Juvenile board can deliver verdict: SC
New Delhi, August 22 A three-member Bench headed by Chief Justice P Sathasivam passed the verdict while deciding to hear a plea for denying leniency to under-18 juveniles involved in heinous crimes. The JJB presided over by Principal Magistrate Geetanjali Goel has been deferring its verdict on the minor in view of a petition filed in the SC by Dr Subramanium Swamy and others challenging the Juvenile Justice (Care and Protection of Children) Act 2000 which treated alike all juveniles, including those involved in murder and rape, strictly going by the 18-year age cap and ignoring their level of maturity and the gravity of the crime. Juveniles involved in serious offences entailing imprisonment for a minimum period of seven years should be taken out of
the purview of the JJ Act and tried in regular criminal courts instead of by the JJ Board, the petitioners have pleaded. The blanket immunity granted to all juveniles under the JJ Act should be removed going by the international concept of criminal responsibility and the victims’ rights under Articles 14 (equality before law) and 21 (life and liberty). The Bench, which included Justices Ranjana Desai and Ranjan Gogoi (who wrote the verdict), rejected the contentions of Additional Solicitor General Sidharth Luthra, who appeared for the Centre, and advocate AJ Bhambani, representing the JJ Board, that the petitioners being third parties had no locus to intervene in the gang rape case. Pointing out that the petitioners had clarified that they did not want to intervene in the gang-rape case, the SC said its decision on their plea would have a
bearing on all such cases and as such its impact on the minor concerned would be insignificant “in the
backdrop of the far-reaching consequences.”

Rationalist’s killing: Ban sought on right-wing organisation
Mumbai, August 22 Protesters at several places in Pune and Satara have put up posters condemning the organisation for gloating over Dabholkar’s murder. Leaders of the Congress and the NCP reiterated their demand for banning the sanstha. “The Sanatan Sanstha is whipping up hatred against social reformers such as Dabholkar. The government should ban this organisation,” NCP president Jitendra Awhad said. Maharashtra Pradesh Congress Committee president Manikrao Thakre also reiterated that the right-wing ideology propounded by the organisation was responsible for the murder. Even the BJP, which is accused of backing the sanstha based at Ramnathi in Goa’s Ponda town, has been forced to distance itself from the organisation. “The BJP condemns the editorial published by Sanatan Prabhat (the newspaper published by the Sanstha), which describes Dabholkar’s killing as the will of god,” party spokesperson Madav Bhandari said in a statement. The BJP leaders in Maharashtra say it is for the government to take a call on banning the organisation. In the past, NCP leader Sharad Pawar had also sought a ban on the Sanatan Sanstha. The Union Home Ministry had asked the governments of Maharashtra and Goa for reports on the organisation. But nothing came of it. Three years ago, activists of the Sanatan Sanstha were caught planting bombs in Goa during Diwali celebrations. At that time, the sanstha had disassociated itself from the bombers saying they were acting in their personal
capacity.

MLAs vandalise booths to avoid paying toll
Mumbai, August 22 Today, two MLAs --- Anil Kadam of the Shiv Sena representing Pimpalgaon in Nashik and Independent legislator Shirishkumar Kotwal of Chandvad also in Nashik --- allegedly trashed a toll plaza in the area. Video footage telecast by television channels show Kadam threatening employees at the all-woman toll booth for asking him to collect toll. In their police complaint, the employees also alleged that the MLA threatened to send his female relatives to strip all those working in the toll booth. In the other incident at the same toll booth, Independent legislator Kotwal allegedly got a group of supporters to damage equipment to protest toll collection of locals. Kotwal, who has been spearheading an agitation by local farmers who are demanding a bypass road to avoid the toll booth, said his supporters would not allow the levy to be collected from local residents.

AFT working: HC notice to Law, Defence secys
Chandigarh, August 22 A PIL filed by AFT Bar Association former president Navdeep Singh, seeking transfer of control over the AFT to the Law Ministry, grant of proper facilities, security and accommodation to the tribunal members and the institution, and filling of its vacancies, was allowed by the high court late last year and a direction was issued that the AFT would function under the Law Ministry. It was pointed out in the PIL that all orders of the AFT were to be passed against the MoD but that very ministry had been made the parent controlling administrative ministry for the tribunal, leading to a conflict of interest. The decision was hailed in legal circles as a landmark decision for the independence of tribunals. Though the Defence Ministry had filed a special leave petition (SLP) in the Supreme Court against the decision, the SC neither issued a notice nor stayed the operation of the HC decision. In the contempt petition, it has also been pointed out how the MoD was interfering with the functioning of the tribunal and not even providing proper status, facilities and accommodation to its members. Documents have also been placed on record showing insidious interference by the executive in judicial functioning and how in contravention of law, the political executive was “approving” the appointments of judicial and administrative members even after the recommendations by a selection committee led by an SC judge. It has also been averred that the AFT’s judgments were not being implemented and officers of the MoD had openly made contemptuous statements about the tribunal. The contempt petition also states that the entire setup of the AFT was contingent on various approvals of the MoD, which is the first party in all litigation that affects the confidence of litigants and which is against Supreme Court rulings. Incidents where instrumentalities of the MoD have tried to overreach the AFT have also been mentioned along with instances on how the Defence Accounts Department superimposes objections to hamper the smooth functioning of the institution. It has been contended that the MoD treats the tribunal as one of its departments, and its members as its employees. The petition points out how an inter-ministerial group has been constituted by the government to look into the issue of transfer of control of tribunals to the Law Ministry and contends that the implementation of judgments of the Constitutional courts cannot be made dependent upon opinions expressed by such groups. “The shockingly open defiance of judicial authority and an open attack on the functioning of some Benches of the AFT is daring and contemptuous, and shall continue till the time control of the AFT remains with the MoD,” the petition states. “An environment of free and encumbrance-less functioning has not been created for the tribunal, adjudicating members or litigants. While the MoD washes its hands of by issuing letters to various agencies for security and accommodation, it has done nothing on the ground to ensure the very basic facilities to AFT members, some of whom have been judges of Constitutional courts,” it further averred.

Engaging Modi does not mean his endorsement: UK High Commission
New Delhi, August 22 UK High Commissioner James Bevan also asserted that three British nationals were killed in the 2002 Gujarat riots and his country wants "justice" for them. "We do have human rights concerns. Three UK citizens were also killed in the riots and we want trial and justice for that. Engaging in conversation would be better to support our cause," said the envoy. Referring to his meeting with Modi last October, Bevan said it was a diplomatic meet and engaging with him does not mean his endorsement. "I had a conversation with Gujarat Chief Minister in last October and it is good to know important people in a country. I am not in awe of the man or his past, I am here to do my job and any engagement does not necessarily mean endorsement," he said while interacting with the gathering at Jamia Millia Islamia after delivering a talk. Replying to a question on recent invitation by Opposition party's Labour Friends of India to Modi to speak on 'The Future of Modern India', Bevan said, "It is a private invitation issued to the Gujarat Chief Minister by the members of British parliament. The members of British Parliament are free to invite whoever they wish to invite." Asked whether Modi will be granted visa if he applies for it, he refused a direct reply and said, "It's a hypothetical situation, so I would not like to comment on that." UK ended a 10-year boycott of the BJP leader in the aftermath of 2002 communal riots. Earlier this year, European Union also ended its decade- old boycott of Modi over the riots issue when envoys and representatives of several EU member countries hosted a luncheon meeting for Modi here.

26/11: Pak ready to send judicial panel to Mumbai next month
New Delhi, August 22 Islamabad has conveyed to New Delhi that the Pakistani judicial commission is ready to come early September for a visit to Mumbai and suggested two dates for it, official sources said. Seven terrorists, including Lashkar-e-Toiba operations commander Zakiur Rehman Lakhvi, were charged with planning, financing and executing the attacks in Mumbai in November 2008 that killed 166 people and their trial was going on in a Rawalpindi court. India has sought an early conclusion of the trial, which, it feels, is going on at a very slow pace in Pakistan. The witnesses are metropolitan magistrate Rama Vijay Sawant-Waghule, who recorded the confessional statement of Ajmal Kasab, chief investigating officer Ramesh Mahale and two doctors from the state-run Nair and JJ Hospitals who had conducted the autopsies of the nine terrorists. The Home Ministry will soon approach the Bombay High Court for permission to allow the Pakistani judicial commission to travel to Mumbai to question the four witnesses. India has already given a written assurance to Pakistan that the legal panel of that country will be allowed to cross examine the witnesses when it visits Mumbai. — PTI

Indian Army patrols in China New Delhi, August 22 The Indian Army has been doing its patrolling in the same area at periodic intervals over the past several years. China has been lodging protests against what it feels are Indian Army incursions into its territory. Sources told the Tribune that the perception of the Line of Actual Control (LAC) — the name of the de facto border between India and China — in the eastern-most part of Arunachal Pradesh is disputed at Asafila, Dichu, Yangtse and East Dibang. All in the eastern-most part of the state and patrolling is carried out as a matter of routine. Yesterday, it was reported that Chinese troops, on August 11, had intruded some 30 kilometres into what India claims is its territory in Anjaw District in Arunachal Pradesh and had left two days later after Indian troops asked them to withdraw. A source confirmed that an Indian Army long-range patrol is in the area for the past two weeks. A company strength — some 80 men — of the Indian Army is at present in an area which China claims as its own in the eastern-most edge in Anjaw district. The sparse local population in the area is being used to supply the team with information. The locals from the Meshmi tribe speak a dialect of Tibetan that is used on either side of the acrimonious divide and they also act as interpreters. A senior official explained that annually, Indian Army patrols are far greater in number than the ones undertaken by Chinese Army in the Himalayas along the 4057 km of disputed LAC. Since the LAC is un-demarcated and there are no markings of boundary on the ground, troops on either side patrol in areas perceived as their own territory. The claims of India and China overlap and in some cases by up to 40 km. The dispute is 167 years old and the British had tried to sort out the matter five times but failed — the last one being in 1914. At present, the two sides have been conducting boundary talks but there has been no settlement. Explaining the sudden rise in the number of Chinese intrusions being reported, sources gave the example of the latest flare-up in Arunachal Pradesh, saying Chinese troops have been patrolling in this area since 1990 as per Indian Army records. They have returned each time and not camped ever so there is no similarity with the April-May incident in Depsang Plains in eastern
Ladakh.

No rethink on Telangana, Sonia tells Reddy
Hyderabad, August 22 Congress sources said party president Sonia Gandhi told the Chief Minister in no uncertain terms that the decision to divide the state was final and irrevocable and asked him to cooperate in ensuring a smooth transition. Kiran, who hails from Rayalaseema region and is a strong votary of the united Andhra Pradesh cause, had an hour-long meeting with Sonia and party vice-president Rahul Gandhi in New Delhi last evening. He is said to have explained to them that there was a spontaneous and violent backlash in Seemandhra against the division of the state. The Chief Minister sought to put across a strong argument against bifurcation on the ground that it would lead to several intractable problems including disputes over sharing of river waters, power and jobs, besides fears over the future status of Hyderabad. However, the party’s top brass made it clear that formation of Telangana state was inevitable even while assuring that the genuine and legitimate concerns of the people of Seemandhra would be addressed through a proper and transparent mechanism. When Kiran sought to highlight the contentious issues like river water sharing and power generation and the status of Hyderabad, Sonia Gandhi reportedly told him that these issues were not raised by him when the consultation process was on. Besides, she also pointed out to him that he himself had said that he would abide by the High Command’s decision whichever way it went. The AICC General Secretary in-charge of AP, Digvijay Singh, categorically
stated that there was no going back on the bifurcation decision. “All political parties have given their consent to the Centre on creation of a Telangana state and the Congress took the decision finally,” he said. In a related development, Nandamuri Harikrishna, the actor-son of Telugu Desam Party’s (TDP) founder late NT Rama Rao, resigned from the Rajya Sabha in protest against the decision to divide the state. Harikrishna, who is the brother-in-law of the
party chief N Chandrababu Naidu, alleged that the Congress had ruined the Telugu spirit and culture by creating discord among the people.

Plea in SC against AP bifurcation
New Delhi, August 22 The petitioner, advocate PV Krishnaiah, contended that there was no justification for the formation of Telangana as similar demands from other states such as Uttar Pradesh, Maharashtra, Assam and West Bengal were pending for several years. Contending that the bifurcation move had resulted in agitations in Andhra Pradesh and set in a feeling of insecurity and fear among the people, the petitioner pleaded that the present unrest in Andhra could be resolved only through apex court intervention. The PIL pointed out that the UP assembly had passed a resolution on November 23, 2011 for splitting the state into four separate states - Purvanchal, Bundelkhand, Awadh Pradesh and Paschim Pradesh. Demands had also been made for carving out Marathwada from Maharashtra, Bodoland from Assam and Gorkhaland from West Bengal. The Centre had rejected the demand for a Telangana state in 1969 and a similar plea for the creation of Seemandhara in 1972, contending that these would create regional imbalances in respect of employment and education.

Coalgate: Ministry sends files to CBI
New Delhi, August 22 This comes after parliamentary proceedings were disrupted by the Opposition over the missing files of coal block allocations. The CBI had sought files of 45 coal block allocations from 1993 to 2009 to investigate alleged irregularities. But it was told that 257 files were missing, which led to an uproar by the Opposition in Parliament. A spokesperson for the CBI said the Coal Ministry, in its reply, said it had sent some files required by the agency for the investigation. Sources said the CBI had written to the Coal Ministry in May seeking files related to the scam. The agency received the response today. The CBI will inform the Supreme Court that some files required for its investigation were missing, which had hampered its probe. Of the 257 files, around 150 are related to the period between 1993 and 2004 in which 45 coal blocks were allocated. The remaining pertain to 11 allocations of coal blocks between 2006 and 2009. The CBI is still awaiting receipt of applications forms, supporting documents, minutes of screening committee meetings, objections raised by officials and other documents that are important to the investigation.The CBI has so far filed 13 cases into the alleged irregularities of coal block allocations.

New Delhi, August 22 As members, cutting across the party lines, raised the issue of security of the Indian fishermen through a calling attention motion, the External affairs Minister in his reply He said India takes up with Sri Lankan matters pertaining to firing at or apprehending of fishermen immediately after they occur to ensure that their navy "acts with restraint and our fishermen are treated in a humane and pragmatic
manner". Khurshid told the House that the matter had also been taken up by National Security Adviser Shivshankar Menon during his visit to Colombo July 8-9 this year. The Sri Lankan High Commissioner was issued a demarche August 7 for the early release of Indian fishermen, he said.
Khurshid said the need has been felt for "creating greater awareness among Indian fishermen to avoid crossing over into Sri Lankan waters for their own safety and security".

Mumbai, August 22 The video appeared online sometime yesterday and shortly afterwards, Bachchan hit out against it. “... FAKE !! FAKE !! FAKE !!! APPALLED AND ANGERED BY THIS ILLEGAL ACT ON ME.....,” Bachchan tweeted. Later, the actor clarified that content from an advertisement campaign he had participated in to glorify India was morphed with visuals to indicate that Bachchan was endorsing Modi. “I wish to state that this is an illegal act, inviting strong action, one that I am appalled by, and one that has no concurrence from me at all... I have brought this to the notice of the authorities concerned, and asked my Digital Team to find out its origin so that we can initiate action against the perpetrator,” Bachchan said in a statement. The actor also received immediate support from the Gujarat Chief Minister himself. “Agree with @SrBachchan. The author of the fake video should take action immediately and apologise to Amitabh ji,” Modi said in his own Twitter message. Following these exchanges, Utpal Jeevrajani, a member of the so-called Narendra Modi fan club from Rajkot, Gujarat came forward to take responsibility for the video. “I got the video on WhatsApp as somebody added me to a group. But I don’t know who exactly sent it to me. We are from Gujarat and we are fans of Modi. I also respect Amitabh Bachchan as an actor. I liked the video hence I uploaded it. I haven’t made the video nor have I edited it. I am a music director of Gujarati films. I sincerely apologise for uploading the video and will delete it immediately,” Jeevrajani said in his statement.

Lucknow/Mumbai, August 22 As the war of words involving the SP, the BSP and the Congress over the yatra from Sunday escalated, heavy police force is being deployed in Faizabad-Ayodhya district. "Besides PAC and RAF, two SPs, 16 Additional SPs, 32 Deputy SPs, 80 inspectors, 240 sub-inspectors have been deployed in the Faizabad district to maintain law and order in wake of the yatra", IG (law and order) R K Vishwakarma told reporters in Lucknow. Alleging that the BJP, RSS and VHP were using saints as their tools to fulfill their political ambitions ahead of Lok Sabha polls, Samajwadi Party(SP) said that it would not allow them to communalise the atmosphere through their proposed yatra. "The BJP, RSS and VHP are using saints as their tools to fulfill their political ambitions ahead of Lok Sabha polls as they have no public issues left. SP government will not allow them to communalise atmosphere of the state through their proposed 84-kosi yatra", SP spokesman and cabinet minister Rajendra Chowdhury told reporters in Lucknow. Apart from that, in the 1962 Calcutta National games, he got past the legendary Milkha Singh in the 400m race to garner gold. He ended up winning four medals in different events in the same championship. The family of Makhan Singh, who was conferred the prestigious Arjuna Award in 1964 by the then President Dr S Radhakrishnan, lives in abject penury in Bhathula village in Hoshiarpur. His wife Salinder Kaur and son Parminder Singh, who works as a sewadar in the Hoshiarpur BDPO office, have threatened to return the award and the scores of other medals Makhan Singh won back to the government “if it does not wake up to their

GJM calls for fresh bandh in Darjeeling
Darjeeling/Kolkata, August 22 This comes as a response to the arrest of the party's assistant general secretary Benoy Tamang on Thursday, along with six party workers. The GJM said the protest will continue until its leaders are released. GJM supremo Bimal Gurung, who earlier in the day announced a two-day shutdown beginning Saturday, later declared an indefinite "ghar bahira janata". Following the Calcutta high court declaring the shutdown, including the peoples' curfew, as illegal, the GJM has changed its mode of protest, calling for people to protest in the streets. The arrested GJM leaders led by Tamang will also go on an indefinite hunger strike. "Ghar bahira janata agitation will continue indefinitely till GJM members are released and cases against them are withdrawn. The 721 arrested people who are in judicial custody will also go for an indefinite hunger strike," GJM supremo Bimal Gurung said. Tamang, a close associate of the GJM supremo, is also the senior-most of the GJM leaders to be arrested so far. He is, however, only one of over 700 party activists held by state authorities since the renewed protests for the formation of a separate Gorkhaland began last month, after the United Progressive Alliance at the centre approved the carving out of Telangana from Andhra Pradesh. Gurung, who Wednesday had sought West Bengal governor MK Narayanan's intervention in the matter, however, ruled out any dialogue with West Bengal chief minister Mamata Banerjee and her government. "We will not talk to the state government. This matter concerns the centre and it will have to intervene," Gurung said. Meanwhile, Narayanan who earlier had expressed his willigness to talk to the GJM leadership, said the Gorkha outfit should first come to him if it wanted his intervention. "If they want my intervention, let them come and ask," Narayanan told mediapersons in Kolkata. Following heavy rains and thunderstorms earlier in the week in Darjeeling and surrounding areas, the GJM had deferred its agitation to enable relief work to go unhindered. The Gorkha outfit which has accused Banerjee of going on an "arrest spree" said the state government is wrongly treating the issue as a law and order problem. "The government is treating this as a law and order issue. Can a solution emerge like this? It has to be handled as a political issue, but the government is handling it administratively. Such administrative actions have been taken over the last 107 years," said GJM legislator and spokesperson Harka Bahadur Chettri, adding that the movement cannot be curbed by a government crackdown on its leaders. The GJM, which has joined hands with other pro-Gorkhaland parties to form the Gorkhaland Join Action Committee (GJAC), under which the protests are now being carried out, will meet Saturday to decide the future course of action. North Bengal development minister Gautam Deb defended the arrests, saying the GJM protests had been resulting in destruction to government properties and hindering development of the region. Meanwhile, the Congress and the Bharatiya Janata Party (BJP) have criticised the Banerjee government for its crackdown on the GJM movement, which was resulting in the "issue going out of hand". "This oppressive approach of the state government is only causing the issue to flare up. The government must explore ways to find a solution to the issue through dialogue before it gets completely out of hand," state Congress president Pradip Bhattacharya said. Lucknow, August 22 According to principal secretary Home and Jails R M Srivastava, the role of the jail attendants is also being scrutinised and action would be taken against them if their connivance is also found. Those suspended include jail superintendent R N Pandey, jailor Srikrishan Pandey and deputy jailors Rakesh Kumar Verma and Ajay Kumar Jha. According to Srivastava the prisoners had meticulously planned their escape by making a hole in the toilet wall by removing a few bricks and then locating and disconnecting the water supply pipeline to use it as a ladder to scale the steep jail wall. Among the three prisoners was an under trial Rakesh alias Tandoori charged of rape and murder, Shakir
Ali serving life imprisonment for murder and Sanjay Kori who was serving term for rape.

It is wrong to suggest that it was in my knowledge that STPL had applied for UAS (telecom) licence for the Jammu and Kashmir service area in 2007. I cannot recall if Reliance Telecom Limited had made an investment to the extent of 9.9 per cent in STPL,” he told the court of special CBI Judge OP Saini. Appearing as a CBI witness, he replied to several questions put by special public prosecutor UU Lalit for nearly four hours. “I do not recall” was his reply to most of the questions. His wife Tina is slated to depose as a CBI witness tomorrow. He also denied that he had not handed over any note to the CBI in February 2011 at the time of the investigations in the case relating to the allotment of 122 telecom licenses in January 2008 by the then Telecom Minister A Raja at 2001 prices on the basis of first-come, first-served basis. The Supreme Court cancelled all these licenses on PILs challenging the allotments. |

New Delhi, August 22 "No question of her exemption arises," a Bench of justices G S Singhvi and K S Radhakrishnan said when the counsel appearing for Ammal's daughter said she is not fit to depose. The Bench said the according to a medical board report, she is unfit to depose as a witness before the court as she cannot travel and asked the special CBI court hearing the 2G case, to appoint a commission to examine her in the case in Chennai where she resides. "We are satisfied that the purpose would be served by appointing a commission to examine her in Chennai," the Bench said. Earlier, the apex court had on July 10 directed AIIMS director to constitute a medical board to examine whether Ammal is medically fit to depose as a witness before the special court. Karunanidhi's daughter and DMK MP Kanimozhi and Sharad Kumar, Managing Director of the TV channel, are also facing trial in the case along with former Telecom Minister A Raja, DB Realty Ltd MD Vinod Goenka and others. The Bench passed the order on a plea filed by Ammal's daughter Selvi seeking court's direction to exempt her mother from appearing before the trial court as prosecution witness on medical ground. — PTI

Theni (TN), August 22 Police said today the doctor, Sekar, who was running a private clinic, had asked the woman, a farm worker, to get operated for hernia, and took her to a private hospital where the surgery was done. However, even after the operation, she continued to have pain and got herself admitted to the Government Medical College Hospital here but as there was no Nephrology specialist, she was referred to the government hospital at Madurai, police said. The doctor at Madurai hospital told her that she had cervical cancer. She was admitted to a private hospital where a scan revealed that one of her kidneys was missing. When doctors asked her, the woman denied that she had donated her kidney and told them that she only underwent an hernia operation at Gudalur. Following a complaint from her husband, police registered a case against Sekar for violating Organ Transplantation rules and were searching for him, sources said. The doctor had allegedly cheated many patients one way or the other as most of them were illiterate farm workers, police said, adding, they had sent a team to Kerala to trace him. — PTI
