Haryana to amend appointment rules
for Civil Judges

The Haryana Cabinet today decided to amend the rules of appointment for Civil Judges (Junior Division).

An official press note said the requirement for an applicant to be an advocate for at least three years had been done away with to attract young graduates in the judicial services. A person would now be eligible for appointment as a Civil Judge (Junior Division) if he held a degree of law from a recognised university.

The Cabinet also approved a draft Bill — the Kurukshetra Shrine Bill, 2003 — which would enable the state government to take over the administration and management of 75 pilgrimage centres and temples falling within a radius of 48 km of Kurukshetra.

The administration, management and governance of shrines would be vested in a board consisting of a chairman, vice-chairman and 11 members. The Chief Minister would be the Chairman and the Urban Development Minister the Vice-Chairman. The Secretary, Urban Development, would be the ex-officio member and the Deputy Commissioner, Kurukshetra, the ex-officio member secretary. The government would nominate as members two persons who have distinguished themselves in the service of Hindu religion or culture; two women who have distinguished themselves in the service of Hindu religion, besides advancement of women, three others who are experts in administration, legal affairs or financial matters and two eminent Hindu persons of Haryana.

The Cabinet also decided to exempt chemical fertilisers from the payment of sales tax. The measure is likely to result in a relief of about Rs 50 crore to farmers during the current financial year, the press note said, adding that the decision had been taken in view of stagnation in the procurement price of foodgrains on the one hand and a steep rise in the prices of fertilisers on the other.

The Cabinet also approved a proposal of the Town and Country Planning Department for developing a special zone provided in the plan for Gurgaon. It had been decided to collect the fees and other charges as per the rates prevalent at the time of issue of licences.

In view of the growing demand for houses and to safeguard the interest of Haryana Tourism in future, the earlier ratio of land use in the special zone was revised and refixed as 40:30:20:10 for group housing, commercial, recreational or entertainment and institutional uses, respectively. However, if a party wanted to develop more area for recreational and entertainment over and above the ratio, there would not be any bar on this.

Verma panel may extend date for receiving affidavits

The Justice J.C. Verma Commission of Inquiry, popularly known as the second commission on prohibition, is likely to extend the last date for receiving affidavits from the general public and other interested parties.

Justice J.C. Verma is a former Judge of the Rajasthan High Court.

The commission was set up by the Haryana Government to look into the circumstances under which prohibition was first imposed and then lifted by the Bansi Lal Government after being in force for about 20 months. It is to also look into the loss suffered by the state due to prohibition as well as whether liquor smuggling took place during those 20 months under political patronage.

The Verma Commission was set up after the Punjab and Haryana High Court quashed the appointment of the Chehal Commission set up for a similar exercise. The appointment was quashed on a writ petition filed by former Chief Minister Bansi Lal.

The commission had earlier asked for the affidavits till July 10. The period was extended till July 15. It is believed that the number of affidavits received by the commission is below expectations. However, sources in the commission say several persons have requested the commission to give them more time to file affidavits. It is likely that the commission may give about three weeks more for submitting affidavits. It is believed that about 50 affidavits have been received by it so far.

Sources say the commission will also depend upon the material and evidence collected by the Chehal Commission, which had submitted its report to the state government a couple of days before its appointment was quashed. The state government went in appeal before a Division Bench, which, while issuing notice of motion to the respondents, was assured by the government that it would not use the report of the Chehal Commission during the pendency of the appeal. However, later the government withdrew the appeal and set up the Verma Commission.

There were two opinions on the issue whether the Verma Commission could rely upon the evidence collected by a commission of inquiry, the appointment of which was quashed by the high court. Sources say legal opinion was sought from the Legal Remembrancer and the Advocate-General. It is believed that the commission has been advised that it could use the material collected by the Chehal Commission. However, it should re-examine witnesses as their testimonies given before the previous commission would not have legal sanctity before the new commission.

The Chehal Commission had received a large number of affidavits. However, many a witness told the commission later that they had merely signed the affidavits brought to them by the police.

Publicise govt achievements, boards told

The Haryana Government has asked all boards and corporations to launch a massive publicity drive to highlight the INLD government’s achievements”. The boards and corporations have also been asked to make generous contributions to the Chief Minister’s Relief Fund.

At a meeting convened by Mr B.D. Dhalia, Principal Secretary to the Chief Minister, here yesterday, representatives of various boards and corporations were asked to launch a statewide campaign to project the Chautala-led regime’s achievements.

Each of them was given papers containing 16 small replicas of what such advertisements should look like. The ‘sarkar aapke dwar’ programme, enhancement of the old-age pension, better power availability, hike in the purchase price of sugarcane by the cooperative sugar mills, abolition of octroi, etc, were among the “achievements” that figured in the dummy advertisements.

The boards and corporations were asked to set up 15 ftx10ft bill-boards to display these advertisements. Specific spots were identified for setting up these billboards. These included spots in the vicinity of schools, hospitals, the DCs offices, approach roads to villages etc.

The boards and corporations were also asked to paint these advertisements on Haryana Roadways buses. The participants were directed to display these advertisements in villages.

A few officials pointed out that their organisations did not have budgetary provision for undertaking such a massive advertisement campaign. They were, however, asked to arrange the necessary funds for the purpose.

Initially the plan was to allocate a particular district to one or more boards and corporations for undertaking the campaign. However, when it was pointed out that operations of the boards and corporations covered the entire state, it was decided that each board and corporation would put up a certain number of billboards in all 19 districts. The boards and corporations could add a few lines about their own feats in the hoardings.

The participants were also asked to make contributions to the CM’s Relief Fund. Various corporations were asked to contribute different amounts to the fund, with the Haryana Urban Development Authority (HUDA) and the Haryana State Agricultural Marketing Board asked to contribute Rs 1 crore each.

Sessions judge can’t recall case once trial begins

A Sessions judge has no power to withdraw or recall a case or an appeal once the proceedings have commenced in a trial or an appeal — the Punjab and Haryana High Court has ruled in a judgement.

In a ruling on a bunch of petitions, Mr Justice Nirmal Singh held: “The sessions judge has been empowered under Section 409 of the CrPC to withdraw the cases and appeals.... A perusal of sub-section 2 shows that at any time before the trial of the case or commencement of hearing in an appeal before an additional sessions judge (ASJ), a sessions judge (SJ) may recall any case or appeal which he has made over to any ASJ. But when the proceedings have commenced in a trial or an appeal, an SJ has no power to withdraw or recall a case or an appeal”.

The judge also directed the setting aside of an order passed by Sonepat’s sessions judge withdrawing 11 cases from a fast track court and transferring these to an ASJ’s court for “disposal in accordance with law”.

The judge concluded: “The cases will remain for adjudication before the fast track court. The proceedings in all the cases will commence from the stage those were withdrawn from the fast track court”.

Parties to lead evidence in plea

Fixing July 22 as the next date of hearing on an election petition challenging the election of Indian National Lok Dal candidate Ranbir Singh from the Badhra assembly constituency, Mr Justice Amar Dutt today directed the parties to lead evidence regarding the issues.

Accusing Mr Ranbir Singh of indulging in “corrupt practice” during the election, Haryana Vikas Party candidate Narpinder Singh had earlier alleged that Independent candidate Amir Singh was “induced” by the returned candidate to contest the election. Mr Amir Singh, the petitioner had added, was assured that all the expenses, including the security deposit, would be borne by the Mr Ranbir Singh.

Mahendragarh colleges to be with MDU

While the affiliation of colleges in Mahendragarh district will remain with MDU, Rohtak, those in Sirsa, Fatehabad, Hisar, Jind and Bhiwani districts will be affiliated to Devi Lal University, Sirsa.

This was decided by the Haryana Cabinet today.

According to the Bill passed in the last session of the Assembly on the setting up of Devi Lal university in Sirsa, colleges in Mahendragarh district were slated to change their affiliation from MDU to the new varsity.

The new Cabinet decision will have to be ratified by the Assembly.

Tributes paid to Capt Atul Somra

A blood donation camp and a declamation contest marked the first death anniversary of martyr Capt Atul Somra here today.

Capt Atul Somra had made the supreme sacrifice in an encounter with militants in Kashmir.

The blood donation camp was held at SD College, Ambala Cantonment. About 60 units of blood were collected. Two personnel from Capt Atul Somra’s unit also donated blood. Dr Sushil Kansal donated blood for the 50th time, while the college Principal, Dr Desh Bandhu, donated blood for the 31st time.

Capt Atul Somra’s father, Mr R.S. Somra, said his son’s unit was in constant touch with them. “Laying of a road in his memory has already begun,” he said.

Speaking on the occasion, Mr Anil Vij, Ambala Cantonment MLA, said Capt Atul Somra was always interested in joining the Army.

He announced the skating rink being built in Subhash Park would be named after the martyr.

The college Principal, Dr Desh Bandhu, said a trust would be formed in the memory of the martyr and it would be operated by NSS and NCC units.

Later, a declamation contest was held at SD Senior Secondary School, Ambala Cantonment. The overall trophy was won by Army School, Ambala Cantonment. Surjeet of Army School stood first, while Rahul of SD Senior Secondary School was declared second.

The third spot was shared by Soumita of Army School and Apoorva of PKR Public School. Consolation prizes were given to Navraj of DAV Public School, Sujata of KV No.1, Ankita of Bharati Public School and Ravi Sharma of SD Senior Secondary School.

Irked residents threaten to move Consumer Court

A number of residents of Housing Board Colony, Sector 7, here have threatened to move Consumer Court if their demand is not accepted by the HVPN.

Around 25 residents, including Baljit Singh, Gulshan Kumar, Geeta Rani, Krishan Kumar, Asha Dhawan, Pavneet Kaur, Shakuntal Rani, Kamlesh Yadav and Rishi, have sent a memorandum to the Chief Minister and Deputy Commissioner in this regard.

They have stated in the letter that on June 23 electricity meters at their houses and other home appliances were damaged due to high voltage. They approached the Electricity Department to change their meters as these were damaged due to negligence of the department.

They have further alleged in the memorandum that the department demanded Rs 1,200 each from them for installing new meters. They said they contacted higher authorities of the department but to no avail.

Even though the meters are non functional, the electricity supply is on in their residences. They are afraid that the department might penalise them by sending the bills on flat rate.

They have threatened to approach Consumer Court if no action is taken.

Eight cops booked on bribery charge

A criminal case for taking bribe and planting opium on a person has been registered against eight police officials attached to the Excise and Taxation Department on an order of Karnal Deputy Commissioner R.S. Doon.

The case has been registered under Section 195, 211, 167, 342, 389 and 109 of the IPC at Sadar police station against Sub-Inspector Jagan Nath, Assistant Sub-Inspector Ranbir Singh, two Head Constables and four constables according to Mr Doon.

According to information, a party led by Sub-Inspector Jagan Nath raided a house in the local Urban Estate where a couple lived on June 19 and recovered 2.50 kg of opium.

The police also raided the house of a resident, Mr Om Parkash, in Sector 6 of HUDA. The police claimed that during the raid liquor was allegedly recovered from the house and arrested Mr Punit, son of Mr Om Parkash.

The Deputy Commissioner stated that the raiding party took an illegal gratification of Rs 1 lakh from the couple and let them off. However, it implicated Mr Punit and showed that the opium had been recovered from him.

He was produced in the court of a Judicial Magistrate who remanded him in judicial custody. After that Ms Bharti, sister of Mr Punit, met the Deputy Commissioner along with residents of the mohalla and told him that her brother had been falsely implicated.

They also allegedly complained that the police had demanded Rs 50,000 for freeing Mr Punit in the opium smuggling case. Mr Doon wrote a letter on June 26 to the district police chief, Mr P.K. Aggarwal, asking him to order an inquiry.

Meanwhile, the raiding party in its records showed that on June 23, the house of the couple was raided again and illicit liquor recovered. The couple was also fined to conceal the facts. However, Mr Ranbir Singh, ASI, and constable Hukam Singh who were also members of the party, confessed to have accepted Rs 1 lakh from the couple during the enquiry conducted by DSP Surinder Singh.

Ambala to have cancer counselling centre

The Rotary Club of Ambala will open a cancer awareness and counselling centre here soon.

Talking to mediapersons here today, the new president of the club, Mr Ajay Aggarwal, said the centre would be started with the help of a matching grant from a Rotary Club based in Florida.

He said the centre would be opened at the senior citizens’ home, near Mahavir Dal hospital. “We will generate awareness about cancer. It is possible to cure cancer if there is timely detection. We are going to spread awareness about the symptoms so that people can be alert,” he said.

Mr Aggarwal said counselling would also take place for those persons who were already suffering with cancer. “In hospitals, doctors do not have sufficient time, so cancer patients will get better counselling at the centre,” he said.

He said besides the cancer project, the club would continue with the TB detection and eradication project. “The TB project has been adopted the Rotary District 3080. Mr Naresh Bhardwaj is going to the district chairman and Mr Laxmi Sagar is going to be the counsellor,” he said.

The past president, Mr Ashok Jain, said the club would lay stress on awareness generation so that the community could be benefited.

Cheques worth Rs 90 lakh disbursed

Mr Abhey Singh Chautala, MLA from Rori constituency, has exhorted the youth to work for the progress of the country.

On the second day of his tour, Mr Chautala toured 10 villages of the rural areas of Kalka constituency. Having announced his intention to contest the next Vidhan Sabha election from this constituency, the son of Chief Minister Om Prakash Chautala today distributed cheques for about Rs 90 lakh among village panchayats in the Pinjore block.

Abhey Chautala visited Mallah, Jabrot, Chikkan, Daghotra, Bhogpur, Bitna, Rajipur, Chandimandir, Nadda and Saketri village. He addressed public meetings at these villages and disbursed cheques worth Rs 90 lakh among 26 gram panchayats for carrying out development works. The money for these works was earlier sanctioned by Om Prakash Chautala during the third phase of his Sarkar Aapke Dwaar programme.

Yesterday, Mr Chautala visited 11 villages in Pinjore block and distributed cheques worth Rs 1 crore among 32 gram panchayats.

He highlighted the problems faced by the people of the district, especially those staying in hamlets on the Shivalik foothills. He said in spite of the area receiving sufficient rainfall, water was getting washed away. The government had made several proposals for watershed management, he said.

He was accompanied by Naraingarh MLA Pawan Diwan, Naggal MLA Jasbir Malor, state secretary of INLD Amardeep Chaudhary, district president of INLD Ram Gopal Mehta and Pinjore Panchayat Samiti president Ms Kuldip Kaur.

SHO killed in encounter

Uchana Mandi (Jind), July 18
The Station House Officer of Uchana police station, Mr Hemraj, was killed in an encounter with miscreants here this evening.

The cop reportedly rushed to Bhonsla village after learning about a shooting incident , following an altercation between three miscreants — Guddu, Shiva and an unidentified person. They were gambling in an inebriated condition, when a minor altercation turned violent. One of the accused allegedly fired at Shiva with a gun.

As Shiva was being taken to the hospital, the villagers called the police. A team of cops led by the SHO Hemraj patrolling the area immediately rushed to Bhonsla. The two accused hid in a field and an ambush with the police ensued. Mr Hemraj was killed in the fight.

3 held for stealing travellers cheque

Karnal, July 18
The police has arrested three African nationals for attempting to encash a stolen traveller’s cheque worth $100 dollars at a bank here yesterday, the police said today.

Henry Michael of Zimbabwe, E. Nicholas of Swanciland and K. K. Jack of South Africa submitted the traveller’s cheque to the foreign exchange manager Ashutosh Kaul at Punjab National Bank to get it converted into Indian currency.

When the manager examined the cheque, he found its number had been tampered with. On seeking information from the Delhi branch, it came to light that one of the digits had been tampered with and the cheque belonged to a German tourist who had registered a complaint of its theft. In getting this unfortunation, bank doors were closed and the three youths were handed over to the police. A local court remanded the accused in judicial custody till August 1. The police has registered a case of forgery against them and confiscated their passports.— UNI

Sharan’s judicial remand extended

The Additional Sessions Judge, Ambala, Mr B.M. Bedi, extended the judicial remand of senior IAS officer of Haryana Ajit Mohan Sharan, former Managing Director of the Haryana Financial Corporation, and Mr U.S. Chadda, former Executive Director of the corporation, till July 30 here today.

The state Vigilance Bureau had arrested Mr Sharan on June 25 in a multi-crore loan scam in the HFC.

On the other hand the counsel of Mr Sharan and Mr Chadda stated that their clients had been implicated falsely in the scam as their name did not mention in the FIR.

Three children of family drowned

Yamunanagar, July 18
Three children of a family were drowned in the Som river at Chintpur village about 25 km from here, last evening.

Kamal (12), his younger brother, Ramesh (10), sons of Mr Mem Chand of Chintpur village, along with their cousin brother, Ramesh (8), were taking a bath in the river when they were caught in a whirlpool.

Kamal showed courage and swam to the bank of the river, but collapsed and died there. The news of the death of the three children set a pall of gloom on the entire village.

The cremation was held this afternoon in the village.

Youth shot at

Ambala: A youth was shot at in Ambala Cantonment late last night.

According to information, Roshan Lal, a resident of BD Floor Mill area, was shot at from close range by some persons. He was rushed to the local Civil Hospital. Later, he was referred to the PGI, Chandigarh.

According to the police, the reason behind the incident could not be ascertained so far. The police has recorded Roshan Lal’s statement. No arrest has been made in this regard so far.

Opium seized: The police seized 130 gm opium from a resident of Kaith Majri, Ambala City, on Friday.

According to the police, Jwala Prashad was arrested with opium and a case registered under the NDPS Act.

5 hurt as roof caves in

Five persons, including a son and a brother of a former Haryana minister, were injured when the ceiling of the room in which they were sitting, caved in due to heavy rains today. The ceiling of the office of a petrol station here belonging to family members of late Harminder Singh, a minister in the Bansi Lal cabinet (1996-97), caved in this afternoon due to incessant rains since morning injuring five persons. They were admitted to various hospitals. The condition of all injured persons is stated to be out of danger.

Suit against 5 IAS officers

Mr Malik has alleged that IAS officers with the help of a politician in Haryana had lodged five false criminal cases against him during the period 1997 and 1999.
