Pakistan Information and Broadcasting Minister Sheikh Rashid Ahmed today hinted at a likely meeting between Prime Minister Atal Bihari Vajpayee and Pakistan President Pervez Musharraf early next year. The minister told mediapersons on the sidelines of the third conference of SAARC Information Ministers that Mr Vajpayee was likely to have a separate meeting with Mr Musharraf when he travels to Islamabad for the SAARC Summit next year. The minister also said Pakistan viewed India’s peace proposals with optimism and that Gen Musharraf was “very positive” on the peace process initiated by New Delhi. — TNS

Central forces sought to guard The Hindu office

Ram today demanded the deployment of central forces in front of his office and residences of five staffers against whom arrest warrants have been issued for alleged breach of privilege and contempt of the Tamil Nadu Assembly and said he would soon write to Deputy Prime Minister L.K. Madhumita’s second ‘killer’ identified

New Delhi, November 11
Servant of Madhumita Shukhla and the lone eyewitness to her murder, Desraj, today identified Prakash Chander Pandey as the person who shot dead the poetess at her residence in May this year.

Pandey, arrested yesterday at Lucknow, was produced before Desraj at Unnao jail in Uttar Pradesh where he identified him during a test identification parade, CBI sources said.

The sources said Pandey identified Desraj as the second person who had come along with Santosh Kumar Rai on May 9, the day she was shot dead.

The servant had already identified Rai, a small-time political worker and arrested on November 6.

They said after Desraj’s identification it was now clear that Rai and Pandey had come to the poetess’ residence at Paper Mill Colony, near Lucknow, on the day of the murder.

The CBI was now trying to find out the weapon used by Pandey in killing her.

Besides Rai, the CBI has also arrested Rohit Chaturvedi, cousin of Amarmani Tripathi, who is already in jail.

Meanwhile, the CBI today filed a petition in the Lucknow Bench of the Allahabad High Court challenging a lower court order allowing jailed former BSP minister Amarmani Tripathi to attend the ongoing Uttar Pradesh Assembly session.

The petition, filed after the designated CBI court yesterday allowed Tripathi to attend the session, is likely to be taken up tomorrow, agency sources said.

In its petition, filed under Sections 482, 397 and 401 of the CrPC, the CBI sought an immediate stay on the lower court order and its subsequent quashing. — PTI

Central forces sought to guard The Hindu office

Chennai, November 11
Editor-in-Chief of The Hindu N. Ram today demanded the deployment of central forces in front of his office and residences of five staffers against whom arrest warrants have been issued for alleged breach of privilege and contempt of the Tamil Nadu Assembly and said he would soon write to Deputy Prime Minister L.K. Advani in this regard.

A day after the Supreme Court stayed the arrests, he told reporters here that by posting plainclothesmen in front of The Hindu office, the Tamil Nadu police was adopting intimidatory tactics.

He said he would soon send a "factual report" of what happened in The Hindu office on November 7 and on the happenings at Bangalore on the next day.

On November 7, the police had entered The Hindu office with warrants issued by Tamil Nadu Assembly Speaker K. Kalimuthu to arrest five senior journalists of the paper. The next day, the car in which N. Ram and his brother N. Murali were travelling in Bangalore was intercepted allegedly by Tamil Nadu Police personnel.

N. Ram said N. Murali, the Joint Managing Director of the paper, today telephonically complained to the Tamil Nadu Governor about the deployment of the state police in front of the office and residences of the five staffers.

"I hope the response to the complaint will be positive and immediate”, Ram said. — PTI

No complaint against ministers, says PM

Prime Minister Atal Bihari Vajpayee today denied having received any complaint from Chief Vigilance Commissioner (CVC) P Shankar regarding harassment of PSU chiefs by some Central ministers seeking undue favours.

“No name of any minister figured during the meeting of the Central Vigilance Commissioner and the Cabinet Secretary with me,” the Prime Minister told newspersons at the airport before leaving for a six-day tour to Russia, Tajikistan and Syria.

Stating that the Cabinet Secretary and other officers including vigilance officers, kept meeting on a regular basis, Mr Vajpayee said “it is not good to see ulterior motives in it.”

“Moreover, after clarification from the Cabinet Secretariat, there is nothing more to be said,” he added.

A prominent newspaper had reported that some ministers in the Vajpayee Cabinet had sought undue favours from the chiefs of public sector undertakings which were under their respective ministries.

When Brig N. S. Dhaliwal (retd), a resident of Panchkula, while on a visit to Ambala had the problem of urine retention thrice his doctor told him plainly that he would have to go in for surgery. He was referred to Army Hospital, Research and Referral, New Delhi. Going through a battery of tests, Brigadier Dhaliwal had no idea that he would enjoy the distinction of being the first patient in India to be operated upon for an enlarged prostate by the latest high-energy KTP laser.

The photo-selective vaporisation prostate (PVP) was done successfully at the Army hospital by Dr Tim Larner from the UK and Dr (Col) Rajiv Sood on November 4.

Dr Larner has since returned to the UK. The latter, who is the only certified surgeon in India currently for the PVP laser, revealed that the laser had been imported by Medical Point Urology Laser Institute in New Delhi, it was given as a gesture of courtesy to the Army hospital for a day. The hospital, which reportedly intended buying it, had selected five patients with Brigadier Dhaliwal being the first who were operated upon using the PVP laser.

Sources disclosed that UP Chief Minister Mulayam Singh Yadav had also acquainted himself with this latest technology on that day by visiting the hospital.

Dr Sood said prostate surgery constituted about 50 per cent of all urology practice. The standard treatment for the management of enlarged prostate has been transurethral resection of the prostate (TURP). It involves resection of the prostate using electrical energy. It also requires wearing a catheter through the urethra for two to three days to allow for sufficient healing for the patient to pass urine on his own.

Court fines M.J. Akbar, 3 others

The Delhi High Court today held Editor-in-Chief of English daily The Asian Age M.J. Akbar and three other employees of the paper guilty of contempt of court and imposed a fine of Rs 2000 each on them.

A Division Bench comprising Ms Justice Usha Mehra and Mr Justice Pradeep Nandrajog convicted reporter Venkatesh Kesri, Editor Kaushik Mitter,
Editor-in-Chief M.J. Akbar and Printer and Publisher T. Venkatesh of having committed contempt of court and directed them to deposit the fine with the Delhi Legal Services Authority within a week failing which they would have to undergo simple imprisonment for one month.

“While upholding the right of the Press to report on court proceedings, the courts have cautioned that the Press has a duty of care and caution to investigate about the correctness of the news. The contemnors have violated this duty of care,’’ the judge said.

The court observed that though unconditional apologies have been tendered, which could only be a factor to mitigate the contempt, it did not wipe out the contempt.

The court had taken suo motu notice of a story captioned “Plea in Court to name Judge as fraud accused” in the paper in May this year and held that the offending news item brought to disrepute, in the public eye, a sitting judge (Mr Justice S.K. Kaul) of the High Court, undermining and subverting the dignity of the judge.

The judges, however, said contempt proceedings against main contemnor M.M. Shandilya, whose allegations that Mr Kaul acting as Vijaya Bank’s counsel earlier had submitted in court a false document were reported in the paper, would continue. — UNI

Modi to launch poll campaign in MP

The BJP has decided to launch the election campaign in Madhya Pradesh with Gujarat Chief Minister Narendra Modi on November 18 instead of Prime Minister Atal Behari Vajpayee.

The Prime Minister is scheduled to launch the campaign in Rajasthan with two election meetings, one each in Bikaner and Udaipur on November 18. The next day, Mr Vajpayee will address election meetings in Jabalpur and Indore (in Madhya Pradesh) and on November 20, he will try to woo the voters in Delhi, where party’s chances are reportedly very low.

There are 71 Assembly constituencies where there are sizeable Gujarati population and the party unit want to take advantage of that. Moreover, there is a thinking that Hindutva issue, with which Mr Modi got majority in Gujarat, will have considerable influence in Madhya Pradesh, sources said.

Quitting of job not end to union membership: SC

In a significant ruling, the Supreme Court has held that membership of an employee from an organisational workers’ union could not be struck down on his quitting the job or being sacked by the management unless there was specific provision for this in the union’s constitution.

“In the absence of any provision in the constitution of the trade union for automatic cessation of membership as a result of cessation of employment, it cannot be held that an employee would cease to be a member of the trade union in such an eventuality,” a Bench comprising Mr Justice Y.K. Sabharwal and Mr Justice K.G. Balakrishnan said.

The order came on the petition of the Bokajan Cement Corporation Employees Union against Cement Corporation of India Limited, the management of which had refused to recognise those members as union’s representatives who had ceased to be its employees.

The Nanavati Commission probing the 1984 anti-Sikh riots will issue notices to senior Congress leaders H.K.L. Bhagat, Sajjan Kumar and Jagdish Tytler among others soon and submit its final report to the government by March, 2004.

Justice Nanavati has also directed Congress leaders Kamal Nath, Dharamdas Shastri, Vasant Sathe, and Gautam Kaul to file their statement by December 12 in response to accusations of leading anti-Sikh mobs in 1984 in Central and New Delhi districts, Delhi Sikh Gurdwara Management Committee counsel H.S. Order on interim bail to Hashmi murderers reserved

Allahabad, November 11
The Allahabad High Court today reserved its order of granting interim bail to the accused in the Safdar Hashmi murder case.

Mr Justice C.P. Mishra reserved the order after hearing counsels of both the sides.

Fourth Additional District Judge C.D. Rai on November 2 had awarded life imprisonment to all accused after 14 years of the crime. — UNI

Manu Sharma case

New Delhi: The Delhi High Court on Tuesday dismissed the bail plea of Siddharth Vashisht, alias Manu Sharma, the prime accused in the Jessica Lal murder case, and directed him to surrender before the trial court on Thursday.

Mr Justice J.D. Kapoor turned down Manu’s petition for regular bail and directed him to surrender before the trial court on November 13, when his interim bail is to expire. — UNI

SIMI chief acquitted

A Delhi court on Tuesday acquitted the All-India President of the banned SIMI, Shahid Badar, in a sedition case.

Additional Sessions Judge D.S. Puniya acquitted the accused after the prosecution failed to prove the charges levelled against him.

The alleged incident dates back to February 2000 when the Union Home Ministry received a calendar wrongly depicting the country’s northern boundaries. The calendar also carried SIMI’s name on it. — PTI

Sarabhai case

Ahmedabad: A local court on Tuesday permitted danseuse Mallika Sarabhai, allegedly involved in an immigration racket, to leave the state in connection with a cultural programme in Mumbai from November 12 to 14.

A petition in this regard was filed by Ms Sarabhai in the sessions court here. The court further directed the social activist to return to the state by November 15. — UNI
