Provide alternative sites to 294 Palsora Colony residents: HC
Tribune News Service

Chandigarh, October 1
The Punjab and Haryana High Court today came to the rescue of 294 erstwhile residents of Palsora Colony. Nearly a decade after their jhuggis were demolished, Justice Jasbir Singh and Justice Rameshwar Singh Malik this morning directed the UT Estate Officer, Chandigarh, to consider their cases for allotment of alternative tenement.

The directions came on a bunch of eight civil writ petitions filed through advocate HC Arora. Referring to “Licensing of Tenements and Sites and Services in Chandigarh Scheme, 1979”, Arora asserted the colony dwellers were to be resettled by providing them alternative tenements or sites in a phased manner after demolition of the unauthorised colonies.

But, after demolition of their jhuggis in Palsora Colony on June 25 and 26, 2003, Chandigarh Administration issued a notification on August 18, 2003, stating that only “bonafide residents” whose names figured in the electoral rolls as on December 8, 1996, would be considered for allotment of alternative tenements or sites under the 1979 scheme.

Subsequently, another scheme “Chandigarh Small Flats Scheme, 2006” was notified by Chandigarh Administration on November 6, 2006, for the residents of other 18 unauthorised colonies.

As per the scheme, bonafide residents of those 18 colonies, whose names were included in the voter list of 2006, and whose names figured in the biometric survey conducted in March 2006, were to be considered for the allotment of small flats.

The grievance raised by the petitioners in the eight petitions was that after demolition of their tenements in the erstwhile Palsora Colony, they did not in an unauthorised manner occupy any site in any unauthorised colonies.

As a result, erstwhile residents of Palsora Colony, who without authorisation occupied sites in any of the 18 unauthorised colonies covered by 2006 Scheme, were being allotted small flats.

Pronouncing the order in the open court, the Bench observed the petitioners who did not encroach upon government land after demolition of their tenements deserved to be allotted alternate sites, tenements or small flats as given those encroaching upon government land.
