Probe ordered into misuse of Gandhi samadhi's funds
New Delhi, August 5 Acting on a Public Interest Litigation (PIL) accusing the committee of misusing the samadhi's funds, a division bench of Chief Justice M K Sharma and Justice Sanjeev Khanna recently asked the Economic Offences Wing of the Delhi police to complete a probe into the matter within four weeks. The court's order came after the Comptroller and Auditor General (CAG) submitted its report in compliance with the court's earlier order in this regard. After examining the committee's accounts for 2005-2006, the CAG submitted a report to the bench with an observation that the samadhi's management had committed certain financial irregularities. According to the report, the committee produced a documentary film on Gandhi on the 50th anniversary of the setting up of the samadhi in 2001 for which an expenditure of Rs 8 lakh was incurred. The film has been lying with the committee for the past two years without being screened. The film was neither telecast on any of the channels nor was it distributed to foreign channels. The very purpose of production of the film was defeated, the report said. There was also an alleged discrepancy in the filling up of the post of secretary, which was done on an ad hoc basis. The assistant caretaker of the committee has been performing the duties of secretary and he has been drawing two salaries, the report said. "Men working on shoe racks have been hired on daily basis and their wages are paid from the committee counter. It (the committee) has not evolved any mechanism to hire daily wagers from a recognised agency and the number of workers has been increased but the reason behind this was not shown by the committee," the CAG report said. With regard to staff quarters in the samadhi's premises, the report said 14 of 21 staff quarters had been allotted and the rest were lying vacant which was under-utilisation of quarters. In April, the court had directed the CAG to inquire into the allegations after a PIL was filed by some employees of the committee through their lawyer R K Kapoor. They alleged that funds were misappropriated by the samadhi's management. |

Plot scam: BJP guns for Sheila govt
New Delhi, August 5 The demonstrators wanted to submit a memorandum incorporating the aforesaid demand to the central home minister, but the heavy police presence did not allow them to go further. The police resorted to water cannons and arrested the demonstrators. The agitated workers burnt the effigy of Chief Minister Sheila Dikshit and raised slogans against the Congress government. Addressing the demonstrators, deputy leader of the opposition in Lok Sabha Prof. Vijay Kumar Malhotra and Pradesh president Harsh Vardhan announced that until the anti-poor,
anti-jhuggi jhompri and anti-people Sheila government is not dismissed, the BJP will not take rest. Prof. Malhotra announced that the BJP will demand enquiry into this scam on the very first day of the monsoon session of Parliament beginning after five days. "We shall take rest only after getting all the tainted Congress leaders punished," he said. Prof. Malhotra alleged that efforts were being made by senior Congress leaders to protect those who have earned crores of rupees by grabbing the plots of the
J.J. dwellers of Delhi. The BJP leaders alleged that the CBI was under the direct control of central government, as such no one trusted the enquiry conducted by it. "This is the CBI at whose instance the Bofors gun middleman Quattrochi was allowed to escape and he was also allowed to withdraw crores of rupees from his bank accounts," he said. Harsh Vardhan said for the truth to emerge, the scam should be enquired into by a retired judge of Supreme Court within a fixed timeframe.

Penalty imposed on lawyer in accident claim case
New Delhi, August 5 Justice Pradeep Nandrajog imposed the penalty on advocate N K Shangle for misguiding his client Puran Chand and taking a stand that went against Chand's interests in the case. Shangle was asked to deposit the amount with the High Court Lawyers' Welfare Fund within two weeks. The court also reversed an April 2004 order of the Motor Accident Claims Tribunal (MACT) that directed an insurance company to pay the parents of a motor accident victim Rs 2 lakh and later recover the amount from vehicle-owner Chand. "I am left with no option but to hold that Puran Chand should not be slapped with the penalty due to unethical practice adopted by the counsel," the judge said in a recent order. Shangle, who was representing the national insurance company in a motor accident claim case, filed an affidavit saying the company was not liable to pay the claim of the victim pursuant to the vehicle's insurance policy as the driver possessed a fake driving licence. At the same time, Shangle accepted the brief of the vehicle owner and took the same stand, without realising that there was a conflict of interest between the owner of the vehicle and the insurers, the order said. Little did the counsel realise that representing the owner, he could not have adopted the defence predicted by the insurance company. He also led evidence to prove that the driver had a fake licence, meaning thereby, he led his client namely vehicle owner into an abyss, the court observed. A 24-year-old man was killed five years ago under the wheels of Chand's truck, which was being driven by Gufran. Acting on a petition filed by the victim's parents who claimed Rs 10 lakh as compensation from the truck owner, the MACT in April 2004 had directed the insurance company to pay Rs 2 lakh to the parents and later recover this amount from Chand. Chand had approached the High Court in 2005 to challenge the MACT order. |

Chargesheet filed for betting
New Delhi, August 5 In their chargesheet filed in the court of additional chief metropolitan magistrate M C Gupta recently, the police have invoked various provisions of the Delhi Police Gambling Act against Rajesh Sharma, Manoj Kumar and Gaurav. According to police, the three were arrested from Rohini in northwest Delhi on April 9 during a raid. A special team was constituted by the crime branch after it received information that three were allegedly involved in illegal betting on the World Cup super eight match between New Zealand and Ireland in Georgetown, Guyana. A decoy customer was sent to an apartment in Rohini from where the accused allegedly operated their racket. He was allegedly promised Rs 4,000 on an investment of Rs 2,000 if New Zealand scored 244 runs in the full 50 overs. The customer was also offered a slip with the promise by the accused. The crime branch team, on getting a signal from the decoy customer, raided the premises and arrested the three men. According to the chargesheet, police found a laptop, a TV set, four mobile phones, a calculator and a printer in their possession. The accused were released on

Malhotra still at large
New Delhi, August 5 Several teams of CBI officials conducted searches across Delhi and other areas outside the national Capital to nab Malhotra who has been evading questioning despite being summoned by the agency to appear before it. The agency had yesterday secured a non-bailable warrant from a city court against the contractor. Special judge S K Kaushik also asked the investigating agency to produce him before the court on or before August 14. Malhotra is accused of having entered into a criminal conspiracy with five DDA officials and fraudulently acquiring plots in Dhirpur area that were meant for resettlement of slum dwellers during 2000-02. The CBI was examining voluminous documents recovered during raids at Malhotra's residential premises in Mukherjee Nagar locality and other places here, sources said. Searches at the residential premises of Malhotra have revealed that he was in possession of 17 luxury cars having VIP number plates, Rs 17 lakh cash and about seven kg of gold.

Dreaded criminals arrested
New Delhi, August 5 The police had received an information that Naga Singh, dreaded criminal of Bihar allegedly involved in murder, jail break, encounters with police, attempt to murder, kidnapping, extortion and robbery, has shifted base to Delhi. Following a tip-off that the alleged criminal would come near Pankha road with his accomplices, the police arrested both the dreaded criminals after a brief encounter yesterday. A .38 English revolver with 2 live and 4 fired cartridges and a country-made pistol with one fired and two live cartridges were allegedly recovered from them. |

Five held for highway robberies
New Delhi, August 5 The gang was arrested when they were allegedly going to loot people on Pusta Road. Five people have been arrested in this regard. Acting on secret information, one police officer overheard the robbers while they were planning to commit an offence. A raid was then conducted and five alleged gang members were arrested. According to the police, the female gang member used to take a lift in any of the cars that crossed Pusta Road and then stopped it at some isolated place. Meanwhile, the rest of the gang would follow the car and robbed the owner. Three button-actuated knives and one Maruti van were recovered from them. |

‘Battered women may seek relief’
New Delhi, August 5 Deciding on a complaint that contained allegations of violations committed prior to the law coming into force on October 26 last year, Bhatia said, "The Act sought the enforcement of existing rights that are guaranteed by the law of the land." Referring to the objects of the Protection of Women from Domestic Violence Act, she said the statute was enacted while keeping in view rights guaranteed under article 14 (right to equality), article 15 (prohibition of discrimination) and article 21 (right to life and liberty) of the constitution. "Thus the object of the Act is to further guarantees provided in the constitution against discrimination to women, especially within the domestic fold, by providing an answer through the civil law," Bhatia observed in a recent order. Mentioning the objectives set out in the Act, the court said the statute was promulgated to protect women from being victims of domestic violence and to prevent such incidents. The court said the Act was enacted because though instances of domestic violence were prevalent, they were not addressed except under section 498a (subjecting a woman to cruelty) of the IPC, which dealt with a specific kind of cruelty and was inadequate to tackle the rest of the issues. |
4 kanwariyas electrocuted
Ghaziabad, August 5 The four, hailing from Modinagar, were travelling by a mini-truck when the wires of the music system carried by them, touched an electric wire near Mandavar village, district magistrate Ajay Kumat Shukla said. He said the entire route of the Yatra has been divided into sectors and police officials have been made in charge of it. The deceased have been identified as Ajay Saini, Mukesh, Bhagirath Sharma and Neetu.

According to NNS chairman Kesar Singh Gupta, this year the expo will focus on processing technologies, marketing strategies and latest innovations in agriculture and food-based industries. Delhi govt asked for mobility plan
New Delhi, August 5 "The Delhi government has proposed a number of roadways projects. Easing traffic flow is necessary but at the same time, the city needs to have a comprehensive mobility plan," N Venugopalan, deputy secretary of urban development ministry, said in a letter to the Delhi government. The observations came in the wake of the state government seeking funds over Rs 119.41 crore under the Centre's Jawaharlal Nehru National Urban Renewal Mission (JNNURM) for a canal not being used in Geeta Colony in east Delhi. In April, the government had sought nearly Rs 431.57 crore for its three projects - a bridge across river Yamuna near Geeta Colony (Rs 195 crore), grade separator at Mukarba Chowk Flyover (Rs 119.76 crore) and a flyover at Naraina T-point at Ring Road (Rs 117.81 crore). The Central Public Works Department has already given green signal to these projects after technical committee of the DDA and all other local bodies cleared them.The Centre also seems to be clueless about the number of projects the Capital city is executing as well as those in the pipeline for which it is seeking funds under the Commonwealth Games and Urban Rural Mission categories. — PTI |

Art Alive Gallery opens the new season with 'Generation Next', a show featuring works of 35 young artists from all over the country, from August 6 to 9 at the Visual Arts Gallery, India Habitat Centre here. The artists, from different backgrounds and institutions, however are connected by their respective experimental spirit and freshness of vision. The exhibition traces the new trends in the Indian art scene. While newness in most other fields is defined in terms of cutting edge technology, new trends in contemporary Indian art defy such an interpretation. Most artists in this show adhere to the two-dimensional format and the medium of easel painting while a few have abandoned it for an alternative form of image making stitching cloth on cloth and using natural dyes. Both forms of handling the medium commit them to a "pictorialism" of sorts, within which they work out the complexities of image making itself. Sporting certain playful dalliance with visual narratives, cryptic painted metaphors or even minimalist abstractions, they seem to argue that the medium of oil or acrylic has not exhausted.
