Outburst against EC proves costly for Saptharishi
Sent back to West Bengal cadre
Tribune News Service

New Delhi, June 24
Senior IAS officer L.V. Saptharishi, who created a flutter with his outburst against the Election Commissioners of making castiest remarks, was today repatriated to his parent West Bengal cadre, a month before his retirement.

The decision to repatriate Saptharishi, a 1969 batch IAS officer, was taken at a meeting of the Appointment’s Committee of Cabinet chaired by the Prime Minister Mr Manmohan Singh here late last night, an official spokesman said here. The senior IAS Officer, who was serving as chairman of the Centre for Advancement of Peoples Action and Rural Technology (CAPART), would now have to report to the West Bengal Government for further posting. He retires on July 31.

Mr Saptharishi, who was the Election Commission’s observer in Bihar during the Lok Sabha poll last year, created a controversy last month when he accused the Election Commissioners Mr B B Tandon and Mr N. Gopalaswamy, of attempting to countermand the Lok Sabha poll in the Lalu Prasad’s Lok Sabha constituency Chapra in Bihar and making castiest remarks against Yadavs.

The Election Commission had said it was below its dignity to react to “surrilous and baseless” allegations.

In May, the former Bihar poll observer had accused Mr Tandon and the Election Commissioner N. Gopalaswami of making casteist remarks. He had earlier written a letter to the Law Minister, Mr H.R. Bhardwaj, criticising the Election Commission’s decision to countermand the Lok Sabha elections in Chhapra last year.

Mr Saptharishi claimed that Mr Tandon made the remarks at a meeting of the Election Commission last May where he was called to submit his report on the Chapra elections.

The Ministry of Personnel had issued a show-cause notice to him for alleged violation of the Civil Service (Conduct) rules seeking an explanation for his attack on the two Election Commissioners.

The RJD chief, Mr Lalu Prasad Yadav had used the allegations levelled by the senior IAS officer to malign the election Commission and Bihar poll results.

There were reports that Mr Saptharishi had levelled these allegations at the behest of the RJD, as he had been assured of an extension in the post of CAPART, Director General, apex body for monitoring the activities of the NGOs in the country.

Left unhappy with govt, meets tomorrow
Tribune News Service

New Delhi, June 24
The Left parties are planning to send out a “strong political message” to the Congress-led UPA government expressing their dissatisfaction with the functioning of the government and some of its economic policy initiatives.

The leaders of the four Left parties would meet here on June 26 and decide on the “nature” of the political message to be given to the UPA, which is supported by the Left parties from outside.

CPI national secretary D. Raja told The Tribune that the Left parties were not satisfied with the government’s decision to go ahead with the disinvestment of BHEL and the oil price hike.

“We are meeting on June 26 and would send out “a strong political message” to the government,” he said.

When asked whether that would mean that the Left parties would reconsider its support to the UPA, he said “first we have meet and decide. How can I tell you, what are the option that we are considering.”

CPM politburo member S. Ramachandran Pillai had indicated that the Left parties could consider boycott of the UPA-Left Coordination Committee meeting as it had lost its meaning with the government going ahead with its decision despite strong opposition being expressed by us.

The Left leaders said these coordination meeting had become a farce as the government continues with its own economic agenda despite our opposition.

They said the move to disinvest 10 per cent stake in the profit making BHEL “is a clear violation of the CMP, on whose basis the Left parties extended their support.”

“We are not satisfied with the government’s decision on disinvestment of profit-making PSU’s and the new interpretation CMP is wrong,” they added.

Boycott of the UPA Coordination Committee meeting could be first in a series of steps that the Left parties would take to confront the government as it has numbers by its side. Unhappy with the oil price hike, they have already given a call for countrywide protest on July 28.

Although Congress leaders attribute the upcoming Assembly elections in West Bengal and Kerala to the Left’s aggressive position, the Communists said they did not agree with this view.

“There is no need for us to worry about the state elections. In both states we are in a comfortable position,” Mr Pillai said. Meanwhile, senior CPI leader Sehba Farooqui has quit the party and joined the CPM alleging that the CPI had become “trade-union centric” and issues concerning women were being marginalised.

Mr Raja, however, sought to downplay the issue by stating that she had resigned on “personal ground” and her leaving the party would not affect the CPI.

He, however, stated that Ms Farooqui did not raise the issue, which she was pointing out, at the CPI party congress in Chandigarh.

Ms Farooqui, a central council member, was party to the CPI programme which was adopted at the congress and to change the stance now is not done and is only an attempt to justify her quitting.

Ms Farooqui, 45, daughter-in-law of late CPI veteran said the issue was not a symbolic representation (for women in the CPI’s central council). The party should have taken up the women’s issues and given a clear-cut direction in this regard.

Unless the party takes up women’s issues on agenda, there cannot be any fruitful results, she said claiming that the party had not passed any resolution on women at the party’s congress.

Govt to plug loopholes in FCRA
Tribune News Service

New Delhi, June 24
To ensure that foreign funds received by NGOs are not used for purposes other than those specifically stated by fund-receiving organisations, the Centre has decided to replace or make amendments to the Foreign Contribution (Regulation) Act (FCRA), 1976.

Announcing this, while inaugurating a two-day seminar on FCRA here, Union Home Minister Shivraj Patil said the main emphasis in the amended Act would be on strengthening the monitoring of receipt, utilisation and accounting of foreign contributions by the associations.

Another important feature of the amendment would be establishing de-centralised administrative structure for implementation of the new law with basic purpose of putting in place a more user-friendly and accessible administrative machinery, Mr Patil said.

The grievance-redressal mechanism was also proposed to be strengthened, he added.

The seminar was jointly organised by the Ministry of Home Affairs and the Institute of Chartered Accountants of India.

Once the Bill got Cabinet's approval and was introduced in the Parliament, it might be referred to the Standing Committee, which would deliberate on the Bill and might also seek the views of the public in this regard, the minister added.

"The intention is that the new law on the subject should facilitate rather than obstruct the receipt and utilisation of foreign funds," Mr Patil said.

The Home Minister called upon the participants in the seminar to freely express their views and contribute towards improving the Bill.

In his address, Union Home Secretary V. K. Duggal said sometimes, it was found that as seen from FCRA angle, NGOs had committed some procedural lapses.

"This may be due to the lack of proper understanding and familiarity with the Act and rules," he said and expressed hope that the deliberations on various issues pertaining to FCRA would create the desired awareness.

Rape case divides community on Shariat law
Tribune News Service

Lucknow, June 24
The Imrana rape case has virtually divided the community in Muzaffarnagar between the pro-Shariat group baying for Imrana’s blood and those against caste panchayat’s interference with individual affairs.

This is the assessment of a nine–member fact-finding team of women activists that visited Imrana’s marital town Charthwal as well as her natal home Kukargandi near Grain Mandi in Muzaffarnagar. The team spoke to Imrana, her husband Noor Mohammad, other family members, neighbours, as well as the opinion makers in both the places.

Imrana, mother of five, had challenged the community panchayat’s interpretation of Shariat law by which she had been evicted from her marital home for a period of seven months and 10days in order to prove her chastity after being raped by her father-in-law. She had also refused to accept the panchayat decision to acknowledge her rickshaw -puller husband as her son.

Imrana accepted the panchayat judgment and moved to her natal home . Soon support flowed from the National Women’s Commission and various women’s organizations and she demanded justice.

A member of the team Naish Hasan said it was only after our involvement her own people realized that she had been wronged.

Husband Noor Mohammad, who is now by her side. He was angry with the father, who, he said, had earlier misbehaved with two of his sisters-in-law. Since then both his brothers had moved out.

Pradhan of Imrana’s natal village, Om Prakash Gupta, told the team that she had been wronged .

At Charthwal, her marital town, the community wants to teach Imrana a lesson for publicly charging her father-in-law with rape .The team was surrounded by hostile crowds.

The fact-finding team included Naheed Taban and Kishwar from Muslim Womens’ Forum, New Delhi, Rehana from Astitiva, Saharanpur, Shahnaz, Richa, Suresho and Mr Tiwari from Disha, Saharanpur and Naish Hasan and Shakeela from Tahreek, Lucknow.

Revival of rebel MLAs’ plea baffles BSP
Tribune News Service

Lucknow, June 24
The Uttar Pradesh Assembly’s decision to take up the petition of 13 rebel BSP MLAs who had first crossed over to join hands with Mr Mulayam Singh Yadav has left even the BSP baffled.

Senior BSP leaders were in consultation today trying to arrive at the motive of the current Speaker, Mata Prasad Pandey’s move to revive BSP leader in the Assembly Swami Prasad Maurya’s original petition seeking disqualification of the rebel MLAs filed in September 2003.

BSP state president Barkhu Ram Verma said: “What can we say; ostensibly the Speaker has taken up the case on the request of the rebel members who want the matter to be decided without further delay”. As such the Speaker would hear the petition on July 1.

What is causing anxiety is the timing of the revival of the petition. The Lucknow Bench of the Allahabad High Court, which had got moving on the case just before the summer break, had fixed July 5 as the next date of hearing. After constant prodding, 30 of the 40 rebel MLAs had already filed their response in the court.

Analysing the case from the legal point of view, a senior advocate with the high court, on condition of anonymity pointed out that the motive of the Speaker on both occasions had been identical – to cause delay in the case.

It was only to keep matters hanging that the then Speaker, Mr Keshrinath Tripathi, had decided not to take up the petition seeking to disqualify the MLAs on the plea that a case had been filed in the high court.

Now 20 months later, the Speaker, Mata Prasad Pandey, has decided to take up the matter when it seems to have reached a decisive stage in the high court.

The revision came in response to the request of two BSP-turned-SP MLAs to speed up proceedings as the inordinate delay, according to them, was causing confusion in their respective constituencies. They are Minister of Programme Implementation Veerendra Singh Bundela and Minister of Transport Rajendra Singh Rana.

On the basis of this request, the Speaker revived the petition of all 13 MLAs and notices have been sent to them to file their replies by 30 July.

On August 26, 2003, these 13 MLAs had approached the then Governor Vishnu Kant Shastri expressing their willingness to be a breakaway group of the Bahujan Samaj Party on condition of being recognised as a separate group in the House. Later, 27 other BSP MLAs followed suit to formed a group and merged it with the Samajwadi Party.

Reacting to their strength falling from 109 to 69 in the Vidhan Sabha, BSP leader in the House Swami Prasad Maurya had approached the high court against all 40 defectors.

BJP cautions Sinha against attacking Munda govt

New Delhi, June 24
In a clear disapproval of his open attack on the party-led Jharkhand Government, BJP today made it clear to Yashwant Sinha that he should raise issues within the party forum and not air them through media.

Notwithstanding the party’s caution, Mr Sinha insisted today that he was compelled to raise the issue in public as he felt it was his duty to do it.

Embarrassed over his surprise attack on Chief Minister Arjun Munda charging his government with corruption, which had come on top of his criticism of party president L.K. Advani during the recent leadership crisis, party spokesman Arun Jaitley said: “Mr Sinha is advised that if he has to raise any of these subjects, he should do so within the party forum and not through the media”.

Mr Jaitley’s remarks came after Advani’s discussions with general secretary Rajnath Singh, who had earlier talked to Mr Sinha on his criticism yesterday.

Mr Sinha had recently raised the hackles of the party when he had termed Mr Advani’s remarks on Jinnah as unnecessary and doubted whether he would be effective as the Leader of the Opposition in the Lok Sabha after his resignation as party president.

Mr Jaitley, who had also talked to Mr Sinha, said the former Minister should keep in mind that only two months ago Mr Munda had got a mandate to rule again.

The spokesman said Mr Sinha told the party that his intentions were to highlight some subjects to improve the performance of the party’s government in Jharkhand. — PTI

Be wary of US designs, CPM cautions PM
Tribune News Service

Hyderabad, June 24
The CPM wants Prime Minister Manmohan Singh to be wary of American designs during his visit there next month.

“We expect the Prime Minister to convey firmly our country’s stand on various issues, including the gas pipeline, arms sale and the FDI in retail sector,” party general secretary Prakash Karat said here yesterday.

Dubbing the American threat to Pakistan over the Iran-Pakistan-India gas pipline as blatant interference, Mr Karat said the government should not give in to the US pressure.

Apprehending that the US might offer F-16s and other weapons during the Prime Minister’s visit, he said the government, in its anxiety to please the superpower, should not fall for these sops as this would lead to an arms race in the region.

The CPM leader opposed the US pressure to open up the retail trade sector and allow multinationals like Wal-Mart, as such a move would deprive lakhs of small shopkeepers of livelihood. The Prime Minister should keep in mind that the retail sector was the second largest employment provider in India after agriculture, he cautioned.

Reiterating his party’s objection to the recent hike in petrol and diesel prices and the government’s decision to go ahead with disinvestment in Bhel, Mr Karat described the latter as the first instance of breach of trust and serious violation of the common minimum programme. The Left parties, which were meeting on the 26th of this month, would discuss these issues and chalk out the future course of action, he said.

“We will not be able to save the UPA government, if it continues with anti-people policies,” he said when asked whether the CPM would withdraw support to the government.

CPM ‘internal war’ hots up
Subhrangshu Gupta

Kolkata, June 24
The “internal war” within the CPM in West Bengal has now come to the surface over the reported ‘police excess’ during the June 19 municipal elections here and in the Salt Lake which the politburo leader, Mr Jyoti Basu, had openly criticised and protested against.

The CPM MP, Mr Amitava Nandi, his associate, Mr Joykrishna Ghosh, party workers and supporters had been beaten up by the police at a booth in ward No. 12 of the Salt Lake during the poll. This prompted a large number of CPM activists to openly revolt against Buddhadev Bhattacharjee’s handling of the police force. Mr Basu publicly demanded an independent probe into this ‘police excess’ which the Chief Minister, Mr Bhattacharjee, refused.

On the contrary, Mr Bhattacharjee defended the police action and gave a clean chit to it and lauded its chief for ‘excellent work’ during the poll which helped in holding free and fair election.

Interestingly, the party secretary, Mr Anil Biswas, who had been placed in the chair by Mr Basu himself, denying Mr Biman Bose’s claim (Biman Bose was the late Promode Dasgupta’s choice for the post), defended Mr Bhattacharjee. But apart from Mr Nandi and Mr Ghosh, the Sports Minister, Mr Subhash Chakrabarty, the senior secretariat Minister, Mr Binoy Konar, the CITU leader, Mr Chittabrata Majumdar and some cabinet ministers expressed their resentment against Mr Bhattacharjee’s ‘giving the police a free hand’.

Ministers clash over Bharat Nirman funding
Satish Mishra
Tribune News Service

New Delhi, June 24
Minister of Rural Development Raghuvansh Prasad Singh clashed yesterdy with Finance Minister P Chidambaram over the funding of the much trumpeted “Bharat Nirman” project of the UPA government accusing him of hoodwinking the masses by serving old wine in a new bottle.

The spat between the two Cabinet Ministers took place during a meeting yesterday convened by Prime Minister Manmohan Singh to discuss ways and means to fund the UPA government’s pet programme.

The ‘Bharat Nirman’ programme has six basic components pertaining to rural infrastructure, three of which — rural housing, rural water and rural roads — administratively fall under the Ministry of Rural Development.

Sources said in yesterday’s meeting Mr Yadav said that funds to the tune of Rs 15,000 crore was required for his Ministry to get the programme going.

The Finance Minister, however, said that an allocation of Rs 6,000 crore had already been in this year’s budget for projects pertaining to rural housing, roads and water.

The ‘Bharat Nirman’ programme, which was mentioned in this year’s budget, was announced last month involving an estimated investment of Rs 1,74,000 crore over the next four years to pitchfork rural infrastructure into a higher pedestal.

Punjab CM’s explanation strange: BJP
Tribune News Service

New Delhi, June 24
The BJP today ridiculed Captain Amarinder Singh’s assertion that he was not aware of the controversial background of a gurdwara he visited recently in Canada and said his “clarifications” leave more questions unanswered.

“It appears strange that even when he (Amarinder Singh) visited the gurdwara, he was literally not able to see the writing on the wall nor anybody accompanying him,” BJP spokesman Arun Jaitley said here.

Mr Jaitley pointed out that the function was held under the Khalistan’s banner and “Khalistan Zindabad” was clearly written in Punjabi on the wall there.

“Even when he visited the gurdwara, The Chief Minister should have criticised ‘Khalistan Zindabad’ (separatist group) or at least distanced himself from its views. But he did not consider it necessary,” Mr Jaitley said.

“His explanations are leaving more questions unanswered,” he said and asked the Congress to do some “genuine introspection” on the issue.

India, USA may sign missile development MoU
Tribune News Service

New Delhi, June 24
India may sign a memorandum of understanding with the USA on missile research development training and evaluation (RDTE) during the nine-day visit of Defence Minister Pranab Mukherjee, starting tomorrow.

Senior Defence Ministry officials said here ahead of the start of the visit that no major shopping list was on the agenda of the Defence Minister, who would be the first Indian Defence Minister to visit washington in a long time.

The issue of Mr Mukherjee’s visit to the USA also came up for discussion at the meeting of the Cabinet Commitee of Security (CCS) here this morning. The CCS chaired by the Prime Minister held detailed discussions over the issues which were expected to crop up during the visit. The CCS meeting was also attended among others by Mr Mukherjee, Home Minister Shivraj Patil, External Affairs Minister K Natwar Singh and Finance Minister P. Chidambaram.

Coming out of the CCS meeting Mr Mukherjee said he was not going to the USA with a shopping list of military hardware and that his visit was mainly “exploratory” in nature to expand Indo-US relations. “I am not going with a shopping list. This is a visit by an Indian Defence Minister to the USA after a long time,” Mr Mukherjee told reporters on being asked whether India will enter negotiations on the purchase of F-16 warplanes offered by the USA. Later, when the MoD officials were asked specifically whether India was considering to buy F-16s despite opposition from Left parties, they said no decision had been taken but only technological and commercial aspects of the aircraft were being assessed.

On the purchase of P3C Orion surveillance aircraft for the Navy from the USA, they said it was a “good” plane and various aspects relating to it were being examined.

Some kind of an assurance with regard to uninterrupted supply of defence material and safeguards to this effect could also come up for discussion during the visit, the officials said.

Mr Mukherjee, who is undertaking the visit at the invitation of his US counterpart Donald Rumsfeld, will be accompanied by Defence Secretary Ajai Vikram Singh and other senior officials.

Mr Mukherjee will have meetings with US Vice-President Dick Cheney, National Security Adviser Stephen Hadley and his counterpart Donald Rumsfeld during his stay.

Meanwhile, under Secretary of State for Political Affairs Nicholas Burns today met the Foreign Secretary here to discuss a range of issues.

Mr Mukherjee said the CCS also discussed the Home Ministry report on security in J and K, North and Naxalite-affected areas. The security situation was reviewed and assessed but no decision taken, he said.

Stuck cargo vessel removed

Kolkata, June 24
The movement of vehicular traffic through the Howrah Bridge here began this evening after the removal of cargo vessel M.V. Mani which got stuck below the bridge, Port Trust Chairman A.K. Chanda said.

Dr Chanda said the cargo vessel was going from Budge Budge to Bhunsri taking a route close to the bank. With the high tide a portion of the wheel deck of the vessel got stuck into the sloping structure of the bridge around 2 pm.

“The vessel was empty and it should not have taken the route close to the bank,’’he said.

Dr Chanda said the sting girder of the bridge was damaged.

He said the bridge was closed for vehicular traffic as a precautionary measure. The bridge was thrown open to the vehicular traffic after nearly three hours.

The Port Trust chairman said gas cutters were used to cut the wheel deck of the vessel, which was finally towed away.

Dr Chanda said the total damage was to the tune of Rs 1.5 crore and the Port Trust would claim the entire money from the owner of the vessel, Ganges Water Transport Company.

All Howrah-bound vehicles were diverted through the second Hooghly bridge, the police said.

A “positive” wedding
Tribune News Service

Chennai, June 24
Radhakrishnan and Elizabeth, both HIV positive, took their marriage vows in this state capital of Tamil Nadu today. They sent a powerful message on HIV/AIDS awareness.

The 34-year-old groom and his 28-year-old bride say they want to raise awareness about how HIV-infected people could leadlife normally.

Mr Radhakrishnan, a former mechanical engineer, was infected with the virus a decade ago but is now a HIV/AIDS counsellor for the South India Positive Network (SIPN), a support group for HIV positive patients based here.

Ms Elizabeth was married to a truck driver who died of AIDS a year ago and left her infected with HIV.

They met barely four months ago at an awareness programme at Kancheepuram and fell in love.

Mr Radhakrishnan said, “We see this as a sign of hope. But Ms Elizabeth added,” We want to live life like a normal couple and have children.”

SIPN’s Project Director Mr M. Elango, one of those who encouraged the couple to get married, said this was the eighth such marriage that his organisation had solemnised, but this was the first time that they had decided to publicize it.

The fact that both the bride and groom were keen on promoting awareness about the affliction helped.

“I am sure this will create a clear awareness that even though one is HIV positive, there’s always a normal life possible,” said Elango.

The couple are both on anti-retroviral drugs, and they believe that their future child will not be infected with HIV, as the percentage of transference from parents to children in Chennai among those using ARV is zero.

An academician of repute, Prof Bhattacharya is known to have turned down numerous offers from the government as well as the corporate sector.

“I have done so, because I am an academician and that is what I want to stay. And this assignment has come to me because of my academic credentials which makes me really happy”.

Prof Bhattacharya who assumes office next week, said, “I want to in my modest way do what I can for the university and the students…I love students and I am looking forward to doing something for the University, which has already established itself internationally and is known to have a certain commitment and vision”.

He added, “I come to JNU with an absolute open mind and am willing to debate all issues academically, I will not bow to any pressure that is non-academic because I firmly believe that we have a certain commitment to academic values”.

Stressing that he is “totally against commercialisation of education and diluting the education standards of the University”, Prof Bhattacharya pointed out, “I support academic exchanges, where in students can learn more, but collaborations should not go beyond the academic and certainly not for commercial purposes”.

The term and conditions of service of Prof Bhattacharya as Vice-Chancellor will be those set forth in the act, statutes and ordinances of the university.

Born on March 9, 1945, Prof. Bhattacharya earned his post-graduate degree in economics from the University of Allahabad in 1966 and Ph.D. in 1971 from Delhi School of Economics.

He has published a number of articles and books dealing with macro-economics, money and finance, public finance, international economics, development economics, econo-metric modelling and political economy of development.
