‘Non-repayment to bank is not cheating’

Mere failure of a firm to keep up with its promise of repayment to a bank will not bring the case within the domain of cheating under Section 420 of the Indian Penal Code, Mr Justice Viney Mittal of the Punjab and Haryana High Court has ruled in a significant judgement.

Girls fare better in supplementary exams

Kala Utsav concludes

The two-day Kala Utsav, organised by the PR Educational Society, concluded at Rukmani Devi Hall yesterday evening. Mr Om Prakash Malik, chief patron of the society, said that they organised the Kala Utsav to bring out the talent among the children. “Our effort is to encourage the students to show their creativity,” he said.

Scribes observe ‘black day’

Man crushed
Yamunanagar, November 20
Raj Kumar, a resident of Ratia in Hisar district, was crushed to death by a bus on Monday at Jathlana bus stand, about 20 km from here.

Attack on Dalits: case takes new turn

The attack on Dalits and members of a minority community allegedly by hooligans of upper castes in Nawada village on the Haryana-UP border on November 15 took a new turn today with the victims alleging harassment at the hands of the police and the Sarpanch of Kurad village again.

And with that, the compromise between the Dalits and their attackers, which was worked out by the police on November 17, seems to have run into rough weather. Now the victims have alleged that the attackers had been harassing the Dalits and Muslims and they were not being allowed to use the 8-foot stretch of road which was given to them under the compromise.

In a representation to the DC, the victims alleged that the Sarpanch of Khurad village, Gordhan, in connivance with the police, had been restraining them from levelling the 8-foot street. Demanding action against Gordhan, the victims alleged that their valuable articles such as TV, and taperecorders, which were forcibly taken away by the attackers on November 15, had not yet been returned.

While walls of several houses were pulled down, five women were assaulted by the attackers, who wanted the families to vacate the prime “shamlat land”.

These families were shifted to the present site from Nawada Paar village, which used to get flooded when the Yamuna was in spate in the monsoons. Certain influential persons of the area had been eyeing the prime land, whose prices had skyrocketed in the recent years and the November 15 attack was latest in the alleged series of terrorising tactics.

While no case had been registered by the police till date, it did work out a compromise between the two parties.

‘Non-repayment to bank is not cheating’

Mere failure of a firm to keep up with its promise of repayment to a bank will not bring the case within the domain of cheating under Section 420 of the Indian Penal Code, Mr Justice Viney Mittal of the Punjab and Haryana High Court has ruled in a significant judgement.

Delivering the verdict on a petition filed on the behalf of a Panipat-based firm, Mr Justice Mittal also quashed a first information report registered against the organisation in November, 1997, under Sections 420 and 408 of the IPC.

The FIR was registered on the basis of a communication sent by a senior bank manager to the police authorities. The manager had claimed that the credit limit of Rs 75 lakh was initially sanctioned to the firm against hypothecation of stock.

The limit was later enhanced. However, during a subsequent visit to the firm it was found that almost the entire stock had been disposed of without the bank’s consent and even without depositing the sale proceeds.

Seeking the quashing of the case, counsel for the petitioner had contended that the bank as well as the police had completely failed to distinguish between the concept of hypothecation of stock and it’s pledging.

In the current case, the stock was never pledged with the bank. He had added that mere non-payment of dues by a person to the bank could not attract the provisions of Section 420.

After going through the documents and hearing arguments in the case, Mr Justice Mittal ruled: “It is clear that there was no allegation that the credit limit was got sanctioned by the firm or its partners by practicing any fraud upon the bank. Mere failure to keep up with the promise of repayment will not bring the case within the domain of Section 420 of the code. The petition succeeds and the FIR registered at Panipat Model Town Police Station is hereby quashed”.

Girls fare better in supplementary exams

Sixty per cent candidates have passed the supplementary matriculation examination held in September by the Board of School Education, Haryana

The Chairman of the Board, Mr Rambir Singh said today that the result of the examination would be declared tomorrow. He lauded Board employees for preparing the results in time.

The secretary of the Board Mr M.S. Mor said that 87078 candidates took the supplementary examinations and 52614 candidates were declared successful. He said 17914 candidates were placed in compartment. The girls fared better than boys with pass percentage of 66.73 compared to 57.77 of boys.

He said that the fail/compartment/re-appear cards of the candidates would be sent after a week of the declaration of the result and the certificates dispatched in 15 days.

The secretary added that on the basis of this examination, the candidates who wanted to appear in annual examinations in March 2003 could send forms for compartment/re-appear/ improvement examinations with Rs 250 fee and an additional subject a fee of Rs 150 up to December 6, 2002.

After this late fee of Rs 500 would be payable. He added if the examination forms were deposited 14 days before the examinations Rs 1000 would be charged by way of late fee.

Consolation prizes went to Smile, Ashish, Amanpreet, Anu Saini, Vieky, Vishal, Navneet, Reema, Akash, Reenu, Sumit, Aliee, Madhu, Harvinder, Nishant, Rizwana and Vikas.

In rangoli, the first-prize winners in different groups are Ayushi, Akshansh and Rashmi Bidla, the second-prize winners Lovpreet, Manju and Kanika Goel and the third-prize winners are Sumnit, Namarta, Charu and Jyoti. Consolation prizes went to Sheetal, Baljeet, Hardeep, Kulvinder, Durgadass, Deepshikha, Kapila, Richa, Komal and Nidhi Kalra.

In handicraft, the first-prize winners in different groups are Madvi, Neha and Chinki, the second-prize winners Pratibha, Garima, Nikhil and Aman Kapoor and the third-prize winners are Medha, Tista and Navneet. Consolation prize winners are Paawan, Anshika, Harsimran, Swat and Kanchan.

In salad, the first-prize winners are Satnam Kaur, Nidhi and Leena, the second-prize winners Shantanu, Divya Goel and Dhruv and the third-prize winners are Amandeep, Ruchi, Heena and Monika. Consolation prize winners are Latika, Sabba, Nagma and Chavi.

In flower arrangement, the first-prize winners in different groups are Shivani, Navpreet and Shalu, the second-prize winners Shivdeep, Parag and Palvinder and the third-prize winners are Vikas, Vanya and Vinni. Consolation prize winners are Swapnil and Heena.

In fancy dress (junior), Goyam (1), Ashima (2) Sahil and Ritik (3). Consolation prizes went to Shantanu Garg, Ananya, Yashwant, Namrata and Gurpreet. In fancy dress (senior), Dhauraj Singh was first, Mohit Sharma second and Swapnil third. Consolation prizes went to Sourabh and Deepika.

Scribes observe ‘black day’

Journalists observed “black day” today in protest against the festivity and decoration of the roads by a religious dera here. The scribes wore black badges and local newspapers did not bring out their editions today. Keeping in view the mounting tension between the scribes the religious Dera’s followers Rapid Action Force was deployed at all sensitive places turning the city into a cantonment. However, no untoward incident was reported.

Man crushed

Yamunanagar, November 20
Raj Kumar, a resident of Ratia in Hisar district, was crushed to death by a bus on Monday at Jathlana bus stand, about 20 km from here. He was running to board the bus, but slipped and came under its wheels. He died on the spot. The driver of the bus fled from the site. A case has been registered against him under Sections 279 and 304, IPC.
