SC tells 102 families to vacate flats by May 31

New Delhi, November 19 A Bench headed by Justice GS Singhvi, which had stayed the demolition of the illegal flats on November 13 after taking suo motu notice of the agitation by owners, today clarified the Municipal Corporation would be free to pull down the flats after May 31 as per the SC verdict dated February 27, 2013. Attorney General GE Vahanvati informed the Bench that he was unable to arrive at a proposal to find a permanent solution to the problem as he had told the court on November 13. He had said the unauthorised constructions would have to go, but the flat owners should be given an opportunity to have flats in the society without affecting the February verdict. Against the permission to have only six floors in each of the buildings, the society had constructed seven towers during 1981-89 with 20 floors in one building and 17 in another, prompting the corporation to take action for the demolition of the illegal flats. The court on February 27 had ordered the Brihanmumbai Municipal Corporation to demolish the illegally constructed flats and on October 1 refused to re-consider its earlier order and had set November 11 deadline to vacate 102 flats which were declared as illegal. However, on November 13, hours after over 100 agitated families clashed with the police while the civic squad was bulldozing its way into the premises, the apex court had stayed the demolition till further order,saying it was "badly disturbed by the development that is taking place at Campa Cola premises in Mumbai." |

Raipur, November 19 Led by CM Raman Singh, Congress treasurer Motilal Vora and the first CM of Chhattisgarh Ajit Jogi, as many as 1,39,75,472 electors exercised their adult franchise across 19 districts of the state. In the first phase of polling for 18 seats in the state on November 11, a record turnout of 75.53 pc was witnessed despite the Naxal threat. The trend continued with the Election Commission declaring a tentative 74.70% turnout as of 6 pm, a decent improvement over 71.09% in 2008. The voting would determine whether the BJP would wrest power for a third term in the state with increase in turnout being attributed to 4,675 poll awareness observers the EC had deployed for the first time in Chhattisgarh to encourage voters. But despite EC using 6,372 digital and 400 video cameras to record polling, one person was killed after a policeman in Bhindarwani village of high profile Sajja segment opened fire after an altercation over entry to the booth. Leader of Opposition Chhattisgarh and five-time Congress MLA Ravindra Chobey is in contest here. Overall, the polling trends were encouraging with 40% turnout by 1 pm. The lead was fired by women and youth who made beelines to be counted. As Nirmala Yadav of Durg City segment said: "I woke up early to finish my chores today so I could come and vote for development." Excited young voters like Baliram Kanwal stood with octogenarians in long queues outside booths as in Kota segment of Bilaspur from where Ajit Jogi's wife Renu is in the fray to retain her seat. Congress leader Ajit Jogi's son Amit is fighting from the adjoining Marwahi ST segment which could well have seen the maximum turnout today; it had touched 80% by 4 pm. Poll excitement was, however, missing in Dhraghata village of Korba district which boycotted elections citing lack of development. But elsewhere people ignored Naxal-led interruptions (four tiffin bombs were recovered by the police today) to register their preferences. The voting though was not incident free with an EC observer registering an FIR against BJP candidate from Raipur west Rajesh Munat, who, he said, threatened him. Munat is a BJP minister very close to the CM who cast his vote in hometown Kawardha along with his wife today. If Munat's issue was not enough, Speaker of Chhattisgarh Assembly Dharamlal Kaushik clashed with his Congress rival in Bilha segment over who will vote first considering the two had a common booth. Kaushik broke the queue and the Congress candidate objected. Finally, Kaushik came around. Another BJP minister contesting again from Raipur South seat Brij Mohan Agarwal courted controversy today when he accused the EC of bias after finding the names of 7,000 voters missing from the electoral rolls though they had their voter slips. Agarwal said he would move the apex court on the issue. The EC seized Rs 8.69 crore cash during polls in the state and 38, 780 litres of alcohol worth Rs one crore; this despite deployment of 22 expenditure observers and 19 police observers by the Election Commission. |

Punters bet big money on BJP
Raipur, November 19 “Anyone betting on the BJP winning over 49 seats will win and anyone betting on the BJP getting less than 47 seats will lose if that the party manages 47 seats. For every rupee, one rupee will be returned on a winning bet,” a Raipur-based bookie explained. But punters have set lower victory targets for the Congress. Syndicate operators said police surveillance in Chhattisgarh was very strict, a reason why betting was not as alive here as in Rajasthan where syndicates branched out from Bikaner. “Around Rs 100 crore have been invested. Betting margins are sent from Bikaner. The business is run on the phone,” says the bookie operating from the heart of Raipur where bookies are also betting on the victory or loss of two top ministers in CM Raman Singh’s cabinet. One of them Brij Mohan Agarwal is being challenged by Congress’ Mayor Kiranmayee Nayak (a woman) in Raipur south segment. “We will pay 5 paisa for a rupee on a bet of Agarwal’s victory but Re 10 over one rupee on Nayak’s win,” the punter said. In Raipur West, where another BJP minister Rajesh Munat (a Raman confidante) is being challenged by Congress’ youth leader Vikas Upadhyay (for whom Rahul Gandhi canvassed), odds on Munat winning are 45 paisa for a rupee as against Rs 1.90 for Upadhyay. Though by today’s betting trends, the BJP seemed to be a favourite to win, bookies said the odds could change. When polls were announced, punters had predicted 53 seats for the BJP; that’s now down to 49. Similarly, the Congress had been predicted to win 38 seats earlier; that’s now up to 43 seats. “Once we know voting trends by tomorrow, odds will change further. Syndicates will also bet on the victory margin of CM Raman Singh contesting from Rajnandgaon segment,” the bookie said informing TNS that Chhattisgarh had also a booming cricket betting network which has been demolished by the police. Modi, who also addressed rallies in Alwar and Bandikui, poked fun at Rahul Gandhi, saying poor attendance at the Congress leader’s rally in Delhi on Sunday had forced an embarrassed Chief Minister Sheila Dikshit to plead with people not to leave the venue. “There are rallies where people are told ‘stop, don’t go; stop, don’t go’. And there are rallies where I have to apologise to people because they could not see me because of huge turnouts, he said in Alwar in the run-up to the December 1 Assembly elections in Rajasthan. The BJP’s prime ministerial candidate was apparently referring to Dikshit’s appeal to sections of the crowd seen leaving the venue to wait till Rahul’s speech got over at the November 17 rally. At another rally in Bandikui, Modi accused the Congress-led government of not taking effective steps to control inflation to bring relief to the common man reeling under rising prices. “Look at the arrogance of the Congress leaders, despite high inflation they are not bothered about improving the situation,” he said. Yashodhra won’t campaign against nephew Jyotiraditya Shivpuri, November 19 Jyotiraditya's elevated status as the election campaign committee chief has effectively pitched him against Madhya Pradesh CM Shivraj Chouhan and the entire Shivpuri region seems enthused by the prospect. This, therefore, is the BJP's way of cornering Jyotiraditya on his home turf. While campaigning, Yashodhra makes it a point to tell people that when they press the Lotus logo on the
EVM, they would be voting for Shivraj. "I will be part of the Shivraj government," she says. (Jyotaraditya) attended nukkad sabhas while I was contesting the Lok Sabha polls in 2009. So I would not say that this is something he has not done earlier. Though I would not do it. I have never campaigned against him. However, it (campaigning against her in
Shivpuri) is his prerogative," she says. She may not say so, but clearly Jyotiraditya's breaking the tradition being followed from the times when her mother Vijayraje Scindia and brother Madavrao Scindia contested from opposite camps, has not gone down well with her. But she also acknowledges the extra efforts Jyotiraditya is putting in for the party to bring the warring factions together. "He is doing well. He has managed to get the entire Congress to support him," she says. Apart from the theory that she has pitched in Shivpuri to help the party on the other four constituencies in the Shivpuri
region-Shivpuri, Kolaras, Pichore, Pohari and Karera- there is another conjecture. Sources say she has been moved to Shivpuri to make way for Morena MP Narendra Singh Tomar in Gwalior for the coming General elections. On whether she is happy about shifting from Parliament to Assembly all that Raje says is that her party wanted it this way. "I am happy. I have done a lot of work in the area which I hope people will recognise and reward," she says. Locals say that BJP's chances on the five Shivpuri seats are mixed. Congress has pitched good candidates against BJP "outsiders," and there are also complaints against sitting
MLAs. Yashodhra's plus point is her royal status. Old timers hold her in high regard, quite evident from the way they treat her. But Raghuvanshi is a strong candidate. He lost to the BJP Makhanlal Rathore in 2008 with less than two per cent votes. For 2013 he began his election preparation much early but the fact also is that the Scindia family has never lost an election from
Shivpuri.

Women contestants increasing, but winnability on the wane Sikar, November 19 Data available with the state election commission of Rajasthan points out that of the 13 state assembly elections conducted so far between 1952 to 2008, a total of 699 female candidates from across the state have tried their luck at entering the assembly, but just 133 have been able to make their way to the House. This, only accounts for 19 per cent of the total assembly seats, a far shot from the 33 per cent reservation being sought in the women’s reservation Bill. What has emerged that while with the increase in women’s voters in the state, the number of women looking to contest the elections has also increased. But their winning graph has not gone up but only declined. In the 1962 state assembly elections, 15 women had filed their nominations and of them eight managed to enter the House, which accounted for a staggering 57 per cent. However, in the last 2008 elections, the picture was quite different. While 154 women contested the elections from across the state, only 28 managed to gain entry in the House, just about 18.18 per cent. It was in 1957 that the women started contesting the Rajasthan State Assembly elections for the first time. While 21 women contested, nine were successful in their quest to enter the House. Data has showed that in 46 years, the number of women voters increased by 248 per cent but their number of success to enter the state assembly has decreased greatly. Incidentally, till date, the Election Commission had forfeited deposits of 416 women candidates in the polls conducted, however, the forfeited figure for the first election have been indicated as nil in its
reports. Deeg’s ex MLA Krisnendra Kaur (Deepa) has two records to her credit one being the highest vote getter in the 1985 elections having won by 97.13 per cent of the total votes cast when she contested the election as an Independent candidate while her opponent Munna Marwadi Kisen, another Independent candidate, just scored 1.51 per cent of the total votes cast. In the 1998 elections, Kaur was unlucky despite being contesting on a BJP ticket and her deposit was forfeited for getting only 10.1 per cent of the total votes polled. She lost the seat to Arun Singh, an Independent candidate. Statistics from the EC portal shows that even a strong party brand could not save many female candidates from losing their security deposit. Data shows that while 162 candidates could not cross the mark of 500 votes, 74 female candidates were unsuccessful to cross the 1,000 mark till the 2008 polls. In 1957,

Bikaner, November 19 On a day spent addressing public gatherings in Rajasthan ahead of the December 1 Assembly elections in the state, Rahul told a gathering here: "BJP people are good at speeches ... (they) give very good speeches on TV. "The BJP people will show (the speeches) from every angle ... from top, from behind, from below. They are number one in marketing," he said, while asserting that the Congress, on the other hand, believed in development. "If you see our record in Rajasthan (where the Congress is in power with Chief Minister Ashok Gehlot at the helm) and at the Centre as part of the UPA government, then there is no comparison (between Congress and BJP). "The BJP says during the NDA regime many roads were built...they keep harping on it. We (UPA) constructed three times more roads (than NDA)," Rahul claimed. "We made the Delhi, Mumbai and Hyderabad airports. We don't know how many airports we constructed in Rajasthan... We constructed the Indira Gandhi canal. Bru voters cast votes through postal ballot
Aizawl, November 19 Polling in the relief camps would continue tomorrow if there was any voter who could not exercise franchise today, Mizoram Joint Chief Electoral Officer H Lalengmawia said. “Polling was completely peaceful and conducted under tight security in the six relief camps - Asapara, Naisingpara, Hazacherra, Kaskau, Khakchangpara and Hamsapara in North Tripura district,” he said. The 11,612 Bru voters lodged in the relief camps were eligible to exercise franchise through postal ballots in their relief camps for the November 25 Mizoram polls. As many as 86 polling officials, including seven nodal officers, who reached the relief camps yesterday morning, conducted the polls under the supervision of one special observer and six other observers, he said. Platoons of armed police personnel were deployed in the polling booths, he said. Tripura government officials, he said, had fully cooperated with the election officials sent from Mizoram. The polling party reached Tripura via Zomuantlang hamlet as the activists of the Mizo Students Union had organised a blockade at the Mizoram-Tripura border river Langkaih in Kanhmun village on Sunday. The students objected to the conduct of polling in the camps by sending polling officials from Mizoram as they alleged that the Brus refused to return to the state despite several pleas from the Centre, state government and the civil societies. —

New Delhi, November 19 Sreekumar, who retired as the Director-General of Gujarat Police, has also named BJP spokesperson Meenakshi Lekhi and Nambi Narayanan, a retired scientist of the Vikram Sarabhai Space Centre (VSSC), as accused in his complaint. He alleged the accused hatched a conspiracy and on November 7, Lekhi gave statements harming his reputation “by digging out a closed case of 1994 related to espionage affecting the national interests of country”. India, Vietnam to bolster defence ties
New Delhi, November 19 India’s offer of a $100 million credit line to Vietnam to purchase military equipment, particularly four surveillance boats, has already created the right atmosphere for the visit by the Vietnamese leader. Nguyen will hold delegation-level talks with Prime Minister Manmohan Singh here tomorrow at which security, defence, economic and cultural issues are expected to be discussed apart from various global developments, official sources said. Thanks to Chinese assertiveness in the disputed South China Sea, India has expanded its defence cooperation with Vietnam in recent years. Apart from offering the credit line, the Indian Navy is learnt to have agreed to train Vietnamese submarine crews as Hanoi begins to acquire six kilo-class submarines from Russia. Asked if India was also considering Vietnam’s keenness on buying BrahMos missile, sources said it was not on the agenda at this stage. Beijing’s posturing on the South China Sea is also likely to figure prominently during the talks between the two sides. Both India and Vietnam have noticed a significant change in China’s position over the disputed sea. Sources said the Chinese now appear to discuss the South China Sea sovereignty issue within the ASEAN ambit.

NHRC to probe police brutality on protesters
New Delhi, November 19 A three-member Bench headed by Justice GS Singhvi noted that police video footage “does not show acts of rioting or any arms or brickbats in the hands of the protestors... we are left with no option but to hold, at least prima facie, that in the incident in question, peaceful protestors were subjected to beating by lathis”. The Bench, which included Justices SK Singh and C Nagappan, asked the NHRC to go into the victims’ complaint that the Gokulpuri police with the help of policemen from nearby police stations had thrashed them, thereby violating their fundamental rights to life and dignity guaranteed under Article 21. The Bench pointed out that Section 12(A) of the Protection of Human Rights Act 1993 had specified that human rights “include rights relating to life, liberty, equality and dignity of the individual”. The apex court ruled that the police claim that the protesters had resorted to rioting and damaging public property “is neither supported by photographs nor by the video footage”. The victims, who had suffered serious injuries on the head, back and limbs, had filed a PIL in the SC seeking compensation for their illegal arrest and torture.

Merkel to get Indira Gandhi Peace Prize
New Delhi, November 19 The announcement was made today by the Indira Gandhi Memorial Trust, which said the award was being given to Merkel (59) for her exemplary leadership in Europe and the world during the financial crisis and her stewardship of German economic growth. The trust said the prize was being given to the German leader because of the work done by her for promotion of global economic stability, her commitment to universal peace and disarmament and her leadership role in strengthening productive and mutually beneficial relations with India and other developing countries. Merkel, who became the first woman to be elected as Chancellor of Germany, has been a strong supporter of close relations with India, it said. Her joint declaration with the Indian Prime Minister greatly strengthened the Indo-German relations. —

International Film Festival kicks off today
Panjim, November 19 The 11-day star-studded affair to be held from November 20 to 30 will not only showcase 326 films from 76 countries, but also witness participation by a host of celebrities.
The list of stars who will make the festival a memorable affair runs long. It includes eminent directors and actors from around the world. Among the Indian galaxy, some of the special guests will be Rekha, Asha Bhonsle and Kamal Hassan. Hollywood Academy Award winning actor Susan Sarandon will be the guest of honour at the inaugural ceremony. KPS Gill draws flak for remark on Assam agitation martyr
Guwahati, November 19 During an interaction with the media at Tezpur in north Assam, where Gill had gone to attend a function of North East Sports Foundation, Gill had reportedly commented that the first martyr of Assam Agitation, Khargeswar Talukdar, was not killed in police action on December 10, 1979 but died after getting drowned in a pond while the police were giving a hot chase to some of the agitators. He pointed out that the post-mortem report mentioned that there was no injury mark on Talukdar’s body. That day KPS Gill, then Deputy Inspector General of the Assam Police, was leading the police action at Bhawanipur in Barpeta district and was blamed for Talukdar’s death by people. Talukdar was declared the first martyr of the Assam Agitation (1979-1985) by agitation leaders belonging to the All-Assam Students’ Union (AASU) and the Asom Gana Sangram Parishad (AGSP). Gill’s comment has evoked sharp reaction from nationalist camps in the state. AASU adviser Dr Samujjal Bhattacharyya today termed Gill a “liar” and claimed it was he who had beaten up Talukdar. The AASU leader said people of the state would never pardon Gill for the atrocities he had perpetrated on innocent non-violent agitators in the capacity of a senior police officer. The AASU termed Gill’s comment an insult not only to Talukdar but also all 855 martyrs of the agitation. The Asom Gana Parishad (AGP), which was formed by Assam Agitation leaders, also termed Gill’s comment an insult to the people of the state.

Amethi teen returning from state function ‘raped’
Lucknow, November 19 Police sources said a student of Ramchandra Shukla Smarak Inter College, Jamuari of the Shukul Bazar area of Amethi district along with 50 girls had gone to Dhanpata Maurya Mahila College in Rasulpur in Faizabad to receive the laptop from state minister of social welfare Awdhesh Prasad. No representative of the college management was reportedly accompanying them. The minister arrived late and distribution started around 7 pm and continued till 10.30 pm on Sunday. As there was no arrangement for the girls to stay in Rasulpur they returned to Amethi in the vehicle provided by the college management. After dropping the girls at their respective homes the driver of the vehicle stopped at a deserted spot and allegedly raped the girl and dumped her. The girl later told her her parents who filed a complaint with the Musafirkhana police station yesterday, said Deputy Superintendent of Police Vipul Srivastava. The agitated parents of the rape survivor held the minister and district administration responsible for not making adequate arrangements for the safety of the girls.

Govt withdraws plea on jailed netas from SC New Delhi, November 19 A Bench comprising Justices AK Patnaik and SJ Mukhopadhaya passed the order as Additional Solicitor General L Nageshwara Rao made it clear that the Centre did not want to pursue its petition as Parliament had already passed a law amending the Representation of the People Act 1951 nullifying the SC verdict and enabling aspirants to contest from jail. In its verdict, the SC had ruled that since a jailed person had no right to vote it would not be proper to allow such a person to contest the election. “A person who has no right to vote by virtue of sub-section (5) of Section 62 of the RP Act is not an elector and is therefore not qualified to contest the election,” it had held.

No probe needed, ‘snooped’ woman's father tells NCW Ahmedabad, November 19 Bhuj-based Pranlal Soni, who had earlier issued a statement circulated by the BJP central unit, today wrote a letter to the National Commission for Women requesting the organisation not to entertain any complaint against Modi and former Minister of State for Home Amit Shah on the issue and treat the matter as closed. In his letter, Soni claimed his daughter was aware of the surveillance mounted upon her "at my request". Claiming that he had a long-standing personal relation with Modi, he said he had sent an "oral request" to the Chief Minister for shadowing his daughter for her "safety and security". Soni said his daughter "is an architect and an educated lady. She is married and also deeply perturbed by intrusion into her privacy. With a view to ensure that her anonymity and whereabouts remains out of public gaze, she has requested me to write this letter to this honorable commission on her behalf and her request." "In 2009, due to personal and family reasons, I had made a request to the honourable CM of Gujarat to take steps in my daughter's interest. Bangalore woman brutally attacked, robbed inside ATM booth Bangalore, November 19 The footage, caught on the CCTV camera installed in the kiosk, rattled the viewers of India's IT hub when it was aired on local TV channels. "The incident occurred when the victim, Jyothi Uday, a manager with a branch of Corporation Bank, was hit hard on the head by the assailant inside her bank's ATM kiosk with a machete and left her bleeding before disappearing with her cash (Rs 2,500) and mobile," a police official said. No security guard was present at the kiosk at the time of the incident. Jyothi has been admitted to a city hospital as her head bled heavily. "We have registered a case under Section 397 of the IPC for attempting to cause death or grievous injury while committing robbery or dacoity and formed a special team to arrest the assailant at the earliest," the police official said. The CCTV camera footage, the police obtained from the bank, shows the unmasked assailant entering the kiosk while Jyothi was in front of the ATM to draw cash, and threatening her after downing the shutter from inside. "As seen in the footage, the assailant took out a machete from a shoulder bag and asked Jyothi to draw cash from the ATM. When she tried to escape, he pushed her in a corner and hit her on the head with the machete. After checking her bag, he left the kiosk by again pulling down its shutter from outside," the police official said. The ATM kiosk is located on the ground floor of the LIC building diagonally opposite the Bruhat Bangalore Mahanagara Palike (BBMP) head office in the Corporation Circle and quite near the Ulsoor Gate police station. "As the assailant did not wear any mask and is clearly seen in the footage, we have already circulated his photo to all police stations and check posts to arrest him before he gets out of the city. We are hopeful of cracking the case as the assailant is clearly identifiable," the police official said.

NATO ally aircraft may have snooped on INS Vikramaditya
New Delhi, November 19 The aircraft carrier may have been snooped on by an American-origin P-3C Orion surveillance aircraft belonging to the NATO nations, sources said. They, however, said the warship was with the Russian Navy when the P-3C Orion flew close to it during the sea trials. INS Vikramaditya has generated a lot of interest in the global navies and a lot of them, including both friends and adversaries, want to know about its capabilities and strengths. — PTI
