SC tells NGT to deal with industries polluting Ganga

The Supreme Court today passed on to the National Green Tribunal (NGT) the problem of dealing with the Ganga pollution arising from industrial units offloading untreated effluents into the sacred river.

A Bench headed by Justice TS Thakur said the SC would restrict itself to minimising the household pollution, such as untreated sewer water, flowing into the river. The Bench was hearing a PIL, pending in the SC for the past 29 years, on the need for restoring the river to its pristine glory by checking the flow of all sorts of pollutants into the perennial water body, vital for the survival of a large population in several states.

The Bench acknowledged that the level of river pollution had gone up over the years despite the SC passing several orders and making efforts to ensure their implementation by the Central and state pollution control boards and other authorities.

The petitioner, MC Mehta, told the Bench that the categories of highly polluting industries had risen from 17 to 33 despite the fact that the court was hearing the case since 1985. Agreeing with the petitioner, the Bench said this was due to the authorities’ failure to implement the court orders.

The SC nevertheless acknowledged the fact that the implementing authorities were up against highly resourceful and politically influential industrial units responsible for emptying their effluents into the river.

The Bench, which included Justices AK Goel and R Banumathi, said it was transferring to the NGT all the issues relating to industrial pollution as the tribunal had experts who were in a position to handle it more effectively and expeditiously.

The apex court noted that the highly polluting industries were dealing with pharmaceuticals, fertilisers, oil refining, pesticides, paper and pulp, textiles and tanneries which should be forced to comply with the pollution control norms or wind up their operations.

Delegates participating in a three-day workshop of the Commonwealth Parliamentary Association (CPA) on agriculture today stressed the need to fix the prices of agriculture produce from the farmers’ view. The policies framed for the farm sector needed to have farmers as stakeholders so that agriculture continues to remain economically viable, they added.

The delegates from across the country and several Commonwealth nations had gathered at the Punjab Vidhan Sabha to participate in the workshop for the parliamentary agriculture committees.

They expressed concern over the influence of developed nations in the formulation of “one size fits all” agriculture policy, a perfect example of this being the practice of excessive use of pesticides in all developing nations. The delegates called for fresh outlook to increase the quality of food produced.

Expressing concern over the rising gender inequality, the agriculture committees called upon the policy makers to initiate legislative changes to give more land rights to women as their land holdings were negligible.

The conference saw delegates from the UK, Bangladesh, Tanzania and Sierra Leone, besides participants from various states across the country. The delegates held discussions on pricing mechanism, food security, genetically modified foods, excessive use of insecticides/pesticides, and impact of climate change; and agriculture policies aimed only at increasing yields.

Delivering the keynote address, Punjab Chief Minister Parkash Singh Badal said debts on farmers was a cause of concern. Often criticised for his decision to give free power to farmers, Badal said his decision should seen as a government support to the agriculture sector, whose contribution to the GDP was still high.

Badal found support in Bangladesh Speaker and CPA Chairperson Dr Shirin Sharmin Chaudhary on subsidies for farmers. Badal proposed a working group of members of Commonwealth nations with a permanent headquarters in Punjab to create a mechanism for the exchange of ideas and forming strategies. He sought cooperation from Lok Sabha Speaker Sumitra Mahajan.

Mahajan said India's Parliamentary Agriculture Committee had recommended that any new modern technology should be adopted only after examining its suitability to societal and local needs and conformity with the laws and governmental policies. Tanzanian deputy speaker Job Ndugai spoke on how prices of agriculture produce were determined by the developed countries, which impacted the economic growth of poor countries.

Badal, Khattar share cold vibes

Punjab CM Parkash Singh Badal and his counterpart from Haryana ML Khattar seemed cold towards each other. During the lunch hosted by Punjab Vidhan Sabha Speaker Charanjit Singh Atwal, Khattar tried to pull a chair where Badal and Haryana Governor Kaptan Singh Solanki were seated, the protocol officer took him on the other side of the table. No pleasantries were exchanged between the two CMs. Solanki, along with Punjab BJP president Kamal Sharma followed suit and went and sat with Khattar on the other end of the table. Punjab Industry Minister Madan Mohan Mittal urged Badal to have a photo op with Khattar. However, Badal went off.

Paperless Parliamant soon: LS Speaker

Lok Sabha Speaker Sumitra Mahajan said she was now striving to have a paperless Parliament. “All Members of Parliament have laptops and iPads. My aim is to have a completely paperless Parliament from the next session, though some technical glitches in the Wifi availability have to be sorted out,” she said on the sidelines of the workshop.

J-K poll: 6 sitting MLAs on Cong’s first list

Displaying its poll readiness, the Congress today released its first list of 15 candidates for the Assembly constituencies going to polls in the first phase of elections in Jammu and Kashmir. The list features six sitting legislators and reflects Congress’ strategy of banking on both the old and young for victory in elections in which the party is going solo having parted ways with the National Conference, its current coalition partner in the J&K Government.

Among six sitting legislators in the Congress list are ministers in the state government Rigzin Jora from Leh segment; Abdul Majeed Wani from Doda and Viqar Rasool from Banihal. Other MLAs chosen to defend their constituencies are GM Saroori from Inderwal; J&K Congress Legislature Party leader Mohammad Shareif Niaz from Bhaderwah and Ashok Kumar Doda from Ramban (reserved).

Mohammad Shareif Niaz, brother of former J&K CM and Leader of Opposition in Rajya Sabha Ghulam Nabi Azad, will defend the segment Ghulam Nabi represented as a CM earlier.

From Ganderbal, the constituency which J&K CM Omar Abdullah represents in the 87-member Assembly, the Congress has fielded a former National Conference leader Mohammad Yusuf Bhatt. Among the 15 constituencies going to polls on November 25, the first part of the five-phase election, five are from the twin districts of Ganderbal and Bandipora in Kashmir.

Aircel-Marxis deal: CBI court summons Dayanidhi Maran

Former telecom minister Dayanidhi Maran was Wednesday summoned by a special court hearing the Aircel-Marxis deal, as part of the larger 2G spectrum allocation case, to appear before it March 2.

The CBI Special Court Judge OP Saini, after taking cognizance of the charges framed in the case, also summoned Maran's brother Kalanithi, and Malaysian businessmen T Ananda Krishnan and Augustus Ralph Marshall, among others, as co-accused in the case.

The agency has alleged that Dayanidhi Maran used his influence to help Krishnan to buy Aircel by coercing its owner Sivasankaran to part with his stake.

It was alleged by Sivasankaran that Dayanidhi Maran favoured the Maxis Group in the takeover of his company. In return, he further alleged, the company made investments through Astro Network in a company stated to be owned by the Maran family.

Four companies -- Chennai-based Sun Direct TV, Britain-based Astro All Asia Networks, Maxis Communications Berhad of Malaysia and the South Asia Entertainment Holdings of Mauritius -- have also been named in the charges filed on August 29.

The CBI has said there was sufficient evidence to prosecute the accused. The probe agency has booked all the accused under charges of criminal conspiracy and under provisions of the Prevention of Corruption Act.

The court noted that there was enough incriminating material against each of the accused after carefully going through the copy of the first information report, charge sheet, statements of witnesses and related documents appended to the voluminous records of the case.

At the same time the court observed that Krishnan and Marshall were residing outside the country and Britain-based Astro All Asia Networks, Maxis Communications Berhad of Malaysia and the South Asia Entertainment Holdings of Mauritius were foreign firms.

"It is further submitted by the senior public prosecutor that out of the eight accused, five are residing outside the country, in different countries, that is, Malaysia, Mauritius and UK, and remaining three are residents of Chennai and, as such, at least four months' clear time be granted for effecting service of process of the court on these accused persons," the court said.

Accordingly, the court found the prayer of the senior public prosecutor to be logical, and hence fixed March 2 next year as the date for appearance. — PTI

With estimates of $200 billion in capital flight abroad, analysts say that bringing back half of the black money will yield $30 billion in forex reserves, that is around four months of current import cover. Going by the statements of the government, analysts do not expect an amnesty scheme for black money.

According to a note by Bank of America-Merrill Lynch, reports place Indians’ deposits in Swiss accounts in an astonishingly wide range of $2 billion-2 trillion.

The report says it is working with an estimate of capital flight of about $200 billion based on a recent research study. According to the study, Raghbendra Jha and Duc Nguyen Truong, of Australian National University, estimated total capital flight of more than $186 billion during 1998-2012.

Even if half of this is unearthed, it could add $30-35 billion (three to four months of current import cover) to forex reserves over time, if taxed at 30-35 per cent.

The report says that the Modi government is unlikely to announce a tax amnesty scheme to bring back Indians’ “black” money stashed in Swiss banks based on a statement by Nirmala Sitharaman, Minister of State for Finance, in Parliament.

“In our view, Voluntary Disclosure of Income Schemes (VDIS) discriminate against the honest tax payer, although they allow the government to quickly raise revenue. At the same time, the government proposes to re-launch the Kisan Vikas Patra, which has had relatively relaxed know-your-customer norms but no fiscal incentives in the past,” it adds.

Sitharaman had said in Parliament, “The experience shows when you bring in VDIS, it discriminates against genuine taxpayers. Those of you who pay taxes are disincentivised. It goes against honest taxpayers. It may not be a conducive path for recovering more taxes”.

India has announced several amnesty schemes to allow citizens to disclose their “black” money after paying the prevailing income tax. The 1997 VDIS scheme taxed this “black” money at 30 per cent for individuals and 35 per cent for corporates.

BJP-RSS plan: Identify, groom regional satraps

After picking RSS-backed Chief Ministers for Haryana and Maharashtra, the BJP is expected to follow the trend in two poll-bound states — Jammu and Kashmir and Jharkhand.

Sources say apart from ensuring that the CM with a “clean, disciplined and simple lifestyle” (the “normal Sangh way of life”) heads the state, development is part of the strategy of the Rashtriya Swayamsevak Sangh (RSS) and its political arm BJP to identify and develop regional satraps.

The party is experiencing shortage of well-established political names in the new areas it is making forays into.

Though names of some senior union ministers were doing rounds for the top post in the run-up to the elections in Haryana and Maharashtra, the top leadership was clear that none of the Central leaders would be sent to states in case the BJP won the elections.

“Sending a leader from the Centre would have defeated the purpose. It would have increased vacancies in the Centre and taken away the chance to develop a leader from the state. The aim is to groom a strong line of the leadership in the states along with a second line in the Centre. The BJP is emerging victorious in states where it had never been in complete power. Being out of power at the Centre for 10 years meant that only those with either the RSS background or a firm belief in the party were continuing,” a senior leader said.

“A paucity of winnable candidates from within the party forced us to look outside because winning was the first step,” he said.

About experience in running the government, leaders say that “Sangh’s worldview and BJP’s ideology” is enough for guidance.

“The RSS never intervenes in the BJP’s functioning. It only interferes if the BJP seeks help (in times of turmoil in the party) or when it feels the need, like yesterday when a government-Sangh interface was organised at the RSS’ behest,” a BJP leader said.

However, considering that more than 60 per cent of the BJP members are from the Sangh background, the RSS’ influence in the political functioning is bound to prevail.

‘I love you Hudhud’ post lands Andhra law student in soup

A law student in Andhra Pradesh has landed in trouble for posting bizarre comments on his Facebook page about the recent “Hudhud” cyclone that had battered the north coastal region.

Ch Rahul Reddy, a resident of the coastal city of Guntur and an activist of the opposition YSR Congress Party, posted a comment “I Love You, Hudhud” and then went on to justify his glee, saying the Mother Nature had taken “revenge against betrayers.”

“We have arrested him under the provisions of Information Technology Act and the IPC,” a media release from Criminal Investigation Department said.

The accused was apparently venting out his anger against the people of the state for voting the TDP to power instead of the YSR Congress Party.

Reddy has since been remanded in judicial custody.

Cong plans to corner Modi govt on Patel’s birth anniversary

Wary of BJP's move to observe October 31 as the birth anniversary of India's first Home Minister Sardar Patel instead of the death anniversary of former PM Indira Gandhi, the Congress is readying a counter strategy to corner the ruling party.

At the heart of the strategy would be a plain question - "Was Indira Gandhi not the Prime Minister of India? Was she only the Prime Minister of the Congress?"

Top Congress leaders today hinted that the party would launch a full-fledged attack on PM Narendra Modi's tactic of diluting a long standing practice of remembering Indira Gandhi on the day of her assassination.

"It is very sad that the BJP should employ this tool of wiping off a historical tradition and practice. It is like saying Indira Gandhi was only the Congress' PM and nobody else's. We will question PM Modi's intentions and ask the government what its intentions are behind playing with history and with the sentiments of those who still honour Indira Gandhi's memory," said a Congress leader.

Another part of the party's strategy would be to question PM Narendra Modi's move to appropriate Sardar Patel's legacy at a time when Patel's house in Ahmadabad is lying in a state of utter neglect.

Sardar Patel, credited with expanding Ahmadabad outside the walls of the old city, lived in a house near Vasant Chowk in Lal Darwaza in Ahmadabad.

"But the house is all filth and mess. Weeds have taken over its spaces. It is rather strange that a PM, who does not tire of praising Sardar Patel, could not as the Chief Minister of Gujarat restore a house in which Sardar Patel spent principal and most important years of his life," said a Congress spokesperson adding that the party would take on Modi on the issue tomorrow.

The Congress today asked while the PM could spend crores for building Sardar Patel's statute as the Statue of Unity, the BJP Government in Gujarat is finding it hard to spare a few lakhs to restore Sardar Patel's humble old abode as a heritage site.

Having lost their pre-eminent position in Parliament after the recent Lok Sabha polls, the Left parties have decided to be back in the political spotlight by identifying issues to launch joint campaign against the BJP-led NDA government.

The four Left parties — the CPM, CPI, All India Forward Bloc and Revolutionary Socialist Party – along with the CPI (ML) and SUC will meet here on November 1 to draft a programme and opposed policies of the govt.

Briefing correspondents at the conclusion of the four-day CPM central committee meeting here, party general secretary Prakash Karat said the joint campaign will be conducted on agreed issues. The CPM today flagged the move to restrict Mahatma Gandhi National Rural Employment Guarantee Act to 200 most-backward districts and diluting labour laws in the country.

“The central committee extended full support to the struggle of the central trade unions against the amendments to the labour laws. These proposed changes will take the majority of workers out of the purview of labour laws,” Karat said. A day after PM Narendra Modi announced that the government will do away with inspector raj and bring in labour reforms, trade unions announced a protest on December 5.

Similarly, the CPM today announced its decision to conduct a countrywide campaign on the issue dilution of MGNREGA charging that besides curtailing the districts, the government proposed to increase the expenditure cost on material from current 40 per cent to 49 per cent and reduce the allocation for labour to States.

“Instead of serious improvements in the implementation of MGNREGA to increase the number of workdays from the current dismal national average of 45 days to its full potential of 100 days, the BJP government is seeking to subvert the character of the employment guarantee scheme,” Karat said.

Rafale deal with IAF will be inked soon: France

Almost three years into negotiations over price and work-share arrangement between the Ministry of Defence and French company Dassault Aviation, the French government is positive that the Rafale fighter jet deal will be clinched any time now.

In January 2012, the Indian Air Force selected Dassault Aviation’s Rafale fighter jet out of six global competitors to buy 126 medium multi-role combat aircraft (MMRCA). The planes were tested for 643 parameters before the decision. When the global tender was floated for the MMRCA, the cost was estimated to be around $10 billion.

France’s Ambassador to India Francois Richier today said, “It is a very, very big contract and very complex. From what we have heard from the (Indian) Defence Ministry, we believe it is on the right course.”

When the Narendra Modi government took over in May, Defence Ministry officials had said it would take about three months to wrap up the contract.

Earlier this month, Russian Ambassador Alexander Kadakin claimed that the Rafales “will be swatted like mosquitoes in an August night” by Russia-supplied Chinese combat planes in a war. His French counterpart Richier refused to be drawn into commenting on Kadakin’s remarks.

Under the terms of the global tender, the IAF will acquire 18 of the aircraft in “flyaway” condition. The remaining 108 are planned to be built in Hindustan Aeronautics Limited facilities in Bangalore.Dassault Aviation’s key associate, the SAFRAN conglomerate, today entered into agreements to sponsor research projects at IIT Delhi and the Indian Institute of Science, Bangalore.

Faced with allegation of links with jihadi groups in Bangladesh, All India United Democratic Front (AIUDF), a 10-year-old political party formed as an amalgamation of over a dozen minority groups in Assam, today stated that it would bring a national TV news channel to the curt for telecasting a ‘baseless, motivated’ news against the party as well as its president Badaruddin Ajmal, an MP and a perfume mogul-turned-politician.

A news channel had carried a report yesterday in which it quoted intelligence agencies to say that Ajmal was involved in sending Muslim youths from Dhubri areas in Assam to undergo jihadi training in Bangladesh. The report created a political storm in Assam where Ajmal’s opponents as well as non-political organisations are baying for his blood.

Medical establishments ‘using political clout to duck govt rule’

Medical establishments across the country are “using political clout to avoid government regulation and oversight of any kind”.

Four years after it was passed, the crucial central law that mandated registration of all clinical establishments in both public and private sectors is struggling for implementation. So far, only nine states and UTs of 29 states and seven UTs have adopted the Clinical Establishments Regulation Act, 2010. The Tribune has learnt that Health Minister Harsh Vardhan has written a letter to Chief Ministers of all defaulting states to immediately adopt the law in public interest. The laxity of states in implementing the Act was on the agenda of the first meeting of state health secretaries that Vardhan chaired.

The law makes it compulsory for all state governments to create a registry of all clinical establishments under their jurisdiction. These establishments are to include not only hospitals, clinics and nursing homes but also diagnostic centres and single doctor clinics thriving across rural and urban centres.

“Except the defence forces clinical establishments, the Act provides for registration and regulation of all other clinical set ups whether in the field of diagnostics or medical services such as hospitals. The idea is standardisation of protocols for treatment, fixation of the range of costs which hospitals can charge from a patient; regulation of standards of medical services and facilities. But clinics which enjoy political clout continue to violate the law and have convinced several states that the law is intrusive which it is not. In the absence of the law, hospitals and diagnostic centres continue to charge what they want for the same treatment or test,” a top government source said.

The nine states and UTs that have adopted the central law (health being a state subject) are Arunachal Pradesh, Sikkim, Mizoram, Himachal Pradesh, Uttar Pradesh, Rajasthan, Bihar, Uttarakhand and Jharkhand. “The law was passed following a resolution in respect of registration of clinical establishments by four states, including Arunachal, Sikkim and Mizoram. Since health is a state subject, the Central Government requires a resolution from a set of states to legislate on a subject. Since four of the nine states that have adopted the law are initial movers of the resolution which forms the basis of the legislation, only five more states have practically adopted the provisions,” a Health Ministry official said.

Cabinet nod to Rs 1,050-cr polar research vessel

Looking to give the Indian scientists working in the hard environs of Antarctica and the Arctic region an independent hand in their research, the government today gave its go-ahead to the proposal of the Ministry of Earth Sciences for purchasing of an independent Polar Research Vessel at a staggering cost of over Rs 1,050 crore.

The decision was taken at the meeting of the Cabinet Committee on Economic Affairs (CCEA) chaired by Prime Minister Narendra Modi.

The CCEA gave its nod for the acquisition of Polar Research Vessel (ice-breaker, research-cum-supply vessel) by the Ministry of Earth Sciences at a total cost of Rs 1051.13 crore within a period of 34 months.

The Ministry of Earth Sciences felt it necessary to have the country's own polar research vessel considering the need to sustain two Indian research bases in Antarctica (Maitri and Bharti); dovetailing research initiatives in the Southern Ocean domain with those in the proximal regions of the Antarctic continent; widen the thrust on Arctic research disciplines undertaken through Indian Station Himadri, and to provide a suitable research platform for other tropical sea programmes.

Such a vessel, it is envisaged, can not only perform dual functions, research and logistics, in the polar region but can also serve as a research platform for scientists to undertake scientific research in the ocean realm including the Southern Ocean.

Indian Antarctic expeditions have been undertaken every year onboard ice-class vessels/ice-breakers chartered from the international market. These vessels have largely been cargo ships capable of transporting men and material and are unable to serve as a research platform.

With increased demand for cargo vessels and their dwindling availability, the charter charges of these vessels have been escalating over the years.

The First Indian Scientific Expedition to Antarctica was launched in 1981. From 2004, India embarked on its scientific endeavors in the Southern Ocean realm.

BSF, police to shut down illegal ‘madrasas’ near B’desh border

The BSF has been directed to immediately launch a massive drive jointly with the district police to dismantle all suspected terrorists dens in the border districts adjoining Bangladesh.

They will also cross-check the identity proofs of the local people for identifying terrorists and outsiders.

The state government has also been advised to immediately close down all illegal ‘madrasas’ and to scrutinise and monitor the functioning of the madrasas which were sanctioned by former Chief Minister Buddhadeb Bhattacharjee and the incumbent CM Mamata Banerjee.

These instructions were issued due to the spurt in subversive activities of the Jamaat-e-Islami and other terrorists groups in the Indo-Bangladesh border area. The instructions of the Home Ministry reached the state government today.

The NIA and other central agencies inquiring into the recent blast at Khagraghar, in which two terrorists were killed, also suspect that the terrorists involved in the Khagraghar blast had a plan kill Bangladesh Prime Minister Sheikh Hasina, Opposition leader Khaleda Zia and others.

The BJP, Congress and CPM separately led delegations to the disturbed areas at Makra, Khagraghar and Parui to make an on-the-spot study of the situation. But they were denied permission to visit the areas.

While the BJP and Congress teams returned after failing to enter these areas, the CPM members who included Ritabrata Bhattacharyya, MP, and Anishur Rahman, MLA, were arrested for violating orders under Section 144CrPC.

However, a three-member team of BJP MPs, led by Mukhtar Abbas Naqvi will make a fresh attempt to visit the disturbed areas tomorrow, said state BJP president Rahul Sinha. Other members are Udit Nath and Kriti Azad.

Sinha today met the state electoral officer Sunil Gupta and demanded that the TMC should be declared as a terrorist organisation.

Cadre officer to head Army Aviation Corps

The Army Aviation Corps (AAC), a combat support arm, will now be headed by a Lieutenant General belonging to the corps. Earlier, the AAC Director General (DG) at Army Headquarters was a Lieutenant General from another arm, since the senior most AAC, holding the post of Additional DG, could not go beyond the rank of Major General on account of the relatively smaller size of the corps.

Directing the Central Government to move the vacancy of the AAC Director General from the general cadre to the permanent cadre of the AAC “forthwith”, the Armed Forces Tribunal has also ordered that a special selection board be convened preferably before November 15, to consider eligible AAC officers for promotion to the rank of Lieutenant General.

One of the youngest arms of the Army, AAC operates helicopters to provide tactical air support to Army formations, carrying out anti-tank strikes, surveillance, airlift of troops and equipment and casualty evacuation.

Maj Gen PK Bharali, ADG Army Aviation, had moved the Tribunal contending that the Central Government had released 20 new vacancies for Lieutenant Generals in 2008 and the appointment of DG Army Aviation was to be made a cadre appointment. He had staked his claim to the post on account of being the senior-most AAC cadre officer.

A 1977 seniority officer, Major General Bharali had pointed out that his name was not considered for promotion to the rank of Lieutenant General by the special selection board held for non-general cadre officers in April 2013 on the grounds that the AAC was a “minor corps.” Consequently to a study undertaken by the Army that showed that the strength of the ACC had reached 650 pilots, the government finally approved the transfer of the vacancy of DG Army Aviation to the permanent cadre of AAC.

He was thereafter considered for promotion in October 2013, but not approved. His name was again omitted from consideration in the board held in April 2014 on the grounds that the post of DG was shown as a general cadre vacancy and not a cadre vacancy.

The Tribunal, in his orders a few days ago, held that the rational of the respondents to determine the cadre strength of the AAC and whether he could be headed by a cadre officer was contradictory and discriminatory in nature. The Tribunal observed that the respondents’ themselves were not sure of figures relating to cadre strength and comparison with other arms and corps and the whole exercise undertaken by them was not based on any cogent reason and was contrary to the decision taken by the government when the post of DG was sanctioned.

Sena slams Modi govt on black money issue

The Shiv Sena today took pot shots at the Central government over Prime Minister Narendra Modi’s election promise of revealing the names of those stashing unaccounted money abroad.

In an editorial in the party’s mouthpiece Saamana, the Shiv Sena pointed out that whatever progress has been achieved in the matter is because of the Supreme Court alone. “So far, the government revealed only three names but even for this, the credit will go only to the Supreme Court,” the editorial said.

“The three names revealed so far are nothing compared to the real loot that has been stashed away abroad,” the editorial said.

India fails to attend meet on fighting tax evasion

New Delhi/Berlin, October 29
India today failed to attend an OECD meeting in Berlin where a multilateral agreement requiring a commitment to follow international standards of confidentiality for information received relating to black money was signed.

Official sources said that India was not able to attend the Berlin meeting where it was to sign a multilateral competent authority agreement and intended first information exchange date.

The Government of India had to give an international commitment that it would follow international standards on information received. Late night reports indicate that India was not able to attend that meet, they said without citing any reasons for the absence. — PTI

Those behind '84 riots not brought to book: HRW

India has failed to punish those responsible for the 1984 anti-Sikh riots and it reflects the country's "weak efforts" to fight communal violence, an international human rights advocacy group said Wednesday.

"Successive Indian governments' failure to prosecute those responsible for the 1984 anti-Sikh killings and other abuses during the 1984 anti-Sikh violence highlights India's weak efforts to combat communal violence," Human Rights Watch (HRW) said in a statement.

It said the new Indian government should seek police reforms and to enact a law against communal violence that would hold public officials accountable for complicity and dereliction of duty.

"Ten government-appointed commissions and committees have investigated the deadly attacks against thousands of Sikhs in 1984 following the assassination of (then) Prime Minister Indira Gandhi by her Sikh bodyguards.

"Independent civil society inquiries found complicity by both police and leaders of Gandhi's Congress party. Yet, three decades later, only 30 people, mostly low-ranking Congress party supporters, have been convicted for the attacks that resulted in thousands of deaths and injuries," the statement said.

"No police officer has been convicted and there were no prosecutions for rape, highlighting a comprehensive failure of the justice system," it said. Meenakshi Ganguly, HRW's south Asia director, said: "India's failure to prosecute those most responsible for the anti-Sikh violence in 1984 has not only denied justice to Sikhs, but has made all Indians more vulnerable to communal violence." — IANS
