 5 lakh voters had shown their faith in the party in the Lok Sabha elections. “AAP supporters will be dilemma. But we will go to the party workers and convince them,” said Yadav.

Advocating the separate gurdwara management body for the state, Yadav said: “A separate committee is the right of Haryana Sikhs. It should have been formed years ago. The decision of the government is too late. It has been declared ahead of Assembly elections to gain political mileage.”

Sources in the Haryana BJP said that the main agenda in tomorrow’s meeting would be to chalk out a strategy for the Assembly poll the dates for which could be announced within a month.

Though the BJP is yet to announce its stand on the alliance with the HJC in the state, sources said that practically the ties between the two parties were over for all purposes.

He said the party leadership had already conveyed to its state unit to get prepared to contest all 90 Assembly seats in Haryana.

Sanjay Singh, a resident of Deepawali Enclave, said, “The area known as Palla region consists of over a dozen colonies that have been occupied by thousands of residents, mainly migrants from neighbouring states, since the last 30 years.’’

He added while a majority of the residential plots were small sized, property dealers and colonisers got the residents all documents including the registration certificate, GPA, water and power connections and assured them of getting these colonies regularised.

The residents’ claim that while the authorities may justify its action of clearing the encroachments; where were the officials when the construction was taking place over the years and no one came to put a notice board regarding the problem?

Charging the land mafia, politicians and the officials of the departments concerned, Rishi Kumar, a resident of Ismailpur village here, said nobody stopped the swarms of property dealers operating in the area, who assure water and electricity connections and support of political leaders to assure unsuspecting buyers, who cannot afford a plot or property in an authorised colony or sector.

The violence on Sunday he said was perhaps the result of the frustration of thousands of buyers, who had invested their hard earned money in procuring a house or plot and had been residing here for long.

According to Sumesh, another resident, the problem occurred due to illegal constructions by some builders, who got fake papers prepared on the land allotted to one Durga Builder several years ago.

Admitting that around 60 acres of land had been encroached upon, District Town Planner (DTP) Renuka Singh said 232 acres of land belonged to the original builder. Revealing that around 65 demolition drives were carried out in the last two years she said the problem had now become acute.

Meanwhile, the police today registered a case under sections 148, 149, 186, 188, 332, 353, 427, 435, 307 and 120- B in connection with the violence on Sunday, on a complaint filed by the DTP.

95 farmers booked for blocking NH-10 to protest water theft

The police have booked 95 farmers for blocking vehicular traffic on National Highway No. 10 near Dhangar village here yesterday. They had forced a jam against theft of canal water by farmers from neighbouring Khajoori village.

The FIR registered by the police mentions 25 farmers by their name while as many as 70 unidentified persons too have been booked for the crime.

Farmers from Dhangar, who had been complaining of theft of canal water by farmers at Khajoori, a village situated upstream of Dhangar, blocked the highway for several hours yesterday causing a lot of hardship for the commuters. Hundreds of vehicles remained stranded on the highway for several hours due to the blockade.

Villagers alleged that due to the theft of water at Khajoori, they were not getting enough water for their fields in their village situated on the downstream.

Today, the police said farmers Ugarsen, Anil, Satyawan, Vivek, Bholu, Pappu, Mohan Lal, Jagdish, Bhagwan, Chhottu Ram, Pala Ram, Raju, Vijay, Naresh, Mange Ram, Sahib Ram, Vijay, Bhup Singh, Krishan, Kheta Ram, Prithvi, Dharam Pal, some other named and 70 unknown persons had been booked for blocking the highway.

The case was registered under Sections 147, 149, 341 and 109 of the IPC and under the provisions of the National Highway Act.

Meanwhile, the police have booked Sanjay of Khajoori village for pilfering canal water. The FIR was lodged on the complaint of an SDO of the Irrigation Department, who alleged he was stealing water from Khajoori sub-minor canal.

Karnal hospital insists on OPD slip, woman delivers baby on bench

A 24-year-old woman delivered a baby in the open area of Kalpana Chawla Government Medical College Hospital today morning. The woman was seven months pregnant and delivered a premature boy, who is serious and is under the medical observation.

The hospital authorities have ordered a probe in this matter after family members alleged medical negligence.

Manoj of Pal Nagar, around 5 km from the district headquarter, said he had brought her wife Sonia to the hospital on the bike after she complained of labour pain. He approached the hospital staff and was asked to bring an out patient department (OPD) slip. He alleged staff members refused to help him. He made his wife sit on a bench near the CT scan centre, where her situation worsened.

Hearing her cry in pain, some women waiting their turn near the CT scan centre rushed to Sonia’s aid and she delivered the baby on the bench. The woman and the child were then taken into the ward by hospital staff.

“A probe has been ordered into the matter. A preliminary report reveals that the couple did not come to the delivery room. An ambulance was sent to their village on their demand. An ASHA worker was also sent there for their assistance, but they came to the hospital on a bike. When the staff members went to assist the women while delivery, they were sent back by the people present there,” said Dr Yogesh Sharma, Deputy Medical Superintendent, Kalpana Chawla Government Medical College Hospital.

Breaking its silence over the formation of the Haryana Sikh Gurdwara Parbandhak Committee (HSGPC), the state unit of the CPM has questioned the constitutional authority of the Union Home Secretary in writing to the state government, which apparently challenged the state Assembly’s prerogative to make laws.

After a meeting of party workers here today, state secretary Inderjit Singh said the Haryana Assembly and the Punjab Assembly had identical jurisdiction. He strongly criticised the Home Secretary for writing “on the directions of his political bosses without applying his own mind and checking rules”. He said the SGPC Act was not only the creation of the Punjab Assembly, but had been amended from time to time in the past by various state governments to protect interests.

“The Union Government and its Home Sectary must immediately withdraw the inappropriate communication,” Inderjit Singh said.

He also alleged some communal forces were trying to vitiate the peaceful atmosphere of the state by playing caste and religion cards. He appealed to party workers and residents of all state that the people of all communities should remain vigilant against provocations by vested interests in the name of religious sentiments and maintain social amity at all costs.

The party demanded the Central and state governments treat the prevailing situation in the state as drought and take steps to provide required water and power to state farmers, check theft of irrigation water and improve the public distribution system.

Demand the removal of Akali task force members from state gurdwaras, hundreds of HSGPC supporters today took out a protest march and handed over a memorandum, addressed to Chief Minister Bhupinder Singh Hooda, to Deputy Commissioner Balraj Singh.

The protest march was led by Bhupinder Singh Assandh, a rebel SGPC member, HSGPC vice-president Harpreet Narula, among others.

The protest march passed through main roads of the city and reached the mini-secretariat around 1:30 pm, where a memorandum was submitted to the DC.

Interacting with mediapersons, Harpreet Narula said that MLAs and ministers of Punjab had stationed themselves with their supporters in various gurdwaras of Haryana. This had created a feeling of terror among devotees. Members of the Akali task force should be removed from the gurdwaras to normalise the situation.

Amrinder Singh Arora said the deployment of the task force members was against the prestige of Gurughar and they should be removed immediately.

BJP Legislative Party leader Anil Vij said the Congress displayed haste in tabling the HSGPC Bill and passed it in a dictatorial manner not giving legislators an opportunity to air their concerns.

Speaking to mediapersons at the PWD guesthouse here today after welcoming former Congress spokesman Pardeep Chauhan into the party fold, Vij said Randeep Surjewala tabled the HSGPC Bill at 3.23 pm in the Assembly and it had been passed by 4.23 pm, not giving legislators much time to deliberate the issue.

He said even the report prepared by the Chattha committee, on the basis of which the Bill was passed, was not tabled in the Assembly, leaving huge scope for manipulation. He said the HSPC Bill and the Chattha report should have been circulated amongst legislators at least two days in advance as it was an important Bill that had a direct affect on Haryana and Punjab.

He said the BJP gained political ground in Haryana after the Lok Sabha elections and was on its way to form the next government in the state.

On the issue of Rao Birender Singh joining the BJP, he said the state unit had not received a formal request from the leader.

‘Cong acquired 60,000 acres’

Anil Vij said the Congress government acquired more than 60,000 acres of land in Haryana during the last two tenures. He said the BJP was looking into the matter and will order an inquiry to ascertain if prevailing laws were violated during acquiring land.

The way the Centre acted on the directions of the Badals is an assault on the federal structure of the country,” Sharma said.

Talking to mediapersons here today, he slammed the Centre for doing politics on the issue and said it was making Sikhs fight each other along with Punjab Chief Minister Parkash Singh Badal.

“Badal lost political ground in Punjab and has turned this into a religious agenda. They have nothing to do with the Sikh agenda and are just preparing the ground for the next election. He wants to hand over leadership to his son and they have found a good excuse with this issue. He wants to make Sukhbir Singh Badal next Punjab Chief Minister,” he said.

About implementation of the Act and handing over the management of gurdwaras to the HSGPC, he said: “This is the duty of state government. All required steps would be taken to implement this Act.” In a related development, SAD MP Prem Singh Chandumajra, who raised the issue of the HSGPC in the Lok Sabha on Monday, said: “Going by Union Law Minister Ravi Shankar Prasad’s assurance, the Centre may take action in a couple of days.”

Talking to the media at Gurdwara Chhati Patshahi here, he said: “Had they (HSGPC (ad hoc) chief Jagdish Singh Jhinda and Didar Singh Nalvi) listened to the Akal Takth Jathedar, the situation would have been different.”

Lawyers don’t need permission to work from home, says HC

In an embarrassment to the Haryana Government, the Punjab and Haryana High Court has quashed requirement for lawyers to seek permission and pay fee for carrying out work from residential areas.

Taking up the matter, Chief Justice Sanjay Kishan Kaul and Justice Ajay Tewari asserted: “Keeping in mind the nature of the profession of an individual lawyer, the use of limited space as prescribed in the Haryana Urban Development (Disposal of Land and Buildings) Regulations, 1978, cannot change the character or the activity to non-conforming use so as to invite a fee/permission however large or small the amount of fee may be.

We, thus, quash the applicability of the requirement of permission and payment of fee insofar as it is applicable to lawyers, so long as the premises are used within the restrictions of the definition in the regulations.”

The directions came on a petition by the Panchkula District Bar Association. It had challenged a notification dated January 12, 1999, amending the regulations. In terms of the regulations originally framed, land or building was not to be utilised for “purposes other than for which it has been disposed of”.

A proviso was subsequently brought in by the amendment, permitting 25 per cent of the built up covered area or 50 square metres, whichever was less, for rendering non-nuisance professional consultancy services with the Chief Administrator’s prior permission.

The proviso further qualified that this would be subject to payment of fee as prescribed therein. The permission was required to be given for five years on payment of prescribed fee, to be renewed after five years on the payment of renewal fee.

The petitioner-association argued that the levy defined as fee to carry on professional consultancy services was illegal. The imposition was not really fee in the absence of corresponding services.

The Bench asserted: “There are certain commercial establishments which at times encourage their officials to work from their homes using technologies. Similarly, in order to retain women workforce where there are young children, women are encouraged to work from their homes.”

The judgement

The sewerage system of Sampla township in the district continues to be in a pitiable condition despite crores of rupees have been spent on augmenting it in the past few years. The recent rain exposed the system installed at a cost of nearly Rs 12 crore, with the streets of the township getting submerged in rainwater and slush after the spell of showers.

As per the local residents and department sources, the work of laying the sewerage pipeline began in 2010. Ever since the beginning of the work, the local residents opposed the manner in which the pipelines were being laid.

Protests by local residents notwithstanding, the contractor and officials concerned went on with the work, which was somehow completed in 2013.

However, even after the completion of the work, the newly laid sewerage system failed to siphon off rainwater last year.

Not only this, the main pipeline of the sewerage system caved in soon after it was laid, which even damaged the houses located in the street.

Local residents have been running from pillar to post to get their grievance redressed, but to no avail. They claim that no bed-base was prepared before laying the sewerage pipeline, due to which it caved in so soon.

The residents said they had met the local MP as well as senior officials of the Public Health Department, but no action had been taken in this regard so far.

Ward 2 councillor Shiv Kumar yesterday sat on dharna to register protest against the non-functional system. The councillor said he would resign from his post if no effective action was taken.

The department officials, on the other hand, maintained that steps were being taken to rectify the snag in the sewerage system and things would be put in place soon.

Insufficient rain threatens crops

Farmers in Sirsa are a worried lot as their crops face the threat of withering away due to insufficient rain this year. Farmers maintain that while their cotton and guar crops are healthy, the paddy crop faces a serious threat as the availability of water is grossly insufficient to meet the requirements.

Cotton is sown in over 2 lakh hectares in Sirsa while paddy was transplanted in nearly 60,000 hectares.

“We are neither getting enough water from canals nor getting sufficient power to run tubewells. We have been left with no other option than to burn costly diesel to run tubewells to keep our crops healthy,” said Malkiat Singh, a farmer from the Rania area.

Gurdial Singh, a farmer, alleged that the authorities had assured to provide electricity for eight hours a day for tubewells, but they were getting power only for four to five hours.

Many farmers complained that the paddy crop had already started withering away for want of water in several areas.

Wazir Singh, Deputy Director, Agriculture, however, maintained that there was no damage to crops in Sirsa.

Faridabad Mayor joins race for ticket

With Assembly elections fast approaching, the list of ticket-seekers seems to have become longer. Faridabad Mayor Ashok Arora is among those who have joined the race to become MLA. “Nearly all leading political parties have a list of over 20 contenders for the ticket from each Assembly segment in the district,” claimed Yogesh Sharma, a political analyst here.

While all parties are still engaged in the selection process, the BSP has already announced the names of four candidates. The district has six Assembly segments.

The ruling Congress, which won four of the six Assembly seats of Faridabad, Ballabgarh, Badkhal and Prithla in the 2009 elections, has an average of 10 to 12 aspirants from each seat, claimed party sources.

Faridabad Mayor Arora, a Congressman, has applied for the ticket from the Badkhal seat this time. Badkhal is represented by Mahender Pratap Singh, who is a minister in the Hooda Cabinet at present.

The process of holding interviews of the aspirants for the Congress ticket is over. The list of the ticket-seekers in the BJP is equally long in wake of the party’s success in the Lok Sabha elections.

OP Miglani, a local resident, said, “Ticket aspirants are leaving no stone unturned to gain publicity through hoardings and banners. One of the ticket aspirants of the BJP circulated a pamphlet seeking vote and support for the party in the next elections.”

ZP vice-chairman to quit Cong, join HLP

Fatehabad zila parishad vice-chairman Deepak Bhirdana will quit the Congress to join the Haryana Lokhit Party on July 26. Bhirdana confirmed this and said he would organise a rally on July 26 in Fatehabad where he would join the HLP in presence of party supremo Gopal Kanda.

Bhirdana has been a close confident of state Congress chief Ashok Tanwar and was aspirant for the party ticket from Fatehabad.

During Chief Minister Bhupinder Singh Hooda’s rally in Fatehabad recently, Bhirdana’s supporters had clashed with Chief Parliamentary Secretary Prahlad Singh Gillankhera’s supporters. Gillankhera had won the 2009 Assembly poll as an Independent. Sources close to Bhirdana said he took the decision to quit the Congress after it became clear that the party was most likely to field Gillankhera from Fatehabad this time. — TNS

Rs 22 cr for tourist complexes

Haryana Tourism Minister Aftab Ahmed said Rs 22 crore would be spent on the renovation of Haryana Tourist Complexes in 2014-15. Besides this the Tourism Department would pay special attention for promoting highway and pilgrim tourism in the state.

Presiding over a review meeting with officers of the Tourism Department here today, Ahmed directed the officials to provide the tourists with better services and facilities at all Haryana Tourist Complexes in the state.

He also directed the department officials to explore the tourism possibilities in Shiv Mandir, Chuhimal Talaab, Shermusa Dargah and Kotla Masjid located in Mewat district.

Bhukkal honours Sanskrit writers

Education Minister Geeta Bhukkal today honoured 11 litterateurs of Sanskrit and an institution for their outstanding contribution in the promotion of the language and literature in 2013-14.

Jainarayan Yatri has been awarded with the Haryana Sanskrit Gaurav Samman carrying a cash prize of Rs1.5 lakh. Acharaya Mahavir Parsad Sharma has been conferred with Maharishi Valmiki Samman of Rs 1 lakh, Dr Virender Kumar Alankar was honoured with Maharishi Ved Vyas Samman of Rs 1 lakh and a shawl, Dr Virjanand Devkarni with Mahakavi Banabhatta Samman of Rs 51,000.

Those who have been awarded under Acharaya Samman included Acharya Nirmala, Acharaya Om Parkash Kaushik, Acharaya Madanmohan Sharma and Dr Ashok Kumar Gaur. Similarly, Swami Dharam Dev Sanskrit Samaradhak Samman was conferred upon Shri Haryana Shekhvati Brahamcharyasharam, Bhiwani.

MDU rectifies result of students marked absent

The Maharshi Dayanand University (MDU) authorities today updated the result of over 100 students of Narnaul’s Government College for Women, clearing the way for their admission in postgraduate courses.

University records showed over 100 students of B.Com and BA (math and psychology) as “absent” and consequently “fail” in one subject, despite them appearing in the undergraduate examination. Consequently, these students were ineligible for admission to postgraduate courses.

MDU authorities said the error was the result of a delay in receiving the evaluation list from the college, but the record had been rectified and the college intimated. “It takes time to find the error and to rectify it. We were in the process of correcting the mistake ever since the matter was brought to our knowledge,” said an MDU official.

The students can now apply for admission to postgraduate courses, though they missed the first opportunity as the first cut-off list was declared yesterday.

Lokayukta barred from passing final orders against Bhayana

The Punjab and Haryana High Court today restrained the Haryana Lokayukta from passing the final orders on a complaint against Haryana Chief Parliamentary Secretary (CPS) Vinod Bhayana in the change-of-land use case.

Justice Ritu Bahri passed these orders while hearing a petition filed by Vinod Bhayana against the report of the Haryana Lokayukta Registrar, recommended the registration of a case against him. Bhayana has sought directions to quash the complaint filed against him by the Haryana Lokayukta and the proceedings initiated against him by the Lokayukta office.

On July 2, the registrar had given his opinion that Bhayana and others could be booked in corruption cases. However, the final decision on the Registrar’s report was to be taken by the Lokayukta on July 23.

In September last year, the INLD had released video CDs in which the Chief Parliamentary Secretaryand others were allegedly caught demanding cash for facilitating change of land use in the state.

The matter was referred to the Lokayukta for a probe.

Haryana Vidhan Sabha Speaker Kuldeep Sharma today nominated an all party delegation of 11 members, led by Haryana CM Bhupinder Singh Hooda, which would meet Prime Minister Narendra Modi for the official resolution on SYL Canal.

The other 10 members of the delegation are: Finance Minister Harmohinder Singh Chattha, Parliamentary Affairs Minister Randeep Singh Surjewala, Power Minister Capt Ajay Singh, Education Minister Geeta Bhukkal, Public Health Engineering Minister Kiran Chaudhary, Deputy Speaker Akram Khan, Chief Parliamentary Secretary Prahlad Singh Gillakhera and MLAs Ashok Kumar Arora, Krishan Lal Panwar, and Anil Vij.

Man held on rape charge

Rajbir of Sersa village has been arrested for allegedly kidnapping a woman and raping her for six years while keeping her in captivity in Poanta Sahib in Himachal Pradesh. When he kidnapped the woman on July 26, 2008, he allegedly threw a burnt body of a woman in her kitchen.

DSP Darshan Lal Malik said woman’s husband Rajbir lodged a complaint with the police on July 18 stating that on July 26, 2008, he found a body of a woman in the kitchen of his house. As the body was beyond recognition, it was presumed that it was his wife’s. Her parents were informed and last rites were performed.

On July 18, she returned home and said she was kidnapped by Rajbir. — OC

Wife, son booked for murder

Suresh of Garhwal village in the district was murdered allegedly by his wife Santosh and son Sanjay late last night. After putting his body in a gunny bag, they threw it in the Butana branch of the West Yamuna canal near the village.

His body was found floating in the canal by some village youths this morning. They informed his family members and sarpanch.

The police reached the spot and after preliminary investigations, brought his body to the Gohana Civil Hospital for postmortem.

On the complaint of victim’s nephew, Subhash, the police have registered a case of murder against both the alleged accused. They are yet to be arrested.

Preliminary investigations by the police revealed that the victim was a drunkard and his family members were fed up with his habit.
