BSES to pay Rs 7 lakh compensation for death
Tribune News Service

New Delhi, January 8
The Delhi High Court has directed BSES Rajdhani Power Ltd to pay a compensation of Rs 7 lakh to the family of a man who died after his bike collided with a metal ladder placed negligently on the Capital’s road by one of the company’s contractors.

Rejecting the company’s plea that it cannot be held responsible for the negligent act of its contractor, Justice Vikramajit Sen held that BSES Rajdhani Power Ltd owed vicarious liability for the death.

“Public and civic authorities have on a rampant and ubiquitous scale adopted a cavalier and careless attitude in fulfilling their functions, totally oblivious of the hazards and dangers that are caused to the public by their negligent functioning,” the court remarked while awarding the compensation.

The petitioner, Mrs Suni Manoj Mathew’s husband Manoj Mathew died after his bike collided with a mobile metal ladder which had rolled down the IIT Flyover on June 17, 2002. The ladder was being used for repairing streetlights.

Suni in her petition filed through counsel Hetu Arora held the BSES, police and the Delhi Government responsible for the death of her husband and sought compensation of Rs 10 lakh for the family. Justice Sen pointed that the death occurred as the BSES and the contractor were negligent since none of its personnel was present at the site when the ladder had apparently rolled down.

Disagreeing with the view of the BSES’s counsel Dalal that the writ was not maintainable, the court ruled that referring the petitioner to an alternative remedy was a matter of convenience and in the discretion of the court.

The court ordered the company to deposit the compensation with the Registrar General within four weeks.

The Registrar General was ordered to release Rs 2 lakh from the amount to the family for its immediate use and invest the remaining amount with a scheduled bank or in other remunerative schemes for its future use.

Justice Sen also clarified that the compensation shall not affect any other remedy available to the petitioner or have bearing on the criminal proceedings pending before the trial court on the death.

Yoga guru praised for awakening national consciousness

Gurgaon, January 8
Joining the chorus in favour of the embattled yoga guru Swami Ramdev, national president of the women wing of the Congress, Mrs Reeta Bahuguna, today said that his contribution in awakening the national consciousness in the country’s culture heritage was immense.

Mrs Bahuguna, who was here to participate in a workshop on the functioning of women representatives in Panchayati Raj institutions and municipalities, dismissed the allegations spearheaded by the CPM leader, Mrs Brinda Karat that the Swami’s institution was using bones as a constituent element in preparing Ayurvedic medicines.

She said there was enough herbs available to procure mineral like calcium and there was no need to use bones.

She further expressed reservations in the way sampling was done to products.

She said that it appeared that the entire controversy was related to possible disgruntled elements among the workers in the institute and other vested interests.

Addressing the elected representatives, Mrs Bahuguna said that although the reservation of seats provided for women has given a fillip to their empowerment in the decision making process, much needs to be done towards this goal.

The self-consciousness will unleash a positive energy and women will come forward to assert their rights, she added.

The Centre plans to effect the second generation reforms to the Panchayati Raj institutions to further strengthen them, she said.

She was optimistic that the Centre would introduce the Bill providing reservations of seats for women in the legislatures.

Speaking on the occasion, the national general secretary of the women wing of the Congress, Mrs Krishna Gehlot, came down heavily on female foeticide menace.

She urged the elected women representatives to discharge their constitutional duties with full responsibility and vigour.

DMRC faces uphill task to ensure safe ride
Tribune News Service

New Delhi, January 8
As it is with the introduction of the new Barakhamba-Dwarka line, the pressure on DMRC to ensure flawless and safe ride to its commuters has increased rigorously. With no fewer than 4 to 5 lakh commuters using the metro service every day, the task to ensure a comfortable journey has become quite important.

However, the performance of these trains connecting Shahdara to Rithala, Vishvavidyalya to Central Secretariat and Barakhamba Road to Dwarka has been quite satisfactory in the past year as they managed to maintain a punctuality record of 99 per cent in 2005.

Being one of the most heavily used systems today, metro trains in Delhi run more than 20.000 kilometres with their doors opening and closing around 5.6 lakh times every day. Put into so much use, these trains pose a big challenge before DMRC to maintain the same consistency level in terms of maintaining a high standard of service and security, a release said.

Keeping this in mind, DMRC tries to make sure that daily maintenance of these trains in terms of electrical, signalling, telecommunication and track work is ensured. Apart from running its services from six in the morning to 10 at night, Metro Rail operations generally go on almost all the day round for 24 hours as the trains go to the Metro Depot’s for maintenance only at night.

Also to ensure easy accessibility to its passengers, the Metro train frequency has been brought down to 4 minutes on Line 1 and Line 2 connecting Shadara-Rithala and Vishwa Vidyalaya-Cenral Secretariat respectively. DMRC also intends to increase the train capacity form 4 coaches to 8 coaches soon.

Apart from this, to assure proper and safe handling of the trains, the train operators’ (drivers) are also trained in computers, firefighting, first-aid and night train operations. They are also trained to look after minor technical problems, including door-closing issues en route so that the commuters may be ensured uninterrupted services.

Industrialists urged to conserve energy
Abhay Jain

Gurgaon, January 8
Gurgaon Industrial Association and Petroleum Conservation Research Association (PCRA), Ministry of Petroleum Gas, Government of India, jointly organised a seminar on ‘Energy Conservation Opportunities in Industry’ at GIA House here on Friday.

Inaugurating the function, Mr S.P. Gupta, HUDA administrator, appealed to the industrialists to take measures for conserving fuel oil in industries, which consume approximately 25 to 30 per cent of petroleum products. Industries should endeavour to use the latest monitoring instruments, modern maintenance and creation of energy cell to optimise energy conservation, added the officer.

This will help the country achieve sustainable growth. Moreover, with the opening of the Indian economy, the industries have to keep a vigil on their input cost, so as to keep the end use price more competitive, said Mr Gupta.

Mr V K Bhargava, Director-PS, Northern Region of PCRA in his keynote address, informed about PCRA’s efforts towards petroleum conservation in industries by undertaking energy audit in almost all type of industries.

In his welcome address, Gurgaon Industrial Association (GIA) president V P Bajaj said that the energy conservation is related not only to the industries but also to the household. As industrial units are facing power problem, this seminar is organised to guide the industries on how to use minimum energy without affecting its production.

He also mentioned that the Indian energy sector is highly energy-intensive and efficiency is well below than that of other industrialised countries. Energy crisis is a big threat for the modernisation and industrialisation.

Thus, the energy management is quite important and a well-planned action can help reduce an organisation’s energy bills and minimise the damage it does to the environment, said Mr Bajaj.

Mr K.C. Papreja, general secretary of GIA, thanked the delegates and participants.
