SC declines govt plea for early

The Haryana Government today failed to secure a positive order from the Supreme Court for early hearing of four-point Presidential reference on the constitutional validity of the Punjab Act, terminating all water accords with neighbouring states since 1981 in the wake of the apex court order regarding the construction of the Sutlej-Yamuna Link canal.

SC declines govt plea for early hearing on SYL

The Haryana Government today failed to secure a positive order from the Supreme Court for early hearing of four-point Presidential reference on the constitutional validity of the Punjab Act, terminating all water accords with neighbouring states since 1981 in the wake of the apex court order regarding the construction of the Sutlej-Yamuna Link (SLY) canal.

As Haryana’s counsel Shanti Bhushan made a special mention before a Bench, headed by Chief Justice Y. K. Sabharwal, for listing of the presidential reference on the “Punjab Termination of Agreement Act, 2004”, the court expressed its inability to give special priority to the case in the event of it already being seized of 38 matters involving equally important constitutional questions.

“Of course it is an important matter concerning the two states. You have in mind the concern of the two states but I have in mind 38 constitutional matters equally important… which have wide ramifications,” Chief Justice observed, advising Haryana’s counsel to try his luck by mentioning it after summer vacation so that it could find a way out for early listing of the matter.

When Haryana’s counsel persisted with his plea that the case needed to be heard early as it involved the question of enforcing apex court’s two judgements on Haryana’s suit for the construction of the unfinished portion of the SYL in the territory of Punjab, the Bench merely said “we understand your importance”.

The presidential reference, placed before the Constitution Bench, had raised four questions for determination by the apex court (a) whether the Punjab Termination of Agreement Act passed on July 12, 2004, and its provisions were in accordance with the Constitution (b) whether its provisions were as per Section 14 of the Inter-State Water Dispute Act, 1956, and Section 78 of the Punjab Reorganisation Act, 1966, and notification of March 24, 1976, issued thereunder, (c) whether Punjab had validly terminated the December 31, 1981, agreement and all other agreements relating to the Ravi-Beas waters with neighbouring states and is discharged of its obligation under those provisions, (d) whether Punjab was discharged under the Termination Act of its obligation flowing from the January 15, 2002, and June 4, 2004, judgements of the apex court about construction of the SYL.

In its January 15, 2002, judgement, the apex court had decreed Haryana’s suit against Punjab, directing it to complete the SYL in its territory within one year. But the then Chief Minister Parkash Singh Badal had refused to implement the order and his government filed a counter suit in the apex court for discharging the state of its obligation, while Haryana filed another suit for enforcing the verdict.

This was decided by the apex court in a judgement of June 4, 2004, asking the Centre to complete the SYL under the protection of security forces in Punjab’s territory, leading to the passage of the Punjab Termination of Agreement Act, 2004, by the Amarinder Singh Government. This had threatened to snowball into a major controversy, forcing the Centre to make a Presidential reference to the apex court on July 22, 2004.

Even Sonepat, Rewari catch fancy of realtors

With Gurgaon and Faridabad having reached a saturation point in real estate, the realtors and investors are now looking at other tier II and tier III cities in the National Capital Region — a fact is reinforced by the number of societies registered in the new boom towns of Haryana, Sonepat and Rewari.

Senior officials in the office of Registrar, Cooperative Societies, Haryana, inform that as many as 1,249 group housing societies have been registered in Sonepat, and 491 in Rewari. Comparatively, as many as 40 group housing sites are on offer in Sonepat, and 20 in Rewari, in the group housing scheme floated by Haryana Urban Development Authority (HUDA).

With Gurgaon bursting at its seams in terms of the real estate development, and high level of pollution in Faridabad, investors are now eyeing other towns in the NCR. Though the maximum number of societies have been registered in the “real estate capital” of the state-Panchkula (4842), followed by Faridabad (3987) and Gurgaon (3384).

With the proposed Rajiv Gandhi Education City to come up in Sonepat district and the Kundli-Manesar-Palwal Expressway to be built from Kundli, Sonepat is being considered the next big bet for a boom in real estate. On the other hand, Rewari is just a two-hour drive from Delhi (just 55 km from Gurgaon), thus the new-found flavour with investors. Even Panipat has got a good response, with as many as 473 societies being registered, though only 20 sites are on offer in this group housing scheme.

As many as 14,627 group housing societies (GHS) have been registered by the Registrar, Cooperative Societies, Haryana, on the eve of the group housing scheme floated by HUDA. Seeing the tremendous response received for the registration of these societies, the Haryana Government had earlier extended the last date for the scheme from February 14 to February 28.

The closing date for applying for the HUDA sites was February 28, but it is yet to be calculated as to how many of these registered societies have applied for the sites.

Plan to build 88 overbridges

If all goes well, traffic congestion at level crossings on all majors roads in Haryana may become a thing of the past.

The state government has drawn up a master plan for the construction of 88 road overbridges (ROBs) at busy level crossings at various places in the state for smooth traffic.

A spokesman of the Public Works Department (B&R) said that out of these, nine ROBs would be completed next year at a cost of Rs 86 crore. These would be at Ganaur in Sonepat district; the Karnal-Kachwa-Sambali road in Karnal district; Ballabhgarh and Palwal in Faridabad district; Kesari in Ambala district; Thandi Sadak and the Sat road in Hisar district; the Rewari-Narnaul road in Rewari district; and at Kurukshetra.

He said eight ROBs had been recently approved by the state and Central Governments and would be constructed at a cost of Rs 110 crore. The state’s share in this was Rs 55 crore while the remaining cost would be borne by the Northern Railway. These bridges would be completed in 2007-08.

He said in view of difficulty in the movement of traffic at other busy level crossings, a meeting was held with the Northern Railway early this year at which 17 ROBs to be constructed at an estimated cost of Rs 272 crore were sanctioned. One more ROB costing Rs 28 crore had been approved for the Mansa Devi complex at Panchkula which would be sanctioned by the Haryana Urban Development Authority. He said the cost of these 18 ROBs would be shared equally by the state and the Northern Railway.

INLD rally against deletion of Devi Lal’s name

The Indian National Lok Dal (INLD) organised a rally here today to protest against the Haryana Government’s deleting Mr Devi Lal’s name from Panipat Thermal Plant.

INLD chief Om Prakash Chautala, who made public appearance after a long gap, said he would not have objected if Devi Lal’s name were replaced with the names of patriots like Jawaharlal Nehru, Motilal Nehru or Indira Gandhi.

Mr Chautala did not confine himself to the issue of the restoration of the name of the plant only. He criticised the Hooda-led state government and touched various issues, including power crisis, recent incident of the rape of girl students by teachers, land grab by Congress leaders and dithering by the government in the implementation of any decision.

Mr Chautala had announced after the Congress came to power in the state that he would watch functioning of the government for one year and then give his comments on the government. Today he said a one-year period was over and he was ready to air his views on the performance of the government.

The timing of the rally was also chosen carefully. Two days from today the Congress will organise a rally at Hisar to celebrate completion of one year by the Bhupinder Singh Hooda-led government in the state. Mr Chautala said the venue of the proposed function in Hisar was smaller than that where the INLD’s function was being held.

Mr Chautala’s son Ajay, INLD leader and former Finance Minister Sampat Singh, INLD’s Haryana unit chief Ashok Arora, former Haryana Assembly Speaker Satbir Singh Kadian and Rajya Sabha member and former Chairman of the Minorities Commission Tarlochan Singh also addressed the rally.

Mr Tarlochan Singh said by removing Mr Devi Lal’s name from the plant, the Haryana Government had heaped insult on the President of India who had inaugurated the plaque bearing name of the Panipat plant.

Notice of motion in rape case

Mr Justice A.K. Goel of the Punjab and Haryana High Court today issued notice of motion for May 15 on the bail plea of former Panipat City Magistrate Jeet Singh in a rape case.

His plea for grant of anticipatory bail was rejected by Mr Justice Surya Kant in July.

The petitioner is accused of having raped a young woman after 'marrying' her. It later transpired that he was already married and had allegedly made false claims about his single status to lure the woman, who is a teacher, into marrying him.

The woman had, in her complaint to the police, alleged that apart from outraging her modesty repeatedly, the accused also misappropriated her money and jewellery.

A case was registered by the Panipat Model Town police on November 4, 2004.

MDU convocation on March 25

The 13th convocation of Maharshi Dayanand University (MDU) will be held here on March 25. Dr C. Rangrajan, Chairman, Economic Advisory Council, will deliver the convocation address.

An MDU press release issued here today said that compulsory rehearsal for the convocation would be held on March 24.

Meanwhile, the Vice-Chancellor of MDU, Dr R. S. Dhankar has appointed Dr B.K. Behera as Director of Advanced Centre for Biotechnology. He will hold the post for three years with immediate effect.

The VC has also nominated Dr Ishwar Singh, Professor, Department of Chemistry, as member of the Executive Council of the varsity.

Dr A. K. Madan, Dean, Faculty of Pharmaceutical Sciences has been nominated as member of the Finance Committee and Executive Council of the varsity with immediate effect. — TNS

Engg students seek 6-month internship

Students of MM Engineering College today demanded that there should be a six-month internship in their degree programme.

The students stated that the engineering curriculum of Kurukshetra University needed to be revised and it would be beneficial for students if they underwent a six-month internship in the final year of their degree programme.

The students pointed out that in most universities the engineering students have six-month internship programme but in Kurukshetra University, this aspect had not been taken into consideration. They said that there was a need to be at par with the requirement of the industry.

Health Department meeting

A meeting of the Health Department was held to take stock of the different health programmes. The division-level meeting was presided over by the DG Health, Mr NK Sharma. Mr Sharma said that Health Department officials must go to villages to explain the benefits of different health programmes, a press note said.

He said that wherever shortcomings were noticed in the implementation of the health programmes, the officials concerned must be promptly informed. He said that arrangement for blood should be made at the community health centres. He said that blood donation camps should be organised so that there was availability of blood.
