Court hauls up Gurgaon MC for encroachment
Gurgaon, November 10 The court was responding to a private petition, which alleged that the municipality had allowed its land to be encroached upon by a builder, which was dumping solid wastes on his adjoining land. The controversy came to light after the private petitioner alleged that the civic body had grabbed 3 acres of his agriculture land and started using it as a dumping site for the solid waste material. What is striking is that the builder-company has already carved out the land into about 10 plots for farmhouses. The plots have been converted into “pucca” farmhouses by those who purchased the plots. The Court of Civil judge, Ms Rachna Gupta, restrained the municipality from any further dumping of solid wastes on the land of the petitioner. The municipality had taken the land from the village Panchayat of Gairatpur Bas after paying in two installments. Meanwhile, the civil body was also using the remaining portion of its three acres of its land taken on lease for dumping the solid waste material. It is striking that the municipality procured no objection certificate from the Haryana State Pollution Control Board and the Environment Department for dumping the solid waste from Gurgaon city. The court has ruled that the certificates were illegal as they pertained to the land of the petitioner. The attempt to set up the dumping ground is a sequel to a general directive of Supreme Court in Almitra
H.Patel Versus Union of India and others that every Class 1 city, having population over one lakh, must have solid waste management scheme. Meanwhile, in another court of a civil judge a suit of the petitioner for mandatory injunction against the municipality is pending for adjudication. In the suit, the petitioner has prayed for the removal of garbage from his land as well as compensation for damage to the plantations and his land. |

No functional toilet, no water, no place to sit for kids
New Delhi, November 10 Even as the Education Departments of the Delhi Government and the MCD eulogises their own “efforts” to improve the quality of education, schools like the one in Nathupura are a testimony to its failure to secure for these students their fundamental right to education. “Time and again, it has been reiterated that basic amenities are a part of right to education. The court has given directions to the Department of Education and the MCD to ensure that basic amenities are provided to students but unfortunately examples like the Nathupura school continue to come to the fore,” said advocate Ashok Agarwal of the Social Jurists, a lawyers’ collective, which has filed several petitions against the government’s inability to improve the standard of schools in the National Capital. Despite repeated reminders and written complaints, the DoE as well as the MCD have failed to provide students in this Nathupura school drinking water, toilets and even a place to sit. “While some lucky ones manage to sit on dhurries (carpets), others have to sit on the floor. The schools, which runs in two shifts, has no provision for toilets as the existing ones are clogged and even girls have to relieve themselves in the open,” alleged Mr Vikas Saini, president of the North Delhi Youth Club, and a member of the Vidyalaya Vikas Samiti. Another example of an unconcerned department is the Mukhmelpur school, where uncut grass has almost enveloped the building. The primary girls’ school here has five classrooms for 180 students of which one room is used as the headmaster’s office as well as the science and computer lab. “No maintenance work
is carried out. It is dangerous for students to venture out in the playground because of the tall grass that surrounds the building. There could be snakes and poisonous insects, but the department couldn’t care less,” said Mr Saini. This negligence on the part of the authorities, says Mr Agarwal, is not only a violation of fundamental rights but is “ a design…to promote privatisation of education. By deteriorating the state of their own schools, the department is trying to promote private schools,” he alleges. |
Thousands of electric metres found faulty
Noida, November 10 This means that the billing for these 3,000 consumers is based on just assumption. The departmental officials do not know the demand and consumption of power in these areas. This hopeless position about metres and electricity prevails in an area which contributes the maximum revenue to the UP Power Corporation. In a top-level meeting of the UPP Corporation in its head office, the corporation had ordered a survey to be conducted in Noida area. In the survey, it was found that 294 metres in Division-I were out of order. Another 1,500 metres had never been installed on the premises which were given power connections. C.S. Software and Unitron Co are conducting this survey in Power Division-I and Khora respectively. Survey in Division-II and III is yet to be completed for defective metres. Dy General Manager, Rajesh Kumar of Power Corporation said by the end of November, survey of all metres will be completed. The defective metres will be examined and new metres installed on the premises of all consumers in the area. |
Deepa Mehta seeks out-of-court settlement on ‘Water’
New Delhi, November 10 Mehta’s father, appearing in person, said she would seek adjournment to settle the issue out-of-court with the writer and others. While adjourning the matter till February 23, 2006, Justice Anil Kumar asked the Counsel of Mehta to file the settlement report before the court. In 2000, Mehta had filed a defamation suit against Gangopadhyay who had alleged that the film maker had directly copied some scenes from his work ‘Shei Shomay’ or its English translation ‘Those Days’ for the script of her film ‘Water’. Reacting to Mehta’s decision to approach the high court in a suit seeking damages for defamation and a declaration upholding her right to make a film, Gangopadhyay had said that he had left the whole matter to his publisher Anand Publishers. Gangopadhyay said he scrutinised the script which he had received from the West Bengal government and found some similarities in dialogues and characterizations. He said it was possible for any two written works to have some similarities, but these could not be exact copies of dialogues or characterizations. Mehta had filed a suit under section 34 of the Specific Reliefs Act seeking injunction, damages for defamation, libel, and misuse of confidential information with regard to the script of her film. Mehta had embarked on shooting the film after Then, she completed the shooting of the film in Canada and it was supposed to be shown at the Toronto International Film Festival in September, 2005. ‘Water’ is the third in her trilogy about the effect of the elements on the human psyche, the earlier films being ‘Fire’ and ‘1947 – Earth’. On August 24, 2005 the High Court had issued notices to Mehta and her Canadian film company on an application seeking to restrain them from releasing their controversial film ‘Water’ at the Toronto International Film Festival in September. Justice Kumar had refused to pass any interim order on the application moved by Anuradha Dutta and had asked Mehta and Flagship International Ltd. to file their replies by today. In her application filed through counsel Tarkeshwar Nath, Dutta, one of the four defendants in the suit, submitted that Mehta could not release ‘Water’ as her suit for a decree of declaration that she was entitled to make the film using the script duly approved by the Ministry of Information and Broadcasting was pending adjudication before the court. In the suit, Mehta had claimed that her using the said script did not amount to infringement of copyright of Bengali author Gangopadhyaya’s book. In her suit, Mehta had also impleaded Gangopadhyaya, the book’s publisher Badal Basu of Anand Publishers, its translator Aruna Chakravarty and Dutta, who edited the English translation as defendants. The applicants submitted that she came to know about Mehta’s plan to screen the film at Toronto International Film Festival through her statements in the media. |
All corporation schools to get mid-day meal
New Delhi, November 10 The objectives of the mid-day meal are to boost universalisation of primary education, to improve nutritional status of students and to provide nutritional support to the students of primary schools. This scheme was launched after direction given by the Supreme Court, a spokesman of the MCD said. He said that earlier fast food was supplied in the schools. After direction of the apex court that cooked should be supplied in the schools, the corporation contacted NGOs interested in the work. Eleven NGOs came forward to serve cooked food to the children by establishing 13 semi automated kitchens. This has helped in monitoring of the programme in an efficient manner. It has been decided to supply poori chholey, rajmah rice and vegetable pulao on alternate days to the students. The parent-teacher association and a member of the resident’s welfare association or a senior citizen living in the vicinity check the food daily before serving it to the children. When the food is found fit for human consumption, it is distributed to the students. Periodic inspection of the kitchens where the food is cooked are carried out by the authorities of the Education Department posted at the zonal and headquarter level, the spokesman said. |
Governor asked to order probe into Porta Cabin payment
New Delhi, November 10 The Education Department had also requested to increase the size of Porta Cabins but it was not followed. According to the requisition sent by the Education Department, a Porta Cabin classroom may have space for accommodating 45 to 56 students. The classrooms may also have space for adjustment of teacher’s table and chair, left, right front and back space for movement for students and the teachers. Mr Gupta alleged that size of Porta Cabins was reduced intentionally. The scheme of providing Porta Cabins as a substitute for pucca or semi pucca classrooms in the MCD schools requires reconsideration. The Porta Cabins will not be economical and suitable from the comfort and security point of view to the students. They are not suitable in any season whether it is winter or summer. He alleged that policy of providing Porta Cabins in MCD primary schools had been adopted with the motive to financially benefit some predetermined parties. |
Rare surgery saves boy’s life in Hapur
Ghaziabad, November 10 The boy used to complain of pain in the stomach and feel nauseated. It was confirmed from ultrasound that some foreign substance was stuck up in his intestines. According to doctors, if the operation, trickovijor, had been delayed for a few days more, it could have resulted in bursting of intestines and other tubes in the stomach and endangered the patient’s life. The doctors are quite happy with the successful operation performed by a team of doctors led by Dr Shyam Kumar on Jony, the 10-year-old son of Ramphal of Badnauli village on Tuesday night. The boy used to feel pain in the stomach and whenever he vomited, small strands of hair would come out of his mouth. After an ultrasound examination, Dr Narinder Ken found that Jony’s small intestine had swollen alarmingly. The ball of polythene and hair removed from the boy’s stomach was reported to be 33 inches long and three inches in volume. The polythene and hair were intertwined in Jony’s stomach like rope. Doctors at Tara Chand Hospital said such a condition is called trickovijor and there is only one precedent when a two-foot-long ball of hair was removed from the food pipe of a 12-year-old girl in a western country. It is the first rare case of its type, Dr Narinder Ken and Dr Kumar said. According to doctors, the boy must have swallowed bits of hair and polythene in his childhood. Jony’s mother, Ranviri confirmed it saying that he was fond of swallowing bits of gunny bags. Dr Shyam Kumar and Dr Narinder had claimed it to be an unprecedented operation in the medical history. |
One held for robbery and murder
New Delhi, November 10 The Special Cell of the Delhi Police got information about the accused that he would be coming near Escorts Hospital. A trap was laid and the accused was apprehended from there. Another accomplice, Subhash, managed to escape from the spot. Both were coming on a motor cycle at the time of arrest. The police said the accused was kingpin of the gang and has three accomplices. They have been identified as Abdul Shahid, Anil and Subhash, who managed to escape. The police also claimed to have recovered one 0.30-bore pistol from his possession. The police said the accused, along with his accomplices, punctured the vehicle of one trader Mohammed Salim in the area of Kotwali in North district. The incident took place on July 16. The accused then sprayed pepper in the eyes of the driver and tried to rob the bag containing Rs 22 lakh. When the victim tried to resist, the accused shot him, killing him on the spot. |

13 stolen vehicles seized, one held
Faridabad, November 10 Though the main accused was able to flee, one person was arrested by the police from the village on charges of possessing an illegal weapon. The police raid was led by the DSP (Headquarter) and consisted of a large number of armed policemen. The police raid took place after a tip-off that a large number of stolen vehicles were kept at a place in Alimeo village, which would be disposed of anytime. The stolen motorcycles were brought back to the police headquarter here in a truck. The IGP, Gurgaon Range, in a press conference recently had hinted that steps were being taken to nab the criminals and to check the increase in crime in the area. According to reports, the vehicles were being stolen from the various parts of the city and the owners were being asked to pay money for recovering the vehicles. It is stated that all the accused have been able to go scot-free and the victim were left at their mercy, as the police do not register the case or take an action on the complaints. Several gangs have in the region indulge in robbery, snatching and looting of valuables from trucks passing from the areas and selling these items at ‘discount’ in the market. However, “while dozens of vehicles were being stolen in the district every month, there has hardly been any recovery,” said a resident here. He alleged that “such activities could not be carried out without the patronage of the law keepers”. Meanwhile, two chain snatching incidents were reported in the city in the past three days. A gold chain was snatched from a woman by motorcycle-borne youths in sector-7B last evening. |

New Delhi, November 10 The police got information that the five accused were running a satta racket in the area of Mangol Puri. Subsequently, a raid was conducted and the accused were arrested from there. The police also claimed to have recovered a colour television, a notepad, mobile phones and Rs 2 lakh in cash from their possession. Ghaziabad, November 10 Washid of Batrakha village in Garh police station area had married his sister Saira to Suleman of village Palhada under police station Modipuram of Meerut four years ago. Suleman is an auto driver and has two children from Saira. According to police, a few months ago Saira’s two younger sisters were given a motorbike each in their marriage. This apparently made Suleman jealous. He has been beating up Saira since then. Washid is trying to lodge a complaint with the police against Suleman as a case of dowry torture. |

Vikas Yadav’s bail plea rejected
New Delhi, November 10 Earlier, on November 7, counsel for Vikas had sought bail by arguing that his cousin Vishal Yadav, a co-accused in the case, had already been granted bail by the Delhi High Court and there was no reason to deny him the same. Katara, a business executive, was allegedly kidnapped and murdered on the intervening night of February 16 and 17, 2002, from Ghaziabad where he had gone to attend a marriage.—TNS |
