Shimla, November 4
Mr Virbhadra Singh, Chief Minister, filed a criminal defamation complaint against a spokesperson of the state BJP, Mr Baldev Sharma, in the court of the local Chief Judicial Magistrate Mr R.L. Azad, here today.

Mr Virbhadra Singh appeared in person before the court, along with his advocates, and presented the complaint in which he alleged that Mr Baldev Sharma made baseless, frivolous and false statements to the press to tarnish his public image and to harm him politically. The CM stated that he enjoyed a good reputation in social as well as political circles since long but after the publication of news item published in the print media on the basis of his statement his image had been sullied.

In the complaint it was alleged that Mr Sharma released a personal affadavit to the press alleging that Mr Virbhadra Singh was occupying land in excess of the prescribed limit under the local laws. He was pressuring the officials who were investigating the land matters. While talking to the press Mr Sharma had demanded that inquiry should be conducted by the Central Vigilance Commissioner.

Mr Sharma had already written a letter to the Chief Justice of the High Court on the issue raised in the press statements, when he found that the High Court did not take suo mottu action in the matter, he filed a writ petition with a prayer to hand over the inquiries to Central Vigilance Commission (CVC) but the same was dismissed as withdrawn because of some legal infirmities.

Mr Virbhadra Singh, while impleading Mr Sharma as accused in the case, alleged that because of his false and baseless statements his (Mr Virbhadra’s) image has been tarnished. He pleaded that criminal proceedings be initiated against Mr Sharma for penal action under Section 500 of the IPC.

Our Correspondent

Palampur, November 4
Mr Brij Behari Lal Butail, Revenue Minister and Congress leader, here today claimed that the Sagar Katha case registered against Chief Minister Virbhadra Singh was fabricated by the previous BJP government before the Assembly elections, with a view to tarnishing his image.

Addressing mediapersons at the PWD rest house, he said there was no prima facie evidence against Mr Virbhadra Singh that could lead to the registration of a criminal case against him. He said the SP (Vigilance) who had conducted the investigations had written to the government twice that no criminal case could be made against Mr Virbhadra Singh and the investigations should be dropped. However, he was asked by the government to review the records of the case.

Investigation officers had said it was a Cabinet decision and Mr Virbhadra Singh could not be held guilty for extending undue favour and making additional allocations of khair wood to a particular factory.

He said even the Law Department had expressed the same opinion in its communication. Former Chief Minister P.K. Dhumal had then asked the Additional Director- General of Police to avail the services of the Advocate-General in this regard. The Advocate-General managed to get an adverse opinion from the Additional Solicitor- General of India in the case which led to the registration of the case against the Chief Minister, he said.
