Plan to withdraw illegal notification on forest
land Shimla, August 23 Mr Chander Kumar, state forest minister, said since the decision to exclude the wasteland classified as “gair mumkin” and “charagah bila drakhtan” from the notified forest areas was taken by the cabinet, the matter would have to be decided by it only. He said the withdrawal of the notification would have implications on the land already allotted for various projects, mining and other non-forestry uses on its basis. He said it was a complicated matter and all aspects would have to be taken into consideration while taking a decision. In fact, the state had been left with no option after the Centre rejected the decision to exclude such lands and asked it to withdraw the notification. The advisory committee set up by the Centre to examine the issue was of the unambiguous opinion that the state had no authority to issue such notification. It could not exclude land once declared as forest area or to which the provisions of the Indian Forest Act were applicable without the prior permission of the Centre. Under the Forest Conservation Act no forest land could be diverted for non-forestry use without the prior approval of the Centre. However, the Dhumal government found an ingenious way to circumvent the law. It issued a notification to exclude the two categories of wasteland from the notified forest areas which meant that forest laws will not be applicable to such lands anymore. The friendly Vajpayee government at the Centre, the Union Ministry for Environment kept quiet. However, soon after Assembly elections in the state it wrote a letter asking the government to withdraw the illegal notification. The notification also contravened the direction of the Supreme Court which had ended all ambiguity over the definition of forest land. It held that the term forest land would not only include forest as understood in the dictionary sense but also any area recorded as forest by the government, irrespective of the ownership. |

property suit Solan, August 23 The land belonged to Maharaja Yadavindra Singh, father of Capt Amarinder Singh and the erstwhile ruler of Patiala. The state became a part of the Union of India, however, the private property was left out. Capt Amarinder Singh claims that Chail was his personal property. The high court had allowed an application put forth on his behalf regarding the redemarcation of the property which is being contested by the HP Tourism Department. |
High Court judge inspects lower courts Sundernagar, August 23 He visited the court premises on Thursday and inspected the court works of the District and Sessions Judge, Additional District and Sessions Judge, and Chief Judicial Magistrate Mandi, and yesterday inspected the three Judicial Magistrate cum Sub Judges courts. The inspection team of the High court has been camping at Mandi for past few days. Routine inspection is done after every two years to ensure the things were done per high court rules. Dinner was hosted for inspecting Justice by the members of District Bar Association Mandi on Thursday. He called upon the members of Bar and Judicial officers to work hard in the interest of litigants. Mr P.C. Sharma, Registrar General (Inspections), accompanied the inspection team. |
Cops transferred for not giving CM news on
BJP Hamirpur, August 23 The Chief Minister was annoyed that an Independence Day function was organised at Kakker village in Hamirpur district and he had come to know of it only from the press. Source said the CM wanted to know from intelligence agencies what they had been doing when the entire Hamirpur had known that the BJP would hold a function at Kakker. Prof Prem Kumar Dhumal, a former Chief Minister and senior BJP leader, was the chief guest on that occasion. Highly placed sources in the state government told The Tribune here this evening that the Chief Minister had expressed his annoyance over the Hamirpur incidents and blasted officials who had met him recently. He told them to ensure that such “mistakes” were not repeated. The CM also sought comments from the Hamirpur DC, who had met him in Shimla two days ago, and the SP, Hamirpur. They were specifically instructed to ensure that nothing was hidden from the CM, especially the developments on the “political front”. There are reports that a senior officer of the state police is likely to visit Hamirpur next week to assess the political mood in the district and give a detailed report to the Chief Minister. Meanwhile, the Hamirpur officialdom is upset over the reported remarks of the Chief Minister. It is now trying to cultivate more sources in the district to come out with “timely information” to be passed on to the Chief Minister. |
Inquiry sought into graveyard allotment Nurpur, August 23 The complainants claimed that the graveyard was owned by the Punjab Wakf Board and in possession of the Able-Islam, which legally could not be leased out. They alleged that 450 metres of the graveyard was leased out on May 3 by the board for the construction of a shopping complex. The complainants had raised objections before the board authorities at Dharamsala, but in vain. The leasee came on the spot on August 15 for taking possession of the land, but the attempt was foiled. The leasee took physical possession of the land with police protection yesterday. A suit was being filed in the District Sessions Court, at Dharamsala in representative capacity against the allotment. |

Police denies working under
pressure Shimla, August 23 A spokesman said yesterday that prompt action had been taken in the case pertaining to the attack on Mr M.K. Sisodia and Mr Gurtej Garcha of Pinjore and two of the accused had been arrested. He said Mr Sisodia met the DIG, Southern Range, on August 20 and requested him to depute gunmen to escort him till Kalka and the DIG had ordered the Station House Officer, Sadar police station, to provide gunmen to him. Regarding the threatening calls received by Mr I.D. Dhiman a BJP MLA, he said the police did not receive any such complaint from him.
New Act to change power sector: Stokes Shimla, August 23 Addressing a meeting of the state Regulatory Commission Advisory Committee here yesterday, she said the new Act would transform the power sector by speeding up the reform process. It would promote competition in the power sector which would ultimately benefit the consumers. Kokje for farm education for tribesmen Shimla, August 23 Mr Kokje also inaugurated Trilokinath Bhavan at the Kukamsere centre. Dr Tej Pratap, Vice-Chancellor, Agriculture University, Palampur, talked about university projects in tribal and other areas .

Architect charged with forging
NOCs Dharamsala, August 23 After Dharamsala, Palampur and some other parts of the district have been brought under the Town and Country Planning Act, such NOCs have become a must for the release of water and electricity connections. The Town and Country Planning Department, Dharamsala, had noticed some fake NOCs and reported the matter to the police. The police says that it has found this architect to be responsible for it. The Assistant Town and Country Planner, Mr Raina said many connections at Dharamsala and Palampur had been released on fake NOCs or no certificate at all. He said certain IPH and HPSEB officials were not releasing details of such connections, which was hampering detection of unauthorised constructions in Palampur and Dharamsala. Mr Raina said the matter had been taken up with the government. |
Four students held in stabbing
case Kangra, August 23 One of the accused was arrested on Thursday while the other four were in hiding. The police said a team raided a hideout at Andretta village and nabbed the four accused — Sachin Paul, Sanjeev Kumar alias Sunny, Gourav Sood and Vikas Chouhan. Three students were stabbed in a group clash on Wednesday. |
Marketing yards to be computerised Kulu, August 23 The board would try to get farmers the best price. There were 10 big marketing centres and 52 marketing yards in Himachal Pradesh and the local centre was number one, he said. The board would organise workshops and seminars for farmers with emphasis on training in marketing. The board would even hold field training and exhibitions for small farmers and took into transportation problems. Ropeways and roads would be laid. Marketing yards would be constructed at Patlikuhal, Chauri Bihal, Bhuntar, Larji and Banjar. Auction platforms, residential complexes and shops would be built at Bhuntar, Chauri Bihal, Patlikuhal and Kulu, he said. |
Pre-arrest bail for ex-MC

The municipal council had been dissolved on August 14 and the SDM, Dalhousie, had been appointed as the administrator. She said she was apprehending arrest as the government might initiate criminal cases against her. |

Diagnostic centre for Solan hospital Solan, August 23 The centre would be housed in a new building near staff quarters close to the main hospital wing. She set March 31, 2004, as the deadline for completing the project. Ms Chandresh Kumari said the Maternity Child Health Centre at the hospital would be strengthened. There was also a proposal to have incinerators and power back-up devices at all government hospitals. A free hepatitis-B vaccination camp would be held here next month. The minister said that a system would soon be evolved to deal with runaway specialists. |

Una, August 23 The deceased has been identified as Lakhbir Singh, son of Mr Ujagar Singh, a resident of Funfun Kalan village, of Hoshiarpur district in Punjab. He was part of a group which was returning to their native village after offering prayers at the Pir Nigah shrine here. The police could retrieve the body only this morning from the river. The boy was later sent for a post-mortem at the Zonal Hospital here. —
