PIL challenges appointment of CPS, PSs

Chandigarh, January 18 In his writ, Mr Parma Nand of Panchkula has alleged that the appointments were contrary to the provisions of the Constitution and hence illegal. He has also stated that by appointing the party MLAs to the non-existing posts of CPS and PS, the government was only trying to give ministerial perks to the MLAs through the back door. Enjoying all the perks of ministers, these CPS and PS would only prove to be a drain on the state exchequer, the petition says. Interestingly, the petitioner has also prayed for action against Chief Minister Hooda for defying the Constitution and the oath of office and secrecy administered to him. Stating that the 91st amendment to the Constitution, which restricts the number of ministers to not more than 15 per cent of the total strength of the legislature, has been blatantly flouted by the Hooda government by appointing the MLAs as CPS and PC, the petitioner has also pointed out that there is no legal sanction to the posts. Mr Parma Nand has further alleged that by taking such a decision, the Chief Minister and his ministerial colleagues would be violating the oath of office and secrecy taken by them at the time of their swearing in as now all important and confidential files would be accessed by the CPS and PS. The PIL seeks directions to disqualify the legislators appointed as the CPS and PS from the membership of the Vidhan Sabha for holding an office of profit under the government, stop payment of salaries, allowances and other perks, etc to them till a decision on the petition is taken and to recover such salaries, allowances, etc, if already made. Apart from Chief Minister Hooda, other respondents include CPS Dharam Vir, Mr Dilu Ram, Mr Rao Dan Singh, Dr Krishna Pandit, Mr Param Vir Singh, Mr Ram Kishan and Mr Anil Thakkar, all PSs. Today, the Division Bench comprising Chief Justice Mr Justice D.K. Jain and Mr Justice Surya Kant adjourned the matter to February 1. The Bench ordered that the PIL would be heard with pending writs challenging similar appointments in Punjab. Human rights panel
The Haryana Government on Wednesday categorically told the High Court that it had no intention of setting up a human rights commission for the state. This stand was conveyed by counsel for the government during resumed hearing of a bunch of PILs seeking directions to the respondents, including the Haryana Government, to set up a human rights commission for the state. Among others, petitions have been filed by the Peoples Union for Civil Liberties (PUCL), Panchkula, through its president, Mr Ujjal Singh Sahni, Mr Naresh Kumar Kadyan and Mr H.C. Arora. The Bench comprising Chief Justice Mr Justice D.K. Jain and Mr Justice Surya Kant later adjourned the matter to April 5 for final arguments. |
Frost damages vegetable crops
Hisar, January 18 According to official estimates, up to 75 per cent of mustard crop has been destroyed due to the chilly weather. Frost has also caused extensive damage to potato, tomato, brinjal, chilli and castor crops grown in these areas, besides suppressing growth of gram plants. Affected farmers from various parts of the district are visiting the office of the Deputy Commissioner and officials concerned with requests for compensation. On the other hand, Agriculture officials advise the farmers to get their crops insured to get substantial amount in the event of such a situation. Deputy Director (Agriculture) Dr Sultan Singh maintained that the farmers who had taken crop loan could avail themselves of the benefit of the insurance scheme till January 31 by submitting their consent with their bank authorities. He said mustard, castor and vegetable crops in Balsamand, Barwala, Uklana, Hansi and Adampur areas of the district had suffered widespread damage, adding that of the 72,000 hectares under mustard cultivation in the district, timely sown mustard was grown on 48,000 hectares. The Deputy Director said the situation was being reviewed regularly and the higher authorities had been informed about the extent of damage to the crops. He, however, emphasized that instead of depending upon the relief sanctioned by the government, the farmers should get their crops insured for a reasonable amount in the event of damage. Meanwhile, minimum temperature in the region has risen considerably in the past few days, the unexpected occurrence of fog this morning surprised the local residents as well as Weather officials. Dr V.U.M.Rao, Head of the Department of Agricultural Meteorology at Haryana Agriculture University (HAU) here, said that according to predictions received at their end, cloudy weather would persist during the coming few days in the district and nearby areas. “A sharp increase has been registered in the minimum temperatures during the month,” he said, adding that in around 10 days, the minimum temperature had risen from -3.5 degrees Celsius to +10 degrees celsius. According to agricultural experts, if the sudden rise in temperature persists, it can have an adverse impact on wheat and barley crops. |
Quack booked for molesting patient
Rohtak, January 18 She went back to Delhi and narrated her tale to her husband who came to Sampla last evening and informed his father-in-law of the quack’s alleged behaviour. He and some other relatives went to the clinic where a big crowd gathered on hearing of the quack’s misdeed. The angry crowd roughed him up and set fire to his motor cycle. The crowd also damaged his clinic. Later, the police dispersed the crowd and arrested the quack. A case under Section 354, IPC, has been registered against him. |
e-Disha centres to be functional by February-end
Rohtak, January 18 All government departments in each district will be inter-connected through a new network called the D-Net. It will facilitate the general public in securing information from various departments at the district and even lower levels via an intra-district communication backbone, the sources said. The
e-Disha is an IT driven electronic interface between the government and the public. The application software for various public services has been developed by
NIC-HRSC as a citizen interface on D-Net in collaboration with the Department of IT. The NIC centres at district headquarters will act as control and management centres for district networks. The sources said these centres would be located in the Mini Secretariats, each having around 10 public service counters. Initially the centres would provide services for preparing driving licences, vehicle registration, including the transfer of vehicles and issue of duplicate registration certificates, passport application acceptance and providing copies of revenue documents. In addition, these centres will also issue domiciles, income, SC, OBC, and certificates for the physically challenged. The application forms for old age pension, widow pension, handicapped pension, financial aid to destitute children, scholarships for the handicapped children, family benefit scheme, Kanyadan scheme, widow daughter marriage, Indira Awas Yojna would be available. The applications for all these will be accepted at these centres. Besides, services related to the issuance of arms licences, house tax, birth and death registration and issuing these certificates for district headquarters municipal council will also be provided at these centres. On the receiving applications the applicants will be issued a receipt. The data will be transferred to the department concerned for further necessary action. The Deputy Commissioners will be the heads of these centres and the City Magistrates or one HCS Officer will be appointed as Chief Executive Officer of these centres. To begin with these centres will function in a single shift from 9 a m to 5 p m from Monday to Saturday. Depending upon the workload the centres may be functional from 8 am to 8pm in two shifts. |

Two get life term for murder
Bhiwani, January 18 Manphool of Legha Hetwan village in the district was posted as warden in the Bhiwani jail. During the night of August 24, 2001, four youths forcibly entered his house and shot him dead. The son of the victim, Prem Kumar, had put allegations on the then jail superintendent, Raj Kumar Gupta, of releasing few accused on the basis of fake papers. He had said it was the main cause of differences between his father and the superintendent, who had got transferred the former to Jind. The Tosham police had registered a case of murder against Hansa of Charkhi, Sanjay of Rewari Khera, jail superintendent Raj Kumar Gupta, Balraj Singh of Charkhi, Devi Ram and Ajit of Dhanana village. The court has sentenced Hansa and Sanjay to life imprisonment. |
Anti-encroachment drive: 200 served notices
Bhiwani, January 18 According to sources, the Board, viewing illegal occupancy of space around the houses by local residents, had taken stringent measures and went to the court where it got instructions of taking immediate action against such residents. The Board has served notices to the occupants instructing to remove encroachment within 15 days. The sources said more residents who have encroached upon government space would be served notice soon. The sources added that the Board had warned such occupants to remove the encroachments but all in vain. Several occupants have converted the open space outside their houses into parking lots by erecting boundary walls and some have constructed garage to park their vehicles violating the rules. |
HUDA land grabbed
Sonepat, January 18 According to a report, they have also named the colony as Pushpender Nagar after the illegal possession of the land. The dwellers have occupied the land at the behest of Mrs Pushpinder Kaur president women wing of the Bharatiya Kisan Union. A police party was sent there and the officials asked them to vacant the land. Mrs Pushpinder Kaur warned that she would start indefinite fast if the slum dwellers were evicted from the site by the administration. This has cause tension in the area. Meanwhile, the Deputy Commissioner, Ms Neerja Shekhar categorically stated that the slum dwellers had illegal occupied the HUDA land and they would be evicted by the district and police administration. |
On-line land records service
inaugurated
Rewari, January 18 With this Rewari, after Yamunanagar, has become the second district in the state to provide on-line land records service. Besides, the records of the Kosli, Bawal and Dharuhera areas of the district are also expected to become on-line by February 15. Addressing a gathering of farmers, advocates, district officials and others on the occasion, Captain Yadav said the computerisation of land records that was in progress in all remaining 17 districts of the state would be accomplished by February end. He said the computerisation of land records was a hundred per cent centrally-sponsored scheme and was being implemented under the technical guidance of the National Informatics Centre (NIC ). He further said the NIC had developed a new software called Haryana Land Records Information System which was capable of doing on-line mutations and automatic updation of "Jamabandis". Simultaneously the software was also capable of having links with the Haryana Registration Information System (HARIS) software which was being used for the registration of documents. |

Karnal, January 18 The district police today booked the three accused on Sanjiv’s complaint. The police said Sanjiv, in his complaint, said his brother Vikash had an affair with a girl of the accused family. Earlier a report was registered in the case at Civil Lines police station. As the police failed to know the whereabouts of Vikash, an FIR of kidnapping under Section 365 of the IPC was filed against the girl, her brother and their father today.

1 killed in mishap
Jhajjar, January 18 According to information the deceased, identified as Darshan of Daboda village, and two others boarded the vehicle, at Bahadurgarh. The driver was in an inebriated condition. The vehicle overturned when it was about to reach the village. While one of the travellers died after felling the three wheeler, two others sustained injuries and were admitted to hospital in Bahadurgarh.

Mentally challenged youth climbs water tank
Ambala, January 18 Eye-witnesses claimed that the youth threw an envelope into the water tank following which the water supply from the tank was stopped. After much persuasion, the youth came down from the water tank. He was questioned by the RPF personnel. The water from the tank was drained this morning and fresh water was pumped into the water tank. |

Ambala, January 18 In another incident, two scooters and a motor cycle were gutted in a fire at a house in New Janakpuri area. Apparently, thieves tried to enter the residence of Mr Gupta. When they failed to enter, they set afire two scooters and a motor cycle. |
