The Haryana Vigilance Bureau (SVB) has booked Dwarka Prasad, a nephew of former Haryana Chief Minister Bhajan Lal and younger brother of Mr Dura Ram, who contested Fatehabad Assembly byelection recently for transferring a piece of land in his name by tampering with revenue records with the connivance of government officials. Seven others, including three gazetted officers have also been named in the FIR registered at Hisar yesterday.

Mr Dura Ram has termed the action as politically motivated and aimed at tarnishing the image of Mr Bhajan Lal and his family members. He claimed that the police could not arrest Mr Dwarka Prasad without giving him seven-day notice, as per an order of the Punjab and Haryana High Court.

Mr Dwarka Prasad and others, according to sources, have been booked under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code and Section 13-1-D of the Prevention of Corruption Act. The case, the sources said, has been registered on the complaint of Ajaib Singh, a resident of Ganda village in this district.

Mr Dura Ram today alleged that the government had been looking for opportunities to frame them. He said mutation of the land in question was made in the name of Kapoor Singh on June 14, 1996. He said that his brother Dwarka Prasad got the land (26 kanals and 5 marlas) transferred in his name against another property at Bhirdana village 1997. Ajaib Singh a resident of Ganda village and the complainant in the present case gave an application that mutation be made in the name of Kapoor Singh was against the rule and the then Tehsildar entered the mutation in his name.

On appeal by Kapoor Singh in 1999, the then SDM, according to Mr Dura Ram, reversed the order of Tehsildar and upheld the mutation made in the name of Kapoor Singh. He said that his brother Mr Dwarka Prasad had nothing to do with the case except that he exchanged the land with Kapoor Singh in a legal manner. He said that the case against him was politically motivated.

Mr Dura Ram also claimed that the police could not arrest Mr Dwarka Prasad without serving him a notice of seven days in advance. He showed a copy of the Punjab and Haryana High Court order in a case number Criminal Misc 5403 of 1987, directing the police to give seven-day notice before the arrest of Mr Bhajan Lal and many members of his and his brother Mr Manphool Singh’s family in any future case. He claimed that the orders were still valid, as these had not been challenged in the court by the government.

Mr Dura Ram alleged that the government had also initiated process to unseat a Zila Parishad member Ms Paso Devi because she had supported him.

Sever ties with INLD, BJP team urges Advani

The Haryana BJP today drew Union Home Minister, L.K. Advani’s attention to the Chautala government’s steps against state leaders.

Mr Krishan Pal Gurjar, leader of the BJP legislators in the state assembly, Mr Ram Bilas Sharma, a former Education Minister, Mr Ganeshi Lal, vice-president of the state BJP, and a former minister; and Ms Kamla Verma, also a former minister, met Mr Advani at Punjab Raj Bhawan here today and told him that Chief Minister, Om Prakash Chautala was trying to tarnish the image of the party by instituting false corruption cases against Haryana BJP leaders. They also brought to Mr Advani’s notice a statement made by Mr Abhey Chautala, Chief Minister’s son, at Panchkula recently regarding vigilance inquiries against three former BJP ministers.

Mr Advani reportedly gave a patient hearing to the Haryana leaders’ complaints and asked them to discuss the issue with other central leaders of the party, including president Venkaiah Naidu, who was expected to come to Chandigarh on Sunday.

INLD focus on enrolling members

Even as scores of INLD functionaries of Haryana are engaged in campaigning for the party in the scorching heat of Rajasthan for the November elections, Mr Om Prakash Chautala, President of the INLD, has asked his colleagues to strengthen the INLD by enrolling members.

Party sources said Mr Chautala was holding a series of meetings with legislators and party functionaries to focus on increasing the party’s membership. He held meetings with office-bearers and elected representatives of 10 districts at Chandigarh on Wednesday and Thursday.

Representatives from Jhajjar, Fatehabad, Kaithal, Hisar, Rohtak, Bhiwani, Sonepat, Jind, Yamunanagar and Panipat districts attended the meetings.

Mr Chautala obtained feedback from the participants regarding the implementation of promises made by him in the “sarkar aapke dwar” programme.

The enrolment of members was a new agenda which did not figure in the last year’s meeting. The presidents of the district units had been asked to meet workers and ask them to take initiative regarding increasing the members.

The sources, however, tried to play down the speculations regarding the toning up of the party for next year’s parliamentary elections.

KU admission racket busted

A racket of getting admission to the Department of Physical Education of Kurukshetra University by submitting fake sports certificates has been busted.

A social worker had filed a complaint in this regard with the university Vice-Chancellor, Dr A.K. Chawla, who had forwarded it to the Haryana Governor, Babu Parmanand. Following the orders of the Governor, a team led by the Director of the Chandigarh-based Haryana Sports Department, Mr Mahender Singh Mann, conducted a raid on the premises of the Department of Physical Education yesterday and seized 83 gradation certificates and original admission forms.

As many as 139 admission seekers had submitted national gold medalist certificates, while, there might not be such a large number of gold medalists even in whole of Haryana. Interestingly, when the raiding party demanded affidavits in this regard from some admission seekers present there, five affidavits were found to be false.

Due to panic spread by the raid, only five students got admission to the department, yesterday against the list of 43 merit students exhibited. While two students got admission to the C.P.Ed, no one sought admission to the M.P.Ed. This year there were 120 seats in the C.P.Ed, 30 in the M.P.Ed. and 45 in the D.P.Ed. The fake certificates were allegedly submitted in boxing, athletics, racing and kabaddi.

Confirming the seizure of 83 gradation certificates and original admission forms, Mr Mann said the exact number of fake certificates could be confirmed only after their verification.

According to sources, all alleged fake certificates were of national gold medalist, which had been got scanned by computer reportedly from Chandigarh. However, all documents appeared to be original copies.

Meanwhile, Dr A.K. Chawla, who had constituted three inquiry committees for the D.P.Ed, the C.P.Ed. and the M.P.Ed., said guilty would not be spared.

Our Sports Reporter adds from Chandigarh: Mr M.S. Mann, Director, Sports and Youth Welfare Department, Haryana, disclosed that the intimation regarding the detection of fake certificates had been sent to the Chairman, Department of Physical Education, KU, Kurukshetra. He has been advised to initiate criminal proceedings against those involved in the racket.

Mr Mann disclosed that one of the employees of the department doubted the authenticity of the signatures of the office-bearers of the Judo Federation of India. Later, the signature were found to be forged.

B-one grades pertaining to Ms Poonam Lata in athletics, Sarvjit Singh in cycling and Rajinder Singh and Sushil Kumar (both in korfball) were found to be in order.

The signatures of the officials of the Haryana Sports Department on the sport gradation certificates were also forged. Various national federations whose certificates were forged are the Judo Federation of India, Indian Amateur Boxing Federation, All India Football Federation, Amateur Athletic Federation on India, Cycling Federation of India, Wrestling Federation of India, Handball Federation of India, Asian Amateur Kabaddi Federation, Ball Badminton Federation of India, Softball Federation of India and Korfball Federation of India.

Devi Lal varsity to be fully computerised: VC

Chaudhary Devi Lal University here will be the first totally computerised university of the country and every student of the university will be computer-literate. This was disclosed by the founding Vice-Chancellor of the university and Commissioner of Hisar, Mr P.K. Das, here while talking to The Tribune.

Mr Das said the university was coming up on 213 acres of land and there was a plan to take over 83 acres more from the Agriculture Department to expand its campus. A sum of Rs 50 crore have been earmarked for the construction of buildings like administrative block residential complex for employees hostels for girls and boys and shopping complex.

The Vice-Chancellor of the new university said he aimed to make this university one of the best 10 universities of the country within a few years. He said he had made provision to impart computer and Internet literacy to all students. He said there was a proposal to link traditional subjects with alternative subjects for example economics can be combined with industrial economic and the use of economics in different spheres of economic system.

He said the courses that were going to start from this session are M.Tech (Computer Engineering), MCA, MBA, M.Com, Master of Business Economics, Master of Mass Communication Law MA (English and Public Administration) and C.P.Ed.

At least 50 colleges of six districts of Haryana — Sirsa, Fatehabad, Hisar, Bhiwani, Jind, Mahindergarh — were being affiliated to the university. From the next session, subject matter related to every course would be made available on web site in all these colleges and computerised tests would be conducted to test the potential of the students.

When asked if this university has been recognised by the University Grants Commission the Vice-Chancellor said efforts in this direction were on and the UGC will formally grant recognition to this university.

Abhey’s tirade against Cong continues

Mr Abhey Chautala, president of the Haryana Olympic Association, today alleged that former Chief Ministers, Bhajan Lal and Bansi Lal had played with the future of youth and not taken any steps for the promotion of sports in the state.

Mr Chautala, while addressing a gathering at Kalka, alleged that when Mr Om Prakash Chautala took over the reins of the government, the youth of the state were involved in liquor smuggling and instead of books, liquor packets were found in their school bags because of Mr Bansi Lal’s prohibition policy.

Mr Chautala said the implementation of new sports policy by the present state government had helped in the promotion of sports. Mr Chautala assured students that their demand of having modern sports facilities in the college would be brought to the notice of the government.

He announced that work on Ch Devi Lal Sports Complex in Panchkula was almost complete.

Mr Chautala said the present government had spent Rs 128 crore for the development of Panchkula township and Panchkula and Kalka would be developed as the most beautiful cities in the country.

He criticised the Kalka MLA, Mr Chander Mohan, and Mr Bhajan Lal and said that they had made false promises to the people of the area.

Mr Chautala, who was addressing a gathering at Kalka today, said implementation of new sports policy by the present government had helped in the promotion of sports in the state besides achieving a special place in national and international tournament.

On the demand of the college students of the area, Mr Abhey Chautala assured them that their demand of having modern sports facilities in the college would be brought to the notice of the government so that these facilities could be made available in the college.

He said work on the Devi Lal Sport Complex at Panchkula was almost complete and this complex would be one of the best complexes in the country on which a sum of Rs 9 crore had been spent. He said the work on building of the Haryana Olympic Association was also going on speedily and it would also be completed soon.

An 18-hole golf course was under constitution in Panchkula on which of Rs 6 crore would be spent, he added.

Twenty one players have been selected to represent Panchkula district in the Rajinder Goel Trophy (under-17) in the trials conducted by the Panchkula District Cricket Association at Sports Complex, Sector 3, Panchkula.

Eyebrows raised over purchase of kits

Eyebrows have been raised over the manner in which the Kaithal district unit of the Haryana District Primary Education Programme (DPEP) purchased kits for “anganwaris” in the district last month. The Kaithal DPEP published a “quotation notice” in a Hindi newspaper of June 29, (Sunday), calling for quotations along with samples. The quotations were to be submitted in the office of the Additional Deputy Commissioner-cum-Chairman of the Kaithal DPEP before 10 a.m. the next day. The quotations were to be opened at 10-15 a.m. the same day by the purchase committee.

Interestingly, the quotation notice, which mentioned the items, along with their quantities, to be included in the kits, did not mention the number of kits to be supplied to the Kaithal DPEP. The quotation notice also made it mandatory for the successful bidders to complete the entire supply on June 30, the day the quotations were to be opened.

The kit included material like display board, poster colours, brushes, wax colours, drawing sheets, chart paper, human body parts, magnate, medical kit, personal hygiene kit.

Sceptics point out that even short-term tender notices give at least a three-day clear margin to intending bidders. But in the present case, only about 24 hours time was given. Moreover, since the day the quotation notice was published was a Sunday, the intending bidders could not have purchased samples from the manufacturers or wholesale dealers. Since the markets open only around 10 am, the intending bidders could not procure the samples even on June 30, (Monday) because the quotations were to be submitted before 10 am that day. Sceptics point out that since the quotation notice did not mention the number of kits to be supplied, the quotation notice was invalid. They say the quotation notice seemed to have been published only to complete the formalities. Only those persons could have responded to it who would have been briefed about it prior to its publication, thus vitiating the purchase process.

They also point out that it is humanly impossible to complete the entire supply order in one day unless a supplier was tipped much before the order was formally placed with him.

When contacted, Mr J.P.S. Dahiya Chairman of the Kaithal DPEP, said the purchase process had to be rushed because the World Bank grant for the DPEP would have lapsed on June 30, the day the quotations were to be submitted and opened. Denying that the manner in which the quotation notice was published had curtailed free competition, Mr Dahiya said the response to the notice was very good and several parties had submitted their quotations. Moreover, he said, the supply order was split between more than one suppliers. He said the Kaithal DPEP purchased 695 kits in all. There was no irregularity in the purchase of the kits, Mr Dahiya said. The quotations were opened by a purchase committee which comprised several members.

The DPEP at the state level is headed by Chief Minister, Om Prakash Chautala while Education Minister, Bahadur Singh, is its Vice-Chairman. Chief Secretary, A.N. Mathur and Education Secretary, M.L. Tayal are the Chairman and Vice-Chairman, respectively, of the working committee of the DPEP.

It is strange that such a high-profile team was unaware that the World Bank grant was to lapse on June 30 and it failed to take timely steps for the utilisation of the grant. Mr Sanjiv Kumar, who is under suspension these days, has moved the Supreme Court and shaken the state administration by making Mr Chautala a party in the case by name.

Charges framed against Nain, 18 BKU men

Additional Sessions Judge, Sanjeev Kumar, has framed charges against the BKU chief, Ghasi Ram Nain, and 18 other BKU activists in a case registered against them on November 25 last for blockading the national highway attacking police personnel and damaging government property. The Judge directed to delete three of the IPC sections included in the FIR against Mr Nain and others. The hearing was adjourned till July 21 by the court.

The BKU organised a ’Mahapanchayat’ at Shahjadpur on November 25 to protest against the non-payment of the arrears of sugarcane producers of the Naraingarh area by the Sugar Mill management for last one year. Later BKU activists led by Mr Nain blockade the national highway. The police lifted the blockade and arrested 19 BKU activists including Mr Nain in this regard. A case was registered against them under Section 332, 353, 148, 149, 323, 341, 153A, 188, 307, 436, 511, 506 and Prevention of Damaging of Public Property Act 1984.

The Judge while framing the charges ordered to delete IPC section 153A promoting enmity between different groups of religion, and race, doing act prejudicial to maintenance of harmony), 188 (disobedience to order by public servant) and 436 (mischief by fire or explosive substance with intent to destroy house etc.). The court has ordered to add one new Section 435 (mischief by fire or explosive case damage to amount of Rs 100, in case of agricultural produce Rs 10.) in the FIR. The other sections mentioned in the FIR would remain intact.

During arguments on the framing the charges counsels of Mr Nain and others Mr Ajay Jain, Mr Gian Grewal and Mr K.L. Sehgal stated that even if the case of the prosecution was taken on face value the offences under Section 307, 153A, 436, 148, 149 were not made out. They said that the BKU activists had been holding a peaceful procession in Shahjadpur as the Sugarcane producers of that area had been denied for the payment of their arrears by the mill management. Therefore there was no question of unlawful assembly.

The counsels said that the MLR of the hospital depicts only simple injuries and it had not been mentioned in the police report as to what seditions slogans the accused were raising. The public prosecutor submitted that the BKU activists had attacked the police personnel and damaged the government property.

Except Mr Nain all other BKU activists were released on bail by a district court. Mr Nain has been lodged in Ambala central jail since the day of his arrests. Two senior leaders of BKU, Fatheh Singh Fathua and Guni Prakash who were earlier granted bail were later arrested by the police in Ambala for raising slogans near the court premises. Later they were taken by the police of another district where a case had been registered against them.

Breach in Western Yamuna Canal

A 15-feet wide breach has occurred in the Delhi Branch of the Western Yamuna Canal (WYC) near Hullaheri village, about 8 km from here, yesterday inundating several hundred hectares of land in the area.

Official sources said today that the water was flowing towards Khizarpur Jat Majra village at a fast speed thus endangering the ring bundh around Hullaheri village.

The continuous heavy downpour has hampered the work for plugging the breach.

However, they suspected that some unscrupulous farmers have made a cut in the canal embanknent but the farmers have denied the allegations.

The gushing water has already submerged standing kharif crops, including jowar and paddy, in 360 acre of land in Hullaheri and Khizarpur Jat Majra village. The standing jowar crop and plantation of paddy have also been damaged in 100 acres. — PTI

A government school in Ambala City is being run from a building which has been declared unsafe.

There is a constant danger to the lives of the students as well as teachers of Government Co-educational High School No 7 in cloth market in Ambala City. The pre-monsoon showers have heightened the anxiety of school teachers as there are chances of portions of the roof collapsing.

A visit to the school reflects the sorry state of affairs. The crumbling walls and a playground which has turned into a pool of water puts a question mark on the efforts by the government to provide quality education.

The words Asurakshit Hai (unsafe) have been painted on the primary wing classrooms. The classes are held here for lack of an alternative. In some cases, the classes are held in the corridor. The primary wing has no fans and the students have to attend their classes in the sweltering summer heat.

The Deputy Commissioner, Ambala, Mr D.D. Gautam, said he would look into the matter. “Necessary action will be taken,” he stated.

The school students lamented that they have to study in an environment which is not conducive to education. “We do not have option but to study in this school. We do not sit in the classroom as the roof may collapse,” a student said.

The school Principal, Ms Usha Puri, said she had informed the authorities concerned but to no avail. “Nothing has been done despite my repeated requests. As a matter of fact, we were granted Rs 5,000 which was spent on getting the doors painted and the whitewash,” she said.

She said there was a constant danger to the lives of the children and teachers. “The roofs and walls of the classrooms are collapsing. The situation worsens when there is a rainfall. We are forced to hold the classes in the corridors,” she said.

Ms Puri said the PWD had declared the classrooms unsafe a few years back. “But, we are yet to get any grant for carrying out extensive repairs. We are always worried about the safety of the students,” she said.

At times, more than one class is held in the corridor and it becomes a challenge for the teachers as well as the students to carry on with their studies in such conditions. Incidentally, the school was started on a piece of land donated by Lala Duni Chand.

The in charge of the primary wing, Ms Savita Chauhan, said the condition was even worse in the primary section. “There is no fan because there is no power. We even get our water from home,” she said.

Coming down heavily on the trial court for “discarding prosecution evidence without cogent reason” while acquitting an accused in a rape case, a Division Bench of the High Court today convicted him for the offence.

Setting aside the acquittal order, the Bench, comprising Mr Justice S.S. Nijjar and Mr Justice S.S. Grewal, also directed the summoning of the convict through non- bailable warrants for hearing arguments on the quantum of sentence.

The convict — Anil Kumar of Jind — was booked for kidnapping and rape on April 8, 1993, under Sections 361, 366 and 376 of the Indian Penal Code (IPC) after the complainant alleged the rape of his 14-year-old daughter.

According to the prosecution, the victim had told the police that she had accompanied the accused after he promised to take her to a cinema hall for enjoying Haryanvi songs. The victim had added that “bad act” was committed in a ditch after she became dizzy following consumption of tea at the local bus stand.

After hearing the arguments, the Bench ruled: “We are of the opinion that the judgement of the trial court suffers from total application of mind. The evidence of the prosecution was discarded with cogent reason. The conclusions arrived at by the trial court were perverse. None of the findings given by the trial court were sustainable”.

Speaking for the Bench, Mr Justice Nijjar added: “We are of the opinion that the prosecution has proved its case beyond all reasonable doubts. The appeal is accepted. Youth murdered

Sirsa, July 11
Mamman, a village youth from Bhima in the district, was murdered on way to his brother’s house, allegedly by Gurmail Singh of the same village.

According to a complaint lodged with the police by his relative, Mamman was attacked on the head by Gurmail Singh last night. Mamman was seriously injured in the attack and taken to the local Civil Hospital where he succumbed to his injuries.

A past feud between Mamman and Gurmail is said to be the motive for the murder. The police is searching for Gurmail.

Man held on charge of killing wife

Sirsa, July 11
A man has been arrested on the charge of poisoning his wife.

According to the district police chief, Jot Ram of the village of Ganga in the district lodged a complaint with the police that his son-in-law had killed his daughter.

Jot Ram said his daughter had got married to Raj Kumar of the village of Kaluana about three years ago.

He had given her an ample dowry, but the in-laws of her daughter had demanded more.

The complainant said his daughter had been killed on July 2. The police has arrested her husband, Raj Kumar.

Encroachments removed

The Archaelogical Survey of India (ASI) authorities, with the help of the police, got demolished several illegal encroachments, including houses and shops, on the periphery of “Karan Kaa Teela” at Mirzapur village, near here, for the consecutive second day today.

Meanwhile, the affected persons alleged that no notice to remove their houses and shops had been served on them. The ASI officials, however, said that they had informed them about the demolition drive a day earlier.

A clarification

Mr Ramesh Bansal, one of the partners of Shiv Shankar Rice Mill in Indri, has clarified that no FIR has been registered against him and Mr Satpal Bishnoi, District Managar (Karnal) of CONFED at police station, Karnal city, in a case of cheating and forgery, till date. He has contradicted certain other facts contained in the report “FIR lodged against rice mill partner”, which appeared in these columns on June 10.

While alleging that the news-item has been published with mala fide intention, Mr Bansal stated that no attempt was made by the correspondent to seek his version or check the records of CONFED with regard to the allegation of Mr Jai Parkash Gupta, an Independent MLA from Karnal.

The report did not carry the version of the bank even as it alleged that Mr Gupta had made a written request to the bank for stopping the payment since two signed cheques from his cheque book had been stolen. In fact, the cheque of Mr Gupta had bounced due to “insufficiency of funds” in his account.
