INLD seeks special session on khap demand

Continuing to play to the gallery in Jat-dominated Haryana, the Indian National Lok Dal today demanded a special session of the Haryana Vidhan Sabha to recommend to the Centre amendments in the Hindu Marriage Act, 1955, to the Central Government.

In a resolution to Speaker HS Chatha under Rule 171 of the Assembly Rules, Kalayat MLA Rampal Majra, INLD state president and Thanesar MLA Ashok Arora and Israna MLA Krishan Pawar have stated that this be admitted to the next session of the House.

“This House recommends to the state government that it may approach the Central Government to make necessary amendments in the Hindu Marriage Act, 1955, to prohibit marriages in the same gotra in order to maintain harmony, dignity, high values of society and old traditions and customs.

“It is further recommended that till this amendment is made, an ordinance be promulgated by the Cente in this regard.”

The resolution says to avoid any delay in the matter, the government should be approached to convene a special session of the House to pass the resolution and forward the “collective recommendation” to the Central Government. “We want the House to pass this as a private resolution and want the Centre to act on our recommendation. Same-gotra marriages are just not acceptable to us,” Arora emphasised.

This move of the INLD is being seen not only an attempt by the party to step up pressure on the Congress government in the state, but to also boost the sagging morale of the khaps whose campaign on a ban on same-gotra marriages is losing steam.

When the khaps first announced their decision to seek an amendment in the marriage Act, Chautala was among the first leaders to openly support their cause. Gradually, his MLAs started to stand by the khaps and address meeting in their favour. Meanwhile, the khaps continue to press for their demand and have reiterated their threat to cut off supplies to Delhi and gherao Congress MPs reluctant to raise their demand in Parliament.

VHP favours changes in marriage Act

The Vishwa Hindu Parishad has backed khap panchayats on the issue of seeking an amendment to the Hindu Marriage Act for banning same-gotra marriages.

The Arya Samaj has already extended support to the khaps. The VHP has taken exception to the description of khap panchayats as “Taliban-style bodies” by a section of society. Talking to mediapersons here today, VHP spokesperson Surender Jain justified the demand of the khaps for a ban on same-gotra marriages. He, however, urged the khaps not to use any violent means in their agitation. Asking the Sarv Khap Mahapanchayat to seek support of the people of Delhi rather than stop civil supplies to the state on June 20, the VHP leader said mass support would held their cause.

He said khap leaders had approached the VHP for support on the issue and the khaps launched an agitation, the VHP would actively participate in it, but it should be peaceful and “within acceptable norms”. — TNS

In the ongoing political debate over khaps and the issue of amendment to the Hindu Marriage Act, Kuldeep Bishnoi, supremo of the Haryana Janhit Congress, is the latest entrant.

Bishnoi today appreciated the stand taken by Left parties on this issue and said no amendment to the marriage laws was needed as no same-gotra marriages were taking place in Haryana.

Terming the khap panchayats as “self-styled” and unconstitutional, he demanded stern action against those collecting funds for those convicted in the Manoj-Babli case. Coming down heavily on Chief Minister Bhupinder Singh Hooda and INLD supremo Om Prakash Chautala for allegedly flaring up the issue for vote considerations, Bishnoi appealed to the people to see through their game plan. He alleged that both Chautala and Hooda considered themselves “self-pronounced” leaders of the Jat community and hence their respective stand on this issue was to keep the khap panchayats in good humour.

“There are no same-gotra marriages in Haryana so where does the question of banning these arise,” Bishnoi asked. The HJC leader said the issue should have been set to rest the moment Union Law Minister Veerappa Moily made it clear that there was no plan to bring about such an amendment.

He said the statements of Chautala and those of Congress leaders, which, he said, were at the behest of Hooda, were not only encouraging the unconstitutionally set up “self-styled” panchayats, but were also protecting their nefarious activities. “Activists of such self-styled panchayats have been collecting funds for those convicted in the Manoj-Babli murder and the government as well as the INLD has been providing support to these people by speaking in their favour,” Bishnoi said.

He demanded immediate and stern action against such persons, who were out to defy the law of the land. Bishnoi, however, clarified that his party could support any such amendment to the Hindu Marriage Act, provided the Bill to this effect was brought by the Union Government itself, and it was not under any pressure from the khap panchayats.

Property dealer found shot dead
'Suicide note' blames SHO

A 44-year-old property dealer was found shot dead under mysterious circumstances at his home in Ganpati Heights here today.

In a letter, supposed to be his suicide note, the deceased, Dinesh, has stated that the Station House Officer (SHO) of DLF Phase-1 used to harass him, due to which he was forced to end his life.

Rampal, father of the deceased, has also alleged that the said SHO had been harassing his son in connection with a fraud case.

“He had demanded a sum of Rs 10 lakh and used to regularly threaten my son,” said Rampal, who could not hold back his tears.

The Gurgaon police has registered a case of abetment to suicide under Section 306 of the IPC against the SHO.

Gurgaon Police Commissioner SS Deswal confirmed that the deceased had blamed the SHO for his death in his suicide note.

“We have registered an FIR and are investigating the matter...appropriate action will be taken in this regard after we reach a definite conclusion,” he asserted.

Later in the evening, DCP (Gurgaon-West) Ved Prakash Godara said SHO Rishi Pal had been shifted to the Police Lines.

“He has not been suspended or arrested so far as the investigation is still on,” he maintained.

Meanwhile, Dinesh’s body was sent for a post-mortem, which confirmed that he was shot in the chest and then in the temple, which led to his death.

However, though it seems improbable that a person shoots himself twice to commit suicide, the police authorities do not see or suspect anything amiss.

“There is no reason to suspect any foul play as nothing suspicious was found at the scene of crime,” said a senior police official.

Dinesh was a native of Wajidpur village in the district and lived with his wife and two children.

It was the (in)famous smirk sported by former Haryana DGP SPS Rathore as he came out of the court on December 21 last that shook the conscience of the nation and angered all sections of society. The Ruchika case not only led to widespread condemnation, but also rocked Parliament.

After that, every time he visited the court, everyone had only one question - Is the smirk still there? Many feel but for the smirk on Rathore’s face on that winter morning, Ruchika might not have become a household name in the country. Many, in the know of the case, feel that if Rathore had not made the complaint against him as his “moonchh ka swaal”, he might have been leading a comfortable retired life now instead of cooling his heels in the jail over which he once lorded.

Friends of Ruchika, led by the Anand family, had lodged a complaint against Rathore in August 1990, for his misdemeanour. Though the then DGP, Haryana, RR Singh, indicted Rathore, he was helped by politicians as well as the “UP lobby” in the Haryana bureaucracy.

Rathore continued to get promotion after promotion, helped by “friendly” bureaucrats, who just ignored the very damning RR Singh report against him. It was this report, which ultimately got justice for Ruchika.

The way Rathore made strides in his career demoralised those fighting on behalf of Ruchika even after her death. Her family virtually went into exile. At one stage, friends of Ruchika virtually gave up. However, after his promotions, Rathore wanted to “restore his honour”.

He persisted with a defamation case filed by him against all those who had signed the initial complaint against him in 1990 as well as journalists of newspapers which had published that complaint, including The Tribune and Dainik Tribune. The case was filed shortly after August 1990 in an Ambala court, but the case was transferred to Panchkula after it became a separate district.

After being summoned by the court, the defendants were admitted to bail. Their defence in the case could only be the truth. Those who had virtually surrendered before the might of the system renewed their pledge to get justice for Ruchika as well as to defend all those whom Rathore had sued. In the forefront of this fight was not a journalist but a simple, peace-loving couple, Anand Prakash and Madhu, helped by a doctor friend Naresh Mittal. Their daughter, Aradhana, was the sole witness to the misdeed of Rathore.

Madhu Prakash obtained an official copy of the RR Singh inquiry report from the Home Department of Haryana. She then moved the Punjab and Haryana High Court for a direction to the government to initiate action against Rathore in the light of the report.

The rest is history.

Her mother Kaushalya Pawan, brother and brother-in-law have reached here to take her back home. She is to be released from MDD Bal Bhawan, where she had been living for the past some time, tomorrow.

Chinta Pawan, who reportedly got married to Vir Singh of Aligarh a few years ago, was allegedly tortured and ill-treated by her in-laws. She managed to escape from the house six months after her marriage and reached Faridabad, where she come in contact with members of the Mahila Jagriti Kalyan Samiti, who took her to the Deputy Commissioner. The DC sent her to Nari Niketan, Karnal, and she is lodged there since May 5, 2007.

She was one of the five girls of Nari Niketan who wanted to pursue studies and was shifted to MDD Bal Bhavan on the orders of the then DC, BS Alhawat. She expressed her desire to go home after Karnal Deputy Commissioner JS Ahlawat recently asked the Nari Niketan authorities to set free all inmates not facing any court case.

After she made a request to go home, the local authorities traced her antecedents and established contact with the authorities in Durgapur. The local police informed its Karnal counterpart that her mother had lodged a complaint that her daughter had been missing for the past four years.

The Durgapur police also issued a certificate to establish her identity, which carried the photographs of both the mother and the daughter. The certificate was produced before the police here, following which the Nari Niketan authorities were told to complete the formalities for her release.

Raj Singh Chaudhary, president of the Pravasi Suraksha Vahini, said he suspected that the girl was sold and not married and the girl’s mother also suspected that the person who arranged the marriage had cheated them. He urged the police to trace the man and take necessary action against him.

Kaushalya was overwhelmed to see her daughter after several years and is keenly waiting for the night to pass so that she could take her home.

No compensation for Ruchika’s family

In 1998 when the then UT District and Sessions Judge Amar Dutt imposed a fine of Rs 2.5 lakh on Punjab’s former police chief KPS Gill in a molestation case, the media reports said “a Daniel comes to judgment”. Gill was asked to pay a fine of Rs 2 lakh to victim Rupan Bajaj and Rs 50,000 as litigation costs. Out of the total, Rs 25,000 was to be paid to victim IAS officer’s husband BR Bajaj.

If it’s a fit case for enhancing the sentence, it is good enough for increasing the fine.

A Division Bench of the Punjab and Haryana High Court, and even the apex court, upheld the “landmark judgment”, with little modifications on fine and litigation costs. The judgment was even ranked among the top 50 verdicts the country saw during the 20th century. But just over a decade later, it did not serve as a precedent for the appellant court in Ruchika molestation case. Even the judgment by High Court Division Bench headed by Justice Mehtab Singh Gill, granting Rs 1 crore compensation to the victims of crime, was not taken into consideration.

The special judge did enhance the sentence to 18 months, but left the Girhotra family with just the satisfaction of seeing the top cop behind bars. Compensation was not ordered for the victim’s family. The order came less than a fortnight after the Supreme Court asked the courts to liberally award monetary compensation to victims in criminal cases.

Policeman suspended for thrashing students

SP Satinder Kumar Gupta today suspended a police constable for barging into a boys’ hostel of Chaudhary Devi Lal University and beating up two students there. The constable, Rajesh, who was working in the SP office, has been sent to the Police Lines after his suspension. The victims, Surender Kumar and Vikas Dahiya, both students of MA (physical education) were sitting in their room in Lajpat Rai Hostel of the university on night of May 24, when Rajesh came with his brother Ravinder, also a student of the university, and allegedly beat up the two with sticks.

Ravinder, according the complaint of the two students, had a dispute with them and came to the university with his brother to beat them up. The victims had brought the matter to the notice of the university authorities, who asked the chief warden, Dr Vikram Singh, to probe the matter.

The police also made an entry of the incident in its daily dairy register yesterday. The SP ordered the suspension of Rajesh after getting a report from the SHO in this regard.

It was a day of protests and demonstrations in Sirsa and Fatehabad today. Activists of the Haryana Roadways Employees Joint Action Committee today observed hunger strike at Sirsa and Fatehabad roadways depots.

Sarbat Singh Punia, state general secretary of the Haryana Roadways Workers Union, alleged that the state government wanted to issue private road permits despite protests by workers.

He said the roadways employees had been agitating for long for their demands, but the government had not paid heed till now.

The Joint Action Committee of power nigam workers today staged a dharna at the 33-kV power substation in Sirsa. Dalip Kumar, president of the local unit, alleged that the state government had planned to hand over Gurgaon and Panipat circles of the power utilities to the private franchisees despite strong protests.

He said the power workers would fight to the hilt and not allow any privatisation of the nigams. The Haryana Rajkiye Adhyapak Sangh held a demonstration in front of the office of the district education officer and the district elementary education officer in Fatehabad in favour of their demands.

Lastly, the government teachers, who had assembled in the Panchayat Bhawan in Fatehabad for a meeting under the ongoing census operations, held demonstration against lack of amenities.

CN Bharti, state cashier of the Haryana Rajkiye Adhyapak Sangh, alleged that there was no drinking water in Panchayat Bhawan and they were being made to sit without fans for hours as there was no electricity during the meeting time.

No threat to Bishnoi: Centre

Just over three months after the security cover of former Parliamentarian Kuldeep Bishnoi was scaled down from “Z” to “X” category, the Union of India today said his case had been reviewed at the highest level, but there was nothing to substantiate his claims for enhanced security.

Assistant solicitor-general Anmol Rattan Sidhu made the assertion during the hearing of Bishnoi’s petition against the scaling down of his security cover. While “Z” category entitled him to 27 guards round-the-clock, “X” category has left him with one PSO round-the-clock.

The order was passed after his security was discussed recently at a high-level meeting in the Home Ministry. It was decided that there was no threat at all and that the high security given could be withdrawn.

Kuldeep Bishnoi is a former MP and son of known politician Bhajan Lal of the Haryana Janhit Congress. The petition will come up on June 30 for further hearing.

Ex- CM’s daughter moves HC

Former Chief Minister Om Prakash Chautala’s daughter today moved the Punjab and Haryana High Court alleging “mala fide” intention behind the decision to suspend water supply to her land.

In her petition, Suchitra and her mother-in-law Rishal Kaur said the “water supply was discontinued only on the ground that some private persons made a complaint against them that Suchitra’s father was the Chief Minister. Due to the influence of the Chief Minister, water was being improperly utilised.

They sought directions to the state of Haryana and other respondents to continue water supply to orchid spread over 166 kanals in Banohari village in Hisar district.

Taking up the petition, the High Court issued notice of motion to the state of Haryana and other respondents for July 5.

CAT dismisses ex-DGP’s plea

The Central Administrative Tribunal dismissed the petition of former Haryana DGP MS Malik, who had applied for quashing of his suspension orders and chargesheet, here today.

Malik was placed under suspension on June 14, 2005, for his alleged "dubious" role in the recruitment to the now defunct Haryana Industrial Security Force and other cadres. He challenged the suspension orders before the Chandigarh bench of the Central Administrative Tribunal (CAT).

Meanwhile, he was issued a chargesheet on August 3, 2005. The CAT quashed his suspension on September 9, 2005. The government went in an appeal before the Punjab and Haryana High Court, which stayed the CAT order. Malik's suspension was extended till his retirement on October 31, 2006. He again approached the CAT against the extension of his suspension, which quashed his suspension on April 17, 2008.

Malik also applied for quashing the orders of April 4, 2007, pertaining to the appointment of finance secretary as inquiry officer in his case alleging that finance secretary was biased against him. The CAT, in its order, said the apex court had consistently taken a view that courts or tribunals should not interfere in the disciplinary proceedings at interlocutory stage or issuance of chargesheet and applicant had also failed to make a ground to quash the chargesheet. "We find no merit in his original application and the same is dismissed. The respondents are free to proceed against the applicant as per rules and law and interim order passed earlier stand vacated," said the order. — TNS

Vacation advanced, but only for students

In view of the heat wave in North India, the state Education Department has declared holidays for students in all schools, government as well as aided, from May 27 to 31.

The official summer vacation in schools is scheduled to begin from June 1.

Though the summer vacation has been advanced for the students, the teaching and other staff members will have to come on duty till May 31.

These directions of the Director (School Education), Haryana, were issued to all district education officers and elementary education officers in the state.

The communiqué was sent through a fax which stated that there will be no classes from May 27 to 31, but the teachers and other staff employed in schools will have to attend their duties in schools as usual.

3 killed in road mishap

Three persons were killed and four others injured seriously when the Qualis they were travelling in rammed into a stationary dumper parked on the roadside near Pipli, 40 km from here, today.

Two persons died on the spot while another succumbed to his injuries at a hospital in Kurukshetra.

The occupants of the ill-fated jeep, hailing from Uttam Nagar Colony in Delhi, were returning after paying obeisance at the Mata Vaishno Devi temple when the tragedy struck.

One seriously injured person was referred to the PGI, Chandigarh, while three others were rushed to Delhi.

The bodies of the victims have been sent to Kurukshetra for postmortem.

One of the injured persons rued that the injured persons were not properly attended to at the hospital.

Shamsher Singh, SHO, said there were seven people in the jeep which rammed into the dumper. A case had been registered in this regard, he added.

Sudhir Chowdhary, IG, HPA, Madhuban, has been posted as Director, HPA, Madhuban, against a vacant post. Shashank Anand, DCP, Central, Faridabad, has been appointed as Superintendent of Police, Ambala, in place of Bharti Arora who has proceeded on leave. Similarly, Ashwin, awaiting posting orders, has been posted as Superintendent of Police, Bhiwani, in place of Vikas Arora, who has proceeded on leave.
