Krishna to attend ASEAN meetings
New Delhi, July 9 Krishna will represent India at the ASEAN-India Ministerial Meeting, the 2nd East Asia Summit Foreign Ministers' Meeting and the 19th ASEAN Regional Forum Ministerial Meeting. The ASEAN-India Ministerial Meeting, an annual event, takes stock of the ASEAN-India partnership and deliberates on its future direction. India became a Sectoral Partner of ASEAN in 1992 and a Dialogue Partner in 1996. The relationship was upgraded in 2002 to the level of an Annual Summit Level Partnership. The 10th ASEAN-India Foreign Ministers Meeting is significant as India would be hosting a special ASEAN-India Commemorative Summit in December to mark 20 years of the relationship and 10 years of the summit level partnership. A series of events have been planned in the run-up to the Commemorative Summit, officials said. India has been part of the East Asia process since 2005, as a founding member. East Asia Summit (EAS) Foreign Ministers would discuss cooperation in the five core areas of education, energy, finance, disaster management and pandemics as well as connectivity and further economic partnership between the member countries. Regional and international issues of concern and the preparation for the 7th East Asia Summit, which is to be held in Phnom Penh in November this year, would also be discussed. Krishna will also participate in the 19th Ministerial Meeting of the ASEAN Regional Forum (ARF). Set up in 1993, the ARF has 27 members. India attaches importance to the ARF as a forum for constructive dialogue on political and security cooperation in the region with the ASEAN countries playing a central role in the process. Participants at the Phnom Penh meetings will discuss the territorial dispute between China and southeastern countries, such as the Philippines and Vietnam. ASEAN members aim to create a legally binding rule in order to settle the dispute with China in a peaceful manner. Even India has unwittingly got involved in the dispute over the South China Sea, home to vital shipping lanes and believed to be rich in oil and gas deposits. China, which claims sovereignty over the South China Sea, has warned India against undertaking oil exploration in the blocks allocated to it by Vietnam in the sea. The participating nations are hoping to reach an agreement with China to start negotiations on the issue. But China intends to solve the issue by negotiating directly with other countries.

SC seeks report on damaged shrines

New Delhi, July 9 A Bench comprising Justices KS Radhakrishnan and Dipak Misra passed the order on an appeal filed by the state government challenging a Gujarat High Court order directing it to pay compensation. Additional Advocate General Tushar Mehta said the HC should not have passed such a verdict as state funds were not provided for repairing religious places. Even Sikhs had sought compensation for the religious places damaged during the 1984 riots, he pointed out. The Bench, however, wanted to know what was wrong in paying compensation in such cases which were akin to damage caused to houses by floods or earthquake. The HC had passed the order on a petition filed by an NGO, Islamic Relief Committee of Gujarat (IRCG), pleading for compensation to the damaged shrines. As many as 535 such places had become the target of rioters of which 37 were still to be repaired. Even for the already repaired structures, the state government should pay compensation, the HC had said. The HC had also held that the inaction on the part of the state government had resulted in the rioters targeting religious structures. |

BJP’s Keshubhai set to float own party
Ahmedabad, July 9 The other two contenders are well-entrenched ruling BJP and the Opposition Congress. Keshubhai's group has indicated that he would form a party and a formal announcement is likely later this month. "It is more than 100 per cent certain that Keshubhai will form a new party and we will contest the elections on all 182 seats. There is no doubt that Keshubhai will lead the party and the state will have a three-way contest," said Patel's supporter Gordhan Zadafia, a former minister in the Modi government. The BJP is in power in Gujarat since 1995. Regional parties have grown strong in other parts of the country in the past two decades, but the trend was not witnessed here. Attempts to provide a regional choice failed. Former Chief Minister and Congress leader Chimanbhai Patel formed Janta Morcha in the 1980s, but realised soon that it was a non-starter and went back to the Congress. Another former CM, Shankarsinh Vaghela of the BJP, floated Rashtriya Janta Party in 1986. He managed to get only four seats out of the total 184 and later joined Congress. In the decade before, Sanstha Congress of Morarji Desai had some success, as it came to power after the Emergency in alliance with four other parties, trouncing Congress (I). A BJP leader, speaking on the condition of anonymity, said Gujarat had never accepted regional fronts. "Attempts were made in the past but they have not been successful and Patel group's attempt will not succeed... The contest is between the BJP and Congress," he said. But Zadafia differed. K’taka HC disposes of Nithyananda's plea for damages
Bangalore, July 9 Justice Ajit Gunjal disposed of the petition on the grounds that the "Nithyananda Dhyanapeetham" Ashram in Bidadi had already been unsealed and returned to Nithyananda. The court observed "the propriety of the seizure will be decided in appropriate proceedings later, if initiated." Senior Counsel Ravi B Naik represented Nithyananda. Nithyananda, in his June 14 petition, sought Rs 10 crore damages from Karnataka Chief Minister D V Sadananda Gowda, Ramnagar District Deputy Commisioner among others and a regional news channel as damages to his property from the government during search and seizures at the Ashram. — PTI |

Cong MLAs backing Ashok Chavan walk out of party meet
Mumbai, July 9 According to sources, several Congress legislators voiced their opposition to the treatment meted out to Ashok Chavan and walked out of the meeting. Earlier, 12 party MLAs handed over a letter stating their point of view to Chief Minister Prithviraj Chavan. Abdul Sattar and Vijay Wadettiwar, two of the MLAs who are supporting Ashok Chavan, have publicly come out in support of their leader in the past few days. "The government did not do enough to prevent the humiliation of Ashok Chavan," Sattar had told reporters ahead of today's protest. Both MLAs found fault in the government's handling of the Adarsh scam probe. They said the government should have filed an intervention petition before the Bombay High Court challenging the CBI inquiry into the Adarsh controversy. At today's meeting, Ashok Chavan's supporters alleged that former Chief Ministers Vilasrao Deshmukh and Sushilkumar Shinde, who were also responsible for giving clearances to the controversial project, got away lightly. Both Deshmukh and Shinde have been named as witnesses in the case. On the other hand, Ashok Chavan along with 12 others has been charged with cheating and criminal conspiracy. Ashok Chavan has blamed the filing of the chargesheet against him as part of a political conspiracy. According to Ashok Chavan, the decision to allot land for the project was taken by then Chief Minister Vilasrao Deshmukh, who was also the revenue minister in the government.

Chandigarh, July 9 The numbers are undoubtedly unprecedented as such a heavy rush is hardly ever witnessed when a judge is transferred from one high court to another. In fact, such huge gatherings are seen only when a judge goes to another high court upon elevation as the chief justice. The numbers are not only an indicative of Justice Nirmaljit Kaur’s popularity and esteem, but also of the conviction and confidence the Bar and the Bench has in her. The numbers also validate what has been talked since long at the Bar - Justice Nirmaljit Kaur was not wrong when she called in the police after Rs 15 lakh erroneously landed at her house, leading to the exposure of the cash-for-judge scam. Justice Nirmaljit Kaur was administered oath by Chief Justice of the Rajasthan High Court Arun Mishra at 10.30 am; and she shared the Bench with him today. From Tuesday, Justice Nirmaljit Kaur will be holding the Bench all by herself. Available information suggests Justice Nirmaljit Kaur will, for the time being, be on the Jodhpur Bench of the Rajasthan High Court. Justice Nirmaljit Kaur was instrumental in unearthing the scam that rocked the judiciary in August 2008. Justice Nirmaljit Kaur had, in fact, called the Chandigarh Police after a carry bag stuffed with Rs 15 lakh in cash was wrongly delivered at her residence. The case was initially registered by the Chandigarh Police, but the investigation was later handed over to the CBI. In the probe, another judge with similar name, Justice Nirmal Yadav, surfaced as the alleged intended recipient of Rs 15 lakh. Justice Yadav has since retired and a criminal case against her is going on in Sector 17 district courts. Already, the Punjab and Haryana High Court has made it clear that Justice Nirmal Yadav cannot claim any special right or privilege as an accused, just because she has enjoyed one of the highest constitutional offices. Her plea against the orders is now pending before the Supreme Court.

Abandoned by owner, camel finds shelter in Hyderabad
Hyderabad, July 9 The camel was beaten by its owner before being abandoned in the middle of a busy road at Punjagutta flyover here. The Blue Cross, a city-based NGO working in the area of animal rights, stepped in to take care of the camel. The badly bruised camel is now recuperating at a Blue Cross shelter home in Jubilee Hills. “It may have to undergo a surgery on its fractured left leg. It seems that it was starved and abused by its owner,” said a veterinarian at the shelter. The camel, described by the handlers at the Blue Cross as “gentle and cooperative”, has injury marks all over its body. “The owner might have dragged it by its nose with a noose,” said camel’s handlers.

Manjit Singh GK, the president of the Delhi unit of the SAD, presented a memorandum to the British High Commissioner here saying Tytler and Gill have been included in the official delegation to the Olympics. “We believe that this move would agitate and hurt the sentiments of the Sikh community and the old wounds will be revived. The Sikh community is still awaiting justice,” said Manjit. He cited how the British Government had recently denied visa to Syrian Chief of Olympics for his alleged role in human rights violation in Syria. On the same grounds, visa should be denied to Tytler and Gill for their role in extra-judicial killings and genocidal attacks on Sikhs. In view of the facts stated above and also the sentiments of crores of Sikhs residing all over the world, we strongly appeal to you that Tytler and Gill should not be allowed to enter the United Kingdom, said the delegation. |

Disability groups want Sangma to apologise
New Delhi, July 9 Sangma had said during his presidential campaign in Gujarat on July 6, “India should have a President who is not blind, deaf and dumb. India should have a thinking and functional President.” Condemning the statement, the Society for Disability and Rehabilitation Studies today said in a statement that such derogatory statements were unbecoming of a person of Sangma’s stature and he should offer an apology for the same. The Society sought the Election Commission (EC)’s protection in case Sangma fails to apologise. “While denouncing and registering a strong protest against such irrational, unwanted and uncharitable remarks, we demand an unqualified apology from PA Sangma. If he does not do so, we appeal to the EC and the Chief Commissioner, Disabilities, to take suo motu notice of the statement which has hurt self-dignity of the disabled,” said GN Karna, president of the Society. He said a person aspiring to holds the highest office of the country as the custodian of its Constitution could not voice such biased views.

HC acquits 5, upholds life term to 4 in Best Bakery case
Mumbai, July 9 A division bench comprising Justices VM Kanade and PD Kode, who had on July 3 reserved the judgement on the appeals filed by the accused against the trial court verdict, upheld the life sentence of Sanjay Thakkar, Bahadur Singh Chauhan, Sanabhai Baria and Dinesh Rajbhar. The judges relied on the statements of four injured witnesses, all workers of the Best Bakery, who had identified the accused and said they were present at the place of the incident armed with swords and other lethal weapons during the post-Godhra communal riots. The bench, however, overturned the trial court order and acquitted Rajubhai Baria, Pankaj Goasvi, Jagdish Rajput, Suresh, alias Lalo Devjibhai Vasava, and Shailesh Tadvi, saying there was no evidence against them. The judges said none of the witnesses had attributed any role to them during the riots. The division bench had commenced day-to-day hearing in the appeals filed by the nine convicted accused in March this year. On March 1, 2002, two days after the Godhra carnage, a mob had attacked Best Bakery in Vadodara, looting and burning it down and killing 14 people. The mob targeted the Muslims inside, including the Sheikh family which ran the bakery. Three Hindu workers employed at the bakery were also killed. Of the 17 accused, nine were convicted and sentenced to life by a special court in Mumbai in 2006. The nine had then approached the High Court challenging the order. In a twist to the case, one of the witnesses Yasmeen Shaikh had filed a petition in the High Court stating she was “lured and misguided” into giving false testimony against the 17 accused by social activist Teesta Setalvad. She sought her evidence to be recorded again at the stage of appeal. The court had, however, said it would first hear and decide on the appeals filed by the convicts. Teesta too later filed an intervening application asking the court to hear her view while deciding the appeals. The court will pronounce its order on the applications filed by Shaikh and Setalvad later. — PTI

SC notice to Centre on BSF excesses
New Delhi, July 9 A Bench comprising Justices BS Chauhan and Swatanter Kumar passed the order on a PIL by a Kolkata-based NGO, Banglar Manabadhikar Suraksha Manch, contending that BSF personnel had committed more than 200 such excesses during 2005-11 in the border areas of West Bengal alone. These cases were never probed properly despite the fact that in most of the cases complainants had witnessed the victims being picked by BSF personnel, it said. The state police had booked the victims instead of the BSF personnel and subsequently closed the cases, the PIL said.

Scrutinise Pranab’s nomination afresh, Team Sangma urges EC
New Delhi, July 9 Sangma's representatives Subramanian Swamy and Satpal Jain today submitted a petition to the Election Commission demanding that Mukherjee's nomination be scrutinised afresh as the returning officer had failed to address the objections raised by them. Mukherjee's election agent Parliamentary Affairs Minister PK Bansal, however, shrugged off their allegations. "They should utilise their energy for campaigning for the presidential election. There is no merit in their complaint," he remarked. Stating that they would decide on their next move after receiving a response from the Election Commission, Swamy and Jain said the option of filing an election petition in the Supreme Court was very much on the table. "Let the EC's order come first. As soon as its decision comes, we will take a view on our next step... all options are open," they said. According to Swamy, returning officer VK Agnihotri had failed to address the issue of the genuineness of Mukherjee's resignation letter as the chairman of the Kolkata-based Indian Statistical Institute (ISI), its validity and acceptance. Team Sangma has charged that Mukherjee was holding an office of profit when he filed his nomination papers and that the resignation submitted by him subsequently was "manufactured" at the last minute when the Opposition raised the issue. Swamy and Jain said they had approached the Election Commission as it has the power to supervise the presidential poll and cited the recent instance in Jharkhand when the commission had cancelled the Rajya Sabha election following complaints. While Team Sangma is spoiling for a fight, Mukehrjee's poll managers are going full steam ahead with their arrangements for the July 19 election. While Mukherjee has been travelling to various state capitals to seek support for his candidature, Bansal has held a series of meetings with party leaders from 14 states to brief them about the election procedures. A dummy ballot paper has been prepared to demonstrate how the legislators should vote so as to avoid any errors. Congress president Sonia Gandhi will host a dinner for party MPs and UPA allies on July 18 as a show of strength.

New Delhi, July 9 Passenger V Radhakrishnan was quoted as saying they were told “not to move around, to fasten the seat belt and be prepared for anything” as the plane was making a landing in emergency conditions. “Fortunately, nothing happened,” he added. The 12-hour wait at Nawabshah was a long one. The small airport had no facilities. Even though the flight landed safely, people were in panic and when there was a delay in arrival of rescue aircraft, a few passengers also got angry. Jayshree Purohit, who was travelling with her 19-year-old son Akshay, said since the flight was to land at 5.15 am in Delhi, there was no food and just some water till the relief aircraft from Delhi landed there. “They served us tea in the morning and they were very nice and helpful to us,” she said. At Nawabshah Airport, the Pakistani authorities offered to allow the passengers to disembark and use the Nawabshah airport lounges, but the Captain preferred to have them remain on board. Show-cause notice to UT DC for non-compliance of orders

Chandigarh, July 9 In a first, the State Commission has directed the issuance of a show-cause notice to UT Deputy Commissioner-cum-Estate Officer Brajendra Singh for imprisonment or penalty proceedings, after refusing to grant additional time for compliance with the order. The notice to the IAS officer has been directed to be issued under Section 27 of the Consumer Protection Act, 1986, after the commission doubted the bona fides of the administration to comply with the orders. The section makes it clear that non-compliance “shall be punishable with imprisonment for a term which shall not be less than one month, but which may extend to three years, or with fine which shall not be less than Rs 2,000, but which may extend to Rs 10,000, or with both”. The development is significant as the administration in the case has turned into a compulsive litigant; and has been harassing a lawyer and his family by filing one plea after another, since it first lost a legal battle in 1999. The original bidder, Harinder Singh Giani, did not live long enough to see justice come his way. His son, Harpreet Singh Giani, is now pursuing the case. Taking up the matter, the State Commission, comprising President Justice Sham Sunder and Member Neena Sandhu, also fixed August 27 as the next date of hearing. In its detailed order, the commission minced no words to observe: “The matter has been lingering since 1999, but the decree holders/complainants (the Giani family) have not been able to reap the fruits of the order, which was originally passed in the complaint, till date.” “No ground is made out for the grant of more time to the opposite parties/judgment debtors (UT Administration and another) to comply with the order dated May 21, 2012. Had their intention been bona fide, they would have certainly complied with the order dated May 21, 2012, within the stipulated period. Further adjournment to the opposite parties/judgment debtors, therefore, being unjustified, is declined,” the order stated. The commission had, on May 21, ordered: “The judgment debtors (Administration and Estate Officer) are held liable to pay a sum of Rs 13,85,553 in addition to the amount already deposited by them….” The amount, along with Rs 16,47,860, already deposited by the administration was also directed to be released after the expiry of the appeal period. Harinder Singh Giani had bid for a 1,000 square yard commercial plot in Sector 40-D in 1994. The plot was for the construction of a basement and a three-floor showroom. But Giani soon realised that the possession of the plot, originally auctioned to him, had “already been auctioned to some other person”. The administration tried allotting an alternative plot to him on February 28, 1994. But Giani found that the approach road, sewerage connection, and drinking water facilities had not been provided for the alternative plot that he had been allotted. Left with no alternative, Giani family moved the UT Consumer Disputes Redressal Commission by filing a complaint in 1998. The commission, on May 28, 1999, ordered the administration to provide all basic amenities. The UT Chief Engineer or his immediate subordinate was asked to certify that the amenities have been provided and the certificate date was to be considered the auction date. |

Avalanche-control structures being built on access road

Manali, July 9 There are as many as 13 avalanche-prone sites on the access road from Solang to the tunnel’s south portal at Dhundi. Avalanche mitigation is a priority to prevent the loss of life and equipment as well as damage to the road. As part of the project Snow and Avalanche Studies Establishment (SASE), a DRDO laboratory headquartered here, has designed several avalanche-control structures. These are being constructed by the Border Roads Organisation (BRO) that is responsible for the construction of the 8.82 km long tunnel and its access roads. The structures designed by the SASE include snow galleries, snow fences, snow bridges and snow nets. While a snow gallery, akin to a concrete roof over the road, deflects an avalanche away from the road, other structures prevent the snow mass from tumbling down the slope or break its flow. Depending upon site, different structures would be installed. There are some sites enroute that are highly avalanche-prone and witness some level of avalanche activity every year. One such site, where a snow gallery is being constructed, is located in a cloud burst zone and has a large catchment area of about 9 sq km. This coupled with geological factors and soft soil composition threw up a unique design challenge to cater for safe passage against snow avalanche debris as well as flash floods. The gallery is “closed box section”, something like a tunnel, with a length of 120 meters and a height of 5m. The length of the galleries being constructed range between 90-130m and are located at an altitude of 9,000-10,000 ft. Large areas in Himachal Pradesh as well as Jammu and Kashmir are prone to avalanches and landslides, hampering movement and posing a high risk to troops deployed there. After the 1999 Kargil conflict renewed focus on the operational preparedness in the northern sector, the SASE undertook several projects to map avalanche-prone sites as well as develop models to forecast and mitigate avalanches. |

Hold talks daily, HC tells AI management, pilots
New Delhi, July 9 Accepting the interim report filed by the conciliating officer about the progress of ongoing negotiations between the parties, Justice Reva Khetrapal directed the pilots and management officials to appear before the officer tomorrow. “It is directed that the conciliation process should take place on a day-to-day basis from tomorrow to enable the management to consider the issues pertaining to the pilots reinstatement (whose services were terminated due to their strike) and their salaries," the judge said. Seeking the final report from the conciliator after the talk between the parties, the court posted the matter for July 13 for further hearing. Following the management's assurance before the court to consider reinstatement of the 101 pilots whose services were terminated, the pilots, owing allegiance to the Indian Pilots Guild (IPG), had on July 3 called off their 58 day-old strike. Over 400 pilots had gone on strike on May 7 demanding better career progression. During the hearing, the judge disapproved the "stiff" stand taken by the airline management in expeditiously dealing with the demands of the pilots. "You are adopting a stiff stand...It matters to the employees (pilots) as they have not received their salary for months and the issue of pilots reinstatement is to be decided by you," the court observed. The court's remark came after the pilots alleged that the management has sought 10 days to hold talks with them before the conciliator and that it was not in a mood to resolve the issues at the earliest. — PTI |

The Global Retail Education and Training (GREAT) India is setting up the B-school in partnership with the Australian Retail College (ARC).
To begin with, it will offer intensive one-year full-time post-graduation programmes in retail management and retail entrepreneurship from September.
The B-school will come up on a six acre plot at Gundlapochampalli on the city outskirts. “We have set up this school with complete focus on retail in view of the vast growth potential in the retail sector,” said Rajendra Prasad Nadella, Chairman and Managing Director, GREAT.

Boy falls into borewell, rescued Ahmednagar, July 9 The incident took place when Manoj Anshabapu Ghorpade, who was playing near the open borewell on his family farm, around 42 kms from the district headquarters of Ahmednagar, fell into the borewell around 1.30 pm. According to the police, although the borewell was 250-foot-deep, the boy landed on a rock that was stuck in the borewell at around 35 feet from the surface. His mother saw him falling into the well and raised the alarm, following which his relatives and people in the village gathered. Shrirampur Sub-Divisional Officer (SDO) Suhas Mapari reached the site and coordinated the rescue operation. "There was some construction work going on nearby, from where a JCB machine was requisitioned for the rescue operation," Mapari said. A 40-foot-deep parallel tunnel was dug and the boy was pulled out from the borewell at 5.30 pm, he added. — PTI |
