Srinagar, August 1 The court has directed the government to release Farooq Ahmad Hajam of Hajam Mohalla, Sopore, who was arrested by the police on January 19, 2002. According to charge sheet him, Mr Hajam was booked for propagating secession, seeking accession of the Jammu and Kashmir state with Pakistan on the basis of religion, for being a functionary of the Muslim League, mobilising public against the lawfully elected government and for organising processions and rallies. He was also charged for mobilising public opinion in favour of the Jammu and Kashmir Liberation Front (JKLF) founder Mohammad Maqbool Bhat and against the execution of former Pakistan Prime Minister Zulfiqar Ali Bhutto. In his judgement, Justice Muzaffar Jan said an attempt on the part of any citizen to elicit public opinion in favour of a person who had been sentenced to death in order to save him from the gallows could not be considered as acting in any manner prejudicial to the security of the state, because this act could not be considered as an attempt to overthrow or overawe the government established by the law in the state. Although it is stated that the detainee had tried to arouse the sentiments of people against the state government, the alleged act on the part of the detainee, even if proved, could not be considered to be prejudicial to the security of the state, the judge ruled, as the Jammu and Kashmir state had nothing to do with the execution of Mr Bhutto. Quoting the previous judgement of the court in the case of Mohammad Yousuf Rather vs State of Jammu and Kashmir, the court observed, “peaceful and lawful revolt, eschewing violence is one of the well known modes of seeking redress in the country.’’ Considering the case of the detainee in a ‘casual manner’, the District Magistrate had obviously sworn a false affidavit, Justice Jan said. Taking serious note of it, he directed the Chief Secretary to ascertain the reason and circumstances of the case. — UNI |
Fresh warrants against Shah, Geelani, Malik Jammu, August 1 While issuing warrants, presiding officer of the TADA court, P.N. Razdan said the case was pending for the past so many years and despite issuance of bailable and non-bailable warrants, the same had not been executed by concerned police officials. The Judge expressed displeasure over the inaction of police officials and their failure in executing the warrants against the "high profile" personalities of Kashmir, who had been addressing press conferences and public meetings. Under these circumstances and the facts of the case, the Judge directed the Jammu and Kashmir, DGP to initiate an inquiry against the police officials who failed to execute the arrest warrants from time to time. The court sent the fresh warrants to the DGP for execution. During a political rally at Iqbal Park in Srinagar on Aug 20, 1987, the accused had allegedly made anti-national speeches and also dishonoured the National Flag. A case was registered against them in Srinagar under relevant provisions of law and the case was later

team to advocate Kashmiris' role Srinagar, August 1 The delegation headed by Chairman Maulana Mohammad Abbas Ansari will leave for Delhi tomorrow, Hurriyat sources said. The delegation also includes former chairmen Abdul Gani Bhat and Mirwaiz Umer Farooq, the sources said adding that some other members might be joining the delegation.

Over 200 youths
cross over to Pak for arms training Jammu, August 1 According to police sources, groups of youths from Shopian, Tral Kulgam (in Pulwama and Anantnag districts), Sumbal, Sonawari, Bandipore, Rajwar (in north Kashmir) and a few pockets from Surankot, Mendhar (in Poonch) and Thanamandi in Rajouri were assisted by Pakistan trained border guides to cross over to the occupied Kashmir and Pakistan. The sources said that Hizbul-Mujahideen and Lashkar-i-Toiba activists were responsible for motivating these youths to cross over the Pakistan for arms training. Some of them were taken to the border under threat. A senior police officer said finding that their man power had decreased with the elimination of over 700 militants during the first six months of the current year leaders of various rebel outfits had resorted to what is called forcible recruitment drive. He said some groups of youth belonging to militancy-infested belt of Rajwar near Handwara too had been motivated to cross to Pakistan for training in the handling of weapons and explosives. With a sudden step up in the rate of egress of Kashmiri youths the level of infiltration from across the border too has shot up in recent days. The police sources confirmed that groups of militants, equipped with weapons and explosive had infiltrated into Jammu and Kashmir from across Poonch, Rajouri, Kupwara and Uri in recent days. The sources cited a series of encounters between the security forces and the infiltrators in Dard Pora, Reshi Gund, Dard San, Jum Gund in the Kupwara sector where about 15 militants were killed recently. Eyewitnesses had told the police that more than 30 militants had crossed over into the Kupwara sector and after 15 were eliminated by the security forces the remaining managed to sneak into the valley.

Top Hizbul militant shot in encounter
Srinagar, August 1 The sources said Sheikh, alias Kinga fired on the security personnel when asked to surrender and was killed in retaliatory firing. The militant was carrying a fake identity card and was identified as Kinga, resident of Konibal village of Pampore, only after his body was handed over to the police. The Gujjar boys killed in the firing were identified as Mohammad Iqbal and Kala Gujjar. According to another report at least six persons, including five militants and two security forces personnel, were killed in separate incidents in the Kashmir valley since yesterday. The police here said that two foreign militants of the Hizb-e-Islami were killed in an encounter with the security forces at Manchater forests in Kupwara district yesterday. Two AK rifles, eight magazines, four hand grenades and 68 rounds were recovered from the site of encounter. Two militants and a security force jawan were killed in an exchange of fire at Danas village in Budgam district yesterday. Two residential houses were also gutted in the exchange of fire. — PTI |

Number of Amarnath pilgrims goes up to 1.40 lakh Srinagar, August 1 This, according to an official spokesman, includes the lowest number of 724 yatris who arrived from Jammu today. The yatra formally began on July 12. So far over 1.38 lakh pilgrims have had darshan of the ice Lingam at the cave at a height of over 13000 ft. The yatra will conclude on August 12, coinciding with Raksha bandhan, when the final batch, led by Mahant Deepinder Giri, will offer prayers at the cave. Meanwhile, the chhari sthapana and dhwajarohan ceremonies were held at Dashnami Akhara, the resting place of the holy mace, here today, led by Mahant Deepinder Giri. Chhari pujan will be performed at Dashnami Akhara tomorrow afternoon. Chhari Mubarak (holy mace of Lord Shiva), led by Mahant Deepinder Giri, will start its journey to the cave shrine on the morning of August 7. |
5 hurt in heavy Pak shelling Srinagar, August 1 The shelling, which began last night continued today in Noushera, Janghar, Romlidhara, Jallas, Salotri, Laam, Bhawani, Chokichora and Sabzian areas of Poonch and Rajouri sectors, the sources said. Two security personnel Dharam Singh and Karan Singh, were injured in the shelling at Romlidhara and a civilian, Mohammad Sharief, was wounded at Jallas, they said. Two civilians were injured in the Pakistani shelling in Dras sector of frontier region of Ladakh today, the sources added. Dras along with Batalik witnessed heavy shelling from across the border early today which sparked panic among residents in forward areas, the sources said, adding that markets and business establishments remained closed. Pakistani Rangers also fired along the international border in R.S. Pura and Samba areas of Jammu frontier to disrupt the ongoing fencing work being undertaken by the BSF, the sources said. However, no casualty was reported in the ensuing exchange of fire, they said. —

5-year jail term for ultra Jammu, August 1 Judge P.N. Razdan sentenced KCF ultra Anoop Singh to five years’ imprisonment under Section-3 of TADA for “causing terrorism” and fined him Rs 1000 in a looting case. Anoop Singh was brought here from Gurdaspur jail in Punjab, where he was serving a life term. According to the prosecution, Anoop Singh, along with two other accused — Pawan Kumar and Vinod Bhalla — used force to extort Rs 1.10 lakh from one finance company managing director, Subash Chander Chopra, at Channi Himat on the outskirts of Jammu city on September 1991. While Bhalla was acquitted, Pawan Kumar had absconded.
