HUDA penalised by redressal forum
Chandigarh, July 12 HUDA has been asked to pay Rs 25,000 as fine and Rs 5,000 as the litigation cost. The complainants, Anil Diwan and Arun Goel, residents of Sector 19, had applied for a residential plot of 14 marlas in Sector 23, Sonepat, for which they deposited Rs 23,020 each as 10 per cent earnest money. They were declared successful and vide allotment letters dated August 1991, they were asked to deposit further Rs 34,505 equivalent to 15 per cent of the total price of the allotted plot. Pankaj Chandgothia, counsel for the complainants, stated that as per Section 17 (3) of HUDA Act, it could only forfeit the earnest money of 10 per cent and not the entire deposited amount. The commission ruled that the action of the opposite parties to forfeit the entire 25 per cent amount of tentative price of the plot is wrong. The opposite parties could forfeit earnest money which was equivalent to 10 per cent of the tentative price and while ordering resumption of plot in 1995, 15 per cent deposited by the respondent should be refunded. “This action of the opposite parties certainly caused physical harassment and mental agony to the respondent for which he is entitled to a compensation of Rs 25,000. the Haryana Urban Development Authority has also been directed to pay Rs 5,000 as the cost of proceedings,” stated the forum.

Lok Adalat directs LIC to pay Rs 20,000
Mohali, July 12 If the amount was not paid within 30 days, the LIC would pay interest at the rate of 12 per cent per annum. Ran Singh of Magar village in Kharar Tehsil had obtained a policy from the LIC. A sum of Rs 15,000 was to be paid by the LIC as money back in January 2006. A cheque was issued on January 15, 2006, which was encashed on February 2, 2006. Ran Singh, however, did not receive the said amount in his bank account with Indian Overseas Bank, PTL branch, Phase IV, Mohali. He approached the LIC for payment of the amount but it maintained that the cheque had already been sent to his bank. On the other hand, the bank denied having received any such cheque. Ran Singh, therefore, filed the application before the Lok Adalat. The stand of the LIC was that it had already paid the amount through the cheque dated January 15, 2006. The bank, however, denied having received any such cheque. The LIC could not produce any evidence as to which bank the cheque was sent and in which account the money was credited. The account statement produced by Ran Singh showed that no such payment was credited to his account. However, the account statement produced by the LIC showed that the amount was payable to one “Ron Singh.” When the efforts to bring about reconciliation between the parties did not succeed the Lok Adalat decided the case on merit. |
