Law panel opposes blanket power to police New Delhi, June 4 “There should be no blanket power to the police to arrest a person, especially for non-cognisable offences as only about 5 per cent of such cases reach the chargesheet stage,” Law Commission member M.N. Ghatade told The Tribune. He said the commission had favoured amendments in the law to prevent the police from arresting or detaining a person merely on suspicion. The commission’s report, which is based on Supreme Court’s rulings in various cases, views of jurists, NGOs, social scientists and public, has said the arrest or detention of a person only for questioning would amount to “unwarranted and unlawful” interference with his personal liberty guaranteed under Article 21 of the Constitution. Mr Ghatade said the commission was of the view that such arrests tarnish the reputation of the person concerned, adding that the arrest, even in cognisable offences, should necessarily be effected by the police only after it has strong evidence against a person. The Criminal Procedure Code (CrPC) identifies only 60 of the 510 offences enlisted in the Indian Penal Code (IPC) as cognisable and non-bailable. While 103 of the remaining offences listed in the IPC are cognisable but bailable, 111 are non-cognisable under which a person should not be arrested at all, the panel has opined. A former Chief Justice of India and Chairman of the Constitution Review Commission, Justice M.N. Venkatachaliah, as the head of the National Human Rights Commission in 1999, had taken initiative for seeking amendment in the criminal law and asked the Law Commission to examine the issue. |
Bus service to Lahore from July 1
likely New Delhi, June 4 Independent diplomatic observers here, however, sounded a note of caution and said there were only “thin” chances of the “peace bus” resuming the service snapped in the wake of December 13, 2001 terrorist attack on Indian Parliament building. Issues such as logistics, visa, immigration facilities, customs and security aspects need to be sorted out before the bus service is resumed. It is understood to have been decided at the meeting that Pakistan has to agree to the schedule before the bus service is resumed. The Indian decision comes close on the heels of statements emanating from Islamabad hours ago that Pakistan was ready to resume the Lahore-Delhi bus service and the Samjhauta train at a “24-hour notice”. The Vajpayee government is yet to unveil what “schedule” it has in mind. Sources said for the resumption of Samjhauta Express, a lot of ground work needed to be done from the Indian point of view as New Delhi has often accused Islamabad of using the peace train for anti-Indian operations like smuggling. |

World Seed Congress from June 7 Bangalore, June 4 Briefing newspersons, he said the five-day event would give a boost to the Indian seed industry currently estimated at $ 1 billion as against the world’s $ 30 billion. Apart from trading opportunities to those connected with the field, it would also provide first-hand opportunity on the latest technological advances made in the field. There were also ample opportunities to explore joint ventures with foreign companies, he added. Replying to queries, Mr Attavar said India had traded Rs 1,500 crore worth seed varieties to various countries during 2002-03 and the exports had crossed $ 20 million. Hoping that genetically modified (GM) seeds would offer greater value to the farmers, he said there would be a separate session on GM seeds during the event. Noting that the Indian seed industry faced many constraints like inconsistent export policy and inadequate credit system, he urged the government to set them right in the interest of the sector.

Slum girl wins world contest Mumbai, June 4 The prize-winning entries, including that drawn by Haseena Mulla, the Mumbai girl, will be used for a ‘2004 Environment Calendar’, to be distributed worldwide. They will also be used for posters and publications. The paintings will be exhibited in Japan and in other countries and will be preserved at the National Museum of Ethnology in Osaka, Japan. There were 8473 entries by children from across 60 countries in the contest.

Ex-judge’s bail
extended New Delhi, June 4 Mr Justice B.A. Khan, sitting in vacation, extended till July 15 the interim bail of Mukherjee, which will be expiring on June 12. The court, meanwhile, issued notice to the CBI on his petition for regular bail with the direction that the agency should file its reply by July 15. The court also fixed hearing on sacked DDA Vice-Chairman Subhash Sharma’s petition for regular bail on June 13 and that of another accused Yashpal Minocha on June 6. Mukherjee was arrested by the CBI on April 30. He had resigned from his post on March 31 following reports of his alleged involvement in the DDA bribery scam which appeared in media. |
