Illegal hoardings dot NH-22
Dera Bassi, November 8 While land developers, builders and owners of private educational institutions continue to flout the rules with impunity, the authorities concerned are in slumber. Taking benefit of the dispute over jurisdictions among local civic bodies, Greater Mohali Area Development Authority (GMADA) and the National Highway Authorities of India (NHAI), the violators have erected huge hoardings and banners advertising their establishments along the national highway till the Jharmari barrier near Lalru in Punjab. Illegal hoardings welcome the commuters starting from Chandigarh and Panchkula borders till one enters Haryana in Ambala district. Reportedly, the worst affected is a small stretch of the highway along the Ghaggar river bridge in Bhankharpur village where massive hoardings have come up on the either sides of the road. The advertisers had even displayed their hoardings on the walls of houses and showrooms facing the highway. Shifting their responsibilities on their counterparts, officers of Zirakpur and Dera Bassi municipal councils claim that the hoardings had come along the highway on NHAI land and it was their duty to remove them. They also claimed that the land, where a number of hoardings have come up, was out of their limits and GMADA was responsible for the violations. OC Mathur, project director, NHAI, revealed that the NHAI often pulls down the illegal hoardings that come up on the land under their jurisdictions. Dera Bassi SDM Sanjiv Kumar, when contacted, said he would ask the block development and panchayat officer (BDPO), Dera Bassi, to look into the matter. |

physical and mental harassment case Aneesha Sareen Tribune News Service
Chandigarh, November 8 The builder has also been asked to refund a sum of Rs 1.4 lakh charged as transfer fee from the complainants along with interest at the rate of 9 per cent per annum from the date of deposit and to pay a litigation cost of Rs 7,000. The complainants — Shakuntala Joshi and Sahil Joshi — residents of Sector 43 had moved the forum stating that a flat in Tower Lotus, Bollywood Heights, Dhakoli Road, Zirakpur, was allotted to Tilak Parkash Kataria and Anjali Kataria. The Katarias had availed a loan of Rs 15 lakh from HDFC Bank. Thereafter they approached the builder to sell the said property and represented that the said property was free from all encumbrances and that the purchasers would have clear title over it. The complainants agreed to purchase the property and a sum of Rs 1.4 lakh was paid to the builder as transfer fees. However, the builder accepted the transfer fee though the loan availed by Katarias was not yet cleared. The complainants then sent letters to the original allottees for expediting the transfer of the title but in vain. Subsequently, the original allottees repaid the loan and only thereafter the property was transferred in the complainant’s name. It was alleged that Hanumant Builders wrongly charged Rs 1.4 lakh from the complainant as transfer fee for transferring the property in question, while the loan availed by the original allottees — Tilak Parkash Kataria and Anjala Kataria — against the said property has not been cleared and the property was mortgaged with the bank. It is pleaded that the complainants went though mental trauma and agony as on the one hand, they had paid the cost of the flat to the original allottees and on the other hand, the builder was not transferring the property in question in their favour. “The complainants have proved their case by sufficient documentary evidence supported by duly sworn affidavits. The builder did not turn up to prove its defence against the assertions of the complainant and preferred to proceed exparte, which draws an adverse inference against them,” ruled the forum headed by President PL Ahuja. |
