Sexual harassment: SC upholds HC Deputy Registrar’s dismissal
New Delhi, August 10 The victim had complained that the accused had given her “slips,” saying: “I want to kiss on cheeks, chin and lips” and repeatedly telephoned in the middle of the night. The accused had contended that the “slips” had gone missing from his drawer and these were part of a case study he had prepared for his dissertation for the post-graduation course in law. He admitted that he had telephoned the victim in the night, but had made the calls only to ask her to return the Rs 10,000 she had borrowed from his wife. Left with no option, the then Chief Justice of the HC had initiated disciplinary proceedings against him. The inquiry officer found that the Deputy Registrar was guilty of sexual harassment. After considering and accepting the report, the CJ ordered his compulsory retirement on October 10, 2002. The accused challenged the order in the high court by filing a writ petition. In June 2007, the court set aside the CJ’s order after accepting the explanation given by him for the “notes” and telephone calls. Setting aside the high court’s verdict, an apex court Bench comprising Justices Ranjan Gogoi and MY Eqbal said the CJ had passed the order in the light of the inquiry report and the statements of the victim and her husband which were corroborated by four “co-employees of the delinquent.” The Chief Justice had “specifically recorded his reasons” for rejecting the contention that the contents of the “slips” and that of the dissertation had similarities, but the HC had not given reasons for arriving at a contrary conclusion, the SC noted. Also, the high court had relied upon additional material which was not given to the inquiry officer. “It is therefore clear that the HC had exceeded its jurisdiction in coming to the impugned findings with regard to the culpability of the delinquent and in reversing the order of compulsory retirement,” the apex court ruled. The Deputy Registrar had retired when the case was pending in the SC since 2009. The SC asked the disciplinary authority to decide on the impact of its ruling on the delinquent’s pension and other aspects. The SC clarified that HCs had the power and competence to disturb the findings of fact in exercise of its writ jurisdiction under Article 226, but “this wholesome power has to be exercised by the HCs only on a careful appraisal of the facts of a given case.”

I have a Yale varsity degree: Irani
New Delhi, August 10 Irani (38) made the remark when pressed by a questioner at a conclave to clear the “mystery” over her educational degrees. Soon after the Lok Sabha results were announced on May 16, Irani was at the centre of a raging controversy over her educational qualifications after it emerged that she had made contradictory declarations when she contested the parliamentary elections in 2004 and 2014. “In that kitty of mine where people call me ‘anpad’ (illiterate) I do have a degree from Yale University as well which I can bring out and show...” “Extraneous circumstances are being created so that I deviate my concentration from what my goals are,” she said at the event yesterday. The BJP leader said she should be judged from what she delivers as a minister. Irani did not explain what the Yale degree was but she was part of a group of Indian MPs which underwent a crash course at Yale University, during which the elections in India, the prospects for Afghanistan and Pakistan after the US military withdrawal in 2014, the implications of political and economic transitions in China dominated. The 11 Indian MPs came to the Yale University campus in New Haven, Connecticut on June 19 last year to complete a six-day leadership programme with Yale faculty. The 2013 participants were drawn from five different national and regional political parties in India, and included Irani, who was BJP vice-president at that time, and her TDP counterpart C Ramesh. In addition to the BJP and the TDP, there were also representatives from the Congress, Trinamool Congress and Shiv Sena. When pressed further at the event to clear the air over her educational qualifications, Irani told the questioner to file a Public Interest Litigation (PIL) if he wanted to know the truth about the poll affidavit controversy. “Please go and file a PIL against me in court, I shall give you your answer in court to settle this once and for all,” she said when asked which of the two poll affidavits she had filed in 2004 and 2014 was real. — PTI |

Navi Mumbai to get SEZ
Mumbai, August 10 Prime Minister Narendra Modi will lay the foundation stone of the SEZ which is estimated to cost Rs 4,000 crore. The SEZ will come up on 277 hectares of land and provide 1,50,000 direct and indirect jobs, according to the Shipping Ministry. The project, which will be developed by a special purpose vehicle, will be completed in three years. The SEZ will include a free trade warehousing zone and facilities for engineering goods, electronics, hardware, apparel, textiles, non-conventional energy and services like IT and healthcare. Along with the development of the SEZ, the highway connecting the JNPT will also be developed under a Rs 1,926-crore port connectivity project.

Will explore options if Centre’s directive not annulled: Telangana
Hyderabad, August 10 State Information Technology and Panchayat Raj Minister KT Rama Rao, who is the son of Chief Minister K Chandrasekhara Rao, termed the August 8 letter of the Ministry of Home Affairs (MHA) as an “unprecedented situation”. “We are not inviting conflict with the Centre,” the minister stressed, but added that if the Centre “imposes its opinion” (does not rescind the directive), the state government would be left with no choice but to take recourse. “And what that recourse would be... it would be made explicitly clear in the coming days,” the minister said. Pointing out that law and order is a state subject, Rama Rao said any move by the Centre to infringe upon the rights of an elected state government is detrimental to the overall spirit of federalism. Noting that the Chief Minister had yesterday written to Prime Minister Narendra Modi asking him to rescind the order, he expressed hope that Modi would respond positively to it. He said after the Andhra Pradesh Reorganisation Act was passed on February 18 and the state of Telangana came into being on June 2, not even a single noteworthy (untoward) incident had happened and wondered as to “what necessitated the present move of the central government”. In addition, the Telangana government has allocated Rs 400 crore-plus for enhancing security measures and improving law and order situation in Hyderabad, he said. “We believe that it (the directive) may have come without the knowledge of the Prime Minister’s Office. New Delhi, August 10 The pokesperson said Singh's condition remained grave though his vitals were stable. “The former Defence Minister is still in the Intensive Care Unit (ICU) of the Army Research and Referral Hospital here and is under constant watch,” he said. The 76-year-old former minister, who is in coma, was admitted to the hospital on Friday and operated upon for the head injury after he fell down. Singh, who has also served as External Affairs and Finance Minister during the previous NDA regime, was expelled from the BJP early this year after he decided to contest the Lok Sabha elections from Barmer in Rajasthan as an Independent after being denied a party ticket. — PTI

Flood-like situation in Jaipur, Army called to rescue people
Jaipur/New delhi, August 10 District Collector K Kunal said the Army was called as a stand by arrangement to meet any exigency in Jaipur's sub-urban towns of Bassi, Lalsot and Chaksu. So far, over 500 people stranded in low-lying areas were evacuated to higher places, he said. Monsoon remained active in north India as moderate to heavy showers lashed several parts in the region. Widespread rains lashed Delhi keeping the mercury below normal levels even as citizens had a tough day as roads were water-logged, leading to traffic snarls at many places. The Safdarjung observatory recorded 76.5 mm rainfall while areas under Palam, Ridge and Ayanagar observatories received 47.4 mm, 52 mm and 57 mm of rainfall respectively. The maximum temperature was recorded at 32.5 degrees Celsius, while the minimum settled at 27.7 degrees Celsius. However, above normal temperatures were recorded at many places in Punjab and Haryana, a day after some parts in the two states were lashed by rains. Chandigarh recorded a maximum of 35.9 degrees Celsius, three notches above normal, MeT department report said. In Punjab, Amritsar recorded a high of 34.4 degrees Celsius while Ludhiana and Patiala registered above normal maximums of 35.3 and 36.1 degrees Celsius. In Haryana, Ambala recorded above normal maximum of 35.8 degrees Celsius while Karnal registered a high of 35 degrees Celsius. Intermittent rains lashed many places in Uttarakhand throughout the day as landslips left roads unusable and people immovable. One person died and another injured when the vehicle in which they were travelling in was hit by boulders from a mountain in Uttarakashi. Barring scanty rains at some places in Himachal Pradesh, monsoon remained weak in the state as the Met office declared a deficit of 36 per cent in the monsoon rains. Pandoh in Mandi district received 13 mm of rains while, Kasauli and Sarahan recorded 11 mm rains, followed by Mashobra and Rampur 5 mm each and Dharamsala and Mandi 4 mm, it said. — PTI |

Divert Dharamsala flights to Pathankot in bad weather: MPs
New Delhi, August 10 Former Himachal Chief Minister and Kangra MP Shanta Kumar and Gurdaspur MP Vinod Khanna recently met Civil Aviation Minister Minister Ashok Gajapathi Raju and also urged him to upgrade the airport to facilitate landing and take off during all kinds of weather conditions. They said the diversion of flights to Pathankot would further encourage tourism in the Himalayan state. Two flights from Delhi to Gaggal Airport operate daily, but during hostile weather conditions they are cancelled and made to return to the national capital. They said the flights should be diverted to Pathankot, 40 km from Kangra. Dharamsala, the headquarters of Kangra district, is a major tourist and religious place for Buddhists.

CBI: Dropping of probe against Finmeccanica won’t hit inquiry
New Delhi, August 10 CBI sources said after the news of proposed dropping of charges came, the agency has sought details of court proceedings from Busto Arsizio in Milan where Finmeccanica is facing trial for alleged corruption and bribery to Indian officials. They said the documents have been received and translated from Italian into English after which investigators have come to the conclusion that dropping of charges is not going to affect the line of probe CBI is pursuing in the case. A senior official said Finmeccanica had agreed to pay fine for ending the Italian prosecutor’s investigations into the deal with India with a caveat that it does not mean admission of allegations against the company. Finmeccanica has denied any wrongdoing in the deal. They said no such mechanism exists in Indian laws related to corruption charge levelled by the CBI in its FIR against former IAF Chief SP Tyagi and 13 others, including the then Finmeccanica CEO, in connection with the deal. The sources said they were awaiting responses to Letters Rogatory from various countries after which it would proceed with the filing of charge sheet in the case. “There are two aspects to the case. First is the conspiracy in which bribe was allegedly received. Second is the money trail, how the bribe was routed to India. We are clear about conspiracy, but money trail will be clear once responses to Letters Rogatory are received,” a senior CBI officer said. The CBI, which carried out a probe in India, has named 13 individuals, including SP Tyagi and European nationals Carlo Gerosa, Christian Michel and Guido Haschke, in the FIR as accused in connection with the bribery case. Italian agencies had arrested then CEO of AgustaWestland Giuseppe Orsi for alleged bribe given to Indian middlemen to clinch the deal. The supply of 12 VVIP helicopters had come under the scanner after Italian authorities alleged bribe money was given by the company to clinch the deal. — PTI

Maoists kill 2 CRPF men
Raipur, August 10 The exchange of fire took place in the forests of Murtunda village under the Basaguda police station limits in which two CRPF men were killed, said Inspector General of Police (Bastar Range) SRP Kalluri. A squad of 168th battalion of the paramilitary force was on an area domination operation in Basaguda region, located around 450 km away from the state capital Raipur. When they reached Murtunda forests, the Maoists opened indiscriminate firing at them leaving two CRPF personnel dead on the spot and another injured, the IG said. However, when security personnel launched retaliatory attacks, the rebels fled into the forests, the IG said. Reinforcements have been sent to the spot, the IG said, adding that efforts are on to retrieve the bodies of those killed and injured. — PTI

15-yr-old gang-raped by four students in Assam
Dibrugarh (Assam), August 10 The incident took place around 11.45 pm last night when the 15-year-old girl, along with a teenaged boy, her next-door neighbour, had gone to Dibrugarh station to board the Brahmaputra Mail, Additional Superintendent of Police (ASP), Dibrugarh, Hiranya Burman said. The two were on their way to Panitola station in Tinsukia district, the ASP said. They were dropped outside the station complex by an auto-rickshaw driver and were walking towards the station when they were intercepted by the four college students, Burman said. “The boy was thrashed and pinned down by a few while others took turns to rape her”, he said. Around 1.30 am, a police patrol team found the girl in semi-naked condition on a road near the Dibrugarh railway station. She was taken to Assam Medical College and Hospital, where the assault was confirmed. She is critical and is being treated there, the ASP said. The police arrested three youths around 3.30 am, while search for absconding accused was on, Burman said. Those arrested have been identified as Kalyan Dutta and Pranjit Dutta, both graduation students of Lahowal College, and a higher secondary student of Aniruddha Dev College, he said. Indians descendants of Hindu culture: RSS chief
Cuttack, August 10 "The cultural identity of all Indians is Hindutva and the present inhabitants of the country are descendants of this great culture," Bhagwat said while speaking at the 'Golden Jubilee' function of an Odia weekly here. The RSS chief further went on to say that Hindutva is a way of life and Hindus could be of any religion worshipping any God or not worshipping at all. Referring to Vivekananda, Bhagwat said not worshipping any God is not necessarily an atheist rather the one who doesn't have faith in self is sure an atheist. He said the world has now realised that Hindutva has been the only basis to keep India united since ancient days despite having plenty of diversities. He, however, expressed concern saying that some in India were not realising it and whenever a discussion on it took place, the protagonists were wrongly branded as communal. Speaking on the current world scenario, the RSS leader said the world at large was looking at India for solace. New Delhi, August 10 It said though mandatory self-reporting is in place, health officers posted in identified international airports all over India are screening passengers getting off aircraft. Health Minister Harsh Vardhan denied reports of a "suspect" Ebola virus case in Chennai. "The government of Tamil Nadu has informed the Central Government that a person had indeed landed at Chennai airport from Guinea August 9. Plea against Sena MP to be heard on Aug 18
New Delhi, August 10 The plea, which seeks filing of an FIR against Vichare under various sections, including 153 A (promoting enmity between classes), 323 (voluntarily causing hurt), 341 (wrongful restraining any person) and 506 (criminal intimidation), of the Indian Penal Code came up for hearing before Metropolitan Magistrate Puneet Pahwa who fixed it for hearing on August 18. During the hearing, advocate Vishal Sinha, appearing for petitioner Kamran Siddiqui, alleged that Vichare’s act was not acceptable in a civilised society and that they had moved the Delhi High Court with a complaint on August 1 but it asked them to approach the trial court for appropriate legal remedy. Sinha told the court that they had filed a complaint in this regard before Delhi Police but no action has been taken till date. The petitioner has alleged that Vichare had “deliberately targeted the Muslim canteen worker in front of media and TV channel crew with camera to ensure wide coverage of his action with intention to hurt religious sentiments...” — PTI |

Bhopal, August 10 Constable Ritu Kumari (25) shot herself on August 5, after being allegedly scolded by a Central Industrial Security Force officer. She is battling for life at a hospital, Bhopal Superintendent of Police (North) Arvind Saxena said. The constable, in her statement to the magistrate, said she shot herself with her service revolver after being scolded by CISF’s Deputy Commandant as she reported late for duty, he said. The woman failed to inform her seniors that she would reach late for work, following which she was summoned by the Deputy Commandant. — PTI

Israel hopes India’s UN vote won’t impact bilateral ties
New Delhi, August 10 Noting that Israel was in touch with the Indian government at various levels “before, during and after the voting” on the UN Human Rights Council resolution to launch a probe into Israel’s offensive on Gaza, newly-appointed Israeli Ambassador Daniel Carmon says his country would appreciate better understanding among its international interlocutors on its role in the current Gaza conflict. However, Carmon, who assumed charge 10 days back, did not comment on whether he conveyed Israel’s disappointment to Indian interlocutors after New Delhi voted against Jerusalem. He said: “We have expressed to all our interlocutors including in India, how we feel about the conflict, sources of the conflict...and we will continue doing so.” Criticising the United Nations for allegedly indulging in “Israel-bashing”, the Israeli Ambassador told PTI in an interview that “I don’t like the voting and resolution, For many years what is going on in the UN is very much politicised.....We did not like the result of international community (voting) on the resolution. We have the mission to make our interlocutors understand (our stand)... “We expect the support and understanding of our friends and interlocutors all over the world to the need of Israel to safeguard (its interest).” India joined Brazil, Russia, China and South Africa to vote for a Palestinian-drafted resolution on “Ensuring Respect for international law in The Occupied Palestinian Territories, including East Jerusalem”. In the 47-member council, 29 countries voted in support of the resolution while 17 nations abstained. — PTI

ISRO plans more powerful communication satellites
Hyderabad, August 10 Radhakrishnan also said the premier space research organisation is looking for suitable foreign partners to acquire the technology and upgrade ISRO’s current satellite platforms to meet the future demands. “For the future, we are looking for communication satellites in the higher frequency bands with about 15 KW of power and data handling capacity in the range of 100 Gigabits per second that can meet the ever growing demand in the country towards broadband internet, rural telecom connectivity etc,” the ISRO chief said. He was speaking at the convocation of BITS-Pilani Hyderabad campus. Besides launching new satellites, the organisation has also plans of replacing the ageing satellites and enhance the observation capability to the level of 0.25 m spatial resolution and provide new capability for imaging from geo stationary orbit with 50 m spatial resolution, he said. ISRO is also partnering with Jet Propulsion Laboratory of NASA to jointly develop a dual frequency microwave imaging satellite by 2020, Radhakrishnan said. “In this scheme of alliance, ISRO is responsible for the overall satellite platform, S Band synthetic aperture radar and the launch of the satellite by GSLV,” he explained. On the moon mission, he said India is in the process of developing its own Lander-module and lunar rover as well as orbiter craft for Chandrayaan-2 that is targeted for launch by GSLV within the next three years. Elaborating on the Mars mission, the ISRO head stated that the Mars orbiter space aircraft has traversed nearly 88 per cent distance along its designated path to the red planet. “The next operational milestone is the insertion of the spacecraft into the Martian orbit on September 24, 2014. If successful, India will be the first Asian country to orbit a spacecraft around planet Mars and the first country in the world to achieve this in the first attempt,” he said. — PTI

Bharat Ratna for Vajpayee, Netaji?
New Delhi, August 10 The speculation has been fuelled by the Home Ministry placing an order for five Bharat Ratna medallions. BJP leaders have in the past demanded Bharat Ratna be awarded to Vajpayee. Prime Minister Narendra Modi would take a call on this and probably would announce it in his Independence Day speech. Among others whose names are being speculated is Netaji Subhas Chandra Bose. A senior Home Ministry official said four days ago, the government mint had been asked to make five medallions of Bharat Ratna. “But ordering five medallions does not mean that five persons will be bestowed with Bharat Ratna. This is to keep adequate number of medallions in reserve,” he said. Besides, the government’s rule for Bharat Ratna is clear that the number of annual awards is restricted to a maximum of three in a particular year. — PTI

Roy tries to sell US hotels from Tihar
New Delhi/Mumbai, August 10 “They are happy, they can now talk to known people all day,” said a jail official. “Our work will be done now,” Roy told a senior prison officer after moving to the new office-cum-cell, according to the official. It’s a race against time for the 66-year-old head of the Sahara conglomerate. Under a deadline set by the Supreme Court, Roy has just a few days left to post 100 billion rupees in cash and bank guarantees that would secure his release. Roy was jailed in March after he failed to repay billions of dollars to investors. In Tihar, the office given to Roy has a conference room with a big table, office chairs, and Wi-Fi and video-conferencing facilities, said the prison official. People are allowed to visit from 6am to 8pm. “All options are being explored. It can be an outright sale or mortgage lien. Phone calls are being made to interested parties and things will become clear by early (this) week,” said a source close to the Sahara group. — Reuters

After US offers, India finds itself at crossroads
New Delhi, August 10 Some hard-nosed decision making will be needed on how New Delhi accepts the US offers without seeming to move away from Russia or even remotely looking like a 'cat's paw' for America in the region. In other words, a fine balance has to be struck between the US and Japan on one side and Russia and China on the other side - a balance that could put the Indian diplomacy to test. US Secretary of Defence Chuck Hagel, who ended his three-day visit to India yesterday, raised two specific issues. First, he showed keenness to co-produce military equipment, unfettered access to technology that is reserved for countries like UK, Canada or Australia. Second, he asked India to make a strategic shift and forge a trilateral alliance with the US and Japan, buttressing it with "as the US and Indian security interests converge, so should our partnerships with other nations". In case New Delhi accepts this, it will have to be seen equidistant from the decades-old Japan-China acrimony. Japan has given some major infrastructure like the Delhi Metro and the Delhi-Mumbai Industrial Corridor (DMIC). What India awaits is Japanese Prime Minister Shinzo Abe's plan of shifting the thousands of Japanese factories in China to India along the upcoming DMIC and also the Chennai Bangalore Industrial Corridor (CBIC). Former Defence Minister AK Antony was not so keen on co-development ties with the US but had allowed purchase of specialised planes, the C-17 and the C-130-J for the Indian Air Force and the Boeing P8-I for the Navy. After 2008, the US won military contracts worth military $9 billion (approx Rs 54,000 crore). Al those years when India was in the Soviet Union bloc during the Cold War, the US did business worth only $ 500 million (Some Rs 3,000 crore at today's value). Between 2009 and 2013, India imported 14 per cent of all global arms sold and Russia accounted for 79 per cent of those supplies, said the Stockholm International Peace Research Institute (SIPRI) in its March 2014 report 'trends in international arms transfers for the period 2009-1013'. India has joint development project with Russia, France and Israel. The US has offered a similar tie-up. India may find it tough to sever its umbilical cord from Russia. As of today projects worth $39 billion are in the pipeline with Moscow including co-development of the next generation of fighter jets. The Russia has helped New Delhi in its indigenous nuclear submarine, the Arihant. At its launch in 2009, Prime Minister Manmohan Singh was candid: "I would like to express our appreciation to our Russian friends for their invaluable cooperation". Moscow has also leased out a nuclear submarine, the Chakra. Long standing ties with Russia means India has more often than not voted along pro-Moscow line at the international forum, recently on the conflict in Ukraine. Antony's successor Arun Jaitley, carries no such baggage or history of dithering on deeper ties with the US, rather by raising the level of foreign direct investment, to allow foreign firms to hold 49 per cent stake in military equipment-producing firms, he has sent out a signal. New Delhi will also be looking to factor in apprehensions and looking for assurance that no hurdle shall be placed at the behest of altered US interests.

Black money pursuit: India gets 24,000 pieces of secret data
Berne/New Delhi, August 10 These cases are now under investigation by the taxman even as the Special Investigation Team (SIT) on black money has set its eye on tracking the outcome of this classified information which has been received from over a dozen countries during the 2013-14 fiscal year. The bulk of the information on these foreign accounts and statements, with a basic fledgling domestic connect in each of them, has been received from New Zealand, followed by Spain, the United Kingdom, Sweden and Denmark. According to the data provided to the SIT by the Finance Ministry, its special unit designated for the task and placed under Central Board of Direct Taxes (CBDT) received a total of 24,085 pieces of data under the automatic tax information exchange route, which is also the legal treaty for exchange of data related to tax matters.
