Jalandhar, August 31 Jaswant Singh, alias Basant (25), had reportedly died after consuming a poisonous substance while in custody. A resident of Sudana village, he was lodged in the jail in connection with two FIRs against him at Bhogpur and Police Station Division Number 7. He had suddenly fallen ill on July 19, 2010, at 5 pm and died on way to Civil Hospital. Since it was a custodial death case, the Commission had taken cognisance of the matter under Section 2(d) of the Protection of Human Rights Act, 1993, and had called for reports from the state government in the Home Department, DGP (Prisons) Punjab, District Magistrate Jalandhar and Superintendent, Central Jail, Jalandhar. The Commission chaired by Jagdish Bhalla and four other members has said, "It is intriguing that when he was in judicial custody with the jail authorities, how the poisonous substance reached his hands? It is presumptive evidence regarding the negligence on part of the authorities." While pronouncing its decision, the Commission further observed, "A young boy aged 25/26 died in the custody of the jail authorities, when he was in the prime of his life. It would certainly send a wrong signal to the society and those citizens who relish and cherish the cause of human rights. The signal must be clear and loud lest no public servant in future may take into his head that he can violate human rights of a citizen with impunity and that there is no institution to scrutinise his actions." After his release from the jail, he was to serve his family members. Due to his death in the prime of his life, his family members have suffered. They are, therefore, to be given adequate compensation." The case has been adjourned to October 30, 2013 for an action-taken report. During the investigation, the panel had directed the authorities to submit the inquest/magisterial inquiry report, postmortem examination report, detailed report of the Superintendent Central Jail Jalandhar, report of the chemical examiner/histopathologist regarding the viscera of the deceased and report regarding the cause of his death by the board of doctors concerned. Booked twice for theft
Undertrial Basant had been lodged in jail in an FIR No. 122 of October 21, 2008, under Sections 379 (theft) and 411 (dishonestly receiving stolen property) of the IPC at the Bhogpur police station. He also had been booked in another FIR No. 137 of 2006 under Sections 457 (housebreaking by night to commit offence) and 380 (theft in dwelling house) of the IPC at Division No. 7 police station. The deceased's father, Sucha Singh, had got recorded his statement in the court that he went to jail to meet his son many times and he was normal. Inmates Monu, Balbir Chand and Manohar Lal, who were in the same cell along with him, have also stated that Jaswant Singh had taken the daily meal and then gone to sleep at about 3 pm and when they called him, he was not responding. The report of the chemical examiner read that a chemical of chlorocompound group of insecticides was detected. The cause of the death as per the opinion of the board of doctors was due to poisoning resulting from chlorocompound group of insecticides which was sufficient to cause death in the ordinary course of nature. The panel gave a notice under Section 16 of the Protection of Human Rights Act to the state and its functionaries, including Principal Secretary, Home, DGP (Prisons) Punjab and Superintendent, Central Jail, Jalandhar, affording them a reasonable opportunity to explain the circumstances leading to his death in their custody and to produce evidence in their defence, if any. While other authorities did not respond to the notice, Superintendent, Central Jail, Jalandhar, had come up with a vague reply, "The matter regarding the cause of poisoning death has already been initiated by Superintendent, Central Jail, Ludhiana, and further Director-General of Police (Prisons), Punjab." |
Loan approved for development works
Jalandhar, August 31 The Municipal Corporation (MC) is likely to start various pending development works within a few months, as a HUDCO loan of Rs 60 crore has been approved for it. MC Commissioner Vinay Bublani said various development works, including reconstruction and patch-work of dilapidated roads, would start within a few months according to favourable weather after paying arrears to contractors. Rs 10 crore of the first HUDCO loan instalment of Rs 25 crore has already been issued to it and that amount has been used by the MC for paying arrears to those contractors who had knocked at the doors of the Punjab and Haryana High Court for getting their payments. Bublani said the MC would soon get the remaining Rs 15 crore of the first loan instalment. That amount would be used to pay arrears to other contractors who had not even filed any case in any court for getting their payments. Subsequently the MC would get the second instalment of Rs 15 crore, third and fourth instalments of Rs 10 crore each at regular intervals. The loan would be repaid with quarterly instalment of Rs 2.25 crore, he said, adding that the financial condition of the MC started improving after the approval of the loan. The MC's financial condition would continue to improve further as its revenue in the shape of VAT, property tax and house tax was likely to go up in the coming months, he added. So following construction and patch-work of damaged roads, various development works in each of the 60 wards would start, he added. |
Kapurthala declared 'tobacco smoke-free'
Kapurthala, August 31 District officials had already empowered several government officials to challan those who were seen smoking in public places. Warning messages with phone numbers of officials concerned for complaints have already been put across the district through bold signages. The administration had already checked the sale of tobacco products around 100 yards of all educational and religious places. Deputy Commissioner DS Mangat said the tag had come to Kapurthala after it was observed by the School of Public Health PGIMER, Chandigarh, through its "Compliance Survey and Opinion Poll" that the district followed 96.4 per cent compliance, the highest in the state. While 10 of the 20 districts of the state have already been declared tobacco-free, Kapurthala and Hoshiarpur got the status today, with a formal announcement made by the Health Minister. — TNS |
Tributes paid to Beant Singh on death anniversary
Jalandhar, August 31 Chaudhary, Amarjit Singh Samra, Punjab Youth Congress president Vikramjit Singh Chaudhary and a number of workers paid tributes to Beant Singh garlanding his statue at BMC Chowk here. PYC president Vikramjit Singh Chaudhary said sacrifice and the valour with which Beant Singh fought and contained terrorism has no example anywhere in the world. He laid down his life for the unity, integrity and peace in the state. Vikramjit along with his youth workers pledged to keep the flame of national integration alive and work relentlessly as vanguards to carry his mission of peace and unity in the state. He reiterated that by eulogizing the assassins of the great martyr by the ruling alliance sends a feeling of insecurity amongst the masses. Such agenda is not in the favour of anyone, He lamented the insidious approach of the Badals who have yet to contribute a single penny towards the memorials of such great martyrs who laid down their lives for securing peace in the state and Badals never let a single chance go to take credit of maintaining peace in Punjab for which they have no contribution. He asked the ruling party to rise above narrow politics and make sincere and efforts to maintain peace in the state. |
Improvement Trust told to pay back earnest money to applicant
Jalandhar, August 31 In his complaint, Krishan Kumar, a resident of Fazilka, said he had applied for the allotment of a 153 sq yards plot through draw in the 94.97-acre Surya Enclave Extension Scheme of the JIT by paying an earnest money of Rs 2,60,100. He said the scheme was operative from August 8, 2011, to September 7, 2011 with 50 plots earmarked in the category. The applicant had applied for the plot by getting the amount financed through Punjab Gramin Bank, Dharampura, on September 6, 2011. He said he was not even aware as to whether the draw of lots had been held, as he had so far not got any information regarding the same. He said according to the instructions, appearing under the heading "Refund of Earnest Money" of the brochure issued in the advertisement of the scheme containing the terms and conditions, the earnest money of the unsuccessful candidates was required to be refunded within 60 days from the period of draw of lots. He said in case of the applicants who had got their earnest money financed from banks, it was to be refunded to the banks only. In the case of the applicant, the bank had charged financing charges of Rs 14,305 and the financing was for a very short period. He said the bank was pressing for the repayment of the amount with interest on account of the non-refund of the earnest money. He said that he had also been issued a notice for the recovery of amount of the Rs 2,60,100 with interest. He claimed that since the draw of lots could not be held, there was no reason for the JIT to have withheld the amount of the applicant deposited on account of the earnest money. In such an event, the amount of earnest money should have been immediately refunded. By not refunding the money in time to the applicant, which has been raised from the bank, there has been an unnecessary financial burden for him in the form of the payment of interest, he said. The applicant said he had also requested the JIT time and again and also issued two letters on December 3, 2012, and October 30, 2012, for the refund of earnest money. Upon notice, the opposite parties appeared and filed a reply due to the stay order granted by the Punjab and Haryana High Court in the CWP 3559 of 2011, the plots were not allotted. The reply also read that the complainant had been asked to file a self-declaration/affidavit so that the matter could be referred to the government for the refund of the money, but the complainant deliberately had not filed the same. The officials said the JIT had from its own side also referred the matter to the government as per letter JIT 2008, dated December 27, 2013. The forum, represented by Jaspal Singh Bhatia, president, and Jyotsna Thatai and Darshan Singh, both members, found that the JIT had admitted that the plots were not allotted. “So in these circumstances, the Trust was required to refund the earnest money to the complainant. The complainant had applied for the refund of the earnest money through two applications. When the Trust did not refund the earnest money, the complainant deposited the loan amount in the bank. He has produced a certificate showing that he has paid an interest of Rs 30,000 to the bank. In our opinion, the opposite party is not justified in not refunding the earnest money to the complainant till date,” the forum observed. It accepted the complaints and directed the JIT to refund the earnest money with interest at the rate of 12 per cent per annum from the date on which he moved the application for refund October 30, 2012, till the date of the payment. The complainant has also been awarded Rs 2,000 on account of litigation expenses. |
Biker killed in accident
Jalandhar, August 31 While the youth was killed on the spot, pillion rider Rajiv Kumar of Aman Nagar got badly hurt and was rushed to Civil Hospital in 108 ambulance. Despite injuries, he tried to flee from the hospital since he had consumed liquor and smack. We have tried to coax him a lot to know about the identity of the youth, who died in the accident, but to no avail, said the police. Even eight hours after the effort, the police had no clue about the identity of the deceased, who too was reportedly in an inebriated condition as he was driving from Pathankot Chowk to Maqsudan. The police is also clueless about the vehicle and its owners who hit them from behind since there were no witnesses to the incident. |
Mid-day meal back to square one
Jalandhar, August 31 Under-feeding schoolchildren, lack of efforts to provide hygienic mid-day meals and no efforts to ensure the provision of proper meals to students are also reflected in the directives issued by the health department to the education department. DEOs Kuldeep Sharma (primary) and Neelam Kumari (secondary) have also not initiated any aggressive efforts to counter substandard mid-day meals, even after administration’s reprimands after the Bihar tragedy. While students still drink contaminated water at many of the schools, the recent inspection by health teams regarding mid-day meals has also revealed glaring discrepancies at the Government Elementary School, Reru Pind. Among the urban schools especially in the basti and bazaar areas were badly hit and rural areas - being out of bounds — are even more ignored because visiting teams only venture into these areas after a controversy and leave them ignored otherwise. Mud bounds and overgrowth near school kitchens are excessively common as, some of the schools which were even reprimanded about overgrowth in their respective compounds, especially near the kitchen, haven’t cleared them off. Schools at Ladowali Road and Basti Peerdaad are some of the examples. Well meaning rural teachers say due to dearth of visits by teams, rural schools are often very complacent. A teacher in one of the village schools said, “We are aware of schools not using mid-day meal funds judiciously and feeding substandard food to students. There would be hardly any school which is providing the food as per the ideal 150 gram standard. Kitchens are unkempt. While teachers themselves eat a well made meal, students in comparison are fed bad food.” |
