DDA fined for failing to execute lease deed
‘Construction of hospital delayed for 8 years’

The Delhi High Court has imposed a penalty of Rs 10,000 on the Delhi Development Authority (DDA) after the housing body failed to execute a lease deed for construction of a hospital by an NGO.

Asking the body to pay the amount to the petitioner, Shanti Memorial Society, within four weeks, Justice S Muralidhar in an order on Wednesday said the NGO had paid the entire considerations and the DDA cannot be expected to delay its decision indefinitely.

The court passed the order in response to a petition filed by the NGO which alleged that the DDA did not execute the lease deed, as a result of which eight years had passed and the construction of the hospital was yet to start.

Shanti Memorial Society was allotted 10,000 sq m land in the prime Lado Sarai area in South Delhi by DDA in May 1999, the society had complied with all formalities and paid Rs 4.5 lakh for the land.

In September 2001, the land was jointly surveyed and measured by the institutional land and Nazul land branches of DDA and a demarcation report was submitted to the land department.

Later, the NGO was informed that only 7,528 sq m would be allotted to it. In the petition, the NGO challenged DDA's demarcation report and demanded the total land for which it had paid money.

Flaws in appointment of guest teachers

The provision of appointing 'guest teachers' in the government schools is made to provide immediate relief from the staff shortage. However, there seems to be gross irregularities in their appointments. The school principal's authority of appointing a guest teacher has slipped away either to the senior education officials or some influential political persons if the recent incidents are to be believed.

Alleging that bribe was being taken in a majority of such appointments, the 'Haryana Rajkiya Adhyapak Sangh-70' affiliated to the Haryana Karamchari Mahasangh' has demanded a probe into the matter.

A total of over 1,200 such teachers have been appointed in the district so far.

Citing a recent case, an office-bearer of the Sangh, who had herself been a teacher in a government school here, claimed that there had been gross irregularities in appointment of guest teachers. She disclosed that a young woman candidate had applied for the position of guest teacher in one of the schools, but she was neither called for an interview nor informed of the status of her application by the school.

She said the applicant then contacted the office of the department and came to know through an employee that a vacancy existed in one of the schools, but she was told that she could not be appointed as she had no political backup. She was then asked to cough up Rs 15,000 for such an appointment, but she expressed her inability to pay this amount.

According to sources in the department, nearly all the appointments made in the recent past had been based on either political recommendation or the bribe.

Regarding the norms that ought to be followed in such recruitment, the school principal should put the vacancy on the notice board outside the school or on the front gate and receive the applications in school office within a stipulated period. The appointment would be made after screening and interview by a five-member committee of the school staff headed by the principal, but reports indicate that no such procedure is being followed and all appointments are made on the recommendation of either the District Education Officer (DEO) office or the local MLA or any influential personality.

Sources claim that classes which ought to be taken by a regular teacher are allegedly being taken by a guest teacher.

It is feared that changing the subject teachers--giving classes of regular teachers to guest teachers-- would harm the interest of students, particularly when they face the semester exams in September.

6 held in murder case

The police today claimed to have arrested six persons for pushing one Sagar Arora in the shaft of a lift, 25 feet deep, in an abandoned building at Barakhamba Road on November 13 who later succumbed to his injuries.

Sagar Arora was allegedly pushed in the shaft by his friends in the abandoned Skipper House Building. Sagar remained unfit for statement for almost two months due to injuries sustained on his backbone, hands and head. His father named some of his friends being responsible for the incident.

According to the police, during preliminary investigations, the cops came to know that the accused and the victim were all gay. All these people use to meet at Connaught Place mostly on the weekends.

Two months after the accident, the injured Sagar Arora named Goldy, Ahat, Rohit, Rex, Chand, Rahul and Rohit Rana, as those responsible for his injuries. He claimed that on November 13, he had gone to Connaught Place, where he met all his friends, who had decided to resolve all the differences between them. All of them had beer and then Sagar was taken to an isolated semi-constructed building at Barakhambha Road. Here, he was allegedly beaten up by all the persons and thrown in the shaft of the lift.

Some raids were conducted and a few of the accused were arrested.

On July 12, Sagar Arora succumbed to his injuries.

According to the police, all the accused were arrested by July 27. On interrogation, they allegedly revealed that Sagar had levelled allegations against Ashish Aggarwal, one of the accused, in regard to a blue film. On this, Ashish Aggarwal along with his accomplices allegedly pushed Sagar Arora in the shaft of lift.

The police said six accused had been arrested, while one Rohit Rana was absconding.

Use of force to take loaned vehicles ‘impermissible’

The National Consumer Commission has strongly disapproved employing of musclemen by finance companies to repossess loaned vehicles, terming the use of force as impermissible saying rule of jungle could not prevail.

"It is impermissible for the money lender, financier or banker to take possession of the vehicle, for which loan is given, by use of force," the commission bench comprising president M B Shah and member Rajyalaksmi Rao said, while dismissing a petition of m/s Citicorp Maruti Finance ltd.

The commission was hearing a revision petition filed by the company against an order passed by a lower consumer body, which had slapped on it a punitive damage of Rs 50,000 apart from a compensation of Rs 1.5 lakh to the complainant.

S Vijayalaxmi, the complainant, had earlier approached a consumer forum, alleging that the finance company had in May, 2003, forcefully repossessed her car, which was bought on a loan from Citicorp and that they later sold it.

Taking exception to the forceful seizure of the vehicle, it said this unlawful and unethical procedure could be said to be against public policy and also against the protection of public interest.

It held that the finance companies had no authority under the law to employ musclemen for forfeiting the loan or repossessing the vehicles and this could not be done under the garb of the judicial process being slow in the country.

"May be that the procedure of law is slow, but that is no excuse for use of force for repossessing the vehicle. If the contention of the petitioner (company) is accepted, the rule of jungle would prevail and might would be right," the commission said.

Citing various judgements of the apex court and the Delhi High court, the commission observed that the companies were under legal obligation to follow the statutory remedy available under the law to take possession of the vehicle in cases of default in payment by a loanee. It also took to task the Citicorp for incorporating clauses in the contract giving unrestricted right of entry in the premises of the complainant and said that any such term would be in violation of the established legal system in a civilised society and may attract penal consequences.

The commission further pulled up the police for not registering a case against the guilty persons.

43 per cent of Metro riders use two trains: Survey

It seems that the actual Metro Train occupancy on July 21, the day the Delhi Metro also carried largest number of commuters, was around 10.5 lakh. Incidentally, earlier the Delhi Metro had said that a ridership of 7,36,435 was recorded on July 21.

Metro officials say that this was confirmed through a Metro commuter survey which found that 43 per cent of commuters use two or even three trains once they enter the network as they may use trains on Line-1, Line-2 and Line-3 in the same journey to reach their destinations.

The survey is based on interviews conducted with 6,248 commuters at Patel Chowk, Kashmere Gate, Tis Hazari, Vishwa Vidyalaya, Chawri Bazar, Shahdara, Rajiv Chowk, Central Secretariat, Pitampura, Chandni Chowk, Barakhamba Road, Karol Bagh, Rajendra Place, Pragati Maidan and Mandi House.

Besides the ridership, the survey has also come up with some other interesting details, like education, job profiles, age and also the time commuters spend on platforms while waiting for their train to arrive.

The survey, conducted over 20 days with actual data of passenger flow on the Delhi Metro, brought out that 37 per cent of passengers who entered the system from Line-1 between Shahdara and Rithala used the Kashmere Gate interchange station to enter Line-2 between Central Secretariat and Vishwa Vidyalaya. Eleven per cent of the total number of passengers also went to Line-3 between Barakhamba Road and Dwarka Sector 9 using the Rajiv Chowk interchange. Similarly, 29 per cent of the commuters who entered from Line-2 used Lines-1 and 3 and out of those who entered the Metro system from Line-3, 35 per cent used Line-2 and nine per cent Line-1.

"Thus, if one considers the ridership of 7,36,435 recorded on July 21, the actual usage of different Metro trains works out to 10,56,305," explain DMRC officials. The survey also found that 79 per cent of Metro users are male and the rest female. Incidentally, 40 per cent of Metro commuters are between 18 to 24 years of age, 39 per cent between 25 and 34 years, 14 per cent between 35 and 44 years and seven per cent above 45 years.

It also found that as much as 48 per cent of Metro users are graduates, 16 per cent postgraduates or professionally qualified, 17 per cent are doing graduation and 19 per cent are undergraduates. "Regarding occupation, 48 per cent commuters belong to salaried class, 19 per cent are students, 17 per cent self-employed and 12 per cent businessmen, thus showing that a majority of Metro commutes are young, well-educated and working," the official adds.

It was found that 63 per cent commuters spend only two to three minutes on platforms while 37 per cent four to five minutes.

Incidentally, the Metro ridership is expected to reach 26.17 lakh in 2011 after the completion of Phase II of the Metro network when the total Metro network will be 183 km.

MCD wants to be made nodal agency for Games

The Municipal Corporation of Delhi (MCD) has asked the government to appoint it as the nodal agency for implementing the schemes and projects for 2010 Commonwealth Games and demanded a Rs 5,000 crore fund for the same.

Seeking Prime Minister Dr Manmohan Singh's intervention in the matter, the civic body said its claim was ignored despite it being the prime agency involved in developing infrastructure in the national Capital.

Delhi Mayor Arti Mehra, who along with MCD Standing Committee chairman Vijender Gupta met Dr Singh, told the prime minister that the civic body was capable of taking the responsibility of building games infrastructure within a stipulated time frame.

"Keeping in view the fact that we have vast experience in building up infrastructure for the games...We seek your kind intervention to ensure that the MCD is made the nodal agency," she said.

Reminding that the MCD has taken the responsibility of infrastructure development during the 1982 Asian Games which was well recognised, she said, "The civic body richly deserves the honour of being the apex agency for this for the 2010 sports extravaganza. The MCD has prepared an estimate of Rs 5,000 crore for developing Games-related facilities, she said seeking funds for the same. This fund would be earmarked exclusively for the development of Games-related infrastructure.

The Delhi Development Authority was earlier appointed the nodal agency for implementing the schemes related to the Games.

Robbers loot truck

Five criminals who had boarded a truck overpowered the driver, cleaner and helper, and then disrobed them last night before dumping them on Noida Expressway and driving away with the vehicle. The victims somehow managed to put on some clothes and reached different police stations, but there was none to listen to their tale of woe. The cops shooed them away at Sector 39 and Phase II police stations.

Rakesh was driving a truck from Delhi's vegetable market Azadpur with cleaner Rajesh Kumar and helper Promode Kumar. While they were returning after emptying the truck, five miscreants boarded their truck on the pretext of lighting their 'bidis'.

The truck-jackers threatened the driver and cleaner, and drove the truck to Noida Expressway before dumping them at Expressway. Somehow the victims reached Noida Phase-II police station, but the cops said the loot had taken place under Sector-39 police station. They were shooed away by the cops who said since the loot and truck-jacking took place in Azadpur, they must go back to Delhi to lodge the report with Delhi Police.

A slew of functions are being organised all over the national capital territory of Delhi to observe the 27th death anniversary of the singing legend, Mohammed Rafi, the man with a mellifluous voice, on July 31.

However, the main function is being organised by the Delhi Chapter of the Rafi Foundation on July 30, the eve of the anniversary, at the Punjabi Bhawan auditorium here. The function will begin with the release of a book, "Meri Awaz Suno", the first biography of the singer who reigned over the music world for well over three decades. The book written by Vinod Viplav, a local scribe, will be released by the famous classical singer, Padabhushan Shanno Khurana and Padamshree Pushpa Hans, famous actress and singer of yesteryears.

This will be followed by a discussion on "The relevance of Mohammed Rafi in the present time and the role of his songs in propagating communal harmony". The evening will culminate with a musical tribute to the legend.

Exhibition of paintings by 30 artists

The omnipresent 'bindu' or the 'polka dot' makes a comeback on canvas as Polka Art Gallery's second annual show titled "Round & Round" begins at the Visual Arts Gallery, from August 1 to August 5. The show will continue from August 7 to August 20, Polka Art Gallery, in Defence Colony here.

Curated by Sushma Bahl, the show is a group exhibition of paintings by 30 contemporary artists who have interpreted the bindu/polka in their own way. Says Aarti Singh of Polka Art Gallery: "Polka gives me a Zen feeling. For me, it is the beginning and the end of existence in the form of the sun, moon and earth.

It is universal; it is versatile- traditional as a bindu on the forehead and spiritual as 'shunya'. It is international in taste and yet so exclusive that not everybody can relate to it.

The polka to me is like the sun in my spirit- irrepressible and always shining." Says curator Sushma Bahl: "The show is centered on the concept of bindu or polka which in Indian philosophy is the source of all energy and trigger for the universe that goes round and round in an endless circle.

The exhibition presents a plurality of thoughts, expressions and palettes around Bindu, dot, circle, world, universe, seed, musical notations, swirls of a dance or entrapments in the whirlpools of life and much more--the endless cycle of birth, life and death.

'Prerna Utsav' on Aug 5

Students of Kalyani Kala Mandir are presenting 'Prerna Utsav 2007', the school's fourth annual presentation of its traditional Bharatanatyam repertoire, at the India International Centre here on August 5, 2007 at 6.30 pm.

Trained by the renowned Bharatanatyam danseuse Rashmi Khanna, the students of Kalyani Kala Mandir will perform in individual and group pieces. Renowned dancer and choreographer Guru Shri Shashidharan Nair shall preside over the function as the chief guest.

The evening shall conclude with an award ceremony for scholarship holders of the institute.

Sufiana Quawali album released

Mushaira to celebrate Urdu poetry

Mushaira Jashn-e-Bahar 2007 will be held at the Siri Fort auditorium here on August 3. More than 20 distinguished Urdu poets from India, Pakistan, Saudi Arabia and Afghanistan are expected to participate in the annual event which is held to celebrate Urdu poetry.

This will be the sixth such Mushaira to be organised by the Jashne Bahar Trust founded by Urdu activist and writer, Kaamna Prasad.

Political touch to campaign for Palwal district

A campaign seems to be on to make the Palwal subdivision of the district as the new district. Reportedly lacking mass support, the move has been blessed by certain politicians and their supporters who perhaps have vested interests in such a campaign. Though rumours are afloat that an announcement may be made on August 15, the state government has reportedly not shown any interest on the issue, paving way for a debate on such a development.

Mewat had been carved out as 20th district of the state two years ago taking away two subdivisions of Faridabad and Gurgaon districts.

"While creation of Mewat district had made Faridabad and Gurgaon smaller, the present campaign regarding Palwal has served a fresh threat to this premier industrial hub of northern India," claims Rajender Singh Bisla, a former MLA from Ballabgarh constituency here. He said there was hardly any need for such a drive as there were more important issues like strengthening and expanding the basic infrastructure which include more flyovers, better roads, adequate water and power and employment opportunities in the district, especially the rural parts.

Claiming that this region has been ignored by the previous governments and demand to make Palwal the new district was raised many decades ago, he said perhaps the lack of fast development had made a section of people take up the issue again.

He added that if the size of a district was reduced to a subdivision level, then it would be a problem to look after the development work as the government expenditure would rise phenomenally.

Stating that while there had been unusual delay in the construction work of Badarpur flyover at border, he said the state government should try to get the Metro train extended up to Palwal town.

According to T.C. Gupta, president of the Citizens Welfare Association, Palwal, the town required more infrastructural development.

3 lakh property receipts have no computer entry

The new Noida CEO, Balvinder Kumar had announced on the second day of his assuming charge that all Noida operations would be computerized and in a few days, all 67,000 Noida properties would be made on-line.

But this drive has suffered a setback as for over 3 lakh receipts, there is no entry in the computers. According to officials, it will at least take two months to arrange all the data pertaining to residential plots, group housing and housing departments and feed them into computers.

It is due to sheer carelessness of Noida officers and employees that over 3 lakh receipts had not been fed into computer records, it came to light on Saturday.

It has created a big hurdle in putting all the properties on-line in Noida. Even if the properties are made on-line, owners' latest position cannot be made available on computers, the officials say.

Now CEO Balvinder Kumar has instructed accounts officer Sunil Kumar to complete the feeding of all the receipts of last 3 years into computers in next three months.

Traffic diversion on Mehrauli-Gurgaon Road

Traffic will be closed for thorough passage through the Sikandarpur market on Mehrauli-Gurgaon Road from now onwards. The exit point of the market near the old fountain towards Gurgaon will be closed but visitors to the market can use the entry located near Global Business Park.

The DMRC has also created an optional road of 14 metres width on Sikandarpur bypass and the traffic will now be diverted on this 14 m wide road to reach Gurgaon, Faridabad or NH-8. As per the DMRC, the diversion will provide smooth movement of traffic as the carriageway is maintained well and at the same time, the market area will get only those visitors wanting to go there, making it convenient for shop owners as well as others.

DMRC has put proper signage on all turnings and roundabouts and also deputed 20 traffic marshals.

The police has arrested one Sanjay Katara on charges of being involved in many cases of drugging passengers in moving train before robbing them.

A secret information was received that one Sanjay Katara would come via Asaf Ali Road and would go to Ajmeri Gate side. He was apprehended on July 26. Sanjay is alleged to have been involved in several drugging cases in moving trains and is also wanted in a case of robbery with drugging in Indore. The accused used to drug passengers in running trains and then he used to commit theft. He was also allegedly involved in a criminal case committed in Shakarpur.

Pipeline gas to replace LPG in Tihar

The Tihar Jail authorities have decided to replace LPG for cooking with Pipeline Natural Gas (PNG) as cylinders can pose a security threat.

The decision to replace LPG is part of the modernisation plans of the Asia's largest prison.

The major benefit from the new step would be that the gas will come through pipe and the movement of cylinders will be done away with. This will improve security, a senior official said.

In addition, natural gas is cheaper and cleaner. The jail will get the gas from Indraprastha Gas through a dedicated pipeline.
