Uttarakhand CM’s fate to be decided today
New Delhi, January 9 Bahuguna arrived in Delhi today almost parallel to the arrival of Congress MLAs from Uttarakhand known to owe allegiance to senior state leader Harish Rawat, who had wanted his own anointment as the CM when the party narrowly won state elections in 2012. Ever since then, the pro-Rawat camp has been agitating for replacing Bahuguna saying he has not been able to hold the ranks together. Amid the growing pressure, the Congress core group headed by party president Sonia Gandhi is expected to discuss the issue of replacement of Bahuguna at a meeting tomorrow. Meanwhile party general secretary in charge of the state Ambika Soni today said that MLAs from the state had met her and their views “were being considered”. The Tribune has reliably learnt that Harish Rawat, who was later rehabilitated by being made Water Resources Minister at the Centre, today met both Soni and Sonia Gandhi giving weight to the likelihood of Bahuguna’s replacement. The final decision would, however, be taken at the level of the core group with insiders saying the odds were against Bahuguna considering the growing dissidence in the state ranks. Bahuguna’s sister and UPCC leader Rita Bahuguna Joshi also met Janardan Dwivedi.

New Delhi, January 9 On January 30, 2004,
Mukherjee, who was the Chief Whip and Manmohan Singh the Leader of the Opposition in the Rajya
Sabha, had taken exception to the Vajpayee government move for not proroguing Parliament after a short winter session in 2003 and then re-summoning it for passage of the vote-on-account amid talk of early
elections. Mukherjee also objected to making announcements on policy issues and concessions outside Parliament when the Houses were technically in session. Ten years later, the issue has come a full circle. Now, the scenario bears similarity on two counts, vote-on-account and possible push for some key legislations including the framework Bill that Congress vice president Rahul Gandhi had advocated necessary to tackle graft.
Mukherjee, who is now the President, in the Rajya Sabha speech sought to know from the government the reason for not to prorogue the House after adjourning it sine die. ``But what is the rationale behind extending the winter session? Approval of the vote on account because the full Budget cannot be placed before the House due to general election?'' and then went on the quote precedents pointing to Dr Manmohan Singh who as the Finance Minister presented the vote on account in 1996 and not a full budget because of elections that year. On the decision to pro-rouge, he said once both the Houses are adjourned sine die, the President cannot prorogue without the advice of the Prime Minister. Referring to Article 87 (1) (ii) of the Constitution, he said the decision also does away with the requirement that President is to address the Joint Session of both the Houses at the beginning of each year. Recalling the historical context, he said, this was the "very first amendment" to the Constitution necessitated after President every provisional session of Parliament in stipulation of the Article that each session of Parliament was to be addressed by the President. "Therefore, the normal practices all these years is that in an election year, the President addresses both the Houses twice, once at the beginning of the year and again when the new Lok Sabha is constituted," Mukherjee said reminding that while it is the Prime Minister's prerogative to hold early elections, "what is not understandable is, what would have happened if there was a normal session since the President's address is an account of work done by the government during the year with members getting an opportunity to review it. "We are deprived of that opportunity", Mukherjee noted then.

Disclose source of Rs 22,000 cr or face CBI probe, SC to Sahara

New Delhi, January 9 “No matter what you do, you have to return the money. If you have already returned it as claimed by you, show us the source” from where you mobilised such a staggering amount, a bench comprising Justices KS Radhakrishnan and JS Khehar told Sahara’s senior counsel Aryaman Sundaram and UU Lalit. “We have been most polite and generous with you. But you don’t seem to like it. In that case, we will show you the stick,” the bench remarked. The apex court asked for the source of funds as the market regulator, SEBI, said it was finding it difficult to ascertain Sahara’s claim on the basis of the several truckloads of refund vouchers it had submitted. The simple way to verify the genuineness of the refund was to go by the group companies’ records which, however, did not reflect the mobilisation of such huge funds and the disbursal. Two Sahara companies -- Sahara India Real Estate Corp Ltd (SIREC) and Sahara India Housing Investment Corp Ltd (SHIC) - had raised a total of Rs 22,885 crore from three crore small investors through convertible debentures. SEBI, however, found fault with the fund raising exercise and directed them to return it. Upholding the SEBI ruling, SC directed them to route the refund through SEBI with 15 per cent interest. But the Sahara group gave a little over Rs 5,000 crore to SEBI claiming that it had refunded about Rs 22,000 crore directly to the investors, prompting the regulator to file a contempt of court case against the two companies for violating the apex court directive. As Sahara sought three weeks time for disclosing the source, the Bench said given the kind of technology being used by the corporate sector “it should take just 10 minutes, not even 11 minutes.” “Don’t think the court is helpless. We will summon the Registrar of Companies and CBI officers and ask them to find out the source and take action against you,” the Bench said and remarked that for the past nine months it had been showing the maximum leniency but the group was adopting delaying and subversive tactics. The Bench asked SEBI to verify the documents to be submitted by Sahara before January 23 and come prepared with its response for the next hearing on January 28. Till then, the order restraining Subrata Roy and three directors of the group -- Vandana Bhargava, Ravi Shankar Dubey and Ashok Roy Choudhary -- from leaving India would be in force. |
SC to refer deemed varsity issue to UGC
New Delhi, January 9 Reserving its verdict on a batch of petitions filed by the deemed universities, a Bench comprising Justices KS Radhakrishnan and Vikramajit Sen said it was referring the matter to the commission as the government did not consult the UGC before taking a decision to de-recognise them. "We can't bypass the UGC. Its views were not sought. So, the matter should be referred to it. Let it go to the UGC and then to the government," the Bench remarked. During today's hearing, the Centre and the UGC took different stands for assessing the quality of education imparted by these institutions. While the UGC said it would even inspect the institutions, if necessary, Additional Solicitor General Indira Jaisingh said the commission should give its advice on the basis of the already available documents, without involving the institutions. There were also sharp differences as to whether the Prof PN Tandon committee report of 2009, which had prompted the government move to de-recognise them, should form the basis for the UGC exercise. The varsities said they wanted a de-novo assessment and did not want to go to the UGC with the stigma arising from the committee's report. "We will not totally discard the Tandon committee report. At the same time, we will not give our stamp of approval to you," the Bench remarked during the arguments. Senior counsel Rakesh Dwivedi said the UGC would require about three months for assessing the quality. The Bench, however, set a two-month deadline. It would outline the scope of the UGC exercise in the verdict. At the conclusion of arguments, the ASG said she would file written submissions on January 13. Appearing for some of the institutions, senior counsel Mukul Rohatgi said 16 of the 44 deemed universities were offering medical education on the basis of the recognition given under the Medical Council of India (MCI) Act that had set exacting standards. "Dr Tandon can't wish away our status granted under the MCI Act," Rohtagi said. More than two lakh students are studying in these institutions. But the government has assured the SC that it would protect their interests by accommodating them in other institutions or by facilitating state government affiliation to the affected educational bodies. Three of the 44 affected institutions are in Haryana-Lingaya's University, Nachauli, Faridabad ; Maharishi Markandeshwar University, Maulana, Ambala; and Manav Rachna International University, Faridabad. Most other institutions are in Tamil Nadu, Karnataka, Maharashtra and Uttar Pradesh.

SC: Army promotion can't be denied citing extended tenure
New Delhi, January 9 "The denial of promotion to the appellant (Maj Gen HM Singh VSM) mainly for the reason that the appellant was on extension in service, to our mind, is unsustainable besides being arbitrary," a Bench comprising Justices AK Patnaik and JS Khehar ruled. This was especially so in the light of the fact that the vacancy had become available well before the date of his retirement on superannuation, it said. "We have, therefore, no hesitation in rejecting the basis on which the claim of the appellant for onward promotion to the rank of Lt General was declined by the Appointments Committee of the Cabinet," the SC ruled. It also noted that the Selection Board had recommended his promotion on the basis of his record of service - performance, leadership qualities and vision - out of a panel of four names. The Appointments Committee of the Cabinet did not record any reason to negate the recommendation. "We are therefore of the view that the appellant deserves promotion to the rank of Lt Gen from the date due to him. Ordered accordingly," the SC said. Singh, who had been commissioned as Second Lieutenant in June 1969 in the Armoured Corps and permanently moved into the DRDO, shall be deemed to have been in service against the rank of Lt Gen till February 28, 2009 when he attained the age of 60 years and entitled to all monetary benefits which would have been due to him on account of his promotion and revised retiral benefits within three months. The Selection Board had cleared his promotion on February 27, 2008, two days before his retirement as Maj Gen. In order to ensure that his claim was not frustrated, the President had extended his service initially for three months and subsequently till the approval of his promotion by the Appointments Committee.

LS polls: Cong forms screening panels for states New Delhi, January 9 Top general secretaries of the AICC including Mohan Prakash, CP Joshi and Ajay Makan who were made charges of the screening panels ahead of four state elections in which Congress got a drubbing have been spared this time and the responsibility given to a trusted set of old guard and new leaders. The stamp of Congress vice-president Rahul Gandhi is evident in the panels with the Gandhi scion’s confidantes heading the screening committees as well as serving as members attached to panel heads. MoS, Defence, Jitendra Singh, a close Rahul aide, has been made the chairman of Uttar Pradesh screening committee. Attached to him as member of the UP screening panel will be Avinash Pande, another Rahul confidante, and Rajya Sabha MP from Maharashtra. Each screening committee will have a chairman, a member, and the general secretary in charge of the state in AICC, the state Congress president and the Congress Legislature Party leader as members. The screening committees for Himachal, J&K and Uttarakhand will be chaired by Assam Congress Committee Chief Bhubaneswar Kalita and the member appointed by the party high command is Harish Choudhary, currently AICC secretary handling Punjab. Additionally, state Congress chiefs and CLP leaders will be members of the committee - such Sukhwinder Sukhu and Virbhadra Singh respectively in Himachal; Yashpal Arya and Vijay Bahuguna in Uttarakhand and Saifuddin Soz and Mohd Aslam in J&K. For Delhi, Chandigarh, Haryana and Punjab, senior Congress leader and Lok Sabha MP from Kerala PC Chacko has been named as head of the screening committee and the member attached to him is Deepak Babaria, a close Rahul aide hailing from Gujarat. New Delhi, January 9 US-based Google had earlier this week made a formal presentation to the Election Commission proposing a tie-up with it for voter facilitation services ahead of Lok Sabha elections. The Commission, in its meeting here today which was attended by Chief Election Commissioner V S Sampath and Election Commissioners HS Brahma and SNA Zaidi, deliberated on the issue and decided not to go ahead. "After due consideration, the Commission has decided not to pursue it any further," said an EC official. The EC said Google had proposed to provide electoral look up services for citizens to help in Commission's efforts for better electoral information services. The Commission had earlier signed a non-disclosure agreement with Google but had not shared or handed over any data to the internet giant so far and was deliberating on the tie-up with it for using its search engines for voter facilitation. Congress and BJP besides some cyberspace experts had voiced concers over the proposed tie-up, saying stakeholders should have been consulted before a decision. The Congress legal cell has written to the Chief Election Commissioner raising security concerns over the proposed tie- up and hoped it will not have any effect on the electoral process and national security. — PTI |

Kiran Bedi backs Modi as PM New Delhi, January 9 On Thursday late night, Bedi said that her vote would go for Modi in order to have a stable, well governed and inclusive country. She wrote on social networking website Tweeter,"For me it is India First! Stable, Well Governed, Administered, Accountable and Inclusive. As an independent voter, my vote is for NaMo." In October last year, while delivering a speech in Ahmadabad, she had backed Modi. "The man is delivering and has brought good development in Gujarat. Govt nod to 10,000 plus MBBS seats
New Delhi, January 9 The Cabinet Committee on Economic Affairs (CCEA) today approved the Rs 10,000 crore proposal of the Ministry of Health and Family Welfare to upgrade existing state government/Central Government medical colleges to increase the Bachelor of Medicine and Bachelor of Surgery (MBBS) seats. Of the Rs 10,000 crore proposal, the Centre would bear Rs 7,500 crore and state/Union Territory's share will be Rs 2,500 crore. The funding pattern under the scheme will be 90:10 by Central and State Governments respectively for North Eastern states and special category states and in the ratio of 70:30 for other states. The total cost of one MBBS seat is approximately Rs 1.20 crore. — PTI

Maharashtra plans sops ahead of poll
Mumbai, January 9 Apart from the widely publicised proposal to reduce power tariff across the state and introduce free medicines for the poor, the Congress-NCP government is also planning to extend reservations to the Maratha community and Muslims. Deputy Chief Minister Ajit Pawar himself indicated on Wednesday that a comprehensive set of proposals was under consideration by the state government. According to sources here, the ruling alliance is considering providing 10 per cent reservation in education and government jobs to the Marathas and 4 per cent to the Muslims. At present, there is 52 per cent reservation for SCs, STs, notified and nomadic tribes, etc. However this is not likely to be touched, sources say. Industry Minister Narayan Rane is presently heading a committee on reservations for the Maratha community in the state. The state government has already rolled out a scheme under which blood would be provided to patients by simply dialling 104. Health insurance schemes covering several major illnesses are already being rolled out across the state.

Lucknow, January 9 "The political parties have resorted to negative opposition of the SP government, which has fulfilled almost all its promises made in election manifesto. Our policies and schemes are being followed by others states," SP spokesman and Cabinet minister Rajendra Chowdhury said. Defending foreign tour of eight ministers, Chowdhury said there was a tradition of such tours through which Parliamentary functioning of other countries was understood and better ties between two countries established. "The SP government has not done anything new," he said. On the cultural festival in SP supremo's native village Saifai, which ended last night with performances by Bollywood actors, Chowdhury said opposition parties were unnecessarily making hue and cry over the event, through which folk arts and local talent is promoted.

UP riots: Held LeT operatives urge Shinde to order NIA probe
New Delhi, January 9 In a letter to Home Minister Sushilkumar Shinde, MS Khan, who is representing arrested Rashid and Shahid in a Delhi court, said the matter requires "thorough and fair investigation" as there were loopholes in the version of Special Cell of Delhi Police probing the case. In the letter, the counsel referred to a speech given by Congress vice-president Rahul Gandhi on October 24 at Indore when he had said “an officer of Intelligence Bureau had briefed him about the infiltration of ISI in relief camp in Muzaffarnagar for the purpose of recruitment of youngsters”. In the communication, which the lawyer said was sent through e-mail and post to the Home Ministry, he recalled that Gandhi had stated that an IB officer had also contacted those youngsters wherein the special cell had claimed that they had received secret input about Rashid and Shahid, who were arrested from Haryana’s Mewat region, from the Central Intelligence Agency (CIA) in November-end. "Special cell of the Delhi Police claims to have arrested two persons from the Mewat region in the aforesaid case namely Mohd Shahid and Rashid on December 7 and 16, 2013 on the basis of alleged secret input received from the CIA in the end of November 2013 and now those two persons have been connected in such a manner so as to prove the contents of speech of Rahul Gandhi as true,” he said in the letter. Yeddy formally rejoins BJP
Bangalore, January 9 The Karnataka strongman, who successfully mobilised members of the numerically strong Lingayat caste to bring the BJP to power in Karnataka in 2008 for the first time in the history of the state, is expected to contest the upcoming lok Sabha polls under the leadership of Narendra Modi. The function held at the BJP state headquarters here to welcome Yeddyurappa back to the party fold, however, was a low-key affair with no central leader of the party taking part in the event. BJP Karnataka unit president Prahlad Joshi and other senior state leaders, including Bangalore (South) MP Ananth Kumar, received Yeddyurappa as he walked into the party office along with his supporters and was given the BJP’s primary membership. “Let us forget the past....let us remove the mutual suspicion and work together as the children of a mother,” said Yeddyurappa, who had announced the decision of his party KJP’s merger with the BJP a week ago. Yeddyurappa, who had left the BJP after he was forced to resign from chief the minister’s post by the party’s high command following corruption charges against him, said the Congress was facing “bankruptcy of leadership” and the country was looking forward to seeing Gujarat Chief Minister Narendra Modi as the country’s Prime Minister.

15 YSC Cong MLAs suspended
Hyderabad, January 9 The din prevailed in the House as the YSR Congress members stormed the Speaker’s podium and demanded that a resolution be passed to keep the state united. The YSR Congress, headed by YS Jagan Mohan Reddy, has been the most aggressive among those opposing the draft AP Reorganisation Bill, 2013, referred by President Pranab Mukherjee. After two adjournments in quick succession in the morning amid furore, YSR Congress members continued to stall the proceedings, following which Speaker Nadendla Manohar asked Legislative Affairs Minister S Sailajanath to move a motion to suspend the “unruly” members. The motion was then carried through voice vote and marshals were called in to evict the slogan-raising members. Later, the suspended members staged a sit-in near the main gate of the Assembly building, but were taken into preventive custody by police. Earlier, the party floor leader and Jagan’s mother YS Vijayalakshmi argued that a discussion on the draft bill would tantamount to accepting the division of the state. Asserting that her party was opposed to bifurcation, she insisted on taking
up voting on the bifurcation issue before debating the bill. “We have been repeatedly seeking a resolution by the House against the bifurcation. We even petitioned the President on this,” she said, adding: “We are not against the debate per se. We are against the bifurcation of the state. If we don’t talk we are being targeted by saying that we are favouring the division.”

AAP govt’s anti-corruption helpline gets good response
New Delhi, January 9 The Chief Minister also announced that the entire cabinet will sit in front of the Delhi Secretariat from 9:30 AM to 11 AM on Saturdays to receive grivances from people and efforts will be made to solve them i
mmediately. On weekdays, one minister will receive grievances from the public. Launching of the helpline was the third major initiative of the AAP government after subsidising power tariffs and making 20
kilo-litres of water free monthly. The Chief Minister, who is personally monitoring operation of the helpline, said out of these calls, 53 callers were found to be having serious complaints out of which 38 have agreed to do a sting operation. Officials said if a complaint is considered serious, a team of anti-corruption sleuths would help the complainant on how to conduct a sting operation to trap the accused and collect the "first evidence". The government's vigilance team after receiving evidence will pursue each case within 24
hours. Kejriwal said a four digit number will be made available in a couple of days as the helpline number so that people can remember it. — PTI

Mumbai, January 9 “The day Modi was nominated the BJP’s prime ministerial candidate he should have resigned as the Gujarat chief minister. The Prime Minister belongs to the entire country, not just one state,” Thackeray told mediapersons in Nashik. The MNS leader criticised Modi for his speech in Mumbai last month, which the former claimed focused excessively on Gujarat. “Instead of talking about his achievements in Gujarat, Modi should have spoken about what he has planned for the country as a whole,” Thackeray said.

Top Maoist leader surrenders in AP
Hyderabad, January 9 Usendi, who carried a reward of Rs 20 lakh on his head, was the spokesperson of the CPI (Maoist) Dandakaranya Special Zonal Committee (DKSZC) and was suspected to be involved in several sensational attacks, including the killing of 76 CRPF personnel in an ambush near Tarmetla in Chhattisgarh in April 2010. Usendi (45), a native of Warangal district in Andhra Pradesh and a member of the DKSZC, gave himself up along with his wife Santoshi Markam, also a Maoist from Kondangoan in Chhattisgarh and a divisional committee member of the DKSZC press unit. Producing the couple before the media today, State Director General of Police B Prasada Rao said the top Naxalite leader was “disillusioned with the mindless violence” perpetrated by his organisation and also had “ideological differences” with the CPI-Maoist leadership. Usendi, who spent 28 years underground, was suspected to have played a key role in the ambush of a convoy of Chhattisgarh Congress leaders in Bastar forest region last year that claimed 27 lives. Though the couple surrendered before the state police two days ago, the announcement was made today. The DGP said the surrendered Maoist would be given the reward amount of Rs 20 lakh as part of the state government’s rehabilitation policy.

Goa building collapse toll rises to 25
Panaji, January 9 Rescuers have managed to pull out 16 people alive so far. More than 40 people were trapped under the debris when the under construction five-storey building caved in on Saturday afternoon. The rescue work through drilling was withdrawn earlier this week after adjacent buildings began tilting, posing a threat of collapse, following which manual rescue operations were commenced on Tuesday. The work to demolish these buildings will begin today. Goa police have already arrested Deputy Town Planner Prakash Bandodkar for illegally sanctioning permit to the building while several others including builders, contractor and a municipal engineer are untraceable. — PTI |

Gandhinagar, January 9 A chargesheet has already been filed against Asaram in Jodhpur, Rajasthan, in another rape case. The fresh chargesheet, filed in the court of Chief Judicial Magistrate JB Parikh, indicts Asaram, his wife Lakshmi, daughter Bharti and his four women followers - Dhruvben, Nirmala, Jassi and Meera. All of them have been charged under Sections 376 (rape), 342 (illegal confinement) and 120 B (criminal conspiracy) of the IPC. — PTI

Rahul's Amethi visit deferred
Lucknow, January 9 UPCC spokesperson Akhilesh Pratap Singh said Rahul's January 10-11 Amethi visit had been cancelled and fresh dates would be announced soon. "Nonstop rain has flooded the Ramlila maidan where the Congress vice-president was expected to address a public rally," said Singh. Gandhi was to inaugurate nine branches of the State Bank of India along with an FM radio station. He was also expected to inaugurate a 'Rail Neer' plant that supplies mineral water to the Indian Railway. Launching a railway shopping complex in his constituency was also on his itinerary before addressing the Ramlila maidan public rally. The visit had assumed significance since it was to take place just two days before the January 12 Aam Aadmi Party's rally to be addressed by Kumar Vishwas at the same venue. Vishwas who has declared himself as the Lok Sabha candidate from Amethi against Rahul had announced to kick-start the party's campaign on January 12.
