SC gives land rights of ex-ruler to HP New, Delhi, November 20 Dismissing an appeal by four occupants, led by Masood Beg against the order of the Himachal Pradesh High Court, which had upheld the lower courts’ judgment decreeing a suit in favour of the government, a Bench comprising Mr Justice Shivaraj V. Patil and Mr Justice D. M. Dharmadhikari said the state has a right over the entire property — the agriculture land, building and the shops — gifted to Din Mohammad, a contractor of Chamba State by the King in 1927. However, taking a sympathetic view of the fact that the property had come in the possession of existing occupants — Masood Beg, Anwar Beg, Asghar Beg and Munwar Beg — in peculiar circumstances, the court said they would be at liberty to submit an application to the state government to get the building and shops by way of sale or allotment as per the law prevailing in this regard. But the Court made it clear that the land would vest in the state of Himachal Pradesh as per the decree of the lower court, which passed the judgment in 1979. The property is estimated to be worth crores of rupees at the existing market price and the building and the shops were situated at the “Chaugan grounds” area, in the heart of Chamba. The court agreed with the contention of Himachal’s Additional Advocate General (AAG) J. S. Attri that the order of settlement by the revenue department, on the basis of which the occupants claimed to be the “Malguzars (possessors)” of the property, had no legal basis. The government counsel said the king, subsequent to the gifting of the property to Din Mohammad, had renewed his order under which his daughter-in-law Tajo was given only lifetime right so that she could repay the debt of Rs 2,000 incurred on her after the death of the male members of the family. Rejecting the claim of the occupants that they were the legal heirs of Tajo, the apex court accepted the plea of the Himachal government that the two orders of the king could not be superseded by any subsequent order passed by revenue department, giving “Malguzari” to the occupants. Since she had subsequently mortgaged the property for Rs 4,000 and paid the debt and earned for herself Rs 2,000, there was no question of the present occupants, who claimed to be Tajo’s relatives, to get the legal right of the property, the AAG said. |
Third party can’t intervene in criminal case: SC New Delhi, November 20 Dismissing a public interest litigation (PIL) seeking converting of death penalty of two convicts from Alipur in West Bengal into life sentence, a Bench comprising Mr Justice Doraiswamy Raju and Mr Justice Arijit Pasayat said “repercussions of permitting a third party to challenge the findings of the court in a criminal case can be serious.” “Unless the aggrieved party is a minor or an insane or one who is suffering from any other disability which the law recognises as sufficient to permit another person, a next friend, to move the court on his behalf...” there was no scope for their party intervention under the provisions of the Code of Criminal Procedure (CrPC), the court said. In the PIL, filed by one Ashok Kumar Pandey, had pleaded for converting the death sentence of the condemned prisoners Dhananjay Chatterjee and a co-accused into life sentence on the ground that they had not been executed for a long time even when their clemancy petitions were turned down by the President. Since they had not been executed, they had “suffered a great degree of mental torture which was a sufficient ground in itself for conversion of the death sentence,” the PIL had said. |
Jaswant to open economic summit New Delhi, November 20 The summit, organised under the aegis of the WEF and the Confederation of Indian Industry (CII), will have the theme “Enhancing India’s competitiveness : A must for growth”. CBI begins examination of videotape New Delhi, November 20 Sources said the videotape was being viewed by the investigating team after which it would be sent to the Centre for Forensic and Scientific Laboratory (CFSL) to ascertain whether it was “genuine” or “doctored”. CBI registered a preliminary enquiry (PE) on November 18 with regard to the controversial videotape purporting to show Mr Judeo, the then Environment and Forest Minister, who later resigned, receiving money. The sources said the identity of the persons in the videotape would have to be ascertained as it was not clear as to who was the bribe giver. The CBI would also meet Mr Judeo to record his voice so that the voice spectrography test could be conducted by the agency. The focus of the investigations, besides finding out whether Mr Judeo had allegedly
accepted the bribe, would be to establish missing links like who had hatched the conspiracy to “entrap” the former minister, which was an offence under law. —

Telgi had ISI links: sena Mumbai, November 20 Mr Narayan Rane, the party’s Leader of the Opposition in Maharashtra Legislative Assembly, said Telgi’s links with Dawood Ibrahim needed to be probed by the Central Bureau of Investigation. However, Mr Rane who has been making these statements at press conferences across the state, has provided no proof of Telgi’s links with Ibrahim or the ISI. So far the ruling Democratic Front government in Maharashtra has not heeded to demands by the Opposition and Governor Mohammad Fazal about handing over the investigations to the CBI. Maharashtra’s Chief Minister Sushilkumar Shinde told the media that the government was satisfied with the progress made by the Special Investigation Team handling the probe. The fake stamp scandal is expected to figure prominently in the forthcoming session of the state legislature due from December 8 at Nagpur, Maharashtra’s second capital. The Shiv Sena and the Bharatiya Janata Party have threatened to make the stamp paper scandal a major issue in the forthcoming Assembly elections in Maharashtra. Politicians from all major political parties are suspected to have links with Telgi. Maharashtra’s former Chief Minister Vilasrao Deshmukh, present Deputy Chief Minister Chhagan Bhujbal of the Nationalist Congress Party, former Deputy Chief Minister and leader of the Bharatiya Janata Party in the Maharashtra legislature Gopinath Munde have all had to issue statements in their defence since the scam broke. So far two legislators, Mr Anil Gote from Maharashtra and Mr Krishna Yadav from Andhra Pradesh, have been arrested in connection with the scam. |
BJP misleading on Telgi, says Congress New Delhi, November 20 The judgment, passed today by the Bombay High Court Chief Justice S J Vazifdar, mentioned a statement by the Additional Solicitor General of India stating on behalf of the CBI that the incident was being ‘effectively’ probed by the states concerned and it would not be desirable to transfer the case to the central agency at this stage. Producing a copy of the court judgment, Mr Sharma said it was a matter of concern if Mr Advani, who is also the Home Minister, was not aware of the fact that the CBI itself had refused to accept the case, while it was ‘’shameful if he tried to mislead the people despite knowing it.” —

Dhruv gets DGCA certification Bangalore, November 20 The HAL Chairman and Managing Director N.R. Mohanty told UNI that the DGCA certification was received on October 30. Several states have already shown interest in acquiring the 14-seater, twin-engine state-of-the-art helicopter. “We will soon export the civil variant of Dhruv,” he said. When asked where it would be exported, he said he would disclose the country’s name at an appropriate time. Mr Mohanty, who recently returned from a tour of the USA, where several aviation companies had shown keen interest in partnering with HAL, said Bell Helicopter had also shown inclination to work with HAL. According to aviation experts, besides the cost factor, the certification would help Indian aviation operators acquire a state-of-the-art helicopter, which could fly up to four and a half hours. With its wide body, spacious and quiet cabin, Dhruv is well suited for various civil roles at low direct operating cost. Besides VIP travel, it could be used for commuter services, search and rescue operations, disaster relief and offshore operations. Mr Mohanty said HAL had successfully tested the mission computer developed by it jointly with the Defence Avionics Research Establishment for Jaguars and similar development projects were also being taken up for other fighter aircraft. —

Naga peace talks in
December Kohima, November 20 According to NSCN (I-M) sources, the next round of peace parleys, which were deferred because of the coming Assembly polls in five states would be held at the Thai capital next month. This time the talks would focus on making the political dialogue more substantive and productive, sources said and added that in the last round of talks the NSCN (I-M) had hinted it would like the Centre to address political issues, including the contentious issue of integration of the
Naga-inhabited areas in the North-East and the degree of political sovereignty to be offered to the
Nagas. Meanwhile, in yet another large defection of the NSCN(K) cadres to the NSCN (I-M), four more cadres of the outfit switched allegiance to join the NSCN (I-M), sources informed. —

Presiding officer killed in Bihar Patna, November 20 State Election Office sources said a presiding officer was killed at booth number 244 at Barakchatti jungle under the Barachatti Assembly constituency by MCC ultras, who had called for poll boycott. Sources said that a police person was also injured in the attack. The injured was rushed to
hospital. Polling staff and security personnel also came under the MCC attack at Monahar block during the bypolls under the Barachatti Assembly constituency. District Magistrate Brajesh Mehrotra said that a member of the polling party and a policeman sustained injuries as the rebels swooped down on them at Mohaniya river. Lok Sabha member from Sheohar Anwarul Haque and 26 others were arrested at Sitamarhi. —
