New house tax policy under fire
From K.G. Dutt

KARNAL, Feb 7 — A section of municipal councillors from almost all municipal committees in the state are up in arms against the new house tax policy of the state government. Signs of revolt are already visible among the municipal councillors in Sonepat, Ambala, Jind, Panipat etc.

According to reports made available to The Tribune, almost all councillors of Sonepat have revolted against the introduction of the new house tax policy. Cutting across party lines, the councillors have objected to the survey being undertaken for the assessment of new house tax policy. This had made the position of the president of the municipal council and the Executive Officer awkward. Even the INLD councillors have joined hands with the BJP to oppose the move to impose house tax on new lines.

The Om Parkash Chautala government had tried to impose new slabes of house tax about a year ago. But following stiff resistance both from the municipal committees and general public, the idea was dropped. The BJP and the Congress in the state had opposed the imposition of house tax as per the new policy.

In Sonepat, the argument advanced by the authorities for the introduction of new house tax policy is to collect more funds for taking the municipal council out of financial crunch.

It is a known fact that almost 95 per cent of the municipal committees in Haryana are in the red. A majority of these are not even in a position to pay salary to their employees in time. In some committees, the sweepers have not been paid salary for the past about six months. The financial crunch has gripped the municipal committees after the abolition of octroi which was a major source of income for them.

Although, there was pay-scale bungling the collection of octroi, yet it resulted in filling the empty coffers of the municipal committees.

The Chautala government stands to gain doubly from the new policy. One in the cities, the BJP enjoys majority in most of the municipal committees. The imposition of new house tax and its collection will have naturally lead to the erosion of the support base of the BJP. The second argument is that in almost all municipal committees, house tax has been levied as per the discretion of the municipal authorities. There is no set formula for the imposition of the house tax.

Reports gathered by this correspondent indicate that in Sonepat, the councillors have decided not to co-operate in the house tax survey being undertaken by the authorities.

Similarly, in Jind, although the authorities have hired a contractor for undertaking survey, yet apprehensions in the minds of councillors are there that it will result in bunglings. The authorities have decided to pay Rs 5 per house to the survey contractor. The contractor is reported to have hired semi-literate people for the purpose. The councillors are of the opinion that the new policy and the new survey is unlikely to be approved by the finance committees of the municipal councils. Moreover, it is being felt that the new policy is also full of flaws and this will not in any way plug the loopholes of the past policy.

In Panipat too the municipal council has hired the services of a private company to do door-to-door survey in all 31 wards of the municipal council.

In Ambala, the councillors have opposed the new move on the plea that it will lead to the imposition of more taxes on the low income group, salaried classes and middle class people. Therefore, it is being surmised that the new policy is likely to meet the same fate as the earlier ones relating to the house tax in different cities.

Cong ‘dharm yudh’ against INLD
From Our Correspondent

BHIWANI, Feb 7 — The INLD government has failed on every front and to apprise people of the anti-public policies, the Haryana Pradesh Congress Committee will organise a state-level rally at Bhiwani on March 18. Stating it as “dharm yudh” against the INLD-BJP government, the HPCC chief Bhupinder Singh Hooda, while addressing a press conference here yesterday, said that some central leaders besides state’s MLAs and DCC presidents would also be invited in the rally. He claimed the rally would show the unity of the Congress in the state.

Mr Hooda said a meeting of the general body of the party would also be held to decide further strategy to make the rally a big success on February 18 at Bhiwani. The Congress leader said resentment prevailed among people of the state against the failure of the present government’s policies and they wanted immediate change.

Criticising the INLD leadership, Mr Hooda said claimant of the farmers’ cause the state government despite being a staunch supporter and a wing of the NDA government, had not been able to get any relief package like the Punjab Government. He said the Centre was yet to decide the support price for wheat.

Mr Hooda said the Congress had organised anti-government demonstrations throughout the state which got good response from public and it could be termed as public opinion against the government.

Answering a question Mr Hooda said he would challenge the INLD and the HVP by holding a big rally here. He said Bhiwani had been known as the big base of the HVP but this rally would prove this claim as a myth.

Reacting to question about the proposed rally of Mr Bhajan Lal on March 4 at Bhiwani the PCC president categorically denied getting any notice in this connection but he said disciplinary action would be taken against any personal rally. He said the Congress High Command had already banned such rallies.

Criticising the BJP, he said the BJP had proved itself as a opportunistic party. The BJP has not even touched the SYL issue though it was ruling at the Centre and even sharing government in the state.

Mr Dharmbir Singh, MLA, Dr Vasudev Sharma, former minister and DCC president, NSUI president Verender Kaushik and Sandeep Singh were among those present at the press conference.

On the other hand, former Chief Minister Bhajan Lal was firm on holding rally at Bhiwani on March 4. He also addressed a press conference here today at the residence of former Chief Minister and Rajya Sabha member B.D. Gupta.

Gurgaon ‘sitting’ on powder keg
From Ravi S. Singh
Tribune News Service

GURGAON, Feb 7 — Gurgaon district, having its tectonic feature in Sohana fault and falling in one of the most seismic volatile areas, sits on a powder keg. The other tectonic features affecting the region, including Delhi, Rajasthan and Uttar Pradesh, is the hidden Moradabad fault, main Himalayan boundary fault and the juction of the Aravali and alluvium near Delhi, known as the Delhi ridge fault. This can lead to an earthquake of the intensity measuring eight on the Richter scale, according to experts.

Haryana is in the danger zone as it is closer to the tectonic features. The outer boundary of the Sohana block in this district begins from about 10 km from this city.

Experts of Haryana are of the view that remedial and preventive measures, along with damage control mechanism, should be in place in the event of an earthquake.

According to Dr Abhey Srivastava, an expert on disaster-related studies and working with the Haryana Institute of Public Administration (HIPA), if an earthquake recording eight on the Richter scale occurs, it will raze this district to the ground. A circumference of 100 km around the epicentre of the Sohana fault will be equally disastrous in Rewari and Mahendergarh districts.

According to him parts of Delhi, including Parliament, the Supreme Court, President House and Prime Minister House, can be reduced to rubble in the face of a high-intensity earthquake.

This point was raised by a committee which submitted its report to the state government in 1992. This committee was constituted to prepare a contingency action plan.

Seven summoned for forging loan papers
From Our Correspondent

HISAR, Feb 7 — Mr J.S. Sidhu, Judicial Magistrate, has summoned seven persons, including the Managing Director of a local credit and leasing company, for forging a loan agreement on a blank stamp paper for extorting money from a local advocate, Mr Gagandeep Mehta.

The magistrate said the complainant had signed the paper as a guarantor for his former employer who had sought a small loan from the company. However, the paper was later misused in forging a loan agreement in the name of six persons. The amount ran into several lakhs.

The order stated that it had been proved that the signed stamp paper was used to forge the agreement. The loan amount shown in the agreement had in fact been paid by the six persons to purchase shares of the credit company which were duly allotted. However, the agreement falsely showed the amount as having given to the complainant as loan.

Those summoned included Mr Rajender Lahoria, Managing Director of the credit company and six others including a Chartered Accountant of the company. The summons have been issued for June 6.

Excise officer’s arrest stayed in murder case
From Jatinder Sharma

ROHTAK, Feb 7 — The Additional Sessions Judge, Mr Shiva Sharma, today stayed the arrest of Mr R.S. Malik, Deputy Excise and Taxation Commissioner, Jhajjar, charged with the murder of his wife.

The Judge in his order said the documents and the bail application militate against the involvement of the petitioner in the murder of his own wife some 23 years after marriage. “As such, I stay the arrest of the petitioner till the next date of hearing”, he ordered and issued notice to the state for February 13.

The police here has registered a criminal case under Sections 302/201, 14 and 306, IPC, against Mr R.S. Malik on the complaint of his father-in-law Shiv Charan. He told the police that his daughter Rani married Mr Malik about 23 years ago. They have a 21-year-old daughter from the marriage.

He alleged that there used to be fights between his son-in-law and daughter over domestic affairs. He further alleged that his daughter was murdered on November 5, last year and he was informed about it on telephone.

Mr Charan added that Rajender Singh and his brother Sajjan Singh had taken the body to the fields during night and tried to burn it, when he accompanied by his wife, son Luxman and son-in-law Sandeep Kataria noticed this on their way to the village.

These allegations were, however, denied by Mr Malik while seeking a pre-arrest bail. He said there was no reason for him to murder his wife when they were leading their life happily.

High Court
Haryana restrained on teachers’ test results
Tribune News Service

CHANDIGARH, Feb 7 — Issuing notice of motion for March 7 on two separate petitions seeking the quashing of notices for holding tests to select music and science masters and mistresses, a Division Bench of the Punjab and Haryana High Court today directed the state of Haryana and other respondents against declaring the results.

In their petitions, Manju Taneja and 19 others had earlier contended that according to the Haryana Education School Cadre Group Service Rules passing the test was not a qualification. They had added that their academic record and experience was being ignored.

Seeking directions to the respondents against holding the tests during the pendency of the writ petitions, counsel for the petitioners had added that they were eligible and qualified for the posts.

Giving details, counsel had added that the petitioners were appointed on an ad hoc basis on the recommendations of the selection committee and possessed three to five years’ experience.

The written test, counsel had added, was to be held on February 11 at Panchkula. An advertisement for the various posts, including 131 post of science masters and 20 posts of music masters, was initially issued on November 14, 1999, counsel added.

SSP told to probe harassment

Directing Ludhiana’s Senior Superintendent of Police to probe the alleged harassment and implication of a resident in case under the Narcotic Drugs and Psychotropic Substances Act after he filed a petition for the release of his father from “illegal detention”, Mr. Justice S.S. Nijjar of the Punjab and Haryana High Court today asked him to submit the report by March 7.

Giving orders on the petition filed by Randhir Singh, Mr. Justice Nijjar also directed the Station House Officer of a Ludhiana Police Station, Chain Singh, to be present in the court on the next date of hearing.

Randhir Singh, it may be recalled, was booked under the NDPS Act on the allegations of carrying opium soon after the warrant officer, appointed by the court, submitted that the petitioner’s father was subjected to third degree torture at the instance of the SHO after being detained at several police stations for 10 days.

In his report the warrant officer had added that the detainee was being pressured into withdrawing a civil suit filed by him against one Kishan Chand. He had added that there was no entry in the roznamcha to justify the presence of the detainee.

Counsel for the petitioner contended that the Special Judge had granted bail to Randhir Singh but due to the fear of the SHO he was not availing of the concession.

After hearing arguments, Mr. Justice Nijjar observed that this kind of behaviour by the police officials was completely outside the domain of their legitimate duties and powers. He pointed out that the interest of justice would be served if the SSP was instructed to ensure the safety of the petitioner and his family.

Fresh poll ordered to college body

On a petition filed by a former Cabinet Minister of Haryana Brij Mohan Singla, a division Bench of the High Court today directed the holding of elections to the governing body of Hindu Kanya Mahavidyalaya in Jind.

In his petition, Mr. Singla and others had earlier challenged the action of Dean of Colleges, Kurukshetra University, whereby he had directed the cancellation of the elections to the governing body held on November 5 last year.

Going into the background, the petitioners had stated that they were declared elected in the polls but under political pressure the election was cancelled by the Dean without notice. They had also alleged that INLD, with the intention of controlling the institute, had introduced party politics in the management.

Plea dismissed

A senior secondary school lecturer’s plea, seeking promotion from the date persons junior to him were allegedly promoted, was dismissed by a Division Bench of the high Court.

Delivering the verdict on the petition filed by Mohinder Singh Shergill, lecturer of a school in Hoshiarpur district, the Bench observed that the petitioner was not eligible when a circular for filling the vacant posts was issued on October 7, 1994.

The Bench, comprising Mr. Justice M.L. Singhal and Mr. Justice R.C. Kathuria, also observed that the petitioner had passed his M.Com on October 30, 1995, while the respondent whose promotion was challenged had passed the examination more than a year earlier — on June 17, 1994.

The Bench concluded that in their opinion the petitioner was rightly not promoted as the lecturer when the respondent was given promotion as the latter was eligible for the post from the day he passed M.Com.
