The Punjab and Haryana High Court, in a significant judgement, today ruled that the Punjab Civil Services (Punishment and Appeal) Rules of 1970 were inapplicable to the state of Haryana.

According to information, Rinku (10) was crossing the road near police post No. 4 when a truck coming from the front side hit him.

Irate mob sets ablaze 3 shops in Ambala village
Death of youth sparks off violence

An agitated mob of villagers today set on fire three shops and a house at Doodla Mandi village, which falls in the Padao police station of Ambala Cantonment, in protest against the alleged police inaction against the accused responsible for the death of a youth of their village. Among the shops gutted were three shops of the accused and the house of the main accused, Jatinder, alias Mintoo. A scooter and a few other articles lying in the vicinity were also damaged.

The irate mob set the shops on fire as soon as they received the news that Balwinder, alias Billoo had succumbed to his injuries at Government Medical College and Hospital, Sector 32, Chandigarh this morning. The DC, Mr D.D Gautam, and the SP, Mr Hardeep Singh Doon, who reached the site on receiving the information, tried to pacify the mob. Mr Doon assured the villagers that police force would be deployed in the area round-the-clock till the remaining three accused named in the FIR were arrested. Five of them who were arrested yesterday, were remanded in judicial custody. The accused who are reported to be in their late 20s and early 30s were booked under Sections 148, 149, 323, 506, 379, 525, 341 of the IPC, and now section 302 has also been added.

The SP ordered the suspension of Assistant Sub-Inspector, Randhir Singh and Head Constable, Dayal Chand of the Padao police post and transferred the SHO, Padao, Mr Puran Chand, to the Ambala Cantonment police station as a Sub-Inspector for dereliction of duty. The former two have been sent to the police lines.

Meanwhile, the investigations of the case have been handed over to the CIA Inspector, Mr Som Raj. According to sources, a case has also been registered under Sections 148, 149, 436 and 506 of the IPC against the irate mob for taking law into their hands. The body of the deceased arrived in the evening and a panel of two doctors has been asked to conduct the post-mortem examination in the Ambala Cantonment Civil Hospital, following which the body would be handed over to the family for cremation.

The incident was a fallout of the beating up of Balwinder by the accused on the morning of April 30, when he was going to his workplace in Ambala Sadar. Billoo used to work in a shop as a salesman. According to sources, the accused had allegedly beaten him hard with lathis and iron rods under the railway bridge. And the FIR was subsequently registered late in the evening on the basis of the statement of injured Billoo, and five persons — Jatinder, Lachman Khatik, Ravinder, Subhash and Narinder — were booked along with three others.

According to information available, Billoo was allegedly attacked, as the accused who had been indulging in illegal smuggling of liquor suspected Billoo to be an informer of the police as only recently the liquor smuggled by them was seized. In fact, there was enmity between them and they always thought Billoo to be a police informer.

Billoo, who was admitted to the Civil Hospital, here was later shifted to the GMCH-32, Chandigarh, where he reportedly succumbed to his injuries today. It is learnt that Billoo had been taken to his relative’s place in Kalka after he was discharged from GMCH-32, but died on his way to the hospital today, when he was being brought here after he complained of a pain in the chest. As soon as the villagers got to know of his death, an irate mob set on fire the shops of three of the accused, Jatinder, Lachman Khatik and Narinder, and also the house of the main accused Jatinder. The house adjacent to this was also reportedly damaged. The camera of a photographer was snatched and was later released on the intervention of the police, though the mob made him delete the pictures of the incident. The family and the relatives of the accused ran away from the village seeing the fury of the mob.

However, as the news spread the police force from the entire district was present there in large numbers to control the mob from further destruction in the area. A fire tender, which also reached there to extinguish the flames could hardly do much for the shops had already been destroyed. A general store, a cosmetic shop and an STD/PCO were completely destroyed.

The villagers reportedly told the DC and the SP that when the Billoo was beaten up by the accused, SI Randhir Singh and H.C. Dayal Singh, who were present there did not interveneor take any action against the accused. They further alleged that the SHO, Padao, Mr Puran Chand, adopted delaying tactics in registering the FIR. They alleged that Head Constable, Dayal Chand was close to the accused and never paid heed to the complaints against them. The SP, Mr Doon, deputed DSP (HQ), Mr Raj Gopal, to supervise the security of the villagers and make round-the-clock deployments of the force to avoid any untoward incident, particularly till his body arrived here from Chandigarh.

The DC, Mr Gautam, while pacifying the family of the deceased, asked them to submit an application, on the basis of which some financial assistance could be provided to them from the Red Cross.

Meanwhile, the grandmother of the deceased, Ram Dulari, told the police that since she had been a witness in a murder case against the accused, they beat her grandson only to take revenge for the same. Bimla, the mother of the deceased, was finding it hard to come to terms with her son’s death.

EC warns candidates on cavalcades

The Election Commission today warned various political parties and candidates contesting the Fatehabad Assembly byelection to stick to the condition regarding the number of vehicles in cavalcades while campaigning. The district election officer, Dr R.B. Langyaan, said today this while addressing a meeting of representatives of various political parties and candidates. The SP, K.K. Rao, and Election Commission observers A.N. Dass and Suresh Kumar were also present on the occasion.

He said campaigning with a cavalcade of more than three vehicles was a violation of the Election Commission orders and the administration would take action in this regard. He, however, added that vehicles used by the security staff were not be counted in the number of vehicles for a cavalcade. He said the administration had already impounded four vehicles for violating the directions of the commission.

The district election officer appealed to the representatives of the political parties and candidates contesting the poll to cooperate with the administration in the free and fair conduct of poll.

The Election Commission observer of expenditure, Mr Suresh Kumar, urged them to maintain an account of the expenditure incurred by them on a daily basis. He added that the total expenditure on the election must not exceed Rs 6 lakh in any case.

KURUKSHETRA: The Kurukshetra District Congress Committee (DCC) in a resolution, unanimously passed at a meeting held under the chairmanship of its president, Mr Pawan Garg, at the Congress Bhavan here today, urged the Election Commission to deploy CRPF in place of the Haryana police for Fatehabad byelections scheduled to be held on May 21.

Releasing a signed statement to mediapersons here today the DCC spokesman, Mr Laxmikant Sharma, said through another resolution they had also demanded an impartial enquiry into the Kurukshetra University annual examination question papers’ leak. On the occasion the Haryana Government’s decision regarding the curtailing of the Haryana Governor’s powers was also criticised.

Among others who addressed the meeting included Haryana Pradesh Congress Committee vice-president, Mr R.D. Goyal, former MLA Saheb Singh Saini, and a senior Congress leader, Mr Jasbir Singh Jassi.

Antagonise political heavyweight and suffer

The case of Mr Anil Kumar, a Haryana-cadre Dalit IAS officer, shows what it means if one rubs a political heavyweight the wrong way.

Mr Arun Kumar has fought and won two cases against the state government in the Central Administrative Tribunal (CAT). He has also got favourable verdicts from the SC/ST Commission and the Union Ministry of Personnel and Training.

Mr Kumar's latest victory was won in the CAT where he had challenged his posting as Principal Director of the Kurukshetra-based Haryana Irrigation Research and Management Institute (HIRMI). In the written order handed down by the CAT on April 28, the tribunal said the state government had made arbitrary use of its power in posting the applicant against a non-cadre post of Principal Director, HIRMI. It added that Mr Kumar's posting to the HIRMI was liable to be quashed and set aside and asked Chief Minister Om Prakash Chautala and other respondents to consider posting Mr Kumar against a cadre post within one month from the date of receipt of a copy of the order.

Importantly, the state government's policy of entrusting a handful of officers with additional charges of important departments also came under scrutiny. The tribunal found that the respondents were not able to satisfactorily explain how some of the officers were holding more than one cadre posts. The practice, according to the CAT, was creating an artificial scarcity of cadre posts. Similarly, they were also not able to explain how a non-cadre officer was posted against an IAS-cadre post (the case in question was relating to the post of Director, Sports, held by an IPS officer for more than three years now), the CAT observed.

Earlier, the CAT had asked the state government to clear within three months Mr Kumar's dues that accumulated during the period when he was under suspension. When it was not done, Mr Kumar approached the CAT again which issued a contempt notice to the Haryana Chief Secretary. The contempt notice will come up for hearing on May 26.

Mr Kumar was placed under suspension on January 19, 2000, for his alleged involvement in funds released for road repair works in Rohtak district, where he was the Deputy Commissioner. He challenged the state government's decision in the SC/ST Commission and got a favourable recommendation but the state government ignored the commission's view. However, when the Union Ministry of Personnel and Training also questioned the state government about Mr Anil Kumar's suspension, it was revoked on July 20,2001. He was first posted as OSD, Manpower Planning, Haryana, and then as Principal Director, HIRMI.

Mr Kumar's woes started in 1998 when he was the Deputy Commissioner of Rohtak. That year Mr Devi Lal lost the Lok Sabha election in the constituency to Congress candidate Bhupinder Singh Hooda by a paltry margin of about 400 votes. Mr Kumar had then turned down the INLD request for recounting which seemed to have antagonised the party leadership. He was put under suspension after Mr Chautala came to power in July, 1999.

Minister’s assurance to Roadways staff

Following rally of the Haryana Roadways Workers Union in front of New Bus Stand here on Sunday opposing privatisation of the Haryana Roadways, Haryana Transport Minister, Ashok Kumar Arora announced that no employee of the Haryana Roadways would be retrenched.

Mr Arora told reporters here last evening that the government would neither remove any bus from fleet of 3500 buses nor abolish any depot.

On permits to the private bus owners for certain routes, Mr Arora said that this was being done for the benefit of people and commuters without harming the interests of Haryana Roadways employees. He said he was ready for a dialogue with Haryana Roadways employees to settle other demands too, he added.

Meanwhile, Haryana Sarv Karamchaari Sangh general secretary Rajinder Singh and district treasurer, Hukam Singh criticised the police for stopping their procession and alleged beating of some of the workers by the police when they were marching towards Haryana Transport Minister, Ashok Kumar Arora’s residence for submitting a memorandum protesting against the privatisation of the department and in support of their demands.

They said several employees would court arrest on May 7 and May 8 and appealed to the employees to join the national-level strike on May 21.

Mr Karan Singh Dalal, lone MLA of the Republican Party of India in Haryana, alleged today that Chief Minister. Om Prakash Chautala was sending fodder to Rajasthan to prepare the ground for the INLD’s participation in the ensuing assembly elections in that state.

Addressing presspersons here today, Mr Dalal said following instructions from the Chief Minister, fodder was being purchased on a large scale for supply to Rajasthan. As a result 40 kg of fodder now cost Rs 100 as against Rs 25 to Rs 40 earlier, Mr Dalal said. The resultant scarcity of fodder and its higher prices had put small farmers of Haryana in a spot, Mr Dalal alleged.

Official resources were not only being misused for satisfying Mr Chautala’s political ambitions, but government personnel were also indulging in illegal collection of money from transporters, businessmen etc in the name of purchasing fodder for Rajasthan farmers.

Mr Dalal said Mr Chautala must clarify as to which agency in Rajasthan had been entrusted with the task of distributing fodder sent from Haryana.

Punjab rules ‘not’ applicable

The Punjab and Haryana High Court, in a significant judgement, today ruled that the Punjab Civil Services (Punishment and Appeal) Rules of 1970 were inapplicable to the state of Haryana.

Delivering the verdict on a petition filed by a retired Assistant Executive Engineer with the Dakhin Haryana Bijli Vitran Nigam, a Division Bench of the high court, comprising Mr Justice Swatanter Kumar and Mr Justice S.S. Saron, ruled: “It may be noticed that Punjab Civil Services (Punishment and Appeal) Rules of 1952 were applicable to the joint state of Punjab before its re-organisation in pursuance of the Punjab Re-organisation Act of 1966 which came into force from September 18, 1966.”

The Bench concluded: “The 1970 rules have been framed by the present state of Punjab after its re-organisation. It is not shown by the petitioner as to how the 1952 rules have been repealed in the state of Haryana by virtue of the 1970 rules which are applicable to the state of Punjab. The 1970 rules are inapplicable to the state of Haryana.”

Child crushed under truck

A child was killed in a road accident when a wheat-loaded truck ran over him near the Nahan house area today morning.

According to information, Rinku (10) was crossing the road near police post No. 4 when a truck coming from the front side hit him. A part of his stomach was crushed under the truck.

Rinku was rushed to the local Civil Hospital. The doctor of the hospital referred him to the PGI, Chandigarh. Rinku succumbed to his injuries on the way to the PGI near Zirakpur.

Haryana bans transfers

There will be no general transfers in Haryana in 2003-04, according to an official press note.

As per a circular issued by the Chief Secretary, all heads of departments, Divisional Commissioners and Deputy Commissioners had been directed that essential transfers, however, could be made after obtaining approval of the Chief Minister.

Trains carrying fodder flagged off

Kurukshetra, May 6
The second train, loaded with 6,000 quintals of wheat husk fodder, was today flagged off from the Kurukshetra railway junction by Haryana Agriculture Minister Jaswinder Singh Sandhu Billa for the famine-affected Ajmer district of Rajasthan. The minister said Haryana would send 17 more trains to Rajasthan.
