The Baldev Nagar police station at Ambala city has registered one more case against an officer of Punjab Wakf Board, Mr Zakir Husain, and two others on the statement of Imam of Shahi Masjid, Pinjore Abdul Kayum. Earlier, the Maheshnagar police station, Ambala Cantonment, had also registered a case against Zakir on charge of abducting a newly married girl of Ambala Cantonment, Avedna Sharma.

SC sends LADT Act case to larger Bench

A bunch of appeals against the Punjab and Haryana High Court judgement upholding the Haryana Local Area Development Tax(LADT) Act has been referred to a Constitutional Bench of the Supreme Court.

The Act was challenged in the High Court, among others, by M/s Jindal Strips, the Faridabad Industries Association and Sony India Private Limited. A Division Bench comprising Mr Justice G.S. Singhvi and Mr Justice Nirmal Singh dismissed the petitions on December 21, 2001.

The appellants filed special leave petitions in the Supreme Court, which granted the leave. A Division Bench comprising Mrs Justice Ruma Pal and Mr Justice P. Venkatarama Reddi, which heard the appeals in July and August, reserved its orders on August 13 on the issue as to whether the matter should be referred to a three-Judge Bench or the Constitutional Bench.

During the course of arguments by the appellants and the state, it transpired that a two-Judge Bench in the Bihar Chamber of Commerce case and a three-Judge Bench in the Bhagat Ram Rajiv Kumar case had taken a view different from that taken by the larger Benches in the Automobile Transport Company, Rajasthan, and the Ataibari Tea Company cases, which also related to free flow of inter-state trade and commerce with reference to Article 301 and Article 304 of the Constitution.

In the LADT case of Haryana, the appellants pleaded that the law laid down by the larger Benches should be followed. According to information received here today, the Division Bench has now referred the case to a five-Judge Constitutional Bench.

Bansi promises power supply round the clock

Addressing a rally at Jagadhri, former Chief Minister and supremo of the Haryana Vikas Party lashed out at the BJP, saying it always raised the Ayodhya issue near the elections to woo votes.

The main motive of the BJP was to divert the attention of the people from the main issues.

Mr Bansi Lal blamed Mr Om Prakash Chautala, Chief Minister, Haryana, for “poor” law and order in the state. He said industrialists were migrating to other states. The government had failed to provide power in the state round the clock. The HVP supremo claimed that during his tenure as Chief Minister, Mr Inder Kumar Gujral, former Prime Minister, had laid the foundation stone of a gas plant at Faridabad. He said if he came to power, round-the-clock power would be supplied to the people of the state and power tariff rates reduced.

He also said residential plots would be provided to Dalit and Backward Classes and Form-38 abolished. Mr Nand Lal, former President of the Municipal Council, Jagadhri, Mr Jatinder Singh Kaka, General Secretary, HVP, and others also spoke.

Earlier, Mr Bansi Lal, addressing mediapersons here declared that the HVP would contest all 10 Parliament seats in the next elections. He said the HVP would not opt for alliance with any political party in the state. He said he was not personally against Mrs Sonia Gandhi, but he opposed any “foreigner” as Prime Minister.

Row stalls pension scheme

The non- implementation of the pension scheme for over 7,000 employees of the Haryana Urban Development Authority (HUDA), almost two years after it was introduced, has caused a lot of heartburn among employees.

HUDA had introduced the pension scheme for its employees in November, 2001. However, with the office of the Regional Provident Fund Commissioner (RPFC) , Karnal, asking HUDA to first deposit damages worth Rs 27 crore with the office, the pension scheme has been stalled. Officials in HUDA have been pleading that the RPFC office release the Employees Provident Fund (EPF) share of its employees already deposited with it after making deductions for these damages of Rs 27 crore. With the RPFC not releasing the balance money, HUDA says it has no funds to begin its pension scheme.

It is learnt that the entire HUDA establishment has been covered by the Karnal RPFC office since 1991. Earlier, the HUDA establishment was covered by the RPFC, Chandigarh. HUDA had been deducting Contributory Provident Fund (CPF) of its employees since 1977, but not depositing the same with the RPFC, Chandigarh. It was in 1982 when HUDA failed to get a stay against the RPFC, Chandigarh, that it finally deposited Rs 9.25 lakh with the RPFC, Chandigarh. It was in 1991 that HUDA was shifted under the RPFC, Karnal.

But HUDA also failed to deposit the provident fund even with the RPFC, Karnal, from 1991 to 1999. It was then that the Regional Provident Fund Commissioner, Karnal, passed an order asking HUDA to deposit the entire EPF collected since its inception in 1977, along with a detail return of the EPF deducted from each employee’s salary.

It was after the HUDA authorities implemented a pension scheme, on the pattern of the state government’s scheme almost two years ago that the differences between HUDA and the RPFC have come to the fore.

SAD (Haryana) to contest Assembly, LS poll

The Shiromani Akali Dal, Haryana, at a meeting here yesterday decided to contest the forthcoming Lok Sabha and Assembly elections in the state.

The meeting was presided over by the president of the state unit of the party, Mr Sukhdev Singh Gobindgarh. Besides senior leaders of the Punjab Akali Dal, Capt Kanwaljit Singh and Prem Singh Chandumajra, senior leaders of the Haryana Akali Dal, Kartar Singh Takkar, Didar Singh Habri, Amarjit Singh Maghi, Ranbir Singh Fauji, Harpal Singh Pal, Ajit Singh Saonta and Amarjit Singh Sidhu were also present in the meeting.

Mr Gobindgarh said in the last Assembly election, the Akali Dal had supported the INLD candidates but the INLD government had not taken their leaders in confidence in any matter. He said the Haryana Akali Dal would establish its independent identity in the state. He would request the party high command to allow them to contest at least two Lok Sabha seats and 10 Assembly seats either independently or with the support of any political party in the forthcoming elections.

The meeting condemned the Jind incident in which the police personnel assaulted four Sikhs. The meeting demanded proper security to Sikhs in the state. It was also decided in the meeting that a delegation of the Haryana Akali Dal would soon meet Mr Parkash Singh Badal.

1 more case against Wakf Board officer

The Baldev Nagar police station at Ambala city has registered one more case against an officer of Punjab Wakf Board, Mr Zakir Husain, and two others on the statement of Imam of Shahi Masjid, Pinjore Abdul Kayum. Earlier, the Maheshnagar police station, Ambala Cantonment, had also registered a case against Zakir on charge of abducting a newly married girl of Ambala Cantonment, Avedna Sharma.

A fortnight back, Mr Kayum had got his statement recorded in a local court at Ambala alleging that Zakir Husain, Mohammad Sardar Wani and Jamil Ahmad had come to his mosque at Pinjore a few months back and forced him to enter a fake nikahnama in the register. He had also alleged in his statement that Zakir and the others had pointed a pistol on him and threatened for the dire consequences if he did not obliged them.

The police said the copy of this FIR and other related documents were being sent to SP, Panchkula, for further investigations and action since the crime had been committed in Pinjore. It is learnt that the police has included Section 506, 452, and 386, IPC and Arms Act in the FIR.

Zakir had produced a nikahnama of June 4, 2003 in the court issued by the Imam of Shahi Masjid, Pinjore, in which it was mentioned that Zakir and Avedna got married with mutual consent. Later, the Imam of the mosque disclosed in the court by appearing personally that no such nikahnama was registered in his mosque.

The Superintendent of Police, Ambala, Mr Hardeep Singh Doon, said four police parties had been sent to Gurgaon, Malerkotla. Chandigarh and Delhi in search of Zakir Husain and Avedna. He said Zakir and other accused would be nabbed soon.

Girl recovered: The Ambala police recovered a girl, Salma, who was abducted from Barara around four months back. The police said doctor who had been practising in Barara had abducted Salma luring her that he would marry her. The police has recovered the girl from Yamunanagar.Top

 

 

Farmers’ relay fast continues

Relay fast in protest against the closure of an outlet of Khaishergarh Minor by farmers and Congress men continued for the fifth day today.

Five farmers — Subhash Kaswan, Ram Partap Baniwal and Sahab Ram of Panniwala village and Vikas Kumar and Kaka Singh of Bhagsar — sat on strike at the Khaishergarh minor. Senior Congress leaders, former Irrigation Minister Jagdish Nehra, former HPCC spokesman Dr K.V. Singh, former Organising Secretaries of the HPCC Hoshiyari Lal Sharma and Mohan Lal Darolia were present.

The demonstrating farmers demanded restoration of water supply from the outlet. The Congress leader, Dr K.V. Singh, and Mr Om Parkash Keharwala accused the government of causing loss of lacs of rupees to hundreds of farmers.

Mr Keharwala said farmers would file a petition in the court asking for compensation. He alleged that the closure of the outlet was illegal and had been executed on the oral orders of the Chief Minister.Top

 

 

Dalits’ interests safe with Cong alone: Meira

The future of Dalits and Backward Classes is secure in the hand of the Congress alone, said Mrs Meira Kumar, Senior Congress leader and daughter of Jagjivan Ram, while addressing a rally at Jagadhri today.

She asked the Dalits and Backward Classes to join hand and give a befitting reply to the BJP in the next elections. She criticised BSP leader Kanshi Ram and Mayawati, who, she said, had done nothing for their people.

She reminded the gathering about the contribution of the late Jagjivan Ram whose efforts had resulted in facilities in the Dalits.

Mrs Meira Kumar blamed the Mr Om Prakash Chautala government for “lawlessness” in the state.

Mr Phool Chand Mullana, Mr Laxman Singh Kamboj, former ministers, Mr Aman Kumar Nagra, former member of Parliament, Mr Raj Kumar Tyagi, District Congress president (Urban), and senior Congress leaders Thakur Singh, Narinder Tyagi, Gurdyal Puri and Chaudhary Randhir Singh also spoke.

Hepatitis-B, C cases on the rise

Cases of hepatitis B and C are reportedly increasing in Ambala. According to a report by a blood bank, here, during the past six months, 48 voluntary donors, who had donated blood in different donation camps in Ambala district, were found to be infected with hepatitis B & C.

According to the report, 24 donors, otherwise appearing to be healthy, were found to be infected with hepatitis B. Twenty-five donors were infected with hepatitis C. Besides this, the blood samples of 11 donors were found to be HIV positive. A senior doctor at the hospital said generally healthy persons donate blood at such camps. However, if such a high number of hepatitis cases had been detected among donors, it was a serious matter.

The blood bank authorities do not tell donors if they are carrying any infection. Which means that HIV positive persons can easily transmit the disease to others if they are not aware of their condition. Blood banks keep complete addresses of its donors and can easily inform them about their disease.

A doctor at a blood bank said they were not supposed to give the information to donors as the National Aids Control Organisation had banned the disclosure of any disease to patients concerned. Moreover, the Health Department had also not issued any direction to them in this regard, he added.

The doctor said the facility of voluntary counselling centre was available at the Civil Hospital, Ambala City. Counsellors there guide HIV positive patients and anyone could get the HIV test done by paying Rs 10, he added.Top

 

 

3 injured in clash

Hisar, September 27
Three members of a family were injured in a clash at Parav Chowk here last night. They were admitted to the local Civil Hospital.

According to reports, Gulab Singh, Surat Singh, Jarnail Singh, Dilbag Singh, all government employees, and their accomplices attacked a house in the same colony with sharp-edged weapons and bricks last night over a minor dispute. The house owner Vijay Singh, and his two sons, Krishan Kumar and Joginder Singh, received serious injuries in the clash.

The city police has registered a case in this connection under Sections 452, 506, 323,148 and 149 of the IPC. No arrest has been made so far.
