Chandigarh-based coloniser penalised for deficiency of service
Bathinda, June 12 A complaint was moved by Bhupinder Pal Singh, a resident of Bibiwala Road, deployed with Powercom. Pal alleged that he was duped by UK Homes Private Limited, having corporate office, UK Group at SCO 68,69,70, Level-IV, Sector 17-C, Chandigarh. His counsel, Ashok Gupta said an agent of developer came to Bathinda to allure the complainant to purchase a plot measuring 125 square yards in Capital Greens project at a cost of Rs 13,500 per yard in Zirakpur. He showed all the related documents pertaining to the colony, developer and government authorisation certificates as well. After paying a booking amount of Rs 1, 87,500, the complainant also paid Rs 2, 34,375. The developer promised to give allotment letter after another payment of Rs 1, 99,657 but all pleas of the complainant fell upon deaf ears. He however was given a plot number 711 by the developer. Despite sending registered notice to the opposite party in March 2014, nobody appeared on their behalf despite receiving the summons from the Consumer Forum. In its decision the forum observe that though there is no record placed on file by the complainant to prove that the agent of developer came to Bathinda, a perusal of record however shows that the payment has been done from Bathinda through RTGS. Thus a part of cause of action arises in Bathinda and the Forum has territorial jurisdiction in the case. The forum after hearing all the pleas of complainant reached on the conclusion that there is deficiency on the part of the coloniser. The developer was directed to pay Rs 1 lakh as compensation and Rs 5,000 as cost of litigation. The developer was directed to refund the amount of Rs 8. 21 lakh with 9 per cent rate of interest. It is pertinent to mention here that last month the Consumer Forum of UT, Chandigarh too passed a similar order against the same developer. The Chandigarh Forum, on the complaint of a Sector 49 based couple, had directed the developer to refund an amount of Rs 3.75 lakhs. |
