HC acquits patwari in 25-yr-old graft case
Chandigarh, September 29 More than 13 years after the patwari was convicted in a corruption case, the High Court has reversed the trial court judgment after observing that the same was not based “on proper appreciation of evidence”. Allowing patwari Harjit Singh’s appeal against the UT, Justice Daya Chaudhary added that the prosecution too failed to prove its case beyond a reasonable doubt, “which goes in favour of the appellant”. In his appeal, Harjit Singh had challenged orders dated July 14, 2001, passed by the UT Special Judge after he was sentenced to undergo rigorous imprisonment for two years. Working as patwari, he was accused of demanding Rs 1,500 from a complainant as bribe. The money was allegedly demanded for entering mutation on change of ownership of 11 marlas purchased by his wife in Sarangpur village in Dhanas circle. The prosecution story was that the complainant visited the accused on June 2, 1998; and Rs 1,000 was agreed upon to be paid the next day. But the complainant made a written complaint to the CBI Superintendent of Police, for taking legal action against the appellant for demanding bribe. On the basis of the complaint, a raiding party was constituted before associating postal assistants Pawan Kumar and Bikram Singh. Before laying the trap, shadow witness-Pawan Kumar and complainant went to the office of the accused. Two currency notes of Rs 500 each were asked to be paid to the accused. The amount was allegedly accepted by the appellant. The independent witness, Bikram Singh, was asked to conduct personal search of the accused and the two currency notes were recovered from his pocket. Allowing the appeal, Justice Chaudhary asserted: “On perusal of the statements of the prosecution witnesses shows that serious contradictions/discrepancies are there. Even prosecution witnesses Pawan Kumar and Bikram Singh have not supported the case of the prosecution as they have denied all the allegations levelled against the appellant. “There is inconsistency with regards to the recovery of the amount as it has not been proved from the statements of the prosecution witnesses as to whether the amount was recovered from the pocket of the accused or from the store room. “In case the amount was recovered from the store it cannot be said that the amount of bribe was accepted by the accused. Neither the recovery nor the acceptance of the amount has been proved on record.“Pawan Kumar has stated that the notes were recovered from the store room and not from the pocket of the accused. Bikram Singh has even denied having recovered the amount in his presence. “He further stated that recovery was affected from the books lying in the store room. He also stated that he saw CBI officers having caught hold of the accused from his hands and there was no public man in the room at the time of their arrival. |

Student acquitted in rape case
Chandigarh, September 29 The case was registered on December 26, 2013, when the 35-year-old prosecutrix had lodged a complaint with the police that the accused raped her while forcibly taking her to Delhi. The victim is married and mother of three children. She stated in her police complaint that the accused also raped her one-and-a-half year prior to the date of her lodging complaint when he threatened her of killing her two-year -old son and raped her in his house. He had also made a video of the victim who knew him as he was her friend’s brother. She added that she was forcibly taken to Delhi in a car by the accused in October 2013 where he raped her for one month and then abandoned her. Following her complaint, the accused was arrested in the case of rape. The victim stood by her statements in court and alleged the accused raped her. However, the defence proved that the story of rape was a concocted one and the UT police lodged the FIR without investigating the case. Defence counsel Tarminder Singh stated that the police did not investigate the case at all and thus the acquittal speaks volumes of the inefficiency of the police. The defence counsel told the court that there was no date or proof available with the victim that the accused raped her in 2012 also as stated by her. Also, it was proved that the prosecutrix stayed with her sister while she was in Delhi in 2013 and was never taken there forcibly as stated by her. It was also proved on record that the victim had exchanged more than 600 calls with the accused and had also sent him an ‘I love you’ message on the day she lodged the police complaint. Besides, a Daily Diary Report of her ongoing dispute with her husband was also lodged in the same police station on the same day when she lodged the police complaint. All the claims of the victim thus fell flat in court. |
