Bills on civic poll not violating Constitution: Aiyar
Chandigarh, October 8 Speaking on the Haryana Assembly’s recent passage of three Bills providing for the curtailment of tenure of panchayats and municipal bodies, Mr Aiyar said: “Prima facie, I feel that there is no violation of the constitution.” Mr Aiyar was here at the conclusion of the two-day round table conference on Panchayati Raj institutions. Interestingly, the Congress in Haryana has opposed the Bills, saying they are illegal and unconstitutional. The Haryana Assembly has passed the Bill to hold elections four months prior to the expiry of their terms. The matter is pending with the Governor, who has already sought legal advice on it. Elaborating on it he said: “Only this much has been mentioned in the Constitution that elections should be held after five years. It is not specified in the Constitution whether election to panchayats could be held prior to completion of the term or not.” His words suited the Indian National Lok Dal (INLD) chief Om Prakash Chautala more than the Congress, which is opposing the Bills. When asked to clarify as Panchayat minister whether he felt such a step (curtailment of panchayat’s tenure) by the Haryana Government was a healthy trend, the minister shot back: “It can’t be a question of yes or no. I am not the Law Minister. Such a move by the Haryana Government does give rise to questions.” When pointed out that Indian Youth Congress chief Randeep Surjewala had protested against the Bill this morning, Mr Aiyar said Mr Surjewala as a Congress man had every right to protest against these Bills if he found anything wrong with them. He said it was for the Governor to take a decision on the Bills and after that anybody could approach the court if there was any legal question to be sorted out in this regard. The elections to panchayats in Haryana were due in March-April next year and the Assembly polls were due in February next. |

Chandigarh, October 8 Mr Aiyar told newsmen here earlier in the day that "prima facie, I feel there is no violation of the
Constitution (in holding the panchayat elections 120 days before the expiry of their term)". Mr Aiyar's assertion is completely negates the stand of the Haryana Congress and the Youth Congress, which today urged the Governor not to give his assent to the controversial Bills as they violated the Constitution. Mr Surjewala said in a statement issued in the evening that Mr Aiyar's remarks seemed to have been made "off the cuff". He said the minister seemed to have not read the Constitution and the controversial Bills. The Youth Congress leader said his party as well as the Haryana Congress had examined the Bills and the constitutional provisions in this regard thoroughly and were of the considered view that the Bills were illegal and violated the Constitution. He said even the courts had upheld that the terms of the panchayats could not be curtailed. He reiterated that the Governor should not give his assent to the Bills. |
Surjewala asks Kidwai not to give assent to Bills
Chandigarh, October 8 A delegation led by All-India Youth Congress president Randeep Surjewala, met the Governor here today and submitted a memorandum to him in this regard. The president of the Haryana unit of the party, Mr Satwinder Singh Sandhu, was among the delegates. The memorandum gave a detailed legal position to justify the contention of the Youth Congress that the Bills were ultra vires of the Constitution. Mr Surjewala and his colleagues also told Dr Kidwai how the Chief Minister, Mr Om Prakash Chautala, was using these elections as an instrument to serve his political interests, even at the cost of dividing society badly. He said in 1999 when the panchayat and civic elections were due, Mr Chautala subverted the Constitution to defer these elections till after the Assembly elections because he knew that society, particularly in the rural areas, would be badly divided. The factionalism in the rural society would have adversely affected the prospects of his party in the Assembly elections. Mr Surjewala said after suffering a humiliating defeat in the recent Lok Sabha elections, Mr Chautala wanted to hold the early panchayat elections so that his party might gain from factionalism in the rural society. He also alleged that the ruling party would resort to large scale violence during the panchayat elections so that at least one faction in the villages aligned with the INLD. The Youth Congress leader said when Mr Chautala deferred the panchayat elections in 1999, the Punjab and Haryana High Court passed strictures against various functionaries of the government. The strictures, he said, had not been expunged so far. He claimed that the amendment Bills aimed at surreptitiously curtailing the tenure of the panchayats and civic bodies, which was in violation of several Articles of the Constitution and court judgements on the issue. The Assembly had no power to pass these Bills. The party urged the Governor to send the Bills for the consideration of the President of India. |
HVP gets into election mode
Sohna (Gurgaon), October 8 Former Speaker of the Haryana Assembly, Chattar Singh Chauhan, who has been deputed by the HVP to give a thrust to its ongoing campaign in the Sohna segment, said that the coming elections in the state would be a contest between Mr Bansi Lal and others for the post of Chief Minister and appealed to the masses to give their verdict on the basis of performance of Mr Bansi Lal in the past 38 years of the formation of Haryana. Prof Chauhan is here on a two-day tour of a score of villages in Sohna. The villages include Khatola, Kassan, Baas Kasla, Aliar, Wazirpur, Badha, Khandsa, Palda, Bhondsi, Sahjawas, Khedla, Sirmathla, Lausinghani, Dohla, Sohna, Ghamdauj and Thanda. The villages are dominated by the Rajput community which constitute about 17,000 of about one lakh votes. Addressing the meetings, he said that local HVP leader, Mr Ram Chander Yadav would in all probability be his party nominee for the election. On the Sutlej-Yamuna Link (SYL) canal, Prof Chauhan said that it was Mr Bansi Lal who was instrumental in conceiving the project with the indulgenece of Indira Gandhi. Had Mr Bansi Lal not gone out of power in the 1987, the project would have seen the light of the day. After the elections, Mr Devi Lal came to power in Haryana and Mr Parkash Singh Badal in Punjab. Both of the them “colluded” to throw a spanner in the construction of the remaining portion of the canal, he added. He asserted that the SYL was the lifeline of south Haryana. While coming down on the INLD government headed by Mr Om Prakash Chautala, he was equally sharp on the Congress and the BJP. He said there was no wave in favour of the Congress in the last parliamentary elections. In Haryana where the Congress won nine out of the 10 seats, it was the anti-incumbency factor against the regime of Mr Chautala and the public saw the Congress as the only alternative. The HVP had no stakes in the national politics in the last parliamentary elections. The coming Assembly elections would be a different ball game. He criticised Congress President Sonia Gandhi, for being “non-committal” in the face of the Punjab Assembly annulling the water sharing agreements with other states, including Haryana. Also, the nine Congress MPs from Haryana did not raise the issue in Parliament in the interest of the state, he added. |

Hisar, October 8 Mr Sihag, who was posted as Traffic Manager at Hisar, attended a public meeting in connection with the poll campaign of INLD MLA Abhey Chautala at Jakhod Khera village, near here, in March this year. Mr Abhey had come to seek votes for his brother and INLD general secretary Ajay Chautala, who was a contestant for the Bhiwani Lok Sabha seat. Mr Sihag reportedly welcomed the MLA, apart from addressing the gathering on the occasion. A Hindi daily published from Rohtak carried a report in this regard, along with a picture of Mr Sihag addressing the public meeting. Since it was a clear violation of the Code of Conduct, various political parties decided to report the matter to the Election Commission. Leaders of the BJP, the Congress, the Haryana Vikas Party and several other political parties demanded strict action against the official. Seeing the gravity of the issue, the roadways authorities shifted Mr Sihag to Hansi. Meanwhile, the journalist who had brought the matter to light, alleged that the official had threatened him with dire consequences. A delegation of local journalists met the then Deputy Commissioner-cum-District Electoral Officer, Ms Deepti Umashankar, and apprised her of the situation. She assured them of prompt action. The Election Commission directed the district administration to inquire into the matter regarding the poll code violation and submit a report in this regard. Finally, on the directions of the Election Commission, Mr Sihag was suspended. However, according to roadways sources, the suspension orders were reportedly not implemented for several days due to the official’s “influence and high connections”. Moreover, after remaining under suspension for a few weeks, he was reinstated. Mr Sihag has now been promoted as an HCS officer, apparently as a reward for his services to the ruling party. |
3 Lals looted Haryana, says Maratha Virender
Rohtak, October 8 Addressing a Sarv Jatiya Mahapanchayat yesterday at the historic Chaubisi Chabutara at Meham, he said the three Lals and their kin had looted Haryana. The Ekta Shakti would ensure that all corrupt politicians were tried for their crimes. Had this been done earlier, Haryana would have been the most progressive state in the country, he said. He said even in the Congress, the present leaders vying for the post of Chief Minister were all alike and no different from the Lals. Seeking the support of the masses, he said it was time Haryanvis reposed their faith in the Ekta Shakti and swept it to power. Mr Virender said his party would provide a clean, transparent, efficient and responsive government to the people. The real rulers would be the people of Haryana and the Ekta Shakti leadership would only do what the people wanted it to do. The mahapanchayat passed a resolution expressing its faith in the party and authorised Mr Virender to select the candidate for the Meham Assembly constituency for the forthcoming Assembly poll. |

Women keen to adopt organic farming
Karnal, October 8 A three-day training programme on the preparation of vermi-compost (organic fertiliser) was held at the Krishi Vigyan Kendra (KVK) of the National Dairy Research Institute (NDRI) which concluded here today. At least, 35 women of Kohand and Kailash villages here participated in the programme. Earlier, 20 women of Kailash village were also trained by the KVK in preparation of the vermi-compost technique. Interestingly, most of the women who participated in the training camp, this week, were young and had an environmental friendly vision. “
It is just a beginning and I hope that it will help in giving up chemical fertilisers in the years to come”, a young woman said. Ms Saroj Mehta, Senior Technical Officer of the KVK who coordinated the training programme said the women were given practical training for the preparation of the vermi-compost using earthworms. The vermi-compost unit of the KVK demonstrated various steps involved in making of the manure. She said the women were also taken to a nearby Rindal village where the vermin-compost manure was being manufactured for commercial use. “Apart from the house hold work and their vital role in dairying, the rural women can play an important role in preserving the nutritional value of the soil by manufacturing organic manure and adopting organic farming for the cultivation of vegetables, pulses and oil seeds”, she added. Dr Parminder Singh Oberoi, officiating head of the KVK, said it was the second training programme organised during the current year on the vermi compost technology for rural women. He said for sustainable land use system, the KVK had already made more than 25 demonstrations in various villages of this district during the current year. He said that there was a need to train rural women in the making of the organic fertiliser so that they could learn the vermi-compost technology and adopt it at the initial stage for kitchen gardening and later for large-scale organic farm production. |
Another probe into irregular college admissions
Rohtak, October 8 This follows a directive of the Punjab and Haryana High Court on a petition filed by Poonam Devi who was denied admission to the course. She had alleged that while at least seven candidates were given admission by creating additional seats, she was denied the same in an arbitrary manner. The court asked the government to probe the allegations. Mr
M.L. Tayal, Secretary, Education, conducted a preliminary probe and concluded that prima facie the then Vice-Chancellor, Major-Gen Bhim Singh Suhag (retd) and the Principal of the college concerned, Dr S.S. Yadav, had erred gravely by creating additional seats. The report was placed before a Division Bench of the court. Dr Yadav was issued a chargesheet immediately but no action could be initiated against the then VC as the same came under the purview of the Chancellor. After Mr Tayal’s report was placed before the court along with the action-taken report, the judges wanted to know what action was taken against the then VC who had disregarded university rules and regulations by creating additional seats at will. The matter was referred to the then Chancellor, Babu Parmanand. After seeking legal advice he decided to institute a regular inquiry before taking punitive action against the VC. He was advised that the only possible action against a VC under the circumstances could be his removal from office. As such a regular probe must be conducted under Section 9 (1) A of the MDU Act. According to sources, by the time he ordered the inquiry, Chief Minister Om Prakash Chautala had already announced the candidature of General Suhag from the Rohtak Lok Sabha seat as a nominee of the Indian National Lok Dal. However, the appointment of an inquiry officer was delayed to avoid embarrassment to the government at that crucial juncture. |

Army removes encroachment
Ambala, October 8 The shop owner, Mr Umesh Sahni, who is a former member of the Cantonment Board, claimed that the Army could not take action since his appeal was pending. However, a senior Army officer said the encroachment had been removed under the due course of law. A posse of policemen stood guard at the site since morning. A number of Army men were also present at the site to ensure that the removal of encroachment could be carried out without any hiccups. The Army personnel arrived at the shop site at about 7 a.m. along with a JCB machine. They directed Mr Sahni to remove the encroachment. Thereafter, a few Congress leaders, including a former minister, Mr Phool Chand
Mullana, Dr Pradeep Chauhan and Mr Naresh Chadha, arrived on the spot. The SDM, Mr Satbir Saini, went through the documentation and observed that the Army had to clear the encroachment from defence land. Mr Sahni stated that the Army was initiating a wrong action, pending his appeal. “The Army had not initiated action in this case in 2002. Also, they had themselves constructed the wall, which they now want to demolish and re-construct extending up to my shop. I fail to understand why the Army wants to block a passage,” he said. Col Anil Mathur of PH & HP (I) Sub Area said the anti-encroachment action had been taken under the due course of law. “We are clearing encroachments from A 1 Defence Land. We gave considerable time to Mr Sahni to remove the encroachment and thereafter, the wall was constructed,” he said. He stated that the local residents had an alternative access road and there should not be any problem. “Incidentally, with the wall being formed, the students of Kendriya Vidyalaya will have a large open playing field. This will go a long way in giving an opportunity to the Kendriya Vidyalaya students to hone their sporting skills,” he said. The Haryana Pradesh Congress Committee deputy spokesperson, Dr Pradeep Chauhan, observed that the Army seemed to be taking “selective” action in anti-encroachment drive. “We feel that this action has taken place after Mr Umesh Sahni left the Vikas Parishad, which is led by Ambala cantonment MLA Anil Vij and joined the Congress,” he said. No case of polio this year
Chandigarh, October 8 While stating this here today, DG, Health Services, Haryana, Dr B.S. Dahiya, said the next National Intensified Pulse Polio Immunisation (IPPI) round was scheduled from October 10, 2004, in which Haryana too would participate. He said all arrangements for the successful implementation of the upcoming programme had been finalised in the state. As many as 15,000 pulse polio immunisation (PPI) booths, including transit booths and mobile teams would be set up at locations convenient to the community. These booths would be manned by 60,000 vaccinators drawn from Health, ICDS and Education Departments. Besides NGOs and community volunteers, 2,500 supervisors would be pressed into service to oversee the functioning of the vaccination teams and to ensure that no child was left unimmunised. One hundred independent monitors from WHO, Medical Colleges, Voluntary sector as well as officers of the Health Department and respective district administrations would also be monitoring the activity to ensure complete coverage. About 2,500 vehicles would be deployed for distribution of vaccine, other logistics to PPI booths and for supervisory work. Dr Dahiya said about 38 lakh children would be administered polio drops during the October, 2004. |
Notice on former HSEB officer's plea

Chandigarh, October 8 Petitioner Ram Kishan, who had been compulsorily retired after adverse remarks in his annual confidential report, has sought action against the law officers of the HSEB allegedly involved in the embezzlement of lakhs of rupees of the board. The two officers named by him had allegedly embezzled money that was to be returned to some customers who had sought refund of money overcharged from them. One of the officers had even charged advocates' fee at the rate of Rs 400 per case in case of such complainant-customers even though he was not entitled to the same. The petitioner stated that a vigilance inquiry had found them guilty but the government had not taken action against them, while he had been unnecessarily punished. The petition against his forced retirement is also pending in the High Court. Today, advocate Atul Lakhanpal, counsel for the petitioner, told the court that it was strange that while whistle-blowers like the petitioner were being thrown out of their jobs, no action was being taken against those who had embezzled public money. The case will now come up on December 1. |
Fatehabad gears up for polio drive

dhanis. He said it was a challenge to administer polio drops to all the living in dhanis as these were scattered over the district in remote areas. He exhorted the officers to accomplish their job with sincerity as it was associated with the health of the coming generation. 2 get life term for murder
Ambala, October 8 The Judge held Surender and Sapna guilty in this case on Thursday. Today, he sentenced them to life term. According to prosecution, the body of the property dealer, Joginder Singh, was recovered from the Army ground at Ambala Cantonment on May 23, 1999. The body was wrapped in a woollen cloth and had injuries on the neck. The deceased was an ex-serviceman. The police had registered a case of murder against six persons in this regard on the complaint of Ms Avinash Kaur, wife of the deceased. In her complaint, she had informed the police that on the evening of May 22, 1999, a man and a woman came to her house in a Maruti car and talked to her husband. Later, they took her husband in the car and he did not return. Next morning, his body was found in the Army ground opposite SD College. A letter had been recovered from the pocket of the deceased, in which it was written that informers had to face such a fate. Two police personnel were threatened to be ready to face dire consequences. The police investigated the matter and established that the accused had hired the Maruti car from Dera Bassi. They locked the driver of the car, Sohan Lal, in a house at Sector 9 in Ambala City and used the car to kidnap the property dealer. The police said in the challan that there was a dispute between the accused and the property dealer over a piece of land. According to counsel of the complainant, Mr
D.K. Bansal, during the proceedings, the driver of the car had identified Surender and Sapna and told the court that they had hired the car from him. At least 24 witnesses, including the wife of the deceased, had been produced in the court. |

Bhiwani, October 8 The accused would have to undergo further six months imprisonment if they failed to pay the fine. According to prosecution, Krishan alias Billu, son of Manphool of Saunf village, lifted Poonam, daughter of Dharmbir, forcibly when she was sleeping on the night of May 19, 2002. He took her in a jeep to Lamba village. In between, Narender alias Kalu, son of Har Chand of Gauripur village and Krishan, son of Bhagwan of Saunf village, accompanied him and they took her to Misri village and raped her. A case had been registered. |

Bhiwani, October 8 According to information, six members of a family of Paldi village were going to meet their relative Kamlesh at Charkhi Dadri in a Mahindra Max jeep. At about 10 p.m., driver Harish (30) lost control of the vehicle and rammed the jeep into a parked truck near Ghasola village. Balbir (60), Ram Kishan (40) and Khushboo (4) died on the spot. The injured Sarti Devi (50), wife of Balbir, Neelam (28), Ramesh and driver Harish were admitted to Charkhi Dadri hospital. The doctor referred Sarti Devi, Harish and Neelam to the medical college, Rohtak, where Sarti Devi succumbed to her injuries today. The police has registered a case and sent the bodies for a post mortem examination. |
Farmer beaten to death; 4 arrested
Kurukshetra, October 8 Sources in the police revealed that Amar Singh a resident of Sirsala village in Kurukshetra district, was allegedly beaten to death by Rampal, Ashok Kumar, Jaspal, all brothers, and Rampal’s son, Manoj Kumar while he was sleeping. The assailants fled when neighbourers rushed to save him. He was rushed to a private hospital where he was declared brought dead. The family members of the deceased in a statement recorded before the police alleged that there was a long-pending property dispute between the two families that claimed Amar Singh’s life. However, the dispute was once solved amicably on the intervention of the village panchayat but the wrangling continued between them. On the other hand, Rampal’s son, Amit, alleged that none of his family member was involved in the feud. In fact, Amar Singh had died of heart attack, he said. Meanwhile, the policehas registered a criminal case under Section 302 of the IPC. |

Chandigarh, October 8 Stating this here today, the deputy spokesman of the party, Dr Pradeep Chauhan, said Mr Bhajan Lal, party president, would launch the programme from Ferozpur Jhirka by addressing a public rally to be held in Shamsudin Park there. Dr Chauhan said Mr Bhajan Lal would hold public meetings as part of the “abhiyan” at Ambala cantonment on October 22, at Nathu Shri Chokta in Sirsa district on October 31 and at Hisar cantonment on November 7. Chandigarh, October 8 In a statement issued here Mr Hooda said farmers, who were earlier ruined by the drought, were now unable to get remunerative prices for their produce because of the government’s apathy. He said first the Haryana Government had announced that it would start procurement of paddy from October 1. However, when Punjab started procurement from September 27, Haryana too had to enter the market from September 28. But practically the government agencies were yet to start purchasing paddy because they were not prepared for it. |

Chandigarh, October 8 While stating this here today, Financial Commissioner and Principal Secretary, Food and Supplies, Mr H.C. Disodia, said the state government had approached the Central Government to enhance the procurement price of leviable rice to protect the interests of the millers. He said 5.84 lakh tonnes of paddy had so far arrived in the state mandies as against 3.56 lakh tonnes during the corresponding period last year. Out of the total paddy arrivals, 3.10 lakh tonnes had been purchased by the government agencies at the MSP announced by the government of India. He said the state government had made all arrangements for smooth procurement of paddy and farmers were being paid for their produce within 48 to 72 years. |

Ambala, October 8 A police official said a person who was travelling with Sethi had offered him a cold drink, which was apparently laced with some intoxicant. Sethi was taken to the Civil Hospital. He was robbed of about Rs 75,000, a gold chain, a bracelet and a mobile phone. |
