Forum penalises finance company Ludhiana, June 1 According to the complaint, Mr Dilpreet Singh was a holder of a recurring account no. 405/104 at the Jagraon branch of the company. The consumer stated before the forum that he regularly deposited Rs 500 in the account and the maturity value was Rs 14,750, which was to be paid by the company on November 21, 1999. It was alleged by the complainant that despite giving legal notice to the company, the due payment was not given to the consumer. The company pleaded before the forum that it was not permitted to accept fresh deposits and was paying the depositors out of the recoveries from the investments which were made earlier. The respondent maintained, “The present position is that they have to recover more amount than the amount due to the investors and this imbalance in receipts and payments is the main cause for delay in payment. The company admitted the claims of the consumer and requested before the forum to give some time to settle the claim. The forum observed that it was admitted by the respondent that the consumer had deposited the amount with the company and the maturity value of the deposit was Rs 14,250 which was to be paid on November 21, 1999. The forum held that it was clear deficiency on the part of the company for not paying the due amount to its customer on the due date and as such a penal interest of 18 per cent should be allowed to the complainant on the principal amount (Rs 12,000). |
