HC stays acquisition of land by HUDA

The Punjab and Haryana High Court today stayed the acquisition of land for the proposed sectors 65-68 to be developed by the Haryana Urban Development Authority (HUDA) at Sonepat.

Restraining HUDA from acquiring land, including that belonging to the petitioner - Mr Mohinder Singh and others belonging to villages Asawarpur, Setli, Badh Khalsa, Patla, etc, a Division Bench comprising Mr Justice J.S. Narang and Mrs Justice Kiran Anand Lall also issued notices to the Haryana Government and HUDA for August 7.

The Bench is scheduled to hear a similar petition, relating to another chunk of land that was also being acquired by the HUDA for the posed sectors, on August 7.

In their petition, Mr Mohinder Singh and others have challenged the acquisition of their lands by the HUDA, which they have alleged, was paying a paltry sum in lieu of the land.

In another similar matter, the petitioners - Laxmi Dutt and others - have claimed that the HUDA decision to acquire their lands and houses was illegal as even the Supreme Court has held that constructed area should be avoided while acquiring land, particularly when the public purpose sought to be achieved by acquisition was similar to an already existing one.

A petition filed by Saraswati Samiti School, which has over 1,200 students, also alleges that the government and HUDA were adopting different standards while finalising acquisition.

KU withdraws Ad

Kurukshetra University, Kurukshetra, on Friday informed the High Court that it was withdrawing a recent advertisement through which applications for filling posts of data entry operators on contract basis were invited.

This information was provided during hearing of a petition filed by Mr Rajesh Lohan and others, all presently working on contract basis in the same capacity with the university.

Deepender demands Rs 1,100 cr for state

Member of Parliament from Rohtak, Deepender Hooda demanded a package of Rs 1100 crore from the Centre for Haryana, implementation of Nehru Urban Renewal Mission in NCR municipalities and inclusion of frost, cold wave and heat wave in the definition of natural calamity.

Participating in the discussion on the General Budget 2006-07 in Lok Sabha, Mr Hooda demanded Rs 1100 crore from the Centre considering the fact that State has been supplying foodgrains at a low regulated price for the Central pool while paying high price to other states for power to produce the foodgrains.

He said there should also be a mechanism at the national level to rationalise power charges for all states so that those states with deficit in power generation did not suffer.

He suggested that frost, cold wave and heat wave should be included in the definition of natural calamity so as to give the benefit of Natural Calamity Relief Fund to the affected farmers. Also, the settlement process under the National Agricultural Insurance Scheme should be made faster.

Mr Hooda suggested that instead of covering only New Delhi under Jawahar Lal Nehru Urban Renewable Mission, the Centre should take up entire NCR under this ambitious multi-crore project and include municipalities like Gurgaon, Faridabad, Bahadurgarh, Rohtak and Ghaziabad that fall under NCR.

Bishnoi reminds govt of election promises

It is time for introspection and not celebration for the Congress after completing one year in power in the state. As a lot of promises made to the people of the state are yet to be fulfilled, which has caused uneasiness among the voters. Mr Kuldip Bishnoi, MP, stated this while talking to mediapersons at the residence of a local Congress leader, Mr Narinder Zippy Shorewala, here yesterday.

Terming the recent Congress rally at Hisar as a ‘government rally’, Mr Bishnoi said it was not a party rally but a government rally as the state Congress president, Mr Bhajan Lal, was not present in this public meeting. Mr Bishnoi said it was a matter of concern that the number of people participating in this rally was much below the expectation, which left a poor impression. He said it was a matter of concern and Congress leaders should sit and ponder over this issue because there was no enthusiasm among the people over participating in this rally. In comparison, former Chief Minister Om Prakash Chautala drew more crowds in Sampla and his recent Panipat rally. He said all this should serve as an eye-opener to the Congress leadership.

Mr Bishnoi said the state was facing a number of grave problems and sincere efforts should be made to tackle these problems to win confidence of the people. Giving an instance of some problems faced by the people of the state, Mr Bishnoi said there was an acute shortage of power, which has caused a lot of problems to the farmers, industrialists and the common man. Contrary to the government claims there was a shortage of canal water, thousands of employees retrenched by the Chautala government were yet to be reinstated, the rising crime graph had posed a serious challenge to the government. The young MP stressed upon the need to solve SYL canal issue at the earliest as the Congress government was in power at the Centre, Punjab and Haryana.

Setting at rest all rumours about Mr Bhajan Lal leaving the Congress to join the BJP, Mr Bishnoi said there was no truth in this and his father had full faith in the leadership of Ms Sonia Gandhi and Prime Minister Manmohan Singh.

Village of wrestlers now battleground of criminals

Once considered a nursery of akhara wrestlers, this village has turned into a breeding ground of criminals. The village has become a battleground of two warring factions, which has claimed 21 lives. The entire village has to bear the brunt of this bloody rivalry with fear and a sense of shame gripping them.

The situation has deteriorated to such an extent that marriageable sons and daughters have stopped getting proposals as no one is interested in forging matrimonial alliances in such a turbulent village. The residents are so shaken that whoever has the resources enough to shift to towns, prefers to do so.

With incidents of revenge killing picking up, people are so frightened that no one is ready to even talk about it. However, after some persuasion, when some elders agreed to discuss the decade-long rivalry and its fallout on the village society, they insisted on not disclosing their names.

"It has been a tradition among the youth of this village to pursue a career in wrestling. However, in the early nineties, a tussle during the panchayat polls brought a big chunk of firearms particularly countrymade pistols into the village. That was the inception of criminalisation of the village," recalled a turban wearing elderly person.

A government employee, who is currently residing in Bahadurgarh, revealed that roots of the feud lay in Kabosia Pana (a village colony), which started with a duel between Fateh Singh and Hawa Singh who were supporters of the nominees for the post of Sarpanch, namely Mr Hansraj and Mr Ramphal. "The fact is that there is no reason behind the bloodbath. Anyone who is seen emerging as a leader in the eyes of these criminal elements, becomes their target. One of my relatives also fell in their trap and lost his life and after that we decided to leave the village," he stated.

Though the entire village is affected by this revenge spree, about 20 families are directly involved in it. After each incident, the victims named several persons of the opposing group as accused in the FIR.

RS seat: poll on March 28

Election to the Rajya Sabha seat falling vacant in Haryana will take place on March 28. This was stated here today by Mr Sumit Kumar, Secretary of the Haryana Assembly, who is the Returning Officer for the election.

The seat will fall vacant on the retirement of the sitting member, Mr Faqir Chand. The outgoing member represented the INLD. The composition of the current Haryana Assembly, however, will ensure that a Congress nominee fills the place left vacant by the INLD member.

The names doing the rounds as probable Congress candidates for the seat include that of Mr H. R. Bhardwaj, Union Law Minister. Mr Bhardwaj, a native of Haryana, is at present a Rajya Sabha member from Madhya Pradesh and is about to complete his term in the House.

According to the programme issued by the Returning Officer, nominations can be filed up to 3 p.m. on March 17. The nomination papers will be scrutinised on March 18. The last date for the withdrawal of candidature is March 20.

Polling, if necessary, will be held on March 28 between 9 a.m and 4 p.m in the old committee room of the Haryana Vidhan Sabha Secretariat here.

Free legal aid for freedom fighters, others

The Haryana State Legal Services Authority (HSLSA) has decided that henceforth freedom fighters, ex-servicemen, victims of riots and terrorism and their families would also be entitled to free legal aid under the Legal Services Authorities Act.

A note quoting Mr Shekhar Dhawan, Member-Secretary, HSLSA, said a decision to this effect was recently taken at a meeting held under the chairmanship of Mr Justice Adarsh Kumar Goel, of the Punjab and Haryana High Court, who is also Executive Chairman of the HSLSA. The Haryana Government had already issued a notification in this regard.

According to Mr Dhawan, these categories would be entitled to free legal aid in the shape of advocate fee, court fee, expenses of witnesses and preparation of paper work. Applications for free legal aid can be submitted on a plain paper.

While applications for free legal aid for litigation in the High Court can be submitted to the office of the Member-Secretary, HSLSA, for the districts, such applications can be filed before the respective Chief Judicial Magistrate-cum-Secretary, District Legal Services Authority.

Action against school likely in paper leak case

Apprehending foul play by Sanatan Dharam Vidya Mandir (SDVM) Principal Dinesh Jindal in the paper leak case, the CBSE has decided to investigate whether previous papers conducted at the school had been leaked or not.

The board has hinted at taking strict action against the SDVM, from where the papers had allegedly been leaked.

The decision came after parents and students complained that several papers of Class XII had been leaked here.

Examinations of Class XII commenced on March 1 and the SDVM was one of the four examination centres here.

The board decided to conduct the business studies paper of Class XII of the commerce stream again on March 25 at all centres here.

A senior CBSE official told The Tribune that the board had come across reports regarding complaints of paper leak.

CBSE chairman Ashok Ganguly said the board would investigate whether question papers had been leaked.

Talking about a case detected on the night of March 7, he said Mr Jindal leaked the question papers, allegedly in connivance with officials of the Punjab National Bank extension counter at the school.

Mr Ganguly said the board had doubts that the envelopes containing the question papers had been tampered with.

Investigations made by The Tribune revealed that there were at least 15 more students when a police party raided the Ashoka Guest House on the night of March 7, but the police was able to nab only three of them.

Coming down heavily on the Haryana police, Mr Ganguly said instead of arresting Mr Jindal, the police had arrested the photocopying machine operator.

Rotten school-meal items dumped

More than 100 quintals of soyabean, mung dal, jaggery and other items and hundreds of litres of refined oil supplied in various government primary schools of the district as part of the mid-day meal scheme is being dumped as the material has rotted.

Sources in the Education Department said in May last, refined oil that had expired in October 2004 was supplied to schools. When the mater came to light, officials ordered the dumping of the oil. However, later it was found that soyabean, mung dal and jaggery too had rotted.

Now, the officials have started dumping the material. Sources said that more than 145 litres of expired refined oil was lying in the school of Ram Khera village. Also, 516 litres of oil had been removed from the school of Harnoli and 80 litres from the government school of Dariyapur village.

Additional Deputy Commissioner O.P Lohan said action against the contractors who supplied the matter would be taken and the contractors asked to reimburse the amount they had charged for the material.

HCS officers demand categorisation

Haryana Civil Service (HCS) officers want that their posts should be categorised according to the seniority of the incumbents so that senior officers are not posted against relatively junior posts.

The HCS officers say that unlike IAS officers, the powers that be often post those colleagues against insignificant or relatively junior posts, who are considered to be “inconvenient”. This practice has led to demoralisation in the cadre, which is the mainstay of the middle-rung bureaucratic set-up of the state.

This is one of the demands which will come up for debate at the general body meeting of the HCS Officers Association to be held in Karnal on tomorrow.

The association also wants that the state should have its own rules to govern the HCS cadre. So far, Haryana is following the Punjab Civil Service Rules. The association wants a change in the manner of recruitment provided under the Punjab rules. The Haryana officers say the provision of special recruitment should be dispensed with. Similarly, the ministerial staff should not be nominated to the HCS because employees of this category can be promoted up to the level of Deputy Secretary in their own service.

Pollution killing Markanda river

Pollution and official apathy is practically killing Markanda river which flows through Ambala district. The seasonal river is considered to be holy by the locals and regular prayers are held on the river banks in some villages. However, the pollution in the river is upsetting the local villagers who say that the river is no longer proving to be a lifeline for them.

The extent of pollution of the Markanda river water can be gauged from the fact that labourers who work near the river bed complain of skin diseases on their feet, bovines avoid drinking the water and if the water is used for irrigation, the quality of crop is affected.

Farmers state that the pollution in the Markanda river takes place in the industrial belt in Kala Amb in Himachal Pradesh. They said that industrial effluents are dumped into the Markanda river in Himachal Pradesh which later flows into Haryana.

The villages are affected due to the pollution in Markanda river include Gadhouli, Nagla Rajputana, Kalalti, Kalpi, Zaru Majra, Mullana, Hamidpur, Nahoani, Sohana, Tandwal, Rao Majra and Harioli. After passing through Ambala district, the river enters Shahbad in Kurukshetra district.

Time and again, the farmers living along the river banks have demanded that the pollution in the Markanda river should be checked. However, precious little has been done to stop pollution. Things have now come to such a pass that the Markanda river water turns `black’ during rainy season and the river bed has a dark residue during summer season.

Markanda river is said to have been named after Maharishi Markandey. It is believed by the local farmers that offering prayers at the Markanda river bank before the onset of monsoon will lead to good rainfall, a bumper harvest and the river will not cause any damage. Rice and jaggery is offered to the river during the prayers.

While a weekly event is held on the river bank at Mullana, an annual grand fair is organised at Tandwal. But, for the last few years, after offering prayers people are now reluctant to take a dip in the Markanda river due to pollution. Tubewells have been dug up near the river banks close to the fair site so that people can now sprinkle themselves.

Farmers Krishan Pal Rana, Kanwar Pal Singh, Yash Pal and Raj Pal Rana demanded that pollution of the Markanda must be stopped immediately. They said that the Haryana Government must interact with the Himachal Pradesh Government so that a solution to the problem can be found.

Incidentally, the demand to check pollution in the Markanda river is not new. More than two decades back in 1985, a society had been formed by the farmers to demand controlling pollution in Markanda river. The society was headed by Mr Shamsher Singh Rana.

During the earlier tenure of the INLD Government, Haryana Minister Risal Singh had promised to take up this issue. However, the promise had proved to be hollow.

The farmers say that pollution is killing Markanda river and if nothing is done quickly, then pollution would start taking its toll on the villages flanking its river bank. They demand that a high-powered team comprising officials from Haryana as well as Himachal Pradesh must look into the issue so that a solution can be found.

Procurement of mustard

While stating this here today, a spokesman of HAFED said mustard would be procured at purchase centres and through cooperative societies in mandis.

Five students injured as bus overturns

Six persons, including five students of Class X, were injured as their bus overturned near Katlari bus stand at Jundla yesterday. They were on their way to Assandh from Karnal. The accident took place as the driver tried to save some women who were crossing the road.

All the five injured students, including two girls, belong to MM Public School, Assandh. They were returning to Assandh after appearing for the mathematics paper.

The injured students are Shub Preet, Gauri (both girls of Assandh), Naveen, Amit (both of Jai Singh Pura village) and Karamvir of Jabala village.

Maharshi Dayanand University will award D. Litt (honoris causa) degree to noted writer Khushwant Singh at its 13th convocation to be held here on March 25.

The Vice-Chancellor, Dr RS Dhanker, said here that this degree would also be awarded to Dr C Rangrajan, Chairman, Economic Advisory Council, who would also deliver the convocation address.
