Order in Bansi Lal case a trendsetter Chandigarh, March 27 So far the court had usually avoided interference in the legislative assemblies matters, with an exception in cases relating to disqualification of members by presiding officers under the anti-defection law. However, the judgement in the Bansi Lal case opens the matters relating to the recognition of an MLA as the LOP also to judicial scrutiny. Mr Bansi Lal was elected as the Leader of the Haryana Vikas Legislative Party on July 24, 1999. A copy of the resolution adopted by the 17 HVP legislators was sent to the then Speaker, Prof Chhattar Singh Chauhan, requesting him to accept Mr Bansi Lal as the LOP. The Secretary of the Vidhan Sabha informed the government that Mr Bansi Lal had been recognised by Prof Chauhan as LOP. Subsequently, Prof Chauhan resigned from his post. The government took the stand that Mr Bansi Lal was not declared as the LOP in accordance with the law and as such was not entitled to relief. The Chief Minister, Mr Om Prakash Chautala, against whom Mr Bansi Lal had alleged mala fide, denied the allegations of personal grudge and vendetta, saying that “unfortunately, Mr Bansi Lal despite his long political career, has failed to appreciate that in a democratic set-up like ours, difference of opinion on policies and vital issues relating to the state or nation or criticism of each other’s view point based on sound and healthy reasons, cannot be termed as a deep-rooted enmity or personal vendetta.” The new Speaker, Mr Satbir Singh Kadian, contended before the High Court that the resolution electing Mr Bansi Lal as HVP Leader was not passed by the legislative wing but by that party and only a typed copy of the resolution, duly attested by Mr Mani Ram Godara, then an MLA, was sent to the Speaker and as such there was no proper compliance with the rules. Allowing Mr Bansi Lal’s petition, the Division Bench comprising Mr Justice Swatanter Kumar and Mr Justice Mehtab Singh Gill, said the stand the government “is equally vague and main thrust of all the respondents is that there has been no appropriate compliance to the provisions of the Act and there was no proper recognition of the petitioner as the LOP”. |
Rs 3.26 cr MC budget passed Fatehabad, March 27 Fourteen out of 19 Municipal Councillors had expressed lack of trust in the working of the Municipal president Mrs Sheela Wanti Tuteja. Alleging large-scale irregularities in the functioning of the committee, the members had demanded the resignation of the municipal chief. They also had requested the Deputy Commissioner, Fatehabad, to call a meeting of the committee so that they could dethrone Ms Tuteja through a no-confidence motion. A meeting of the municipal committee was held here on Saturday to pass the budget for the next year. When the president was presenting the budget, 14 out of a total of 19 members rose in their seats and demanded the details of the money spent during the current year. The members alleged that though the municipal president gave a figure of Rs 53 lakh she could not give details of the money spent. Most of the members alleged that not a single penny had been spent on development in their ward. They alleged that most of the development works were on papers only and allotted to a single agency. The members also objected to continuous interference of Mr Jug Lal Tuteja, husband of the municipal president in the day-to-day affairs of the committee. Later, the dissident members assembled at the residence of the municipal councillor, Mrs Usha Dahiya. Besides Mrs Dahiya, Mrs Meena Bansal, Mrs Parmo Devi, Mr Chunni Lal, Mrs Shikha Mehta, Mr Charanjit Sharma, Mr Gobind Chowdhary, Mr Sushil Narang, Mr Mukesh Soni, Mrs Usha Chowdhary, Mr Pankaj Mukhi, Mrs Durgesh Arora and Mr Jagir Singh were present in that meeting. The councillors addressed mediapersons and delivered a photocopy of the letter written to the DC to the reporters. But the unity of the dissidents did not sustain for long. First of all, three women members of the Municipal Committee Mrs Mehta, Mrs Arora and Mrs Bansal deserted the dissidents and joined the municipal chief’s bandwagon. Later, Mr S.P. Bansal also joined the municipal chief’s group and the budget was approved with the required quorum of the house. |
HVP dharna against Union, state Budgets Fatehabad, March 27 Addressing party workers, Mr Gillankhera alleged that the Central and the state governments have been observing anti-people policies. He said the law and order situation in the state was at an all-time low, and the state government had been adopting undemocratic and repressive policies against its political opponents. The party gave a memorandum to the state Governor through the Deputy Commissioner. The memorandum said though less than 15 days were left for the arrival of wheat in the market, the government had still not declared the Minimum Support Price (MSP) for the crop. The party alleged that steep hike in the prices of kerosene, sugar and LPG had hit the poor the most. The prices of the DAP fertilisers had been increased by 5 per cent. The subsidy on the chemical fertilisers had been withdrawn. The hike in the railway fare had disturbed the budget of the poor, it said. The memorandum also criticised the government for making income tax rules more difficult and complicating the banking procedure by making PAN compulsory for any deposit above Rs 50,000. |
HAU offers training
for self-employment Hisar, March 27 The Vice-Chancellor pointed out that NABARD had recently formulated a scheme for agriculture, veterinary and allied graduates to provide financial assistance for setting up agri-clinics and agri-business centres. These trainings would help the graduates to make full use of the opportunity. Under this scheme, NABARD had made a provision for a loan up to Rs 10 lakh individually or up to Rs 50 lakh for a group for setting up these businesses, he said. Giving details of the services to be rendered by agri-clinics and agri-business centres, the Vice-Chancellor said while the former would provide consultancy services on various advance technologies for agriculture and allied activities including information on soil, feed quality, plant protection, veterinary services, fisheries, the latter would let farmers hire various sophisticated agricultural equipments, thus opening new vistas for gainful
self-employment. |
Sampat Singh acquitted Hisar, March 27 Prof Sampat Singh, number two in the Om Prakash Chautala government, was present in the court. Talking to reporters later, Prof Sampat Singh said he had great faith in the judiciary. The truth had prevailed, he added. The police here had registered a case in 1993 against Prof Sampat Singh, for amassing wealth disproportionate to his known sources of income, by Mr Pratap Singh, son of late Deputy Prime Minister Devi Lal and brother of Chief Minister Om Prakash Chautala.

NDA has ‘lowered’ image of Rajya Sabha
Hisar, March 27 Speaking to newspersons after a meeting of party workers held in connection with the preparations for the proposed April 2 rally of the Congress in Kurukshetra he said by this action the NDA government had set a wrong precedent and lowered the status of the Upper House of Parliament. He termed it as the biggest blow to the democratic institutions in the country. He said the BJP had brought the Bill only to promote its narrow political agenda as the existing law was strong enough to curb terrorism in the country. This new Act would only encourage the misuse of the law against political opponents of the government and minorities. He said the Kurukshetra rally was aimed at protecting the interests of the farmers, labourers and the poor whose interests had been sacrificed by the Chautala government. |
Kidnapped advocate returns Ambala, March 27 Mr Akhil Gupta, who was reportedly abducted on Monday, turned up early this morning. It is suspected that Akhil was kidnapped for ransom. Neither his family members nor the police officials were ready to comment on it. Sources said that Akhil had reportedly informed the police about a ransom demand made by the kidnappers. When Akhil expressed his inability to pay the amount, he was dropped off near Golden Forest at about 4.30 am this morning. Akhil has reportedly told the investigators that the kidnappers had kept him in a dark room. Also, the kidnappers had taken away his car and gold ring. The Superintendent of Police, Mr Sandeep Khirwar, said that investigations were on. Akhil went to the residence of the Superintendent of Police, Mr Khirwar, early this morning. Akhil’s family members were relieved to see him back safe and sound. The family members were unwilling to talk about the incident and enquiries were stone-walled. They said that Akhil was traumatised by the experience. Despite repeated attempts, Akhil could not be contacted. At his home, his brother said that Akhil had come home but he had “just now” gone out with some lawyers. The District Bar Association today continued its work suspension for the second day over this incident. A bar association member while strongly condemning the incident said that the police must crack this case at the earliest. |
Blind student missing Ambala, March 27 The student, Satya Pal, was staying at the Sanatan Dharam Institute for the Blind, Ambala Cantonment. On march 23, Satya Pal had taken a sum of Rs 700 from the cook of the institute, saying that he had to deposit his fees in the college. Satya Pal’s friend K.K. Malik said he had left for the college as usual at about 8.30 a.m. Satya Pal (23) is doing B.Ed along with three other students of the institute. The other students came back at about 3 p.m. Since Satya Pal did not attend the class, they presumed that he might have gone home. He hails from Jodhpuria village in Sirsa district. When Satya Pal did not turn up for his classes on Monday, the other students got suspicious. On enquiring about him, they learnt that Satya Pal had not informed anybody before leaving. Mr Malik said Satya Pal’s relatives had no information about him. He said Satya Pal was suffering from a stomach ailment for the past three months for which he was undergoing treatment. This is the second instance of a student of the institute gone missing. Earlier, Sanjay Kumar had gone missing on July 19, 1999. He could not be traced till this day, student said. |

Prohibitory orders in Fatehabad Fatehabad, March 27 The orders, issued here today, prohibit the assembly of five or more persons within the radius of 200 meters of all colleges, educational centres and examination centres. The carrying of arms or ammunition or mobile phones in the vicinity of examination centres has also been prohibited. |
