Notice to ASI on plea seeking protected status New Delhi, May 5 A division bench comprising Chief Justice B C Patel and Justice B D Ahmed directed ASI, MCD and the DDA officials concerned to be present in court on the next date of hearing to explain why action should not be taken against them for their failure to preserve and maintain the mosque and its surroundings. The judges told the authorities to meanwhile stop any misuse of the monument and clean up dirt and filth around the complex of one of the largest mosques in the world. Not taking such steps would amount to contempt of court, the bench observed. The petition, filed by ‘Heritage and Culture Forum’ through counsel Usha Kumar, said illegal structures in the area known as ‘Coat Market’ were blocking the view of Jama Masjid from the Red Fort, the way it was originally made by Mughal emperor Shahjahan. It also sought the removal of shops that had sprung up in parks and fountains adjoining the mosque. Jama Masjid is a Waqf property, which gets ASI funds for its maintenance and upkeep. The Supreme Court recently clarified that a waqf property could also be declared protected under the Ancient Monuments and Archaeological Sites and Remains Act. A protected monument was provided with a 100-m ‘prohibitive’ zone encircling the monument where no construction was allowed and further 200-m ‘regulative’ zone where construction could only be carried out with the permission of the ASI. |
