Almost seven months after the court of the Additional District and Sessions Judge had upheld the demolition orders passed by the Municipal Corporation (MC) on an illegal commercial building on Bhagwan Mahavir Marg, the owners of the building have readied a new showroom for a bakery at the same site that again without getting due change of land use (CLU) sanction of the building plan and payment of various dues.

CLU: MC Commissioner awaits notification of 14 commercially declared roads

Even as the Department of Local Government has already empowered the MC Commissioner with making him the competent authority for deciding the change of land use (CLU) cases under the Punjab Regional and Town Development and Planning Act, the official has not yet started clearing cases as he is awaiting notification of the 14 commercially declared roads in the city.

Auto-rickshaw drivers thwart implementation of one-way traffic rule

The very purpose of declaring the road between the city railway station and Madan Flour Mill for one-way traffic has been defeated by auto-rickshaw drivers. The drivers coming towards the railway station ask passengers to alight a few yards before the barricades, put up for implementing the one-way traffic rule.

Woman burnt alive as fire breaks out in hut

A migrant woman from Uttar Pradesh, Vinni (45), mother of a boy and a girl, was burnt alive, while her husband Mukaan sustained serious burn injuries when a fire broke out in their hut along the railway lines at nearby Khajurala village last night.

Despite demolition orders by court, illegal building raised

Almost seven months after the court of the Additional District and Sessions Judge had upheld the demolition orders passed by the Municipal Corporation (MC) on an illegal commercial building on Bhagwan Mahavir Marg, the owners of the building have readied a new showroom for a bakery at the same site that again without getting due change of land use (CLU) sanction of the building plan and payment of various dues.

The staff of the building branch of the MC have also expressed its helplessness saying that the top functionaries of the MC and the top politicians of the city representing the ruling party have not been allowing them to take action against the owners.

Even as the building, falling in the Adarsh Nagar Chowk area, was demolished last year on the grounds that it had come up in violation of the statutory provisions of the MC Act and the MC orders had been upheld by the court, the owner in utter defiance of the orders has again had the courage to proceed with the construction.

While the shop number 250, Adarsh Nagar, has already been constructed, it is being currently given the final touches. The various bakery items for sale have already been put up by the owner, Ashok Kumar, who also runs Friends Bakery in the Sodal area.

Gagan, a relative of the owner, who was at the shop today, claimed that the reconstruction was being done as the road had now been declared commercial. The owner, Ashok, claimed that he had sought due permissions. When asked as to how much amount he had paid, he could not reply.

While the superintendents, Assistant Town Planners and other staff confirmed that no permissions had been sought for the construction, the senior-rung staff remained evasive. Senior Town Planner Tirlok Singh said he would have to check the matter. Joint Commissioner Anupam Kler said she would visit the site tomorrow morning.

The court orders

The showroom owner, Ashok Kumar, had made an appeal against a notice of the Municipal Corporation issued on February 1, 2012, under Section 269 (1) of the Municipal Corporation Act-1976 to demolish the construction of the property. Finding no merit in the stay, the court of Additional District and Sessions Judge Amarjot Bhatti had, however, dismissed the plea on September 1, 2012.

The owner had pleaded that the notice was illegal and the MC could not demolish the construction which already existing on the plot at the time of the purchase. The MC officials had contradicted his claim stating that the construction had been raised in violation of the statutory provisions of the Act, building bylaws, rules and regulations of the state government.

The applicant had said the first notice was issued on June 21, 2011, and the demolition order came from the Assistant Town Planner on February 1, 2012. The MC officials had said the construction raised by the applicant is unauthorised and without the sanction of the site plan and therefore the owner could not seek the protection of law.

Upon hearing the matter, the court had ordered, "As per the provisions of Section 258 of the MC Act, there is prohibition regarding construction of building without sanction. The applicant does not claim that this construction was raised as per the sanctioned site plan. In case any illegal construction had already existing on the land purchased by him, that will not legalise the said unauthorised construction. The applicant has failed to establish case in his favour. I do not find merit in his stay application and the same is dismissed."

CLU: MC Commissioner awaits notification of 14 commercially declared roads

Even as the Department of Local Government has already empowered the MC Commissioner with making him the competent authority for deciding the change of land use (CLU) cases under the Punjab Regional and Town Development and Planning Act, the official has not yet started clearing cases as he is awaiting notification of the 14 commercially declared roads in the city.

As per the orders issued recently, the Commissioner will decide all cases of CLU in the notified master plan areas of the city, except for multiplexes. The cases pertaining to the multiplexes will be dealt at the government level in the Department of Local Bodies. The Regional Deputy Director, Local Bodies, will, however, be the authority for other towns where master plans have been notified. For areas in towns where master plans are yet to be notified, the matter again will be decided at the government level.

Charges for applicants

The policy has also listed out the CLU charges to be levied on the applicant. Officials of the building branch said in the scheme areas the charges would be Rs 3,000 per sq yard for buildings to be erected up to three storeys. For the buildings going further vertically up, charges to be levied would get doubled up to Rs 6,000 per sq yard. For the non-scheme areas, the MC will levy 5 per cent of the collector rate.

CLU can fetch Rs 8 crore

Once the notification regarding 14 commercially declared roads in Jalandhar is received by the MC, it can expect an immediate recovery of Rs 8 crore from the 55 applicants who have long been awaiting a clearance. The Local Government Department has even issued new forms for the purpose, which the MC office is now asking its applicants to fill up again as a fresh case.

The MC has 14 roads in Jalandhar which have been declared commercial. These include Empress Garden Road, Harbans Nagar main road, Old Post Office-Circuit House-Model Town Road, Mahavir Marg, Mall Road, Rainbow Road, Model Town Post Office Road, Link Road, Ladowali Road, Police Lines Road, Garha Road, Cool Road, GT Road and 120-Feet Road.

A delay on the part of the Department of Posts, in delivering a parcel through speed post, has cost the Senior Superintendents of Posts at Jalandhar and New Delhi dearly. The District Consumer Disputes Redressal Forum has asked the officials to pay up Rs 3,000 as compensation, besides refunding an amount of Rs 68.

In his complaint filed in November 2012, Urban Estate resident Harmeet Pal Singh wrote that he was a commercial pilot licence holder since June 2010. “I was to appear in the Radio Telephony Restricted (Aeronautical) examination, to be conducted by the Ministry of Communication and Information Technology, Wireless Planning and Co-ordination Wing (WPC), GOI.” The date for examination was to be intimated by the addressee after receipt of application from the complainant, he had written.

The complainant had submitted his application form on the prescribed performa to the WPC from Sub-Post Office, Urban Estate, Jalandhar, on September 20. On the back of the envelope, he had written his full address along with his mobile phone number. The said speed post envelope was never delivered to the addressee at New Delhi and as a result, the complainant could not appear in the examination.

He further revealed, “I received back the mail, undelivered, on October 8. I tracked the application through speed post online tracking system and the result was very shocking. The item was booked from Urban Estate on September 20 at 12.42.29. The bag was received the same day at 19.06.31. It was opened on the next day at 19.09.34 and was dispatched to New Delhi General Post Office (GPO) on September 26 at 07.32.41. This makes it crystal clear that the bag containing the letter of the complainant was still at Jalandhar GPO upto September 26. The item was received in Mehrauli on October 3 at 10.29.23. As per the status report, the delivery was attempted on October 3 at 18.08.00 (ie after office hours), 13 days after the post and it was marked unclaimed. The remarks given were ‘delivery attempted-insufficient address inquiry’. On the speed post envelope, complete address of the addressee was given, along with the telephone number, which could have been used by the postal authorities.”

The item was ultimately delivered back to the complainant at Jalandhar on October 8. The complainant said, “I will have to apply again for the same examination to be held at Hyderabad, undergo a 20-days training there and pay fee again for the classes, so I ought to be compensated.”

The office of the Senior Superintendent of Posts said at the time of booking the article, no assurance of time was given to the sender. “Neither assurance was given about the time of delivery nor was it possible to deliver the booked article before September 22 at Mehrauli. It is submitted that it is general practice that an article reach from Jalandhar to Delhi within 72 hours. There are many steps from Post Office Urban Estate, Phase-II, Jalandhar, to Mehrauli via Delhi. No magic could have been done to deliver the article at Mehrauli on or before September 22, the last date for the receipt of the application of the complainant. An attempt to deliver the article was done on October 3. Because of refusal by the addressee, it was delivered back to sender on October 8. The article was returned to the sender with the remark ‘Refused due to late receipt of article’. The alleged loss to the complainant cannot be attributed to the department as the last date of receipt of the application of the complainant was September 22 and it was never possible to deliver in time”.

The forum, however, did not accept the contention of department of. “We have gone through the facts and have come to the conclusion that the article had gone ‘after office hours’ and not due to last date of submission of application. The department of posts has failed to prove the reason of delay to deliver the speed post article in time. We, therefore, cannot brush aside the contention of the counsel for the complainant for delay for 13 days, which is based on cogent and relevant evidence and, therefore, complainant has succeeded to establish his case”.

The counsel for the department had said the compensation or refund of the speed post is double. “We are of the view that reasonable compensation will serve the end of justice”, the forum members decided.

SAD-BJP alliance trying to mislead voters by using Kanshi Ram’s photo, says BSP

The SAD-BJP alliance is allegedly trying to mislead the voters during the poll campaign for the Zila Parishad and Block Samiti elections by displaying the photo of Late Kanshi Ram, founder of the Bahujan Samaj Party (BSP), along with the photos of Chief Minister Parkash Singh Badal and Deputy Chief Minister Sukhbir Badal on its election material being distributed by its candidates.

The Congress and BSP have joined hands for contesting the Zila Parishad and Block Samiti elections in Phagwara as the Congress is contesting 10 out of total 19 seats, while the BSP is contesting nine seats.

This was alleged by BSP state general secretary Jarnail Nangal while addressing a press conference here on Monday evening.

He alleged that the pamphlets of SAD-BJP candidates are being circulated and distributed among voters to give wrong impression of having support of the BSP.

Nangal disclosed that he had written and submitted a complaint to SDM PP Singh, who is the Returning Officer for the elections. He described the misuse of the photo of late Kanshi Ram by SAD-BJP candidates as a criminal offence and violation of election code of conduct. Nangal also demanded legal action against the violators of the rules, including the printing press owner.

He told the media that SDM had appointed the Tehsildar as an inquiry officer, who would look into the matter and submit his report soon. He said he had also written to Election Commission in this regard.

Auto-rickshaw drivers thwart implementation of one-way traffic rule

The very purpose of declaring the road between the city railway station and Madan Flour Mill for one-way traffic has been defeated by auto-rickshaw drivers. The drivers coming towards the railway station ask passengers to alight a few yards before the barricades, put up for implementing the one-way traffic rule.

Soon after the travellers alight, they park their autos there and wait for the new passengers. This creates hindrance in smooth flow of traffic, failing the purpose of the one-way traffic rule.

Some traffic policemen remain deployed at the place, but they turn a blind eye towards the auto-rickshaws which violate the rules. Apart from auto-rickshaw drivers, a number of shopkeepers also create hindrance in the smooth flow of traffic by encroaching upon the road by putting up various items in front of their commercial establishments.

Meanwhile, a social activist, Arun Sharma Pappu, said, “The traffic police should strictly implement the one-way rule, as despite declaring the road as one-way, a number of passengers miss their trains as they fail to reach their destination in time after being stuck in the traffic snarls.”

“The MC should also clear the encroachments by shopkeepers on the road,” he added. The road had been declared one-way several months ago due to regular traffic jams on the road. However, in the absence of strict implementation of one-way traffic rule, the situation remains the same even now.

Woman burnt alive as fire breaks out in hut

Phagwara, May 14
A migrant woman from Uttar Pradesh, Vinni (45), mother of a boy and a girl, was burnt alive, while her husband Mukaan sustained serious burn injuries when a fire broke out in their hut along the railway lines at nearby Khajurala village last night.

Mukaan was admitted to the Civil Hospital. In charge of the Chiherru police post Ramandeep Singh said here today that the deceased woman Vinni and her husband Mukaan, both migrant labourers, were sleeping in their hut after lighting an earthen lamp, when the hut caught fire due to the flame of the lamp yesterday.

He said the body of Vinni had been sent for postmortem and the police had registered a case. The SHO said both Mukaan and Vinni had consumed liquor and went to sleep. Fortunately, their both children were away to their native village Jaspur in Uttar Pardesh at the time of the incident. The SHO said the police had informed their relatives in Uttar Pradesh.

Misconduct costs ASI dearly

The alleged misconduct on the part of ASI Kirpal Singh with mediapersons yesterday has cost him dearly. The ADCP (Special Branch) Diljinder Singh Dhillon assured the mediapersons today that the ASI would not be attached with any police station or given any public dealing work for a year.

"We will assign him administrative work till then. His service revolver would also not be given to him for this period. Only after he establishes that his conduct has improved, we will allow him to carry his weapon," he told mediapersons, who had approached him on the matter.

The ASI had aimed his revolver at a photojournalist and chased him and four other persons who had been following a story on a matrimonial dispute at the Division Number 4 police station.

UK teachers visit Bawa Lalvani Public School

Under the British Council’s Connecting Classrooms Programme, teachers from White House Common School, Birmingham, UK, came for a 10-day visit to Bawa Lalvani Public School, Kapurthala.

Connecting classrooms is a global education programme offered by the British Council and UK aid that supports schools in over 50 countries, working with teachers and school leaders to create enriching teaching-learning experience and develop young people’s skills in global citizenship and other curriculum areas. Jane Harper and Harriet Breeze of White House Common School visited BLPS. During their visit, they observed the classroom practices and the academic excellence of the students.

They also demonstrated their teaching techniques and methodology through activity and story-telling sessions.

The visitors were impressed and excited to visit the school campus and interact with the students and staff of BLPS. School principal and two teachers will visit the UK schools in the month of June.

Badminton competition

A inter-house badminton competition was organised at Innocent Hearts School. The four houses of the school participated with great enthusiasm. Tagore House got the first position in boys’ single and second position was secured by Sarojini House. Tagore House got the first position in girls’ single also and Teresa House got the second position in the category. Tagore House was declared the over-all winner. The winners were felicitated with gold medals and certificates.

Pool party

In the pre-primary wing of Sanskriti KMV School, a pool party was organised to beat the heat, in which students of class prep-UKG participated. All the students brought eatables from home and played indoor games also.

Farewell to MBA students

The first year students of MBA organised a farewell party ‘Parwaaz 2013’ for their seniors. They performed and enthralled the audience. Dance and modelling were the main attractions of the event. Modelling by the outgoing students was appreciated and applauded by all. The function was presided over by co-chairperson, CT Group of Institutions, Parminder Kaur Channi.
